HomeMy Public PortalAbout12-06-1982 add(J0 • PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, DECEMBER 6, 1982 1 The Common Council of the City of Richmond, Indiana, met in regular session 11/ 2 December 6, 1982 at the hour- of 7:30 p.m. in the Council Chambers in the 3 Municipal Building in said City. President Mills presided with the fol- 4 lowing members present: Messrs. Elstro, Williams, Ms. Henry, Hankinson, 5 Welch, Parker, Carter and Paust. Absent: None. The following business 6 was had, to-wit: 7 8 DEVOTIONS • 9 10 Devotions were given by Councilman Parker. 11 . 12 APPROVAL OF MINUTES OF NOVEMBER 15, 1982 13 14 Councilman Hankinson moved to approve the minutes of the previous meeting 15 as received, seconded by Councilman Welch and on unanimous voice vote the 16 motion was carried. 17 18 RESOLUTIONS 19 20 Councilman Welch moved to suspend the rules and. read Resolution No. 14-1982 21 by title only, seconded by Councilman Parker and on unanimous voice vote 22 the motion was carried. • 23 24 RESOLUTION NO. 14-1982 I25 26' The Clerk read by title only Resolution No. 14-1982 - RESOLUTION AUTHORIZING 27 THE FILING OF AN APPLICATION WITH THE STATE OF INDIANA DEPARTMENT OF COM- 28 MERCE, FOR SMALL CITIES COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS UNDER THE 29 COMMUNITY IMPROVEMENT PROGRAM (CIP) AS PROVIDED IN THE HOUSING AND COMMUNITY 30 DEVELOPMENT ACT OF 1974 P.L. 93-383 AS AMENDED. 31 32 Speaking for this Resolution was Mr. Bob Goodwin, Director of Community 33 Development. He noted C. D. is seeking a grant totaling $500,000 from the 34 State Department of Commerce under C. D. Block Grant Program. $150,000 35 will be utilizing local in--kind services and local dollars. $350,000 will 36 be from the State. The project is for the rebuilding of N. W. llth Street 37 and repaving from N. W. "L" to Rich Road and the intersection of N. W. 11th. • 38 39 Councilman Elstro moved for adoption of Resolution No. 14-1982, seconded • 40 by Councilman Paust. 41 42 President Mills announced he is in management at Belden and has stock in 43 the company but will be voting on this Resolution. 44 45 Councilman Williams requested consideration for the area of North "B", 46 "C" and "D" around North 10th.. 47 48 On unanimous voice vote the motion was carried. 49 50 BOARD OF WORKS III 51 52 Councilman Elstro asked if a deadline has been set for the completion 53 of South "L" across the C&O Railroad crossing. City Engineer George Webb 54 stated it is hoped this crossing will be finished tomorrow. 55 • 56 NOTIFICATION 'OF UPCOMING APPOINTMENT TO POLICE MERIT COMMISSION 57 58 City Clerk JoEllen Trimble reminded Council of their upcoming appointment 59 on December 20 in the category of business to the Police Merit Commission. 60 61 WELCOME RHS GOVERNMENT CLASSES 62 63 President Mills welcomed students from RHS government classes. Common Council Minutes Cont'd. December 6, 1982 Page 2 1 MISCELLANEOUS BUSINESS 2 3 Councilman Carter noted at the state level there is 'a move to raise the 4 sales tax and corporate income tax. There is also a proposal to elimi- 5 nate the sales tax on all public utility bills. He recommended Council 6 pass a resolution in support and urge the legislators to eliminate the 7 sales tax on utility bills. President Mills suggested Councilman. Carter 8 get with the City Attorney and have a resolution ready for the December 9 20 meeting. Councilman Carter recommended Council go on record in support 10 and authorize the City Attorney to draw the resolution and forward it to 11 the proper authorities as the next meeting will be too late. City At- 12 torney Ed Anderson noted a resolution has to be submitted in writing and 13 suggested instead lof a resolution a policy statement could be made and 14 in the statement urge the City Attorney draft such an appropriate resolu- 15 tion and it be submitted. Councilman Williams asked the record to show 16 that he is opposed to any resolution. 17 18 Councilman Carter moved to suspend the rules and have a policy statement, 19 seconded by Councilman Welch and on a call of the roll the following was 20 was recorded: Ayes: Elstro, Henry, Hankinson, Welch, Parker, Carter, 21 Paust, Mills. Noes: Williams. The vote being eight (8) to one (,1) in 22 favor of passage of the motion. 23 24 Councilman Carter moved that the Richmond City Council urge the State 25 Legislature and Legislators to consider the elimination of the state 26 sales tax on all utility bills from this date forward, seconded by 27 Councilman Parker, Councilman Paust recommended the words "if financially 28 feasible" be added. Councilman Carter so amended his motion, seconded 29 by Councilman Parker;. The amended motion was passed by a vote of eight 30 (8) to one (1) . Ayes: Elstro, Henry,. Hankinson, Welch, Parker, Carter, 31 Paust, Mills. Noes: Williams. 