25 INC AND AUTHORIZING CERTAIN ACTIONS AND- PROCEEDINGS WITH RESPECT TO
26 CERTAIN PROPOSED ECONOMIC DEVELOPMENT REVENUE BONDS.

28 .Speaking -for Resolution No. 4-1983.was Attorney Gayle Gardner, repre-
29 senting Amedco, Inc: Also present representing Amedco were President -
'30 , Bob-York and Controller Tony Wright.' In response to Councilman Welch's
31 .,question, Mr. York stated the bonds will be for purchase of the Johnson
32 -Sheet Metal plant, including tooling, presses and rolling stock. In
, • 33 response to. Councilman Elstro's question, Mr. York stated Amedco did not
34 terminate any employees. The employees were terminated by the Overhead
35 Door Company. • There is- no •union. there. : The employees who were hired
36 , back are making more than they were when Amedco took over; however, they
37 did.lose their longevity as this is a new company. Councilman Williams
38 stated he -will not be voting for •this resolution due to the company not
39 ' hiring minorities. Mr. York stated they now employ sixty-five (65)
40 people, sixty-two - (62) 'of which are Wayne County residents. •

42 Councilman Paust moved .for adoption of Resolution No. 4-1983, seconded
43 by,Councilman Welch. On voice vote the motion was carried with Council-
44 man Williams voting no. - -

46 - LETTER FROM.BOB GOODWIN REGARDING MANDATING WORK UNDER ECONOMIC
47 DEVELOPMENT BONDS. - -

49 - . -At our Council meeting of February 7, 1983, the question was
III 50 - raised .as to whether or not -a local unit of government could •
51 mandate- a certain percentage of work on an Economic Develop-
52 _ - ment-Bond project to be performed by local contractors and
-- 53 local labor.

55 ` At your request I presented -that• question to Mr. Brian Long, .
56 Assistant Director of the -Indiana Association of Cites and
57 :Towns (IACT) . Mr. Long" informed me _that IACT has researched
• 58 • . . this question for other communities and it is not legal for
59 . a local unit of government to attach such conditions to a
. 60 - - bond request.

64 Mayor Clifford Dickman stated, concerning Ordinance No. 6-1983, the

1 improvement of "L" is a. part of. the City. Master Plan approved by Council
2 in 1968. This was also recommended by the City and County Engineering
3 . Departments after a study of .the South "E"- and Backmeyer traffic problems
4 'in 1975. . It. was put into. the Federal Aid Urban Program. for matching
5 • . funds in. 1976. The preliminary .engineering study,was approved by the
6 Board of Works and Council in 1976 at .a cost of $20,000. Additional funds
7 for engineering were appropriated by the Council in 1977_ totaling $30,000.
8 The official formal hearing was held in 1979 by the .State Highway. The
9 environmental impact and route location was approved in 1980 by the State
10 . and Federal .government. Council approved an appropriation for $150,000 in
• 11 1980 for design. The field check was made and approved in 1981. -There
12 .was no .Federal Aid money available in 1982 as the State had no matching
13 .funds. The new five cent (50- gasoline tax brought this up' recently.
14 ,Funds are now available by July land contracts can possibly be .let in
15 June. We are in a 'position where the engineering has been done and ready
16 to go for a project approval by the State. 'The State _contacted .us to
17 .-put us in the program. The agreement -between the Board of Works and the
18 State is ready for signature upon approval of this appropriation.' •

20 The area for approval this summer is between 8th and 23rd on South "L".
21 This will be a great improvement for the City.. This will be a four lane
22 road with the rest of the road, as scheduled, being a two -lane road with
23 right-of-way for four lanes.

25 REPORT FROM- BOARD OF WORKS • • •
27 - .Councilman- Carter noted a problem with loose gravel.a.t intersections in
28 the Hidden Valley Drive and Hidden Valley' .Lane areas. '.Mr.. -Meredith
29 • noted the street sweepers have been out and will continue to be cleaning.

31 Councilman Elstro noted a manhole at South 8th and. "L" has dropped 2"
32 - to 3". Mayor Dickman stated the State has been notified. . The resident
33 at 930 South 10th pulled a limb from the street and would like it removed.

35 • Councilman Parker .requested the City Engineer check repairs to N. W. and
36 S. W. 18th Street where the Water Works. is doing work to be sure it is
37 ,put back properly. Mayor Dickman stated it is the. Gas Company and. they
38 . are mixing with cold mix which will come out when hot mix can be applied.

