COUNCIL OF THE CITY OF RICHMOND, INDIANA, APRIL 4, 1983 1 The Common Council of the City of Richmond, Indiana, met in regular 2 • session April 4, 1983 at the hour-of 7:30 p.m. in the Council Chambers 3 in the Municipal Building in said City. President Pro Tem Parker pre- 4 sided with the following members present: Messrs. Elstro, Williams, 5 Ms. Henry, Hankinson, Welch, Carter and Paust. Absent: Mills. The • 6 following business was had, to-wit: 7 8 DEVOTIONS 9 10 Councilman Parker gave devotions. It was noted President Mills is in 11 Reid Memorial Hospital and everyone was requested to remember him in 12 their prayers. 13 14 APPROVAL OF MINUTES OF MARCH 21, 1983 15 16 Councilman Hankinson moved the minutes of the previous meeting be 17 approved as published, seconded by Councilman Welch and on unanimous 18 voice vote the motion was carried. 19 20 OPEN HOUSE INVITATION • 21 22 President Pro Tem Parker read an invitation to Council members for an 23 open house introducing Contractors United, Inc. on April 13 from 3:00 24 to 6:30 p.m-. at 2100 Hawkins Road.. 25 III26 COMMUNICATION FROM THE MAYOR 27 28 Mayor Clifford Dickman noted Council .members have been given their 29 annual reports and recommended they look at them closely as there is 30 a lot of good information in them. 31 32 The Mayor reported.House Bill 1374 is now out of Senate and House Com- 33 mittee hearings. The bill has been worked over, but one -thing still 34 alive is the tax for cumulative funds. Hopefully this will stay in the 35 , bill. Three things- we .could use..some additional monies for in our com- 36 munity are (1) an ILS ,at. the airport (2) the arts facility at Richmond 37 Senior High School and (3) the storm sewer fund. The maximum to be 38 raised is ten cents (10Q) a year. - 39 40 MISCELLANEOUS BUSINESS 41 42 President Pro Tem Parker told Council a March .31st legal in the newspaper 43 carried a Medicare notice 'to the public that on April 15, 1983 the. agree- 44 ment between the Heritage House of Richmond, Indiana and the Secretary 45 of Health and Human Services will be terminated. Since Council just 46 passed a resolution for bonding for Heritage Regency, Inc. , he requested 47 the City Attorney look into this to make sure everything is in order. 48 Councilman: Carter noted the bonding issue just passed had nothing to do 49 with Heritage House as it was for Heritage Regency which is a separate 50 corporation. He requested his son be permitted to speak to what is 51 happening. 52 53 Speaking was, James E. F. Carter, noting there are two -(2) separate cor- 54 porations-0 involved which are not related. Heritage House feels the 55 allegations are unfair .:and are taking the proper steps to appeal. They 56 • feel confident this can be resolved and they can retain their Medicare • 57 certification; however-, this does not affect- Heritage Regency. in any way. . 58 April 15 is the deadline for the restriction of admitting new patients ' 59 to Heritage House and May 15 is the deadline for reimbursement of present 60 Medicare patients. Heritage House of Richmond is leased and operated by 61 Wilmetco, Inc. which is a corporation in Indianapolis. Mr. Carter works 62 for them and the action is taken against this corporation: Concerning 63 the.bond issue, Mr. Carter stated the bonds have been purchased, the deal 64 has been closed, they have the money and are ready to. start construction. 316 • Common Council Minutes Cont'd. April 4, 1983 . Page2 1 Councilmen Welch and Williams expressed concerns that they voted for .the 2 bond issue because seventy-one (71) of the beds of the new facility 3 would be Medicare approved. Mr. Carter restated the issue with Heritage 4 . House does not affect Heritage Regency, Inc. There is nothing inter- 5 twined between the two facilities. There is a maximum of twenty-three 6 (23) patients who would be affected by this issue at Heritage House. 7 8 City Attorney Ed Anderson stated he thinks Mr. Carter's comments and 9 .explanation are sufficient.,as .there are two (2) separate entities. He 10 sees no need to look into it any further. He notedhe has not received 11 a bond portfolio with a letter from the bond counsel. Mr. Carter noted 12 all the documents are being printed and as soon as they .are prepared, 13 the city will receive copies. 14 15 ORDINANCES ON 1ST READING 16 17 Councilman Welch moved to suspend the rules and read Ordinance Nos. 18 11-1983, 12-1983, 13-19.83, 14-1983 and 15-1983 on first reading by 19 , title only, seconded by Councilman Elstro and on unanimous voice vote 20 the motion was carried. . 21 . 22 • Ordinance No. 11-1983 23 24 The Clerk read on first reading by title only Ordinance No. 11-1983 - AN 25 ORDINANCE TO APPROPRIATE. THE MUNICIPAL CODE; BEING' ORDINANCE 42 ,NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF 43 RICHMOND, INDIANA, PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT • 44 1915 CHESTER BOULEVARD FROM R-3 ONE-TO-EIGHT FAMILY RESIDENCE DISTRICT 45 TO C-1 SU LIMITED COMMERCIAL SPECIAL USE DISTRICT AND AUTHORIZING THE 46 SPECIAL USE OF SAID PROPERTY AS A .COMMERCIAL DEVELOPMENT UNIT PROJECT. 47 . 48 . -. Councilman. Welch moved to suspend the rules and read Ordinance No. 13- 49 1983 on second reading, seconded by Councilman Elstro and on .unanimous 50 voice vote. the motion was carried. 51 52 The Clerk read on second reading Ordinance--No. 13-1983. 53 54 . President Pro Tem Parker announced' Ordinance No. 13-1983 is. on public * . 55 hearing. . Speaking' for this Ordinance were Attorney Gayle Gardner, 304 • 56 • ' . Peoples Building, representing Harold & Wanda Wood and the constructing 57 partnership of Doctors Ronald 'Brown, Paul Bergfelder, Steven Stoller, 58 • David Jetmore and Timothy Hirons. This is the same property presented 59 in 1980 but that presentation was for one building and this request is 60 for three smaller buildings in the same area. Many people appeared at' ' 61 the Plan Commission hearing showing concern for the storm water runoff; 62 Don Burdsall, Credence Contractors representative, noted drainage 63 problems in the past have been on the back of the property and they are 64 . developing the front' portion with no plans at this time to develop the 317 Common Council Minutes Cont'd. • April 4, 1983 . Mr. Dan Dooley, Assistant Plan Director, 1183 Beelor Road, 19 stated the Plan Commission held a public hearing and voted 7-0 to recom- 20 . mend passage of this Ordinance. 21 22 . Councilman Williams moved for engrossment of Ordinance No. 15-1983, 23 . seconded by Councilman Elstro and on unanimous voice vote- the motion 24 was carried. 25 26 Councilman Welch moved to suspend the rules and read Ordinance No. 15- 27 1983 on third and .final reading by title only, seconded by Councilman 28 Williams and on unanimous voice vote the motion was carried. 29 30 The Clerk read on third reading by title only Ordinance No. 15-1981. 31 • 32 Ordinance No. 15-1983 was adopted by the following vote: 33 AYES; Elstro, Williams, Henry, Hankinson, 34 , .
