HomeMy Public PortalAbout05-02-1983 1I PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MAY 2, 1983 1 The Common Council of the City of Richmond, Indiana, met in regular 2 session May 2, 1983 at the hour of 7:30 p.m. in the Council Chambers in 3 the Municipal Building :in said City. President Mills presided with the 4 following members, present: Messrs. Elstro, Ms. Henry, Hankinson, Welch, 5 Parker, Carter and Paust. Absent: Williams. The following business 6 was had, to-wit: 7 8 DEVOTIONS 9 10 Councilman Welch gave devotions. 11 12 APPROVAL OF MINUTES OF APRIL 18, 1983 13 14 Councilman Welch moved the minutes of the previous meeting be approved as 15 presented, seconded by Councilman Parker and on unanimous voice vote the 16 motion was carried. 17 18 WELCOME GOVERNMENT CLASS 19 20 President Mills welcomed students from RHS government classes to Council . 21 22 REPORT ON NORTH "E" STREET RAILROAD STATION 23 24 Mr. Matt Stegall , 222 North 10th , reported on the railroad station project. 25 He noted Norfolk and Western is now Norfolk and Southern. They have 26 closed on the real estate and are willing to sell the building.. The III27 property has been appraised to set the price and, hopefully, a buyer can 28 be found. The windows have been 'boarded up by the railroad, showing 29 their willingness to cooperate with the community. He noted a change in 30 the neighborhood being-the sale of the old meat market on Ft. Wayne Avenue 31 and "E" for the opening of a New York style delicatessen with work being 32 done to bring it up to code. A study has been conducted by the Ball State 33 School of Architecture under James Massey in cooperation with Mr. Mark 34 Miles of the Huddleston House, who was in attendance. There will be a 35 presentation on May 11 at 7:30 p.m. at the Wayne County Museum by Ball 36 -State and Mr. Miles of the findings of this study. 37 38. President Mills noted Council has made no commitment to this project in 39 any way. 40 41 RESOLUTIONS 42 43 Councilman Welch moved to suspend the rules and read Resolution Nos . 5- 44 1983 and 6-1983 by title only, seconded by Councilman Elstro and on 45 unanimous voice vote the motion was carried. 46 47 RESOLUTION NO. 5-1983 48 49 The Clerk read by title only Resolution No. 5-1983 - A RESOLUTION OF THE 50 CITY OF RICHMOND TO INDUCE H. L. LIBBY, H. L. LIBBY CORPORATION, AN OHIO 51 CORPORATION, OR ANY OTHER CORPORATION OR PARTNERSHIP TO BE FORMED OF III52 WHICH H. L. LIBBY OR H. L. LIBBY CORPORATION WILL BE A PRINCIPAL -SHARE- 53 HOLDER OR GENERAL PARTNER ("APPLICANT") TO CONSTRUCT ADDITIONAL IMPROVE- 54 MENTS AND TO MAKE NECESSARY MODIFICATIONS AND IMPROVEMENTS TO AN ECONOMIC 55 DEVELOPMENT FACILITY AND TO UNDERTAKE TO SELL AND DELIVER REVENUE BONDS 56 TO PAY THE COSTS THEREOF, AND OTHER MATTER. RELATING THERETO. 57 58 Speaking for Resolution No. 5-1983 was Attorney Andrew Cecere represent- 59 ing H. L. Libby. He noted Libby. is the owner of King's Plaza Shopping 60 Center, which is vacant. The proposal is to enlarge a 60,000 square foot 61 building to 80,000 square feet plus an addition of a 16,000 square foot 62 building. The owners have been negotiating with Hills, which is a 63 modern department store with an anticipated employment of T60 people. 64 They have committed to the contracting work being allocated to the 65 community. Also speaking for this Resolution was Mr. Art Vivian, 3587 322 Common Council Minutes Con't. May 2, 1983 Page 2 1 Wernle Road, representing the Economic Development Commission. Mr. Vivian 2 stated when the EOC was first approached by Libby, they called most of the 3 competition in the area to get their reaction and they all welcomed them. 4 Under the terms of the current act, this facility qualified and, in view 5 of the fact that the area is suffering high unemployment, the feeling in 6 this case is to try to obtain this facility as the feeling in the past has 7 been to use these bonds for labor. He noted there will be a public hearing 8 on this facility and if it is presented at that time there is undue compe- 9 tition, the Commission will take another look at it. Mr. Dominic Ranelli , 10 Executive Vice President of H. L. Libby and Mr. Phil Kahill , representative 11 of H. L. Libby, 508 Stambaugh Building, Youngstown, Ohio, noted they hope 12 to have the facility open by the Christmas holidays. 13 14 Mayor Clifford Dickman noted Council , past administrations and this ad- 15 ministration have always been supportive of Economic Development Bonds for 16 industry. There are times when we have to take exceptions for other pur- 17 poses , particularly when there is a vacant building in the community. He 18 urged Council to look upon this resolution favorably. 