HomeMy Public PortalAbout11-15-1982 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, NOVEMBER 15, 1982 11/ 1 The Common Council of the City of Richmond, Indiana, met in regular 2 session November 15, 1982 at the hour of 7 :30 p.m. in the Council Chambers 3 in the Municipal Building in said City. President Mills presided with, the 4 following members present: Messrs. Elstro, Williams, Ms. Henry, Hankinson, 5 Welch, Parker, Carter and Paust. Absent: None. The following business 6 was had, to-wit: 7 8 DEVOTIONS 9 10 • Councilwoman Henry gave devotions. 11 12 APPROVAL OF MINUTES OF NOVEMBER'1 , 1982 13 14 Councilman Hankinson moved to approve the minutes of the previous meeting 15 - as received, seconded by Councilman Welch and on unanimous voice vote the 16 motion was carried. 17 18 WELCOME 19 20 President Mills welcomed the government classes from Richmond High School. 21 • 22 BOARD OF PUBLIC WORKS 'AND SAFETY 23 24 Councilman Carter noted a chuckhole on the north side of Wernle Road 500' 25 east of 13th Street in the wheel lane. 26 27 ORDINANCES ON 1ST READING 28 29 Councilman Welch moved to suspend the rules and read Ordinance Nos. 45- 30 1982, 46-1982 and 47-1982 on first reading by title only, seconded by 31 Councilman Parker and on unanimous voice vote the motion was carried. 32 33 ORDINANCE NO. 45-1982 34 35 The Clerk read on first reading by title only Ordinance No. 45-1982 - 36 AN ORDINANCE TO TRANSFER WITHIN THE GENERAL FUND. 37 38 Councilman Welch moved to suspend the rules and read Ordinance No. 45- 39 1982 on second reading, seconded by Councilman Parker and on unanimous 40 voice vote the motion was carried. 41 • 42 The Clerk read on second reading Ordinance No. 45-1982. 43 44 Explaining Ordinance No. 45-1982 was City Controller Don Meredith, noting 45 the .title should be amended to read "Public Transit Fund" instead of 46 "General Fund". Councilman Hankinson;so moved, seconded by Councilman 47 Williams and on unanimous voice vote the motion was carried. 48 49 President Mills announced Amended Ordinance No. 45-1982 is on public 50 hearing. There-being no one speaking for or against this Ordinance, 51 Councilman Welch moved for engrossment, seconded by Councilman Parker 52 and on unanimous voice vote the motion was carried. 53 54 Councilman Williams moved to suspend the rules and read Amended Ordinance 55 No. 45-1982 on third and final reading by title only, seconded by Coun- 56 cilman Welch and on unanimous voice vote the motion was carried. 57 58 The Clerk read on third reading by title only Amended Ordinance No. 45-1982. • 59 60 Amended Ordinance No. 45-1982 was adopted by the following vote: 61 AYES: Elstro, Williams, Henry, Hankinson, 62 Welch, Parker, Faust, Mills - (8) 63 NOES: Carter (1) 280 Common Council Minutes cont'd. November 15, 1982 Page 2 1 ORDINANCE NO. 46-1982 2 3 The Clerk read on first reading by title only Ordinance No. 46-1982 - 4 AN ORDINANCE TO APPROPRIATE WITHIN THE OFF STREET PARKING FUND. 5 6 President Mills announced Ordinance No. 46-1982 has to be advertised. 7 8 ORDINANCE NO. 47-1982 9 10 The Clerk read on first reading by title only Ordinance No. 47-1982 - 11 AN ORDINANCE VACATING A CERTAIN PUBLIC WAY WITHIN THE CITY OF RICHMOND, 12 INDIANA, BEING THAT PORTION OF NORTH 17TH STREET LOCATED BETWEEN NEW 13 PARIS PIKE AND THE SOUTHERN END OF THE NORTH 17TH STREET BRIDGE. 14 15 President Mills announced Ordinance No. 47-1982 is referred to the Plan 16 Commission. 17 18 ORDINANCES ON 2ND READING " 19 20 City Attorney Ed Anderson examined proof of publication for Ordinance 21 Nos. 41-1982 and 43-1982 and found it to be in order. Councilman Welch 22 moved the proof be accepted and filed, seconded by Councilman Hankinson 23 and on unanimous voice vote the motion was carried. 24 25 ORDINANCE NO. 41-1982 26 27 The Clerk read on second reading Ordinance No. 41-1982 - AN ORDINANCE 28 TO APPROPRIATE WITHIN THE MUNICIPAL AIRPORT FUND. 29 30 President Mills announced Ordinance No. 41-1982 was on public hearing. 31 32 There being no one speaking for or against Ordinance No. 41-1982 33 Councilman Welch moved for engrossment, seconded by Councilman Elstro 34 and on unanimous voice vote the motion was carried. 