CITY OF RICHMOND, INDIANA, SEPTEMBER 7, 1982
1 The Common Council of the City of Richmond, Indiana, met in regular
2 session September 7, 1982 at the hour of 7 :30 p.m. in the Council Chambers
3 in the Municipal Building in said City. President Mills presided with the
4 following members present: Messrs. Elstro, Williams, Ms. Henry, Hankinson,
5 Parker, Carter and Paust. Absent: Welch. The following business was
6 had, to-wit:

12 APPROVAL OF MINUTES

14 Councilman Hankinson moved approval of the minutes as published, seconded
15 by Councilman Parker and on unanimous voice vote the motion was carried.

17 CITIZENS CONCERNED OVER RECENT FLOODING AND SEWAGE PACK-UP

19 Mr. Harmon Benjamin Walterman, Jr. , 417 S. W. 4th, was the spokesman for a
20 group of citizens in his neighborhood. He stated he has lived there since
21 1963 and has never had sewage back up into his basement until the last
22 heavy rain, which was two weeks ago. New storm sewers were put down S.
23 W. 4th, which were 3' to 4' in diameter. When the rain came, the manhole
24 cover blew up in the street and water was backing through his sewer into
25 his basement. His contention is that by putting in the sewers, the problem
III 26 was created and instead of separating them they hooked them together. When
27 the storm water went down, the sewage water started going out of his base-
28 ment. He requested something be done so this does not happen again.

30 Councilman Parker stated he was in the S. W. 4th area the evening of the
31 storm with the City Engineer, a representative of Clark-Dietz and super-
32 visors who were responsible for putting in the sewer. They checked manhole
33 covers, a collector at S. W. 5th & "E" and they felt there were sanitary
34 sewers mixed in with storm sewers. They were trying to locate where they
35 had made a mistake by putting sanitary and storm together by means of blue-
36 prints. They were going to check out sewers in the alleys by means of dye.

38 In response to a question from Mr. Walterman concerning where the people
39 should file claims, noting they had been filing them with the Sanitary
40 Department and the Mayor, Mr. Meredith noted the claims would be sent to
41 the insurance company through the City Attorney.

43 Mr. Eric Steiner, 450 S. W. 4th , asked what steps are going to be taken to
44 correct the problem. President Mills noted the engineers are working on it.
45 Mr. Meredith asked if the group had approached the Board of Sanitary
46 Commissioners at their meetings.

48 Mr. Sanford Lynch, 421 S. W. 4th stated he has been there and talked with
49 the Superintendent and Mr. Dave Knox. President Mills recommended they
50 be put on the agenda of the Board. Mr. Lynch stated he has been trying
III 51 to get something done and everyone is passing the buck. He requested an
52 insurance adjustor be sent to them. He stated pipe was put in a storm
53 sewer in front of his house that didn't belong there. He stated they have
54 a situation that needs attention now and would like help. President Mills
55 recommended he tell this to the Sanitation Board.

57 Councilman Elstro noted problems in the area of South 9th and South "H",by
58 people who have lived there for forty (40) years and never had water before.
59 He recommended Mr. Lynch call the members of the Board of Sanitary Comis-
60 sioners.

62 Mr. Steiner requested the Council make a motion or resolution to support
63 the residents in their effort for a solution. Councilman Carter noted a
64 resolution could be prepared by the City Attorney and brought before

1 Council at the next regular meeting. He noted Council can conduct its
2 own investigation. President Mills stated he assumes Councilman Carter
3 will get with the City Attorney to draft the resolution and sponsor it.

5 Councilman Elstro stated he has not received a reply from City Engineer
6 George Webb concerning the paving of streets. President Mills stated
7 he will call Mr. Webb.

13 Councilman Hankinson moved to suspend the rules and read Ordinance
14 No. 33-1982 on first reading by title only, seconded by Councilman Elstro
15 and on unanimous voice vote the motion was carried.

17 The Clerk read on first reading by title only Ordinance No. 33-1982 -
18 AN ORDINANCE OF THE CITY OF RICHMOND CONCERNING CERTAIN MATTERS CONNECTED
19 WITH ITS MEMBERSHIP IN THE INDIANA MUNICIPAL POWER AGENCY.

21 Councilman Hankinson moved to suspend the rules and read Ordinance
22 No.. 33-1982 on second reading, seconded by Councilman Elstro and on
23 unanimous voice vote the motion was carried.

27 President Mills announced Ordinance No. 33-1982 is on public hearing.
28 Speaking for this Ordinance was Mr. Irving Huffman, General Manager of
29 Richmond Power & Light, noting the purpose of this ordinance is to ratify
30 and approve the attached affidavit to the ordinance which states we fol-
31 lowed the law as it was written in the standards set forth in I.C.
32 8-1-2.2-3. This law states that certain considerations have to be made
33 and have been evaluated by this group. In testimony before the Public
34 Service Company of Indiana they asked if the points in this law had been
35 followed. In order to satisfy the Commission at that time, all the
36 Commissioners signed affidavits saying this was done. The affidavit is
37 a part of this ordinance. The points considered were peaking, amount of
38 energy, load growth and other normal things. This body in this Ordinance
39 affirms Amended Ordinance No. 12-1982 adopted March 15, 1982. This also
40 amends the power sales contract dated April 1, 1982, which was part of
41 Amended Ordinance No. 12-1982. Because negotiations have not been com-
42 pleted with I&M the termination date of September 1, 1982 needs to be
43 removed. This body also appoints Indiana Municipal Power Agency to act
44 as the agent for RP&L in their contract with I&M. I&M has indicated
45 before the Commission in writing that it is their intent not to stand in
46 the way of IMPA becoming an entity; however, I&M is requiring certain
47 things and they do not want to assign RP&L's contract to IMPA because
48 IMPA must be aproven--entity of its own; it must have a generating station,
49 which it will have after the sale of the bonds; it must be in operation.
50 With IMPA acting as the agent the Commission- can go ahead and pass the
51 approval for the issue of bonds and buy a twenty-five percent (25%)
52 interest in Gibson 5.

54 In response to Councilman Carter's question as to the price of Gibson 5,
55 Mr. Huffman stated it is approximately 125 million; however, it is the
56 intent that when IMPA becomes a reality it will be a 500 million entity
57 of its own. Approval is given for sale of bonds for 125 million and any
58 further sale of bonds has to come back before this body.

60 Councilman Williams recommended better public relations to let the public
61 know about this project. Mr. Huffman noted there is no debt in this pro-
62 ject to the citizens of Richmond.

10 Councilman Carter stated he has expressed concerns in certain clauses
11 in this; modification of the power sales contract and agency agreement
12 and, because of these concerns, he will be voting against this Ordinance.
13 President Mills stated he agrees with Councilman Carter as he thought
14 going to IMPA. we would divorce I&M and he feels this should have had a
15 divorce contract in it. •