40 MISCELLANEOUS BUSINESS -

42 Councilman Williams, concerning North Richmond,.' tated articles in the
43 newspaper appeared that things hadn't been reported, as articles have
44 . been cut. He praised Building Commissioner Charles- Roberts for checking
45 , on situations reported to him.

47 - . Councilman -Elstro noted the first visitation to. a City Department by the
48 Council will be March 14th. He will present' a schedule for the year at
49 the next meeting. '

48 City Attorney Ed Anderson examined proof of publication for Ordinance
49 - Nos. 3-1983, 6-1983"and 7-1983. He noted, an error in the Cumulative
50 Storm- Sewer.:Fund, which should read $8,280.07_and _reads $8,280.67 in the
51 total, The line item has the correct amount. This error can be waived
52 as it is a typographical error in the newspaper. Mr. Anderson recom-
53 mended approval of the proof. Councilman Welchmoved it be accepted and
54 filed, seconded by Councilman Hankinson and on unanimous voice vote the -
55 motion was carried. -

62 City Controller Don Meredith noted money has been in this fund for at
63 least the last seven (7) years.' There is nothing 'specific for this fund
64to be used for at this time; however, if an emergency should arise, the

2 Mayor Dickman suggested .this money should be used to raise manholes.

23 APPROPRIATE FROM THE LOCAL ROAD' AND'STREET FUND.

26 Speaking against this Ordinance was Mrs. Margorie Sharp, 981 Breckenridge •
27 Dr. , stating she has always been against- this project.: She-stated-she;
28 . is not opposed to the extension between 8tth and 23rd.but has a problem

29 . with Elks. Road extended to Hodgin. She also is opposed to truck traffic.
30 She recommended putting ..a route further south. .

32 ' In response to Councilman Carter's question concerning a timetable to the
33 starting of--the extension from Hodgin to Main, ,Mr. Fred Burgner, repre-
34 senting" the-engineering firm of Butler,. Fairman, and Seufert, stated this
35' is dictated by 'when the federal funds become available. The program has
36 • ! , been seven years-in getting the first section into construction; however,
37 • , the 5 gas tax has made additional' funds available to the state. This
38 is a four (4) year program. .'Aa the right-of-way is secured, which is a
39 requirement of eligibility for funding for construction; the project can
40 proceed' as funds become available. •

42 Councilman Carter -questioned the legality of the. city building a road in
43 the county, as. Hodgin Road •east- of Hunter's ',Pointe and the extension from
44 Hodgin to .Main Street are mostly in the county. City Attorney Ed Anderson.
45 stated .he .will look up the statutory citation: He noted the city does
46 have the right of annexation. Council was given maps showing the area
47 the city has' jurisdiction over for federal urban funds.

49 "'Councilman.Williams recommended the Mayor and Council 'get together to
50 put some control on construction being done to keep it local as much as
51 possible. '

53 . H _ Councilman Carter. stated he Objects to the extension. from Main to Hodgin
54 . and will be voting against this ordinance. .

,56 Councilman.:Elstro' stated he objects to four (4) lanes from' 8th to 23rd4.
57 Mr. Burgher noted the four (4)- lanes will be done on existing-right-of-
. 58 ! way.

33 * -President Mills read the following letter from City Engineer
34 George Webb regarding the South "L" Street project,-dated,February 18.

36 - _ I will be attending the annual Professional Engineers' meeting
37 on the above date. . '

39 . The South "L" Street project will be on second reading and as
40 . always, I am in favor of it.. As the southeast side of the
41 City continues to grow, we must plan for the future, and we
42 must always be mindful of the total safety and well being of
43 the City.
44 .
45 In matters like this, we must not be so naive as to think
46 - that any special interest group, that normally Would remon-
47 strate, would have the best interests .of the City as their
48 main -concern., To be sure, it is my feeling that the concerns
49 that have been expressed in the recent past have caused
50 . innocent -parties to be damaged by •the'reluctance of people to
51 purchase homes along the subject streets. Also, it is my
52 feeling that in the end, the people in the affected areas will
53 be thankful for the improvements to be accomplished by this
54 project. In fact, I would hope that the City could have these .
55 - streets. constructed 'before we; are in -dire need, o.f them - con-
56 - sidering the time it takes to move these project's through all
57 . the public hearings, reviews and formal preparations before
58 - .. construction.

60 In closing, we have several choices: We -can stop development .in
61 -this area;.-we can continue to place higher traffic loads on
62 -streets that were planned during the, 19th century, or we can
63 - plan for the future.- I-would hope that we have the fortitude
64 _ to plan for the future. .
