PROCEEDINGS OF THE COMMON COUNCIL OF THE
CITY OF RICHMOND, INDIANA, MAY 3, 1982
1 The Common. Council of the City .of Richmond, Indiana, met in regular
2 session May 3,. 1982 at the hour of. 7 :30p.m.. in the Council Chambers
3 in the Municipal Building in said City. President Mills presided with
4 the. following members present: Messrs. Elstro, Williams, Ms. Henry,
5 Hankinson, Welch, Parker, Carter and Paust. Absent: None. The •
6 following business was had, to-wit:

1.2 APPROVAL OF MINUTES OF PREVIOUS MEETING

14 Councilman,Hankinson Moved' to approve the minutes of the previous meeting
15 as received, seconded by Councilman Welch and on unanimous voice vote
16 the motion was carried.

• 18 WAYNE COUNTY CONVENTION & TOURISM'BUREAU'UPDATE

20 Mr. ..Brian Marshall,_ 324 South 4th Street,'.Director of the Wayne County
21 - Convention &Tourism Bureau, presented the 1st annual report of the
22 . Bureau and gave an overview of the-year's goals.

24 REPORT FROM AIRPORT BOARD ' '

26 'Councilman Carter, liaison to the Airport Board, reported the Airport
27 Commission met at the airport on April 29 to hear about and discuss
28 . the idea of an Airport Authority.

30 • Mr. Bill Merkin, 3247 Lantern Trail, head of the Airport Commission
31 spoke noting that the airport has 'been self-supported with its budget
32 provided b.y''revenues generated directly on the airport, which'will
33. decrease due to lower -farm income. ' -During the last _several years the
34 airport has qualified for funds from the federal. government derived
35 , from 'user taxes. These funds are on hold and will not be reinstated
36 for' use in ,less than a year,. Additional funds can be 'obtained if
. 37 Richmond 'isdesignated as a. reliever 'airport. Richmond airport has
38 ,, . .a. non-precision instrument approach, .as opposed to having an ILS,, and
' 39 - this hampers its growth, and it could not be a reliever airport. ' He
40 noted there are two .(2) .types of airport authorities. ' One is a muni-
41 cipal authority with the Mayor as the governing person. He would
42 appoint four (4) airport-authority members. The Authority would have ,
43 the right to tax,- to issue bonds and accumulate a building ,fund to
44 provide for growth at the airport.. ' The second type of Authority would '
45 ' be a City-County Authority. This .type would have two (2) chief
• 46 , executives .- one from the County and one from the City. Each execu-
47 . .tive would appoint three (3) authority members. The approximate cost
48 of an ILS. is $400,000 to' $500,000. . - . '

50 ' Councilman Carter suggested the City Attorney prepare a resolution to
51 bring -before Council.

53 BOARD OF'PUBLIC WORKS& SAFETY ' '

55 Councilman Williams requested' the Board look into the- possibility of
56 closing the road at North 17th & -"J".as it is being used as a dump site.

58 - COMMITTEE OF THE-WHOLE MEETING

60 Chairman of the Committee.of the .Whole Larry Parker announced 'the
61 committee will be meeting May 10 at 7.:00 p.m. in the Board of Works
, 62 room. The items to be discussed are proposed ordinance for manufactured
• 63. housing and a-noise control ordinance. '

5 Councilman Welch moved to suspend the rules and read Ordinance No. 13-
6 1982 on first reading by title only, seconded by Councilman Parker and
7 on unanimous voice vote the motion was carried.

9 The Clerk read an first.. reading by title only Ordinance No. 13-1982 -
10 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING
11 - ORDINANCE NO. 2325-1968, COMMONLY KNOWN S. THE ZONING ORDINANCE OF THE
12 CITY OF RICHMOND, INDIANA ADOPTED JUNE 3, 1968, PROVIDING FOR THE
13 REZONING OF CERTAIN PROPERTY GENERALLY BOUNDED BY NORTHWEST ''L" STREET,
14 . THE CONRAIL TRACKS, NORTHWEST "E STREET AND NORTHWEST FIFTH STREET,
15 FROM M-1 LIGHT INDUSTRIAL DISTRICT TO C-4 GENERAL BUSINESS DISTRICT
16, AND R-3 ONE-TO-EIGHT FAMILY RESIDENCE DISTRICT.

