HomeMy Public PortalAbout02-01-1982 195 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, FEBRUARY 1, 1982 1 The Common Council of the City of Richmond, Indiana, met in regular 2 session February 1, 1982 at the hour of 7:30 p.m. in the Council 3 Chambers in the Municipal Building in said City. President Mills 4 presided with the following members present: Messrs. Elstro, Williams, 5 Ahaus, Hankinson, Welch, Parker, Carter and Paust. Absent: None. 6 The following business was,had, to-wit: 7 8 DEVOTIONS 9 10 Councilman Hankinson gave devotions. 11 12 APPROVAL OF MINUTES OF JANUARY 18, 1982 13 14 Councilman Hankinson moved to approve the minutes of the previous 15 meeting as prepared, seconded by Councilman Welch and on unanimous 16 voice vote the motion was carried. 17 18 PETITION 19 • 20 President Mills stated Council will hold a public hearing tonight on 21 a petition for vacation of a street by Richmond Community Schools to 22 comply with the statute which requires holding a hearing within 23 thirty (30) days of filing of the petition. The Plan Commission was 24 not able to meet at their regularly scheduled time last week, so 25 they have not had a hearing on this petition. If it comes back with 26 a favorable recommendation.by the Plan Commission, there will be an 27 ordinance with it. 28 29 The Clerk read by title PETITION FOR VACATION OF PUBLIC WAY. 30 . . 31 City Attorney Ed Anderson examined the proof of publication and found 32 it to be in order. Councilman Ahaus moved it be accepted and filed, 33 seconded by Councilman Welch and on unanimous voice vote the motion 34 was carried. 35 36 President Mills announced the petition is on public hearing. Speaking 37 for this petition was Mr. Ron Cross, 2 North 8th, counsel for the 38 School Corporation. Mr. Cross noted the request is for a portion of 39 S. W. 1st between S. W. "D" and S. W. "E". Richmond Community Schools 40 has plans to expand educational facilities with the addition of a 41 career education center and cafeteria. The School Corporation owns 42 all abutting property and five or six area property owners have been 43 given notice. He noted they,have discussed the proposal with the 44 Traffic Department and stated there will be traffic problems with the 45 expansion of the High School, which does not necessarily relate to 46 the closing -of S. W. 1st Street. He gave a comparison of enrollment 47 figures noting that in 1983-84 school' year, RHS. will be converted 48 into a four (4) year high school. Also speaking for this petition 49 was Mr. Johnny Martin, Director of. Buildings and Grounds for Rich- 50 mond Community Schools. He described the layout of the new build- 51 ' ings with parking facilities. 52 53 Speaking to this petition was Capt. Dan Wogoman, Department of Traffic 54 Safety, Richmond Police Department, noting his Department is neither 55 for nor against, but does have several questions. The two (2) block 56 area is being used for parking and a drop-off - pick-up area. Boule- 57 yard parking is at a maximum. He reported on a short survey conducted 58 for three (3) days. ' He noted if the street is closed there will be a 59 jam at 1st & S. W. "D" and on the Boulevard. In the future there may 60 be two (2) basic alternatives: (1) make S. W. 2nd from National to 61 Abington Pike or S. W. "E" Street one-way and make S. W. 1st from 62 National to "D" one-way or (2) remove parking off one side of S. W. 63 2nd to facilitate two lanes of traffic. L96 Common Council Minutes Cont'd. February 1, 1982 Page 2 1 Mr. Sam Neff, S. W. 1st and "D", expressed concern for problems of 2 the residents getting to and from their homes, if S. W. 1st is made 3 one way. He requested the green recreational area on the north side 4 of the property be left for use of the neighborhood. He did not object 5 to the street being closed. Mr. Martin noted the green area on S. W. 6 "D" will be used for band practice field and overflow athletic 7 facility, and will not be fenced. 8 9 President Mills announced this Petition is referred to the Plan 10 Commission. 