President Mills 4 presided with the following members present: Messrs. Elstro, Williams, 5 . Ahaus, Hankinson, Welch, .Parker, - Carter and Paust. Absent: None. The 6 following business was had, to-wit: 7 8 DEVOTIONS 9 10 .Councilman Paust.gave devotions. • 11 12 APPROVAL OF MINUTES OF NOVEMBER::16, 1981 13 14 Councilman Williams moved to approve the minutes of the previous 15 meeting as prepared, seconded by Councilman Welch and on unanimous 16 voice vote the motion was carried. 17 18 RESOLUTIONS 19 • 20 Councilman -Welch moved to suspend the rules and read Resolution No. 21 20-1981 by title only, seconded by Councilman-Parker and on unanimous 22 voice vote the motion was carried. 23 • 24 RESOLUTION NO. . 20-1981 25 - 26 The Clerk read by title only Resolution No. 20-1981 - RESOLUTION OF • III .27 THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA CONCERNING THE ' `28 PROPOSED:FINANCING OF ECONOMIC DEVELOPMENT FACILITIES FOR ELEVATOR 29 EQUIPMENT COMPANY. 30 31 Speaking for this Resolution was Attorney Tom Milligan, representing 32 Elevator Equipment Company. He introduced Jerry Benjamin, the plant '33 manager and Dave Runyon from the First National Bank. 34 - 35 - Councilman Carter'-moved for adoption of Resolution No. 20-1981, 36 seconded by Councilman Paust and on unanimous voice vote the motion 37 was carried. 38 39 COMMENTS FROM.THE PRESIDENT. - 40 • 41 President Mills welcomed students from the Richmond High School 42 government class. - 43 44 REPORTS FROM CITY DEPARTMENTS 45 - 46 City Attorney Ed Anderson explained a new law which gives the respon- 47 sibility to Council instead of the Board of Works for vacating streets. 48 Council is required- to hold a public hearing. The public hearing on 49 second reading will suffice. December 7, 1981 Page 2 1 A recently established Wayne County Refuse Disposal Advisory 2 Committee, which resulted from a joint meeting of city and 3 - county officials, .held an organizational meeting on Novem- 4 ber 23, 1981. The purpose of this Committee is to explore 5 .. the possibility of developing a cooperative long range refuse 6 • disposal facility for all the residents of Wayne County; and 7 to offer suggestions' and recommendations to city and county 8 officials which may eventually result in a cooperative long 9 range refuse disposal program. - 10 11 It is realized that any long range cooperative plan will re- 12 quire the combined input and cooperation of -city-and county 13 • officials. Therefore, we would appreciate having a represen • - 14 t'ative of the Richmond Common Council serve on this Committee. 15 Thus far, the membership consists of representatives from the 16 . Gauthier, R.P.S. 26 Chairman 27 Wayne County Refuse Disposal 28 - Advisory Committee 29 30 President Mills appointed Councilman Welch as liaison from the Common 31 Council. 32 33 ORDINANCES ON 1ST READING 34 35 Councilman Welch moved. to .suspend.the rules and read Ordinance .Nos. 86 36 and 87-1981 on first reading by title only, seconded by Councilman 37 ` Paust and on unanimous voice vote the motion was carried. 38 39 ORDINANCE NO. 86-1981 40 41 The Clerk read on first reading by title only Ordinance No. 86-1981-- 42 AN ORDINANCE ALLOWING AND AUTHORIZING EXPENSES FOR MUNICIPAL PROMOTION. 43 44 City Controller Don Meredith explained the Ordinance. 45 46 Councilman Ahaus moved to suspend the rules and readsOrdinance No. 86-1981 47 on second,reading, seconded by Councilman Welch and on unanimous voice 48 vote the motion was carried. 49 50 The Clerk read on second reading Ordinance No. 86-1981. 51 52 President Mills announced Ordinance No. 86-1981 is on public hearing. 53 There being no one speaking .for or .against Ordinance No. 86-1981, Council- 54 man Carter moved for engrossment, seconded by Councilman Welch and on 55 unanimous voice vote the motion.was carried. 56 57 Councilman Ahaus moved to suspend the rules and read Ordinance No. 86- 58 1981 on third and final reading by title only, seconded by Councilman 59 Welch and on unanimous voice vote the motion was carried. 