HomeMy Public PortalAbout10-04-1982 63 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, OCTOBER 4, 1982 1 The Common Council of the City of Richmond, Indiana, met in regular 2 session October 4, 1982 at the hour of 7 :30 p.m. in the Council Chambers 3 in the Municipal Building in said City. President Mills presided with 4 the following members present: Messrs. Elstro, Williams, Ms. Henry, • 5 Hankinson, Welch, Parker and Carter. Absent: Paust. The following 6 business was had, to-wit: 7 8 DEVOTIONS 9 10 Councilman Elstro gave devotions. 11 12 APPROVAL OF MINUTES OF SEPTEMBER 20, 1982 13 14 Councilman Hankinson moved to approve the minutes of the previous meeting 15 as received, seconded by Councilman Welch and on unanimous voice vote the 16 motion was carried. 17 18 PETITIONS 19 20 President Mills read the following petition signed by nineteen (19) persons: 21 22 To Whom It May Concern: 23 24 We, the undersigned taxpayers of the 400 block of Richmond Avenue, 25 would like some help with a matter that concerns us all greatly. 26 There is a house located on the NE corner of Richmond Ave and NW III 27 5th Streets that we would like to see either cleaned up or torn 28 down! Not only is it a health hazard, with its filth and RATS, 29 • but is a nuisance and an eye sore! The alley is always blocked 30 with cars and trucks, or these same vehicles are left parked in 31 front of our homes for a week at a time! 32 33 There is also a large pile of dirt on the sidewalk on NW 5th St. 34 We hope to receive some help with this matter as soon as possible. 35 It`s a shame when we try hard to keep our neighborhood a safe and 36 clean place to live, and one home ruins it for the rest of us. 37 Please help us correct this matter immediately! 38 . Thank you! 39 40 RESOLUTIONS 41 42 Councilman Welch moved to suspend the rules and read Resolution Nos. 7-1982, 43 8-1982 and 9-1982 by title only, seconded by Councilman Elstro and on 44 unanimous voice vote the motion was carried. 45 46 RESOLUTION NO. 7-1982 47 48 The Clerk read by title only Resolution No. 7-1982 - A RESOLUTION AUTHOR- 49 IZING CERTAIN INDIVIDUALS TO RESPOND TO INQUIRIES CONCERNING PUBLIC 50 EMPOLYEES' RETIREMENT FUND. 51 III 52 City Controller Don Meredith explained this Resolution is to designate 53 three (3) individuals to be authorized to release certain information 54 to PERF concerning employees benefits. 55 56 Councilman Carter moved for adoption of Resolution No. 7-1982, seconded 57 by Councilman Hankinson and on unanimous voice vote the motion was carried. 58 59 RESOLUTION NO. 8-1982 60 61 The Clerk read by title only Resolution No. 8-1982 - A RESOLUTION OF THE 62 CITY OF RICHMOND TO INDUCE WAYTRU BANCORP, AN INDIANA CORPORATION, TO 63 ACQUIRE, CONSTRUCT AND EQUIP AN ECONOMIC DEVELOPMENT FACILITY, AND TO 64 UNDERTAKE TO SELL AND DELIVER REVENUE BONDS TO PAY THE COSTS THEREOF, 65 AND OTHER MATTERS RELATING THERETO. 264 Common Council Minutes Cont'd. October 4, 1982 Page 2 1 Speaking for this Resolution was Attorney Andrew Cecere, 101 South 10th 2 Street, representing Waytru Bancorp, who are requesting EDC bonds to 3 build a new facility on the northeast corner of South •5th and "A". 4 Mr. Roger Kem, Assistant Vice President of Wayne Trust, presented a 5 drawing of the structure. 6 7 Councilman Carter moved for adoption of Resolution No. 8-1982, seconded 8 by Councilman Hankinson and on unanimous voice vote the motion was carried. 9 10 RESOLUTION NO. 9-1982 11 12 The Clerk read by title only Resolution No. 9-1982 - A RESOLUTION AUTHOR- 13 IZING AND APPROVING THE SALE OF CERTAIN REAL ESTATE IN THE CITY OF 14 RICHMOND, INDIANA. 15 16 Mr. Meredith explained the procedure for the sale of property under the 17 new State statutes, noting, if Council passes this Resolution, the matter 18 will go to the Board of Works for disposal. 