11 12 REPORT OF THE BOARD OF PUBLIC WORKS AND SAFETY 13 14 Councilman Williams asked if the salaries of all Community Development 15 employees was in the 1982 Budget Ordinance. City Controller Don Mere- 16 dith stated they were all included in the Salary & Position Ordinance 17 but were not included in the Budget Ordinance. 18 19 Councilman Elstro requested the Plan Department check Thor Electric, 20 2000 Boston Pike, as to complying with proper zoning at that address. 21 22 RESOLUTIONS 23 24 Councilman Welch moved to suspend the rules and read Resolution 25 No. 1-1982 by title only, seconded by Councilman Parker and on 26 unanimous voice vote the motion was carried.. 27 28 The Clerk read by title only Resolution No.. -1-1982 - A RESOLUTION 29 AMENDING RESOLUTION NO. 15-1977 THE CITY OF RICHMOND, INDIANA 30 AFFIRMATIVE ACTION PROGRAM. 31 32 . Explaining this Resolution was Ms. Barbara Barnhizer, EEO Director 33 for the City. She noted the grievance procedure is a part of the 34 Affirmative Action program and is a very active program. This 35 Ordinance sets a time limit on when grievances can be filed of 180 36 days. 37 38 Councilman Elstro moved for adoption of Resolution No. 1-1982, 39 ' seconded by .Councilman Paust and on unanimous voice vote the motion 40 was carried. . 41 ' 42 MISCELLANEOUS BUSINESS 43 44 Mr. Kevin Rice, representing Clearview Cable, 23 South 9th Street, 45 appeared to answer questions, as he had been told patrons were to 46 appear to register complaints concerning recent outages. In response 47 ' to a question from Councilman Hankinson concerning preventive main- 48 tenance, Mr. Rice stated that most of the equipment is not original 49 equipment: due to service calls and people moving in and out. He 50 noted all utilities had problems due to the recent ice storm. In 51 .response to Councilman Williams' question as to never being able to get 52 ` through when you call for service, Mr. Rice stated the lines are 53 kept open for calls, but they receive more than the four (4) incoming 54 lines can handle. Councilman Elstro noted Council has no jurisdiction 55 over Clearview Cable as this falls under the Board Of Works. 56 57 ORDINANCES ON 1ST READING 58 59 Councilman Welch moved to suspend the rules and read Ordinance Nos. 2- 60 1982 and 3-1982 on first reading by title only, seconded by Councilman 61 Parker and on unanimous voice vote the motion was carried. 62 63 ORDINANCE NO. 2-1982 197 Common',Council Minutes Cont'd. February 1, 1982 Page 3 1 The Clerk read on first reading by title only Ordinance No. 2-1982 - 2 'AN ORDINANCE AUTHORIZING AND EMPOWERING THE BOARD OF AVIATION 3 COMMISSIONERS OF THE CITY OF`.''RICHMOND, INDIANA, TO ENTER INTO 4 A LEASE AGREEMENT WITH J. A. REKE & SON, INC. , FOR A PARCEL OF 5 AIRPORT LAND..AND CONSTRUCTION' OF A HANGAR THEREON:1- 6 7 Councilman Welch moved to suspend the rules and read Ordinance No. 2- 8 1982 on second reading, seconded by Councilman Williams and on 9 unanimous voice vote the motion was carried. - 10 11 The Clerk read on second reading Ordinance No. 2-1982. • 12 . 13 President Mills announced Ordinance No. 2-1982 is on public hearing. 14 Speaking for this Ordinance was Mr. Bill-'Merkin,. President of the '15 Board of Aviation Commissioners, noting negotiations have been going 16 -on for about a year in regard to a lease and construction of a 17 corporate hangar, in which Mr. Reke can maintain a pavement marking 18 business. -Mr. Reke has also purchased the fixed base operation of 19 the airport. This represents the first private enterprise construc- 20 tion on the airport. Also speaking •for this Ordinance was Mr. Paul 21 Hedges, Manager of Richmond .Airport, noting the lease is , for one- 22 half acre for twenty years, after which time the building will revert 23 to the City.' The- ground is northwest of the first row of. old T 24 hangar. This does-not change the Master Plan. The proposed build- 25 ing is sixty (60) feet by fiftyfive (55) feet and will have a 26 twenty (20) foot lean-to on the side for office space, lounge, and 27 storage area. ' The income to the City will be $980 per year plus 28 the tax 'on the improvement of $375. Mr. Reke will- put in his own 29 septic and water systems and furnish' his own electricity. ' Mr. 30 Hedges noted the paint Mr. Reke uses is water base so there will not 31 be combustible materials stored. 