60 61 The Clerk read on third reading by title only Ordinance No. 86-1981. 62 63 Ordinance No. 86-1981 was adopted, by the following vote: 64 AYES: Elstro, Williams, Ahaus, Hankinson 65 Welch, Parker, Carter, Paust, Mills (9) 66 NOES: None (0) 181 Common Council Minutes Cont'd. December 7, 1981 Page 3 1 ORDINANCE NO. 87-1981 2 3 The Clerk read on first reading by title only Ordinance No. 87-1981 - 4 AN ORDINANCE AUTHORIZING A SPECIAL USE AT 113 SOUTH 3RD STREET BEING 5 IN AN R-3 'ONE-TO-EIGHT FAMILY RESIDENTIAL DISTRICT, OF ORDINANCE 6 NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE FOR THE CITY 7 OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. 8 9 Councilman Welch moved to suspend the rules and read Ordinance No. 87- 10 1981 on second reading, seconded by Councilman Parker and on unanimous 11 voice vote the motion was carried. 12 H - .13 The Clerk read on second reading Ordinance No. 87-1981. 14 15 President Mills announced ORDINANCE No. 87-1981 is on public hearing. 16 Speaking for Ordinance No. 87-1981 was Tom Milligan, representing Steve 17 and Scott Porter. 18 19 Councilman Paust moved for engrossment, seconded by Councilman Elstro 20 and on unanimous voice vote the motion was carried. 21 22 Councilman Welch moved to suspend the rules and read Ordinance No. 87- 23 1981 on third and final reading by title only, seconded by Councilman 24 Parker and on unanimous voice vote the motion was carried. 25 26 The Clerk read on third and final reading by title only Ordinance 27 No. 87-1981. 28 III 29 Ordinance No. 87-1981 was adopted by the following vote: 30 AYES: Elstro, Williams, Ahaus, Hankinson, 31 Welch, Parker, Carter, Paust, Mills (9) 32 NOES: None (0) 33 34 ORDINANCES ON 2ND READING 35 ORDINANCE NO. 84-1981 36 37 The Clerk read on second reading Ordinance No. 84-1981 - AN ORDINANCE 38 AMENDING CHAPTER 154 OF THE MUNICIPAL CODE AND ARTICLE 22 OF ORDINANCE 39 NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE FOR THE CITY OF 40 RICHMOND, WAYNE COUNTY, INDIANA. 41 42 President Mills announced Ordinance No. 84-1981 is on public hearing. 43 Speaking for Ordinance No. 84-1981 were Tom Milligan, representing 44 Scott and Steve Porter; Gertrude Ward, Centerville, and Bob Goodwin; 45 City Plan Director. Mr. Goodwin stated there is not a parking problem 46 on South 4th-4and-if.f, a parking -lot' was,,required, -it would be necessary 47 to tear down some of the historical buildings. 48 49 Councilman Ahaus moved for engrossment, seconded by Councilman Hankinson 50 and on unanimous voice vote the motion was carried. 51 52 Councilman Ahaus moved to suspend the rules and read Ordinance No. 87- 53 1981 on third and final reading by title only, seconded by Councilman 54 Welch and on unanimous voice vote the motion was carried. 55 56 The Clerk read on third reading by title only Ordinance No. 87-1981. 57 58 Ordinance No. 87-1981 was adopted by the following vote: 59 AYES: Elstro, Williams, Ahaus, Hankinson, 60 Welch, Parker, Carter, Paust, ;:'Mills (9) 61 62 ANNOUNCEMENT RE: POLICE MERIT COMMISSION 63 64 President Mills announced the Police Merit Commission appointment is to 65 be made in January. 182 Common Council Minutes Cont'd. December 7, 1981 Page 4 1 ORDINANCES ON 3RD READING 2 ORDINANCE NO. 71-1981 3 4 Councilman Welch moved to suspend the rules and read Ordinance No. 71-1981 5 on third reading by title only, seconded by Councilman Paust and on 6 unanimous voice vote the motion was carried. 7 8 The Clerk read on third and final reading by title only Ordinance No. 71- 9 1981,- AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING 10 ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE 11 CITY OF RICHMOND, INDIANA ADOPTED JUNE 3, 1968, PROVIDING FOR. THE RE- 12 ZONING OF PROPERTY LOCATED AT 302 NORTH 7TH STREET FROM 1-4 MULTI-FAMILY 13 RESIDENCE DISTRICT TO,M-1,LIGHT INDUSTRIAL DISTRICT. 14 15 Ordinance No. 71-1981 was defeated by the following vote: 16 AYES: Ahaus, Hankinson,.
