PROCEEDINGS OF THE COMMON COUNCIL OF THE
CITY OF RICHMOND, INDIANA, DECEMBER 28, 1982
1 The Common Council of the. City of Richmond, Indiana, met in special
III 2 session December 28, 1982 at the hour of 7:00 p.m. in the Council Chambers
3 in the Municipal Building in said City. President Mills presided with the
4 following members present: . Messrs. Elstro, Williams, Ms. Henry,
5 Hankinson, Welch, Parker and Paust. Absent: Carter. The following
6 business was had, to-wit;

8 President Mills announced this special meeting is to consider
9 Ordinance No. 53-1982.

11 ORDINANCES ON 1ST READING •

13 Councilman.Welch moved to suspend the rules and read Ordinance No. 53-
14 1982 on first reading by title only, seconded by Councilman Parker and
15 on unanimous voice vote the motion was carried.

19 The Clerk read on first reading by title only Ordinance No. 53-1982 -
20 AN ORDINANCE CONCERNING AMENDMENT OF THE POWER SALES CONTRACT AND THE
21 CAPACITY PURCHASE AGREEMENT BETWEEN THE CITY OF RICHMOND AND THE INDIANA
22 MUNICIPAL POWER AGENCY AND OTHER MATTERS CONNECTED. THEREWITH.

24 Councilman Welch moved to suspend the rules and read Ordinance No. 53-
25 1982 on second reading, seconded by Councilman Parker 'and on unanimous
26 voice vote the motion was carried.

28 The Clerk read on second reading Ordinance No. 53-1982.

30 President Mills announced Ordinance No. 53-1982 is on public hearing.
31 A memorandum was presented to. Council regarding the City of Richmond
.32 Power Sales Contract and Capacity Purchase Agreement amendments to provide
33 for commencement of service and purchase of capacity after January 1, 1983.
34 Explaining this ordinance was Attorney Thomas Downs, Ice, Miller, Donadio
35 & Ryan, noting this gives the agency an opportunity to expedite their
36 bond sale. The planned closing date is January 27. Mr. Downs noted if
37 the date is not changed technically from January 1 until an ordinance
38 was passed the agency would be in default under the contract.

40 Councilman Welch moved for engrossment of Ordinance No.. 53-1982, seconded
41 by Councilman Williams and on unanimous voice vote. the motion was carried.

43 Councilman Welch moved to suspend the rules and read Ordinance No. 53-
44 1982 on third and final reading by title only, seconded .by Councilman
45 Williams and on unanimous voice vote the motion was carried.

47 The Clerk read on third reading by title only Ordinance No. 53-1982.

49 Ordinance No. 53-1982 was adopted by the following vote:
50 AYES: Elstro, Williams, .Henry, Hankinson,

57 There being no further business on motion duly made, seconded and passed
