PROCEEDINGS OF THE COMMON COUNCIL OF THE
CITY OF RICHMOND, INDIANA, JUNE 7, 1982
1 The Common Council of the City of Richmond, Indiana, met in regular
2 session June 7, 1982 at thechour of 7:30 p.m. in the Council Chambers
3 in the Municipal Building in said City. President Mills presided with
4 the following members present: Messrs, Elstro, Williams, Ms. Henry, .
5 Hankinson, Welch, Parker, Carter and Paust. Absent: None. The
6 following business was had, to-wit:

12 . APPROVAL OF MINUTES OF MAY 17, 1982

14 Councilman Hankinson moved to approve the minutes of the previous meeting
15 as prepared, seconded by Councilman Welch and on unanimous voice vote
16 the motion was carried._

18 RESOLUTIONS
19 RESOLUTION NO. 4-1982

21 President Mills announced Resolution No. 4-1982 - A JOINT RESOLUTION
22 CREATING THE AIRPORT AUTHORITY OF WAYNE COUNTY, INDIANA, was discussed''
23 at the County Council this morning and was taken under advisement.
24 Councilman Carter, Liaison to the Airport Board, reported the County is
25 willing to meet with City Council to see if there is some other approach
26 that might be taken to appropriate enough money to put in an ILS system
27 and make ongoing improvements over the next few years. ' President Mills
28 announced the County Council will meet next Monday.

30 Councilman Carter moved to table Resolution No. 4-1982, seconded by
31 Councilman Hankinson and on unanimous voice vote the motion was carried.

33 BOARD OF PUBLIC WORKS AND SAFETY

35 Councilman Williams noted weeds are a problem and every year it seems to
36 be the same people who do not cut their weeds.

38 Mr. Meredith stated there is a weed enforcement officer and, if there
39 are specific locations, she can be contacted in the Bureau of Buildings.

41 Councilman Elstro reported a problem with a compost pile at 1501 South
42 "L". The odor is offensive to the neighbors. City Attorney Ed Anderson
43 will research to see if there is an ordinance concerning compost piles.

45 In response to Councilman Elstro's question concerning who will give
46 final approval to the repaving of streets in conjunction with the sewer
47 separation project, City Engineer George Webb stated the engineer will
48 approve the job with the contractor. When he is satisfied, he will
49 recommend them to the Sanitary Commissioners, who will accept them. All
50 work will be bonded for one' (1) year after date of final acceptance.
11/ 51 Mr. Webb stated residential streets will be paved curb to curb, which is
52 approximately eighty percent (80%)' of. the total system; however, most of
53 the on system streets lie within the downtown area and will be repaired
54 the trench width only.

56 REPORT OF WAYNE COUNTY REFUSE DISPOSAL ADVISORY COMMITTEE

58 Councilman Welch, Council's representative to the Disposal Advisory
59 Committee, reported the committee has had a series of meetings discussing
60 the direction the City and County should be exploring for solid waste.
61 One problem submitted to date is that existing landfills be updated and
62 continued in use with future consideration for additional landfill
63 areas in the County with establishment of a joint City-County operation.

3 President Mills read a letter from Betty Wilson, 817 North "J" Street,
4 inviting Council members to tour North Richmond with the Neighborhood
5 Advisory Council.

7 President Mills turned the request over to the Transportation, Community
8 Development & Community Services Committee and requested Chairman
9 Hankinson set a date and time for the tour.

13 Councilman Welch moved to suspend the rules and read Ordinance Nos. 20-
14 1982 through 24-1982 on first reading by title only, seconded by Council-
15 man Parker and on unanimous voice vote the motion was carried.

19 The Clerk read on first reading by title only Ordinance No. 20-1982 -
20 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING. ORDINANCE
21 NO, 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF
22 RICHMOND, INDIANA, PROVIDING FOR STANDARDS AND REQUIREMENTS RELATIVE TO
23 MANUFACTURED HOMES PURSUANT TO I.C. 36-7-4-1106.

