HomeMy Public PortalAbout05-17-1982 23 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MAY 17, 1982 1 The Common Council of the City of Richmond., Indiana, met in regular 2 session May 17, 1982 at the hour of 7 :30 p.m. in the Council Chambers 3 in the Municipal Building in said City. President Mills presided with 4 the following members present: Messrs. Elstro, Williams, Ms. Henry, 5 Hankinson, Welch, Parker, 'Carter and Paust. Absent; None. The 6 following business was had, to-wit: 7 • 8 DEVOTIONS 9 10 Councilman Elstro gave devotions. 11 12 APPROVAL OF MINUTES OF MAY 3, 1982 13 14 Councilman Hankinson moved to approve the minutes of the previous 15 meeting as prepared, seconded by Councilman Welch and on unanimous 16 voice vote the motion was carried. 17 18 RESOLUTIONS 19 20 President Mills stated Community Development Director Robert Goodwin 21 has presented Council members with two (2) resolutions, which he is 22 requesting be added to tonight's agenda. 23 24 25 RESOLUTION NO. 2-1982 - - 26 27 28 Councilman Williams moved Resolution No. 2-1982 be presented, seconded by Councilman Parker and on unanimous voice vote the motion was carried. 29 30 Councilman Welch moved to suspend the rules and read Resolution No. 2- 31 1982 by title only, seconded by Councilman Williams and on unanimous 32 voice vote the motion was carried. 33 34 The Clerk read by title only Resolution No. 2-1982 - A RESOLUTION 35 AUTHORIZING AND APPROVING THE CONVEYANCE OF CERTAIN REAL ESTATE IN 36 THE CITY OF RICHMOND, INDIANA, for the use and benefit of its 37 Department of Community Development. 38 39 - Speaking for Resolution No. 2-1982 was Mr. Robert Goodwin noting this 40 Resolution conveys lots on North 12th to WCAC. 41 42 Councilman Paust moved for adoption of Resolution No. 2-1982, seconded 43 by Councilman Parker and on unanimous voice vote the motion was carried. 44 45 RESOLUTION NO. 3-1982 46 ' 47 Councilman Elstro moved to bring Resolution No. 3-1982 on the floor, 48 seconded by Councilwoman Henry and on unanimous voice vote the motion 49 was carried.' 50 ' 51 Councilman Welch moved to suspend the rules and read Resolution No. 3- 52 " 1982 by title only, seconded by Councilman Parker and on unanimous 53 voice vote the motion was carried. 54 55. The Clerk read by title only Resolution No. 3-1982 - A RESOLUTION 56 AUTHORIZING AND APPROVING THE CONVEYANCE OF CERTAIN REAL ESTATE IN 57 THE CITY OF RICHMOND, INDIANA, for the use and benefit of its 58 Department of Community Development 59 ' 60 Speaking for Resolution No. 3-1982 was Mr. Robert Goodwin noting this 61 Resolution conveys lots to Mt. Olive Baptist Church, who has agreed 62 to demolish the structures. 63 ' 64 Councilman Elstro moved for adoption of Resolution No. 3-1982, seconded 65 by Councilman Williams and on unanimous voice vote the motion was carried. 224 Common Council Minutes Cont'd. May 17, 1982 Page 2 1 BOARD OF PUBLIC WORKS & SAFETY REPORT 2 3 ' Mr. Meredith reported the Board has investigated closing of North 17th 4 as requested in the last meeting. The. road going to and through the 5 bridge is in fairly good shape and it is beyond this point where the 6 trash is being dumped; however,..,there.is a house north of the bridge 7 and closing. of the street would cut off access to the house as well as 8 through traffic. The Street Department is planning chip and seal north 9 of the bridge this summer. An effort will be made to try to stop some 10 of the dumping in the area through surveillance. 