HomeMy Public PortalAbout12-21-1981 183 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, DECEMBER 21, 1981 1 The Common Council of the City of Richmond, Indiana, met in regular 2 session December 21, 1981 at the hour of 7:30 p.m. in the Council 3 Chambers in the Municipal Building in. said City. President Mills pre- 4 sided with the following members present: Messrs. Elstro, Ahaus, 5 Hankinson, Welch, Parker, Carter and Paust. Absent: Williams. The 6 following business was had, to-wit: 7 8 DEVOTIONS 9 10 Devotions were given by Bing Welch. 11 12 President Mills reported Councilman Williams is a patient at Reid 13 Memorial Hospital and we wish him and his family a very Merry Christ- 14 mas and a Happy New Year. 15 16 APPROVAL OF MINUTES OF DECEMBER 7 , 1981 17 18 Councilman Hankinson moved to approve the minutes of December 7, 1981 19 as received, seconded by Councilman Welch and on unanimous voice vote 20 the motion was carried. 21 22 . •RESOLUTION NO. 21-1981 23 24 Councilman Welch moved to suspend the rules and read Resolution No. 21- 25 1981 by title only, ,seconded .by Councilman Ahaus and on unanimous voice 26 vote the motion was carried. 27 28 The Clerk read by title only Resolution No. 21-1981 - A RESOLUTION TO 29 TRANSFER WITHIN THE GENERAL FUND. : . : 30 31 Councilman Ahaus moved for adoption of Resolution No. 21-1981, seconded ' 32 by Councilman Carter and on unanimous voice vote the motion was carried. 33 34 REPORT FROM BOARD OF WORKS 35 36 Councilman Elstro requested the Board investigate the following: 37 38 1. South 13th from the C&O underpass to Boston Pike has new 39 blacktop. He asked if anyone ever inspected the black- 40 . - - topping jobs. He noted it was a very poor job. 41 42. 2. In the 2200 block of South 16th the Gas Company and Water 43 Company made cuts which were not properly patched. 44 45 3. Total amount of money spent on legal fees. 46 47 Mr. Meredith stated the Board received a report that there had been cuts 48 on South 16th and investigation showed the Gas Company had made a cut 49 approximately 2'x5' and this was well repaired. The Water Company made 50 a cut approximately 2'x2' and it was too late for it to be repaired with 51 hot patch soit :was repaired with cold patch. This will have to be 52 redone with hot patch when the weather permits.: The amount spent on 53 legal fees has to be hand done. 54 55 MISCELLANEOUS BUSINESS 56 57 President Mills noted it is the duty of Council to appoint three (3) 58 members to the Wayne County Convention and Tourism Bureau. Council 59 representatives Al Barzacchini, David Runyon and Russell Powell have 60 all agreed to serve another two year term. 61 62 It is also Council's duty to appoint a Redevelopment Trustee. Mr. Tom 63 Reddington has agreed to serve in this position. 1.84 Common Council Minutes Cont'd. December 21, 1981 Page 2 1 ORDINANCES ON 1ST READING 2 3 Councilman Welch moved to suspend._the rules and read Ordinance Nos. 88-1981 4 through 91-1981. on first reading by title only, seconded by Councilman 5 Parker and on unanimous voice vote the motion was carried. 6 111 7 ORDINANCE NO. 88-1981 8 9 The Clerk read on first reading by title only Ordinance No. 88-1981 - AN 10 ORDINANCE AUTHORIZING THE CITY OF RICHMOND TO ISSUE ITS "ECONOMIC DEVEL- 11 .OPMENT REVENUE BONDS, SERIES 1981" (ELEVATOR EQUIPMENT CO. PROJECT) AND 12 APPROVING OTHER ACTIONS IN RESPECT THERETO. 13 14 Councilman Welch moved..to. suspend.the rules and read Ordinance No. 88-1981 15 on second reading, seconded by Councilman Parker and on unanimous voice 16 vote the motion was carried. 17 18 The Clerk read on second reading Ordinance No. 88-1981. 19 20 President Mills announced Ordinance No. 88-1981 is on public hearing. 21 Speaking for this Ordinance and introducing Mr. Jerry Benjamin was 22 Attorney Tom Milligan. Mr. Milligan requested Ordinance No. 88-1981 be 23 amended on page 2 Section 3 Line 4 by changing the date from December 30, 24 2001 to May 1, 2002. Councilman Ahaus so moved, seconded by Councilman 25 Paust and on unanimous voice vote the motion was carried. 26 27 Councilman Carter moved for engrossment of Amended Ordinance No. 88-1981, 28 seconded by Councilman Welch and on unanimous voice vote the motion was 29 carried. 30 31 Councilman Ahaus moved to suspend the rules and read Amended Ordinance 32 No. 88-1981 on third and final reading by title only, seconded by 33 Councilman Carter and on unanimous voice vote the motion was carried. 