19 20 Councilman Carter moved for adoption of Resolution No. 9-1982, seconded 21 by Councilman Parker and on unanimous voice vote the motion was carried. 22 23 WELCOME STUDENTS 24 25 President Mills welcomed the students from Test Junior High in attendance. 26 27 PETITION BROUGHT BY BOBBY SMITH 28 29 Bobby Smith read the following proposed resolution: 30 31 Richmond residents who use natural gas request the 32 Richmond Common Council to pass the following resolution: 33 34 Request the Richmond Gas Corp to rescind all recent rate 35 increases residents have incurred due to the actions of 36 its supplier, the Panhandle Eastern Pipe Line Co. 37 Richmond will have one of the state's highest increases. 38 Panhandle's demands for these increases are "cannibal" in 39 nature and "cartel" in practice. The agreement Panhandle 40 signed with Algeria and Canada to supply Panhandle with 41 this unneeded gas at this time is uneconomical. We as 42 citizens do not believe this company is managed by illiterate 43 men, but rather they are taking advantage of their monopoly 44 of gas with their cartel agreement. We will not submit to 45 these "hostage" prices. 46 47 Resisting Citizens of Richmond, Indiana 48 49 Mr. Smith noted a group is going to a hearing Friday in Indianapolis 50 and would like the support of Council at this hearing. 51 52 President Mills explained the procedure for entering a resolution under 53 Common Council's rules and procedures. The resolution would have to be 54 presented in writing and appear on Council's agenda, having gone through 55 the City Attorney. Mr. Mills further noted he just,,attended a meeting 56 of the Indiana Association of Cities and Towns and they are going to 57 intervene in rate cases. 58 59 Councilman Welch asked the City Attorney if Council can adopt a position 60 statement. Mr. Anderson stated Council could express a concensus of 61 Council that Mr. Smith be supported in his position, but no official 62 capacity. 63 64 Mr. Welch moved that we recognize the effort Mr. Smith and his group is 65 making, an effort to resist a large rate increase in the natural gas 66 prices; that we sympathize and agree that some intervention should be ALuo Common Council Minutes Cont'd. October 4, 1982 Page 3 1 forthcoming and that we support his efforts and his group, seconded 2 by Mr. Hankinson and on unanimous voice vote the motion was carried. 3 4 REPORT FROM STORM DAMAGED AREA 5 6 Mr. Eric Steiner, 450 S. W. 4th, representing a community group who had 7 sewer damage on August 24, noted they are having difficulty getting 8 information from the Sanitary District and it appears they should call 9 in an outside engineering investigation. The Sanitary District is con- 10 ducting an investigation and the report should be coming October 19th. 11 He proposed the Council (1) assist the citizens in the financial burden 12 of an independent engineering investigation and (2) write to Mr. Valdis 13 V. Adamkus, Chief Administrator of Region 5, EPA, 230 So. Dearborn St. , 14 Chicago, IL 60604, requesting an official investigation into the damages, 15 with a written report back. 16 17 President Mills stated Council should get with the City Attorney to see 18 what can or cannot be done. Councilman Carter suggested the City At- 19 torney contact the Regional Administrator and direct him to send an 20 investigating team here. Mr. Anderson noted the law does permit the 21 Council to conduct their own investigation and the whole Council must 22 direct for an investigation. He further suggested the President appoint 23 a committee to work with this as there will be cost involved and a 24 determination as to how far to go. 25 26 Councilman Carter moved that Council direct the City Attorney to write 27 a letter of request to the Regional Director of EPA, Mr. Adamkus, re- "' 28 questing that he send an investigation team to Richmond, Indiana, to 29 investigate this matter further. 