11 12 ORDINANCES ON 1ST READING 13 14 Councilman Welch moved to suspend the rules and read Ordinance No. 14- 15 1982. through Ordinance No. 19-1982 on first reading by title only, 16 seconded by Councilman Williams and on unanimous voice vote the motion 17 was carried. 18 19 ORDINANCE NO. 14-1982 20 21 The Clerk read on first reading by title only Ordinance No. 14-1982 - 22 AN ORDINANCE TO APPROPRIATE FROM THE FEDERAL REVENUE SHARING TRUST FUND. 23 24 President Mills announced Ordinance No. 14-1982 has to be advertised. 25 26 ORDINANCE NO. 15-1982 27 28 The Clerk read on first reading by title only Ordinance No. 15-1982 - 29 AN ORDINANCE TO APPROPRIATE FROM THE FEDERAL REVENUE SHARING TRUST FUND. 30 31 President Mills announced Ordinance No. 14-1982 has to be advertised. 32 33 ORDINANCE NO. 16-1982 34 35 The Clerk read on first reading by title only Ordinance No. 16-1982 - 36 AN ORDINANCE TO APPROPRIATE FROM THE FEDERAL REVENUE SHARING TRUST FUND. 37 38 President Mills announced Ordinance No. 16-1982 has to be advertised. 39 40 ORDINANCE NO. 17-1982 41 The Clerk read on first reading by title only Ordinance No. 17-1982 - 42 AN ORDINANCE TO APPROPRIATE FROM THE FEDERAL REVENUE SHARING TRUST FUND. 43 . 44 President Mills announced Ordinance No. 17-1982 has to be advertised. 45 46 ORDINANCE NO. 18-1982 47 48 The Clerk read on first reading by title only Ordinance No. 18-1982 - 49 ORDINANCE OF THE CITY OF RICHMOND AUTHORIZING THE CONSENT OF THE CITY 50 TO THE ASSIGNMENT OF A CERTAIN LEASE, A PART OF A FINANCING AGREEMENT 51 UNDER WHICH RICHMOND ECONOMIC DEVELOPMENT FIRST MORTGAGE BONDS, SERIES 52 1973, (DUNHAM LEHR, INC:_) WERE ISSUED AND SOLD. 53 54 Councilman Welch moved to suspend the rules and read. Ordinance No. 18- 55 1982 on second reading, seconded by Councilman Williams and on unanimous 56 voice vote the motion was carried. 57 . 58 The Clerk read on second reading Ordinance No. 18-1982. 59 . 60 President Mills announced Ordinance No. 18-1982 is on public hearing. 61 Speaking for this Ordinance were Mr. Andrew Cecere, Attorney representing 62 Dunham-Lehr, and Mr. Allan Rosar, 4572 Greenmont Pike. 63 . 64 Councilman Welch moved for engrossment of Ordinance No. 18-1982, 225 Common Council Minutes Cont'd. , May 17 , 1982 Page 3 1 seconded by Councilman Carter and on unanimous voice vote the motion 2 was carried. 3 4 Councilman Welch moved to suspend the rules and read Ordinance No. 18- 5 1982 on third and final reading by title only, seconded by Councilman 6 Carter and on unanimous voice vote the motion was carried. 7 _ - 8 The Clerk read on third reading by title only Ordinance No. 18-1982. 9 10 Ordinance No. 18-1982 was adopted by the following vote: 11 AYES: Elstro, Williams, Henry, Hankinson 12 Welch, Parker, Carter, Paust, Mills (9) 13 NOES: None (0) 14 15 ORDINANCE NO. 19-1982 16 17 The Clerk read on first reading by title only Ordinance No. 19-1982 - 18 AN ORDINANCE TO TRANSFER WITHIN THE AIRPORT FUND. 19 20 Councilman Welch moved to suspend the rules and read Ordinance No. 19- 21 1982 on second reading, seconded by Councilman Hankinson and on 22 unanimous voice vote the motion was carried. 23 24 The Clerk read on second reading Ordinance No. 19-1982. 25 26 President Mills announced Ordinance No. 19-1982 is on public hearing. 