32 33 Councilman_ Hankinson moved for engrossment of 'Ordinance No. 2-1982, • 34 seconded by Councilman Carter and on unanimous voice vote the motion 35 was carried. 36 37 Councilman Welch moved to 'suspend the rules and.read Ordinance No. 2- 38 1982 on third and final reading. by title only, seconded by Councilman 39 Carter and on unanimous voice vote the motion was carried. - 40 • ' 41 The Clerk read on third reading by title only Ordinance No. 2-1982. 42 ' 43 Ordinance No. 2-1982 was adopted by the following. vote: 44 :AYES: Elstro, Williams, Ahaus,.'Hankinson,' 45 Welch, Parker, Carter, Faust, ,Mills (9) • 46 NOES: None • - (0) 47 • 48 • ORDINANCE NO. 3-1982 ' 49 50 The Clerk read on first reading -by title only Ordinance No.. 3-1982 - 51 - AN ORDINANCE ON THE REMOVAL AND DISPOSAL OF ABANDONED VEHICLES IN THE III 52 CITY OF RICHMOND, WAYNE COUNTY, INDIANA. 53 • 54 Councilman Welch moved to suspend .the rules and read Ordinance. No. 3- 55 1982 on second reading', seconded by Councilman Parker and on unanimous . 56 voice vote the motion' was carried. 57 58 The Clerk read on second reading Ordinance No. 3-1982. 59 ' 60 President Mills announced Ordinance No. 3-1982 is on public hearing. 61 62 Speaking for this Ordinance, City Attorney Ed Anderson noted he sent 63 Council a letter of explanation. This Ordinance is complying with a 64 new state statute. He outlined three things this Ordinance does: i98 Common Council Minutes Cont'd. • • February 1, 1982 Page 4 1 (1) adopts the new statute' (2) sets towing and storage charges and (3) 2 gives to the Board..of Works the right to set the rules and regulations 3 as far as operation. and maintenance. Also speaking were Chief of 4 Police Charles Chris noting that the procedure -will be basically the 5 same as it does not change declaring a vehicle abandoned or towing the 6 vehicle from the street. The Ordinance sets the towing fee at $20.00 7 - . for the daylight hours and $30.00 at night. Council was reminded 8 that the fee cannot-be changed without amending the Ordinance. Mr. 9 .Jerry Haynes, Director of Transportation, noted his Department, handles 10 approximately 1100 vehicles per year. He stated if the storage fee is 11 not high enough, the insurance companies will let .wrecked vehicles 12 set for periods of time. 13 • 14 Wrecker owners speaking..were: Mr. Albert' Caplinger, ' 616 No. 49th; 15 Mr. Beard Steele,' .3105 Union.Pike; Dale.Stanton, 1520 National Road 16 West and' Virgil Clark, Hodgin Road. The concensus of .the owners was 17 that the 'Department of Transportation should charge •$7.50 per day and 18 that $15.00 for daylight and $20.00 for nighttime ware sufficient • 19 charges.' Mr; Stanton noted he charges $5.00 per day storage and does 20 not want to see Council place towing charges too high in order to 21 keep down competition. 22 • 23 Councilman Williams moved to put this Ordinance into the Committee of 24 the Whole. 'The 'motion died for lack of a second. 25 26 Councilman Carter moved for engrossment, seconded by Councilman 27 Hankinson. On a call of the roll, the motion was defeated by the 28 - .following vote: Ayes: Hankinson, Carter; -Noes: Elstro, Williams, . 29 Ahaus, Welch, .Parker, Paust and-Mills. (2-7) 11/ 30 31 Councilman Williams moved that the, amendment 'on the towing service 32 be the same at $15.00 in the day and $20.00 at night, seconded by 33 Councilman Elstro. On- a call of the roll, the amendment. was carried 34 'by the .following vote: Ayes: Elstro, Williams, Ahaus, Paust and 35 Mills; Noes: Hankinson, Welch, -Parker, Carter. (5-4) 36 37 Councilman Ahaus moved -to amend to read and- $20.00 for the weekend. 38 -The motion died for 'lack of a second. 39 40 ' Councilman Elstro moved storage be reduced from $7.50 per day to $5.00 41 per day. The-motion died for lack of a second. 42 43 Councilman' Ahaus moved for engrossment, seconded, by Councilman 44 • Hankinson and on unanimous voice vote the motion was carried. 45 46 Councilman Ahaus moved to suspend the rules and read Amended Ordinance 47 - No. 3-1982 on third and final reading by title only, seconded by 48 Councilman Welch.