30 31 Councilman Welch stated he feels the EPA will contact the Sanitary Dis- 32 trict who will report that the consulting engineer is conducting an 33 investigation and they will wait to hear the facts of that investigation. 34 They will not form an independent survey team to come down from Chicago, 35 but will leave it in the hands of the consulting engineer as they are 36 paid from EPA grant funds. He noted investigations take time conducting 37 their tests. He recommended the group attend the Sanitary District's 38 meeting and talk to the consulting engineer. Mr. Steiner disagreed, 39 noting the engineer was invited to their meeting and did not attend. 40 He further noted his group had difficulty obtaining names of persons 41 who had filed claims. His group has attended the Sanitary meetings. 42 43 Councilman Elstro seconded the motion and on a call of the roll the 44 following was recorded: Ayes: Elstro, Williams, Henry, Hankinson, 45 Welch, Parker, Carter and Mills. Noes: None. Eight (8) to zero (0) . 46 47 REPORT ON HIGH SCHOOL AREA CONCERNING SPEEDERS IN AREA 48 49 President Mills read from the Board of Works minutes of September 30, 1982 50 concerning the request from High School area residents to help curb 51 speeders. 52 53 MISCELLANEOUS BUSINESS 54 55 Councilman Williams reported on a meeting with people interested in the 56 North "E" Street areas, noting there has been nothing done in this area 57 as far as streets, curbs and sidewalks are concerned. President Mills 58 stated Mr. Matt Stegall will give a report to Council concerning this 59 area on November 1. Mr. Jim Mays, RP&L, will hold a hearing on a dis- 60 - trict heating project on October 18. 61 62 Councilman Carter noted he had walked the area and had been interested at 63 one time -in preservation of the old depot. Councilwoman Henry noted that 64 whether or not the train depot is preserved, something has to be done in 65 the area. The greatest concern is the sidewalks. She noted it wil take 66 a joint effort of the City and owners to clean up the area. 266 Common Council Minutes Cont'd. October 4, 1982 Page 4 1 Councilman Carter noted a utility is cutting 4' x 6' holes all over the 2 City and not filling them in properly. President Mills noted some holes 3 are cut without proper permits at the time. He further noted the City 4 Engineer is responsible for the permits but this has been transferred 5 to the Department of Transportation. He is working on making someone 6 responsible for these cuts to be sure they have a permit and are put back 7 properly. 8 9 Councilman Elstro asked about the paving of 8th and 9th Street. Mr. 10 Meredith stated the indication was the State was not going to pave "A" 11 Street for at least two (2) years, but he does not know about 8th and 9th. 12 13 In response to Councilman Elstro's inquiry concerning the edges of the 14 new paving from the sewer construction, Mr. Webb stated the contractor 15 did go out and roll the edges and the Engineer and Commission accepted it. 16 He further noted, in response to an inquiry of sweeping on South 8th, the 17 Street Department does that under his contract. Also, the State has been 18 making some repairs at South 8th and South 9th & "E". The 2" drop-offs 19 are due to that being the base coat only and they will come back and put 20 the finish on. He stated utilities' cuts should be color coded as follows: 21 Water Co. - blue; Gas Co. - yellow; RP&L - red. 22 23 ORDINANCES ON 1ST READING 24 25 Councilman Welch moved to suspend the rules and read Ordinance Nos. 36- 26 1982, 37-1982 and 38-1982 on first reading by title only, seconded by 27 Councilman Elstro and on unanimous voice vote the motion was carried. 