27 Speaking for this Ordinance was Mr. Paul Hedges, R. R. 1, Centerville. 28 29 Councilman Carter moved for engrossment of Ordinance No. 19-1982, 30 seconded by Councilman Welch and on unanimous voice vote the motion 31 was carried. 32 33 Councilman Welch moved to suspend the rules and read Ordinance No. 19- 34 1982 on third and final reading by title only, seconded by Councilman 35 Carter and on unanimous voice vote the motion was carried. 36 37 The Clerk read on third reading by title only Ordinance No. 19-1982. 38 39 Ordinance No. 19-1982 was adopted by the following vote: 40 AYES: Elstro, Williams, Henry, Hankinson 41 Welch, Parker, Carter, Paust, Mills (9) 42 NOES: None (0) 43 44 ORDINANCES ON 2ND READING 45 46 ORDINANCE NO. 58-1978 47 48 The Clerk read on second reading Ordinance No. 58-1978 - AN ORDINANCE 49 TO IMPLEMENT THE PUBLIC POLICY OF THE STATE OF INDIANA REGARDING 50 CIVIL RIGHTS OF THE CITIZENS OF THE CITY OF RICHMOND, INDIANA. 51 52 The Clerk read a letter from Barbara Barnhizer outlining procedures 53 followed by the local EEO Director concerning discrimination complaints 54 and containing eleven (11) addresses of State, Federal and local agencies 55 where one can apply. 56 57 President Mills noted page 2 of Ordinance No. 58-1978 under SECTION 2 (e) 58 should be amended to delete "or such other attorney as may be engaged 59 by the commission". Councilman Hankinson so moved, seconded by Council- 60 man Carter and on unanimous voice vote the motion was carried. 61 62 President Mills noted page 7 under SECTION 5 Should be amended to 63 correct the number of the .Ordinance from No. 55 to No. 58. Councilman 64 Williams so moved, seconded by Councilwoman Henry and on unanimous Common Council Minutes Cont'd. May 17, 1982 Page 4 1 voice vote the motion was carried. 2 3 Councilman Parker noted that on Page 6 SECTION 4 (10) "employ an 4 exectutive director and other staff personnel" should be deleted 5 due to funds not available. Councilman Parker so moved, seconded by 6 Councilman Carter. On a call of the roll the following was recorded: 7 AYES: Elstro, Henry, Hankinson, Welch, Parker, Carter, Paust (7) 8 NOES: Williams, Mills (2) 9 10 President Mills announced Amended Ordinance No. 58-1978 is on public 11 hearing. Speaking for this Ordinance were Rev. Robert Girten, 1205 12 South "M"; Elder Thomas Burrell, 1710 North "E", Mr. Bobby Smith, 1109 13 North "I", Rev. George White, 1019 No. "J", Vice-President of the 14 local branch of the NAACP; and Marion Williams, 217 So. 10th. 15 16 Councilman Hankinson moved for engrossment of Amended Ordinance No. 58- 17 1978, seconded by Councilman Parker and on unanimous voice vote the 18 motion was carried. 19 20 Councilman Williams moved to suspend the rules and read Amended 21 Ordinance No. 58-1978 on third and final reading by title only, 22 seconded by Councilman Parker and on unanimous voice vote the 23 motion was carried. 24 25 The Clerk read on third reading by title only Amended Ordinance 26 No. 58-1978. 27 28 Ordinance No. 58-1978 was defeated by the following vote: 29 AYES: Elstro, Williams, Parker, Carter - (4) 30 NOES: Henry, Hankinson, Welch, Paust, Mills (5) 31 32 ADJOURNMENT 33 . 34 There being no further business on motion duly made, seconded and 35 passed the meeting was adjourned. 36 37 Kenneth Mills 38 President 39 40 ATTEST: JoEllen Trimble 41 City Clerk
