Hughes John Major Chuck Powell, Vice Chairperson MINUTES Planning Commission Meeting May 15, 2007 – 7:00 p.m. Chair Barry Brown called the May 15, 2007 Planning Commission meeting to order. Other Commissioners present were: Libby Bacon, Demery Bishop, Charlie Brewer, Sandy Chandler, Bill Garbett, Susan Hill, John Major, and Chuck Powell. Chair Barry Brown called for a motion on the Minutes of the April 9, 2007 Planning Commission agenda meeting. Chuck Powell moved to approve. Demery Bishop seconded the motion. The vote in favor was unanimous. Brown asked for a motion on the Minutes of the April 17, 2007 Planning Commission meeting. Powell motioned to approve. Charlie Brewer seconded. The vote in favor was unanimous. The first item was a Minor Revision to a Recorded Plat, Land Development Code Section 5-130 (J)(2). This item was not a Public Hearing. Walter Rocker, Jr. of Rocker Developments, LLC, requested the revision for the 15 lot Village at Tybee subdivision, at First Street between Miller and Fifth Avenues, PINs 4-0003-12-008 through 4- 0003-12-022, Zones C-2 and R-2. Representing Rocker Developments was attorney Harold Yellin. Yellin said the ordinance defined the situation as a Minor Revision because it does not involve roads or utilities. He said there were no variances. Chair Barry Brown asked if the lots met the square footage and front footage requirements. George Weeks of Ward Edwards, Inc. said they did. Bill Garbett asked that the errors that were made be explained. Walt Rocker said that there was anywhere from a 12-inch to a 1.4-foot mistake in a control line that happened via a mistake through an AutoCAD transfer to an engineer, to an architect, and to a surveyor, and that skewed every building a minimum of 1.4 feet toward the north end of the property. He said that for one particular building there was a combination of the surveying mistake and a block mason laying the wrong column line on the building envelope which sat that building out 2.4 feet. He said all the lines were moved the same amount to the north except for one lot has a jog in order to meet the setback requirements. He said the steps were a construction mistake and they have since been relocated into the setback. Weeks said they had more than the minimum clearance between the buildings initially which allowed them to do this. He said they were able to shift and keep the lines pretty much parallel and perpendicular. John Major asked about the electronic transfer error. Weeks said the electronic file that the surveyor got from the architect had an error in it. He said it was 1.2 to 1.3 feet off. Major asked who discovered the error. Weeks said the surveyor did when the as-builts were done. Major asked if there were any other outstanding issues with the property. Rocker said the heights were being recertified by a surveyor. Drainage was discussed. Brown called for a motion. Chuck Powell motioned to approve the revised as-built survey. Charlie Brewer seconded. The vote was unanimous. Brown told Rocker that the item would go to City Council on May 24. Chair Barry Brown announced that Kevin Carpenter withdrew a Site Plan Approval (LDC Section 5-080) petition for 1605 Inlet Avenue, PIN 4-0008-17-001, Zone C-1. He opened the Public Hearing and asked if anyone from the audience wished to speak in favor of or in opposition to the petition. Brown closed the Public Hearing. The Planning Commission took no action on the item. Attorney Frank E. Jenkins, III, spoke about Legal Aspects of Zoning. Chair Barry Brown called for a motion to adjourn. Bill Garbett so moved and Chuck Powell seconded. The vote was unanimous.
