HomeMy Public PortalAbout07-06-1982 237 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, JULY 6, 1982 1 The Common Council of the City of Richmond, Indiana, met in regular 2 session July 6, 1982 at the hour of 7:30 p.m. in the Council Chambers 3 in the Municipal Building,in 'said City. President Mills- presided with 4 the following members present: Messrs. Elstro, Williams,, Ms. Henry, 5 Hankinson, Welch, Parker, Carter and Paust. Absent: None. The 6 following business was had, to-wit: 7 8 DEVOTIONS 9 10 Devotions were given by Ken Mills. 11 12 APPROVAL_ OF MINUTES OF JUNE 21, 1982 13 14 Councilman Hankinson moved the minutes of the previous meeting be approved 15 as received_, seconded' by Councilman Welch and on unanimous voice vote the 16 motion was carried. 17 18 PRESENTING OF PETITIONS 19 20 The Clerk read the following petition: 21 22 July 3, 1982 23 24 To: All Richmond City Council Members 25 Subject: Proposed R. P. & L. Increase of Rates 26 27 We urge you to consider the following: we are. in the 28 middle of "economic hard-times". Most people are working 29 at either a reduction in wages, frozen wages or at best 30 minimal increases in wages. 31 32 Recently the local water company has sought a 26% 33 increase (this would be doubled when the sewer charges 34 are added) . The gas company is expecting a 40% increase. 35 While the R. P. & L. increase is more moderate than the 36 other utilities, we would recommend that all avenues of 37 cost-cutting be explored before any increase is made. 38 39 We suggest to you that with the high unemployment and 40 other negative economic conditions, that an increase of z 41 the proposed increase would be out of line at this time. 42 43 We think that all energy costs should be looked at 44 closely and be held down. 45 46 Regards, 47 48 /s/ Richard Bodiker, Chairman 49 Wayne-Randolph County 50 UAW-CAP Council , 51 52 President Mills read the following petition noting it contained at least 53 three hundred (300) names: 54 55 Petition 56 Citizens of Richmond Indiana 57 58 Voice, your opinion in the Richmond Power & Light rate increase 59 request. If you're against the Board of Directors granting a 60 rate increase of eleven (11%) percent which according to recent 61 newspaper article would amount to about three (3) dollars and 62 ninety one (91) cents per month for the average customer. Sign 63 your name and address. This information along with this petition 64 will be presented to the Board of Directors of Richmond Power & 65 Light at their July meeting. 238 Common Council Minutes Cont'd. July 6, 1982 Page 2 =: 1 TABLED RESOLUTION 2 RESOLUTION NO. 4-1982 3 4 President Mills recommended Resolution No. 4-1982 - A JOINT RESOLUTION 5 CREATING THE AIRPORT AUTHORITY OF WAYNE COUNTY, INDIANA be taken off the 6 table and stricken from the record. 7 8 Councilman Hankinson moved it be taken off the table and stricken from 9 the record, seconded by Councilman Welch and on unanimous voice vote the 10 motion was carried. 11 12 UPDATE ON CABLE TV 13 14 General Manager Jane Stigleman, R. R. 3, Liberty, IN, noted the new owners 15 of Cable TV have an on-going maintenance program as they have hired three 16 (3) more technical personnel; they do weekly head-end checks; have three 17 (3) men on service call in addition to the others; have replaced trunk 18 lines; and have instructed the answering service to give no instructions 19 but to tell customers they will contact the service man who is on call. 20 She noted there will always be problems during outages; however, during 21 the day they have four (4) lines with four (4) people to answer these 22 lines. Ms. Stigleman answered questions and concerns of Councilmen. 23 24 REPORT FROM BOARD OF PUBLIC WORKS 25 26 Councilman Elstro stated he received a memo from the City Attorney concern- 27 ing a compost pile on South "L" Street. He recommended pursuit of the 27 problem through the garbage and rubbish ordinance. City Attorney Ed 28 Anderson stated the memo says this problem is within the jurisdiction of 29 the Sanitary Department. He noted he is meeting with Sanitary Superin- 30 tendent Ed Goodknight this Thursday to try to find the procedure to 31 eliminate trash problems. 32 33 Councilman Elstro requested the Board investigate the property, at the 34 corner of South "N" and 8th where cars are stored and the property is 35 cluttered. - 36 37 Councilman Williams requested City Engineer George Webb check three (3) 38 storage tanks on North 12th.& "F" to seethe contents. 