32 33 ORDINANCES ON 1ST READING 34 35 Councilman Welch moved to suspend the rules and read Ordinance Nos. 36 48-1982 and 49-1982 on first reading by title only, seconded by Council- 37 man Parker and on unanimous voice vote the motion was carried. 38 39 ORDINANCE NO. 48-1982 40 41 The Clerk read on first reading by title only Ordinance No. 48-1982 - AN 42 ORDINANCE AMENDING SPECIAL USE ORDINANCE NO. 3001-1975 AND NO. 3087-1976 43 WHICH AUTHORIZED A COMMERCIAL DEVELOPMENT UNIT PROJECT AT 2023 CHESTER 44 BOULEVARD, BY AMENDING THE APPROVED SITE DEVELOPMENT PLAN TO PERMIT THE 45 RECONSTRUCTION AND CONNECTION OF TWO (2) EXISTING STRUCTURES AND TO 46 PERMIT THE USE OF SAID STRUCTURE CONSISTENT WITH THE C-2 ZONING DISTRICT. 47 48 Councilman Welch moved to suspend the rules and read Ordinance No. 48-1982 49 on second reading, seconded by Councilman Hankinson and on unanimous voice 50 vote the motion was carried. 51 52 The Clerk read on so.c.ond reading Ordinance No. 48-1982. 53 54 President Mills announced Ordinance No. 48-1982 is on public hearing. 55 Speaking for this Ordinance was Plan Director Robert Goodwin noting the 56 Plan Commission voted in favor of passage. Councilman Welch stated he 57 feels there is a site problem with the exit onto University Boulevard. 58 59 Councilman Welch moved to amend Ordinance No. 48-1982 to add under 60 Section 3 as item c a condition of approval being that the intersection 61 of the access drive to the east of the proposed building and connecting 62 with the north lane of University Boulevard be improved so that site 63 distance to the east from the access drive be adequate to insure traffic 64 safety, seconded by Councilman Carter and on unanimous voice vote the 65 motion was carried. • Common Council Minutes Cont'd. December 6,• 1982 Page 3 1 Councilman Carter moved for engrossment of Amended Ordinance No. 48-1982, 2 seconded by Councilman Paust and on unanimous, voice vote the motion was 3 carried. 4 5 • 6 Councilman Welch.moved to suspend the rules and move Amended Ordinance • 7 No. 48-1982 to third and final reading by title only., seconded by Council- 8 man Parker and on unanimous voice vote the motion was carried. 9 10 The Clerk read on third reading by title only Amended Ordinance No. 48-1982. 11 12 Amended Ordinance No. 48-1982 was adopted by the following vote: 13 AYES: Elstro, Williams, Henry, Hankinson, 14 Welch, .Parker, Carter., Paust, Mills (9) • 15 NOES: None • (0) 16 • 17 ORDINANCE NO. 49-1982 18 19 The Clerk read on first reading by title only Ordinance No. 49-1982 - AN 20 - ORDINANCE AMENDING CHAPTER 154- OF THE MUNICIPAL CODE, BEING ORDINANCE 21 NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF 22 RICHMOND, INDIANA, PROVIDING 'FOR THE REZONING OF PROPERTY .LOCATED AT 238 23 SOUTH 5TH' STREET FROM R-3 ONE-TO=EIGHT FAMILY RESIDENCE DISTRICT TO R-3 24 SU ONE-TO-EIGHT FAMILY RESIDENCE SPECIAL USE DISTRICT AND AUTHORIZING .25 THE SPECIAL USE OF SAID PROPERTY AS A PROFESSIONAL OFFICE. 26 27 Councilman Welch moved to suspend the rules and move Ordinance No. 49- 28 1982 to second reading, seconded by Councilman Parker and on unanimous 29 voice vote the motion was carried. 30 31 The Clerk read' on second reading Ordinance No: 49-1982. • . 32 33 President Mills announced Ordinance No. 49-1982 is on public hearing. 34 Speaking for this Ordinance was Attorney Jim Ronald, .1.120 East Main, 35 representing petitioner Linda Ronald, -who wants to establish a psycho- logist's office in the property. Councilman Carter noted one letter 37 from an adjoining property owner in opposition to the request. Mr. 38 . Goodwin stated the opposer appeared at the Plan Commission and, after . 39 hearing the presentation by the petitioner, withdrew his objection. 40 . • • 41 Councilman Williams moved for engrossment of Ordinance No. 49-1982.,- 42 . seconded by Councilman Welch and on unanimous voice vote the motion . 43 was carried. 44 45 Councilman 'Welch moved to suspend the rules and move Ordinance No. 49-1982 46 to third and final reading by title only, seconded by Councilman Parker 47 and on unanimous voice vote the motion was carried. 4.8 49 The Clerk read on third reading by title only Ordinance No. 49-1982. 50 51 Ordinance No. 49-1982 was adopted by the following vote: 52 AYES: Elstro, Williams, Henry, Hankinson, It53 Welch; Parker, Carter, Paust, Mills.