34 - 35 Amended Ordinance.:No -88-198.1 was adopted- by:, the:. following vote: 36 AYES: Elstro, Ahaus, Hankinson, Welch, Parker, Carter, Paust, Mills (8) 37 NOES: None (0) 38 39 ORDINANCE NO. 89-1981 40 41 The Clerk read on first reading by title only Ordinance No. 89-1981 - AN 42 ORDINANCE ESTABLISHING THE PROCEDURE FOR APPROPRIATION AND PAYMENT OF 43. REWARDS. 44 45 Councilman Welch moved to suspend the rules and read Ordinance No. 89-1981 46 on second reading, seconded by Councilman Parker and on unanimous voice 47 vote the motion was carried. 48 49 The Clerk read on second reading Ordinance No. 89-1981. 50 . 51 President Mills announced Ordinance No. 89-1981 is on public hearing. 52 City Attorney Anderson explained this Ordinance is similar to the one 53 passed on promotion as it falls under the new home rule laws. The law 54 repealed 18-6-21-1 which was the State Law which permitted Common Council 55 to appropriate money for rewards. 56 57 Councilman -Hankinson moved for engrossment of Ordinance No. 89-1981, 58 seconded by Councilman Paust and on unanimous voice vote the motion was 59 carried. 60 61 Councilman Ahaus moved to suspend the rules and read.Ordinance No. 89-1981 62 on third and final reading by title only, seconded by Councilman Carter 63 and on unanimous voice vote the motion was carried. 85 Common Council Minutes Cont'd. December 21, 1981 Page 3 1 The Clerk read .on.third reading by title only Ordinance No. 89-1981. 2 3 Ordinance No. 89-1981 was adopted by the following vote: 4 AYES: Elstro, Ahaus, Hankinson, Welch, Parker, Carter, Paust, Mills (8) 5 NOES: None (0) 6 7 ORDINANCE NO. 90-1981 8 9 The Clerk read on first reading by title only Ordinance No. 90-1981 - 10 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDI- 11 NANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE 12 CITY OF RICHMOND, INDIANA ADOPTED JUNE 3, 1968, PROVIDING FOR THE 13 REZONING OF PROPERTY LOCATED AT 1118 NORTH "J" STREET FROM R-3 ONE- 14 TO-EIGHT FAMILY RESIDENCE DISTRICT TO C-4 GENERAL BUSINESS DISTRICT. 15 16 Councilman Welch moved to suspend the rules and read Ordinance 17 No. 90-1981 on second reading, seconded by Councilman Parker and on 18 unanimous voice vote the motion was carried. 19 20 The Clerk read on second reading Ordinance No. 90-1981. 21 22 President Mills announced Ordinance No. 90-1981 is on public hearing. 23 Mr. Dan Dooley of the City Plan Department stated the Plan Commission 24 conducted - a public hearing on this Ordinance and voted nine (9) to 25 zero (0) that the ordinance be denied. The owner of the property 26 desires to amend the ordinance requesting rezoning from R-3 to C-2. 27 If it is Council's pleasure to accept this proposal, the ordinance 28 will have to go back to the Plan Commission for consideration of the 29 amendment. Mr. Alfred Grimes, 1408 Riley Hills Dr. , was in the 30 audience and verified this request. He is requesting the rezoning to 31 sell the property. 32 - 33 Councilman Hankinson moved to amend Ordinance No. 90-1981 to C-2, 34 seconded by Councilman Paust. Councilman Welch noted Council rezoned 35 the corner lot and the lot next to it less than a year ago. On. 36 unanimous voice vote the motion was carried. 37 38 Amended Ordinance No. 90-1981 is referred to the Plan Commission. 39 40 ORDINANCE NO. 91-1981 41 42 The Clerk read on first reading OrdinanceNo. 91-1981 - AN ORDINANCE 43 AUTHORIZING A SPECIAL USE IN AN M-2 GENERAL INDUSTRIAL DISTRICT FOR 44 A PROFESSIONAL ENGINEERING OFFICE ON PROPERTY LOCATED AT 1805 SHERIDAN 45 STREET PURSUANT TO ARTICLES 48 AND 34.013 OF CHAPTER 154 OF THE 46 MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE 47 ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA. 48 49 Councilman Welch moved to suspend the rules and read Ordinance No. 91- 50 1981 on second reading, seconded by Councilman Hankinson and on 51 unanimous voice vote the motion was carried. 52 - 53 The Clerk read on second reading Ordinance No. 91-1981. 54 55 President Mills announced Ordinance No. 91-1981 is on public hearing. 56 There being no one speaking for or against this ordinance, Councilman 57 Carter moved for engrossment, seconded by Councilman Hankinson and on 58 unanimous voice vote the motion was carried. 59 60 Councilman Carter moved to suspend the rules and read Ordinance 61 No. 91-1981 on third and final reading by title only, seconded by 62 Councilman Hankinson and on unanimous voice vote the motion was carried. 63 64 The Clerk read on third reading by title only Ordinance No. 91-1981. 1.86 Common Council Minutes Cont'd.