35 36 Councilman Welch moved to suspend the rules and. read Ordinance No. 41- 37 1982 on third and final reading by title only, seconded by Councilman 38 Carter and on unanimous voice vote the motion was carried. 39 40 The Clerk read on third reading by title only Ordinance No. 41-1982. 41 42 Ordinance No. 41-1982 was adopted by the following vote: 43 AYES: Elstro, Williams, Henry, Hankinson, 44 Welch, Parker, Carter, Paust, Mills (9) 45 NOES: None (0) 46 47 ORDINANCE.NO. 43-1982 48 49 The Clerk read on second reading Ordinance No. 43-1982 - AN ORDINANCE 50 TO APPROPRIATE WITHIN THE GENERAL FUND. 51 52 President Mills announced Ordinance No. 43-1982 was on public hearing. 53 54 There being no one speaking for or against Ordinance No. 43-1982 Council- 55 man Hankinson moved for engrossment, seconded by Councilman Williams and 56 on unanimous voice vote the motion was carried. 57 58 Councilman Welch moved to suspend the rules and read Ordinance No. 43- 59 1982 on third and final reading by title only, seconded by Councilman 60 Hankinson and on unanimous voice vote the motion was carried. 61 62 The Clerk read on third reading by title only Ordinance No. 43-1982. 63 64 Ordinance No. 43-1982 was adopted by the following vote: 65 AYES: Elstro, Williams, Henry, Hankinson, 66 Welch, Parker, Carter, Paust, Mills (9) 67 NOES: None (0) Common Council Minutes Cont'd. November 15, 1982 Page 3 1 ORDINANCE NO. 44-1982 2 3 The Clerk read on second reading Ordinance No. 44-1982 - AN ORDINANCE 4 CREATING THE CITY COURT OF THE '`CITY OF RICHMOND, INDIANA. 5 6 President Mills announced Ordinance No. 44--1982 was on public hearing. 7 8 There being no one speaking for or against Ordinance No. 44-1982 9 -Councilman Hankinson moved for engrossment, seconded by Councilman Paust 10 and on unanimous voice vote the motion was carried. 11 12 Councilman Elstro moved to suspend the rules and read Ordinance No. 44- 13 1982 on third and final reading by title only, seconded by Councilman 14 Paust and on unanimous voice vote the motion was carried. 15 16 The Clerk read on third reading by title only Ordinance No. 44-1982. 17 - . 18 Councilman Williams 'noted he would not be supporting this ordinance be- 19 cause he feels the city will lose money as people will not be able to 20 pay their fines. Mr. Meredith noted he feels the court would be self- 21 supporting and would add some to the city funds; however, It would mean 22 more to the city in hidden costs, such as the Police Department schedu-- 23 ling their time and a more direct line of communication. There are more 24 ordinances on the books which could be enforced. Councilman Elstro 25 stated he supports the ordinance as it would be a less formal atmosphere. 26 and more time could be taken with the people, giving them a better day 27 in court. Councilman Carter stated some distinguished attorneys and the III28 last three (3) judges of City Court testified before this body and they 29 all came out against recreating the court, feeling it would be a step 30 backward in the unified court system. It was pointed out this ordinance 31 was brought before Council at this time because this would have to be 32 done before a city election and cannot be presented again for four years. 33 Councilman Welch noted at the time we were asked to abolish City Court, 34 we were assured the county court judge could handle the case load with 35 no problem and, if the docket schedule is a problem, the city should 36 contact the judge. It was pointed out the unified court system has 37 stopped in its process and this is why the city court could be reinstated. 38 Councilman Elstro noted, if another county court becomes necessary, the 39 expenses would be much more than recreating the city court. 40 41 Ordinance No. 44-1982 was defeated by the following vote: 42 AYES: Elstro, Parker, Mills (3) 43 NOES: Williams, Henry, Hankinson, Welch, Carter, Paust - (6) 44 - 45 ADJOURNMENT 46 - 47 There being no further business on motion duly made, seconded and passed 48 the meeting was adjourned. 49 50 Kenneth Mills 51 President 52 11/ 53 ATTEST: JoEllen Trimble 54 City Clerk 1