39 40 Councilman Paust noted the June 24 minutes of the Board stated Dale 41 Stanton appeared and showed interest in an impoundment area. Discussion 42 was held at a previous Council meeting a few months back concerning the 43 City's saving=money- by,getting ;out •of:-the impound business. He recom•-- 44 mended the City pursue this as soon as possible. Mr. Anderson noted the 45 City is in the process of writing specs for bidding this and will bring 46 an amendment to the Abandoned Vehicle Ordinance to Council. 47 48 MISCELLANEOUS BUSINESS 49 50 President Mills stated the utilities do not ask the City to cut into the 51 streets and do not put them back in proper order. He noted he is going 52 ' through this _ordinance and it willbe brought up to date and put some 53 teeth in it. City Engineer George Webb!s office will be responsible. 54 If they do not come to the City and do it right, they will be fined. 55 - 56 ORDINANCES ON 1ST READING 57 58 Councilman Welch moved to suspend the rules and read Ordinance Nos. 25-1982, 59 - 26-1982 and 27-1982 on first reading by title only, seconded by Council- 60 man Elstro and on unanimous voice vote the motion was carried. 61 62 ORDINANCE NO. 25-1982 63 64 President Mills announced the Plan Department is not ready with the legal 65 description for this Ordinance and it will be back on the July 19 agenda. 29 Common Council Minutes Cont'd. July 6, 1982 Page 3 1 ORDINANCE NO'.. 26-1982 2 3 The Clerk read on first reading by title only Ordinance No. 26-1982 - 4 AN ORDINANCE AMENDING CHAPTERS 153 AND 154 OF THE MUNICIPAL CODE AND 5 ADDING A NEW CHAPTER 53 TO THE MUNICIPAL CODE, PROVIDING FOR STANDARDS 6 AND REQUIREMENTS RELATIVE TO FLOOD PLAIN MANAGEMENT. 7 8 Councilman Welch moved to suspend the rules and read Ordinance No. 26- 9 1982 on second reading, seconded by Councilman Hankinson. Councilman 10 Carter voted no. 11 12 The Clerk read on second reading Ordinance No. 26-1982. 13 14 President Mills announced Ordinance No. 26-1982 is on public hearing. 15 Speaking for this Ordinance was Mr. Dan Dooley, Richmond City Plan 16 Department, stating this ordinance is a result of efforts of the State 17 Department of Natural Resources and the Federal Emergency Management 18 Agency. The. Ordinance identifies certain flood hazard areas in Richmond 19 and Wayne County. In order for the City to remain eligible to partici- 20 pate in this national: flood insurance program certain administrative 21 procedures have to be put in place to administer various required flood 22 plain management programs. Federal and State agencies have reviewed 23 this ordinance and approved the format. We have until August 16 to get 24 this adopted and maintain eligibility. 25 26 Councilman Carter called for a point of order. He cited under the rules 27 of the Council page 4, paragraph 6 "After introduction of an ordinance, III 28 the ordinance shall not be considered for second reading until the next 29 regularly scheduled meeting, or at a special meeting called pursuant to 30 Rules of Council, unless this rule be suspended by unanimous consent, 31 and then only in case there are present and voting at least two-thirds 32 (2/3) of all the members-elect of the Council." 33 34 City Attorney Ed Anderson upheld the point of order. 35 36 President Mills announced Ordinance No. 26-1982 will be back on second 37 reading at the next meeting. 38 39 ORDINANCE NO. 27-1982 40 41 The Clerk read on first reading by title only Ordinance No. 27-1982 - AN 42 ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE BEING ORDINANCE NO. 43 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, 44 INDIANA, ADOPTED JUNE 3, 1968, PROVIDING FOR. THE REZONING OF PROPERTY 45 LOCATED AT 1434 SOUTH 9TH STREET FROM C-2 COMMERCIAL DISTRICT TO C-4 46 GENERAL BUSINESS DISTRICT. 47 48 Councilman Welch moved to suspend the rules and read Ordinance No. 27- 49 1982 on second reading, seconded by Councilman Elstro and on a call of 50 the roll the following was recorded: Ayes: Elstro, Williams, Henry, 51 Hankinson, Welch, Parker, Carter, Paust and Mills (9) , Noes.: None (0) . III 52 53 The Clerk read on second reading Ordinance No. 27-1982. 54 55 President Mills announced Ordinance No. 27-1982 is on public hearing. 56 Speaking for this Ordinance was Attorney Donald Simkin, 25 North 7th 57 Street, representing the petitioners. Also speaking in favor of the 58 Ordinance was Mr. Thomas Bond, 1434 south 9th Street. The Plan Com- 59 mission met June 22, 1982 and voted six (6) to zero (0) to recommend 60 adoption of this Ordinance. 61 ' • 62 Councilman Hankinson moved for engrossment of Ordinance No. 27-1982, 63 seconded by Councilman Welch and on unanimous voice vote the motion 64 was carried. 2 j 0 Common Council Minutes Cont'd.