28 29 ORDINANCE NO. 36-1982 30 31 The Clerk read on first reading by title only Ordinance No. 36-1982 - 32 AN ORDINANCE TO APPROPRIATE WITHIN THE GENERAL FUND. 33 34 President Mills announced Ordinance No. 36-1982 has to be advertised. 35 36 ORDINANCE NO. 37-1982 37 38 The Clerk read on first reading by title only Ordinance No. 37-1982 - 39 AN ORDINANCE TO TRANSFER WITHIN THE MOTOR VEHICLE HIGHWAY FUND. 40 41 Councilman Welch moved to suspend the rules and read Ordinance No. 37-1982 42 on second reading, seconded by Councilman Williams and on unanimous voice 43 vote the motion was carried. 44 45 The Clerk read on second reading Ordinance No. 37-1982. 46 47 Explaining this Ordinance was City Controller Don Meredith. President 48 Mills announced this Ordinance is on public hearing. There being no one 49 speaking for or against this Ordinance, Councilman Welch moved for en- 50 grossment, seconded by. President 13 Mills announced this Ordinance is on public hearing. There being no one 14 speaking for or against this Ordinanc-e., Councilman Welch moved for en- 15 grossment, seconded by Councilman Hankinson and on unanimous voice vote 16 the motion was carried. 17 18 Councilman Williams moved to suspend the rules and read Ordinance No. 38- 19 I 1982 on third and final reading by title only, seconded by Councilman 20 Welch and on unanimous voice vote the motion was carried. 21 22 The Clerk read on third reading by title only Ordinance No. 38-1982. 23 1 24 Ordinance No. 38-1982 was adopted by the following vote: 25 AYES: Elstro, Williams, Henry, Hankinson, 26 Welch, Parker, Carter, Mills (8) 27 NOES: None (0) III 28 ABSENT: Paust 29 . 30 ORDINANCES ON 2ND READING 31 32 ORDINANCE NO. 34-1982 33 34 The Clerk read on second reading Ordinance No. 34-1982 - AN ORDINANCE 35 VACATING ALL PUBLIC WAYS LYING IN THE TERRITORY GENERALLY BOUNDED BY 36 THE SOUTH SERVICE DRIVE, SOUTH 6TH STREET, SOUTH "A" STREET AND SOUTH 37 5TH STREET. 38 39 City Attorney Ed Anderson checked the proof of publication and found it 40 to be in order. Councilman Welch moved it be accepted and placed on file, 41 seconded by Councilman Parker and on unanimous voice vote the motion was 42 carried. 43 44 Mr. Meredith noted this Ordinance vacates a number of alleys going 45 through the old Wayne Dairy site. President Mills announced this 46 Ordinance is on public hearing. There being no one speaking for or 47 against this Ordinance, Councilman Carter moved for engrossment, 48 seconded by Councilman Parker and on unanimous voice vote the motion 49 was carried. 50 51 Councilman Welch moved to suspend the rules and read Ordinance No. 34-1982 52 on third and final reading by title only, seconded by Councilman Williams 53 i and on unanimous voice vote the motion was carried. 54 55 The Clerk read on third reading by title only Ordinance No. 34-1982. 56 57 Ordinance No. 34-1982 was adopted by the following vote: 58 AYES: Elstro, Williams, Henry, Hankinson, 59 AYES Welch, Parker, Carter, Mills (8) 60 NOES: None (0) 61 ABSENT: Paust 62 63 ORDINANCE- NO. 35-1982 64 65 1 The Clerk read on second reading Ordinance No. 35-1982 - AN ORDINANCE TO 66 APPROPRIATE FROM THE LOCAL ROAD AND STREET FUND. )68 Common Council Minutes Cont'd. October 4, 1982 Page 6 1 City Attorney Ed Anderson examined proof of publication and found it to 2 be in order. Councilman Welch moved the proof 'be accepted and placed 3 on file, seconded by Councilman Parker and on unanimous voice vote the 4 motion was carried. 5 6 President Mills announced Ordinance No. 35-1982 is on public hearing. 7 Explaining this Ordinance was City Controller Don Meredith noting this 8 Ordinance is for the paving of South "A" Street from South llth to 9 South 23rd and North "E" Street from North 12th to North 22nd. Council- 10 man Carter suggested some funds be used to improve South "L".