19 20 Councilman Carter moved to adopt Resolution No. 5-1983, seconded by Coun- 21 cilman Welch. On voice vote the motion was carried with Councilman 22 Hankinson voting no. 23 24 RESOLUTION NO. 6-1983 25 26 President Mills requested the Clerk. read Resolution No. 6-1983 in full as 27 there is a change in the Resolution as Council received it. 28 29 The Clerk read in full Resolution No. 6-1983 - RESOLUTION AUTHORIZING THE 30 FILING OF AN APPLICATION WITH THE STATE OF INDIANA DEPARTMENT OF COMMERCE, 31 FOR SMALL CITIES COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS UNDER THE EMER- 32 GENCY JOBS PROGRAM. 33 34 Councilman Hankinson moved to amend the resolution as read, seconded by 35 Councilman Paust and on unanimous voice vote the motion was carried. 36 37 Speaking for Resolution No. 6-1983 was City Plan Director Bob Goodwin. A 38 letter of intent will be filed for running a ;sanitary sewer from Spring- 39 wood-Lake due north into the former Chrysler site terminating at Industries 40 Road. This would open up approximately seven (7) more industrial sites. 41 42 Councilman Paust moved for adoption of Amended Resolution No. 6-1983, 43 seconded by Councilman Parker and on unanimous voice vote the motion 44 was carried. 45 46 MISCELLANEOUS BUSINESS 47 48 Councilman Elstro announced there will be another tour meeting for Council 49 members a week from tonight. One thing on the agenda will be a tour of 50 the old railroad station. 51 . 52 Councilman Elstro was critical of a newspaper article which reported a 53 possible increase in the sewer use fee. He stated an auditor's report 54 on the Sanitary District should not have been released at this time. 55 Mayor Dickman stated he released the report to the press. He noted the 56 press put pressure on to have the report, so he released it to prove 57 nothing was being hidden and nothing was wrong. President Mills stated 58 Council should have had a copy of the report. Councilman Paust noted the 59 report should be carefully studied for Council to gain adequate knowledge 60 of the operation and costs involved. Councilman Welch reminded Council 61 the Sanitary District is to make a report to Council in July. 62 63 ORDINANCES ON 1ST READING 64 65 Councilman Welch moved to suspend the rules and read Ordinance Nos. 18,:,194., 6c `? d.0 4 e) Common Council Minutes Cont'd. AND APPROVING AND 11 AUTHORIZING OTHER ACTIONS IN RESPECT THERETO. 12 • . 13 Councilman Welch moved to suspend the rules and read Ordinance No. 18-1983 14 on second reading, seconded by Councilman Elstro and on unanimous voice 15 vote the motion was carried. 16 17 The Clerk read on second reading Ordinance No. 18-1983. 18 19 President Mills announced Ordinance No. 18-1983 is on public hearing. 20 Speaking for this ordinance was Attorney Gayle Gardner, 304 Peoples 21 Building, representing Amedco Steel . As of this morning, this firm 22 has 81 employees. This is the old Johnson Sheet Metal plant, which 23 was purchased by Overhead Door and leased to Amedco with an option to 24 purchase. The original request was for 2 million dollars but is now 25 for 1 .6 million. There is a commitment to purchase the bonds by the 26III Mark Twain Bank of St. Louis along with Second National Bank. It is 60 necessary this Department become reconstituted under the new Home Rule 61 law which goes into effect September 1 . The application has to be filed 62 before this time. . 63 64' Councilman .Welch moved engrossment of Ordinance No. 19-1983, seconded 65 by Councilman Paust and on unanimous voice vote the motion was carried. III2 3 Ordinance No. 16-1983 was adopted by the following vote: 4 AYES: Elstro, Henry, Hankinson, Welch, 5 Parker, Carter, Paust, Mills (8) 6 NOES: None (0) 7 ABSENT: Williams 8 9 ORDINANCE NO. 17-1983 10 11 The Clerk read on second reading Ordinance No. 17-1983 .- AN ORDINANCE 12 VACATING CERTAIN PUBLIC ALLEYS LYING IN THE TERRITORY GENERALLY BOUNDED 13 BY WEST MAIN STREET, SOUTHWEST 1ST STREET, NATIONAL ROAD WEST AND 14 SOUTHWEST 2ND STREET. 15 16 The Clerk presented proof of publication for Ordinance No. 17-1983. 17 Councilman Welch moved the proof be accepted and filed, seconded by 18 Councilman Paust and on unanimous voice vote the motion was carried. 19 20 President Mills announced Ordinance No. 17-1983 is on public hearing. 21 Speaking for this Ordinance was City Plan Director Bob Goodwin noting the 22 Plan Commission recommended an, amendment to SECTION 1 of the Ordinance as 23 follows: SECTION 1 . That subject to the preservation of all easements 24 for existing utilities , and subject to an easement being granted to the 25 public for ingress and egress across the petitioner's property to South- 26 west 2nd Street, the public alleys described below are hereby vacated. III 27 28 Councilman Welch recommended the amendment from the Plan Commission as 29 stipulated by the Plan Commission also include Southwest 1st Street as 30 well as Southwest 2nd Street and moved- for the amendments, seconded by 31 Councilman Parker.