18 Councilman Welch moved to suspend the rules and read Ordinance No. 13-
19 1982 on second reading, seconded by Councilman Parker and on unanimous
20 voice vote the motion was carried.

22 The Clerk read on second reading Ordinance. No. 13-1982.

24 President Mills announced Ordinance No. 13-1982 is on public hearing.
25 Speaking for this Ordinance was Director of City Planning Robert Goodwin -
26 stating this Ordinance is sponsored by the Plan Commission. He noted
27 the Commission voted six (6) -to one (1) in favor of approval of the
28 Ordinance .with Councilman Parker vot.ing.no.. Councilman Parker ex-
29 plained he voted no at the Plan Commission because an-area, known as the
30 Pitman Park, is landlocked and should not be changed to an R-3 making
31 it suitable for apartments. He feels it should stay C-4.

33 Councilman Hankinson moved for engrossment of Ordinance No. 13-1982,
34 seconded by Councilman Welch and on unanimous voice vote the motion
35 was carried.

37 Councilman Welch moved to suspend the rules and read Ordinance No. 13c-
38 1982 on third and final reading by title only, seconded by Councilman
39 Parker and on unanimous voice vote the motion was carried.

41 The Clerk read on third reading by title only Ordinance No. 13-1982.

43 Ordinance No. 13-1982 was adopted by the following vote:
44 AYES: Elstro, Williams, Henry, Hankinson, Welch, Carter, Paust, Mills (8)

49 Councilman Williams moved to bring Ordinance No. 58-1978 off the table,
50 seconded by Councilman Elstro and on unanimous voice vote the motion
51 was carried.

53 Councilman Welch moved to suspend the rules and move Ordinance ,No.. .58-
54 1978 to second reading, seconded by Councilman Parker and on unanimous
55 voice vote the motion was carried.

57 The Clerk read on second reading Ordinance No. 58-1978 - AN ORDINANCE
58 TO IMPLEMENT THE PUBLIC POLICY OF THE STATE OF INDIANA REGARDING CIVIL
59 RIGHTS OF THE CITIZENS OF THE CITY OF RICHMOND, INDIANA.

61 President Mills read a portion of City Attorney Ed Anderson's letter
62 which was requested at the previous meeting, as follows: •

64 As a result of the finding of unconstitutionality in the case

1 above, our Ordinance No. 58-1978 was drafted to conform with
2 the new law, IC 22-9-1-12.1 (HB No. 1060) to create the
3 Richmond Civil Rights Commission. ' This ordinance as drafted
4 and presented to the Common Council meets the standards of
5 the new law (IC 22-9-1-12.1) .

7 President Mills asked Mr. Anderson if the quotations of 1971 were
8 adequate and Mr. Anderson stated they are. Under Section 1(e) will
9 have to be changed because of the new law. A typographical error on
10 page 7 changing the number of the Ordinance to 58 will have to be
11 changed and Mr. Anderson will check on the chapter number of the
12 Municipal Code.

14 President Mills announced there are three (3) councilmembers who have
15 not been exposed to this Ordinance, so`there will be no action taken
16 on this Ordinance tonight. It will remain on public hearing until
17 the next Council meeting on May 17, 1982.

19 President Mills announced this Ordinance is on public hearing.
20 Speaking for this Ordinance were Rev. Thomas Burrell; Bobbie Smith,
21 - s 1109 North "I"; Rev. George White, Vice-Chairman of the NAACP; and
22 Rev. Larue Griffin, 1343 Fairacres Road.