25 Councilman Welch moved to suspend the rules and read Ordinance No. 20-
26 1982 on second reading, seconded by Councilman Parker and on unanimous
27 voice vote the motion was carried.

31 Chairman of the Committee of the Whole reported his committee met on
32 this Ordinance and noted the Plan Commission voted 9-0 to recommend
33 to Council that this Ordinance:be passed. Manufactured housing would
34 require a special use authorization in R-1 and R-2 areas; whereas, it
35 allows the placement of manufactured housing in R-3, R-4, C-1 and C-2
36 areas.

38 City Planning Director Bob Goodwin noted the only change in the Ordinance
39 from the work session is the inclusion of a section which provided for
40 banning mobile homes in historic districts as they currently exist and
41 any that Council may provide for in the future.

44 There being no one speaking for or against this Ordinance, Councilman
45 Elstro moved for engrossment, seconded by Councilman Parker and on
46 unanimous voice vote the motion was carried.

48 Councilman Elstro moved to suspend the rules and read Ordinance No. 20-
49 1982 on third and final reading by title only, seconded by Councilman
50 Welch and on unanimous voice vote the motion was carried.

40 Speaking for this Ordinance was Mr. Joe Chamness, Vice President of
41 Second National Bank. Plan Director Bob Goodwin noted the Plan Com-
42 mission voted 10-0 to recommend passage of this Ordinance. One letter
43 was received in opposition to this zoning as a neighbor wanted the
44 neighborhood kept residential with no businesses in the area.

47 seconded by Councilman Paust and on unanimous voice vote the motion was
48 carried. .

10 Committee of the Whole Chairman Larry Parker stated his Committee met
11 with Police Chief Chris, officers of the Kokomo Police Department and
12 a representative of Cities and Towns. A demonstration was held to show
13 how the decibel meter works.

15 President Mills announced Ordinance No. 23-1982 is on public hearing.
16 Speaking for this Ordinance was Police Chief Charles Chris. Mr. Irving
17 Huffman pointed out that some industry may exceed the decibel level at
18 certain frequencies.

57 I have recently discussed the above-referenced ordinance with
58 many of the individuals who have been instrumental in developing
59 and promoting the Ordinance. On behalf of these individuals,
60 primarily members of the Historic Preservation and Restoration
61 Committee of the Richmond Area Chamber of Commerce, I would
62 respectfully request that the proposed Ordinance be withdrawn
63 from consideration by the Common Council at this time. It is
64 our sincere hope that another ordinance of similar concept

1 will be considered by this legislative body in the future.
2 In the meantime, we will be striving to address those concerns
3 and areas of dispute which have been presented by the Common
4 Council and the City Planning Commission.

21 City Attorney Ed Anderson examined the proof of publication and found
22 it to be in order. Councilman Elstro moved the proof be accepted and
23 filed, seconded by Councilman Welch and on unanimous voice vote the
24 motion was carried.

26 Councilman Elstro moved to cut out $3,000 from Engineering for a copy
27 machine, seconded by. Councilman Williams and on a call of the roll the
III 28 following was recorded: AYES: Elstro, Williams, Hankinson, Carter,
29 Paust. NOES: . Henry, Welch, Parker, Mills. The vote being five (5)
30 ayes and four (4) nays.

32 Councilman Hankinson moved to delete $9,800 from the Fire Department
33 for an automobile, seconded by Councilman Paust and on a call of the
34 roll the following was recorded: AYES: Hankinson, Paust. NOES:
35 Elstro, Williams, Henry, Welch, Parker, Carter, Mills. The vote
36 being two (2) ayes and seven (7) nays.

38 Councilman Williams moved to cut $50,000 from the Motor Vehicle Highway
39 for summer help salaries. The motion died for lack of a second.

41 President Mills announced Amended Ordinance No. 14-1982 is on public
42 hearing. Speaking for this Ordinance were City Controller Don Meredith,
43 Assistant Fire Chief Bill Smith, Superintendent of Parks Don McBride,
44 Director of Transportation Jerry Haynes, 'City Plan Director Bob Goodwin,
45 and Mr. Doug Cross, representing the Indiana Department of Transportation.
