COUNCIL OF THE CITY OF RICHMOND, INDIANA, OCTOBER 19, 1981 1 The Common Council of the City of Richmond, Indiana, met in regular 2 session October 19, 1981 at the hour of 7 :30 p.m. ; in the Council 3 Chambers in the Municipal Building in said City. President Mills pre- 4 sided with the following members present: Messrs. Elstro, Williams, 5 Ahaus, Hankinson, Welch, Parker, Carter and Paust. Absent: None. 6 The following business was had, to-wit: 7 8 DEVOTIONS 9 • 10 Devotions were given by City Clerk JoEllen Trimble. 11 12 EXCUSES FOR PREVIOUS ABSENCES 13 14 Councilman Hankinson was absent .from the previous meeting due to illness. 15 16 APPROVAL OF MINUTES OF OCTOBER 5, 1981 17 18 Councilman Williams moved to approve the minutes of the previous meeting 19 as prepared, seconded by Councilman Welch and on unanimous voice vote 20 the motion was carried. 21 22 WELCOME TO STUDENTS 23 24 President Mills welcomed the students from Centerville High School 25 in the audience. 26 27 BOARD OF PUBLIC WORKS & SAFETY REPORT. . 28 1 29 In response to Councilman Elstro.'s question concerning who should be 30 contacted concerning a complaint in the two (2) mile fringe area, Mr. 31 Meredith stated they should contact Bob Goodwin, Director of City Plan- 32 ning. Mr. Webb stated he just read the new law.and in the fringe area 33 the enforcement powers lie with the governmental unit, which, in this 34 case would be the County Commissioners. The. City has control of the 35 zoning and sub-division plats, once they reach final approval, the 36 County has jurisdiction. City Attorney Ed Anderson will research the 37 issue and give an opinion. 38 39 Councilman Williams requested the chair on Council floor be repaired. 40 41 President Mills requested Chief of Police Chris check the signs at 42 Tyndall Tire Service as they are blocking the view for traffic when 43 the stop fights are on flashing. 44 45 Councilman Ahaus stated he has talked with Clark-Dietz Engineering and 46 was told it was hoped all the streets torn up during the sewer separa- 47 tion project would be repaired. Mr. Webb confirmed this. Councilman 48 Ahaus stated South "A" between 15th and 16th is extremely rough. 49 50 REPORT FROM CITY DEPARTMENTS. 51 52 City Controller Don Meredith gave a presentation of a new computer. He 53 noted he has discussed the possibility of going on. RP&L's computer; how- 54 ever, it is not large enough to do what he wants to do and he feels it 55 would be' in the best interest of the taxpayers of the City to proceed 56 with the upgrading in house. He stated he can do this upgrading for less 57 than what it is costing us for our present system, for the hardware, due 58 to new technology. Mr. Meredith will write a letter to Council explaining 59 the system and will try to get a ballpark figure on software. Councilman 60 Paust requested Chief of Police Charles Chris send a letter to Council 61 showing the applications his Department would propose to put on the 62 computer. 63 64 LETTER IN REFERENCE TO ORDINANCE NO. 71-1981 IL 61! October 19, 1981 Page 2 1 P:resident Mills read the following letter: 2 3 October 19, 1981 4 5 JoTrimble 6 Richmond City Clerk 7 Richmond, IN 47374 8 9 RE: Richmond Community Schools/Petition for Rezoning/ 10 Request for Continuance 11 12 Dear Ms. Trimble: 13 14 This letter will confirm my prior conversations with Mr. Kenneth 15 Mills, President of the Richmond City Council, to the effect that 16 the Richmond Community Schools requests that its petition for 17 the rezoning of the Warner School property now set to come back 18 for hearing on October 19, 1981 be continued until the next 19 meeting of Council, which we understand to be November 2, 1981. 20 Our reasons for requesting this continuance are as follows: 21 - 22 1. At the prior public hearing on our petition, various 23 concerns were addressed by Council which require additional 24 investigative efforts on our part and on the part of the 25 Traffic Department of the Richmond City Police. 26 27 2. Mr. Gardner presented a Resolution and minutes of the 5 Economic Development Commission to be attached to the Ordinance. 6 7 Councilman Carter moved for engrossment- of -Ordinance No. 74-1981, 8 seconded by Councilman Williams and on unanimous voice vote the motion 9 was carried. 10 • - 11 Councilman Carter moved to suspend the rules and read Ordinance No. 12 74-1981 on third and final reading by title only, seconded by Council- 13 man Welch and on unanimous voice_ vote the motion was carried. 14 15 . The Clerk read on third and final reading by title only Ordinance No. 16 74-1981. 17 18 Ordinance No. 74-1981 was adopted by the following vote: 19 AYES: Elstro, Williams, Ahaus, •Hankinson, 20 Welch, Parker, Carter, Paust, Mills (9) 21 - NOES: None (0) 22 23 ORDINANCE NO. 75-1981 - 24 25 The Clerk read on first reading by title only Ordinance No. 75-1981 - 26 AN ORDINANCE AMENDING AN ORDINANCE ESTABLISHING CERTAIN FEES AND 27 28 PERMITS FOR THE ,SEVERAL DEPARTMENTS OF THE CITY OF RICHMOND, INDIANA - AMENDING TITLE III, CHAPTER 31, APPENDIX B OF THE MUNICIPAL CODE OF 29 THE CITY OF RICHMOND, INDIANA. 30 31 Councilman Welch moved to suspend the. rules and read Ordinance No. 32 75-1981 on -second reading, seconded by Councilman Parker and on 33 unanimous voice vote the emotion was carried. 34 35 The Clerk read on second reading Ordinance No. .75-1981. 36 37 President. Mills announced Ordinance No. 75-1981 is on public hearing. 38 Speaking for this Ordinance was City Controller Don Meredith, noting 39 • this is a new fee for the sewer connection and a reduction is the ex- 40 isting fee for gun permits. 41 42 - Councilman Carter moved to reduce the storm sewer tap fee to $25.00, • 43 seconded by Councilman Elstro and on a call of the roll the following 44 was recorded: Ayes: Elstro and Carter. Noes: Williams, Ahaus, 45 Hankinson, Welch, Parker, Carter, Paust and Mills. The vote being 46 two (2) to seven (7) in favor of passage of the amendment;therefore, 47 the amendment was defeated. 48 49 Councilman Welch moved to engross Ordinance No. 75-1981, seconded 50 by Councilman Williams. The motion carried with Councilman Carter 51 voting no. 52 53 Councilman Welch moved to suspend the rules' and -read Ordinance No. 54 75-1981 on third and final reading. by title only, seconded. by Council- 55 man Williams and on unanimous voice vote the motion was carried. 56 57 The Clerk read on third reading by title only Ordinance No. 75-1981. 58 59 Ordinance-No. 75-1981 was adopted by the- following vote: 60 AYES: Milliams, .Ahaus, Hankinson, Welchs 61 Parker, Paust, Mills -- - - (7) - 62 NOES: Elstro, Carter 63 64 ORDINANCE NO. 76-1981 164. October 19, 1981 Page 4 1 The Clerk read on first reading by title only Ordinance No. 76-1981 - AN 2 ORDINANCE TO TRANSFER WITHIN THE GENERAL FUND. 3 4 Councilman Welch moved to suspend the rules and read Ordinance No. 76-1981 5 on second reading, seconded by Councilman Williams and on unanimous voice 6 vote the motion was carried. 7 8 The Clerk read on second reading Ordinance No. 76-1981. 9 10 President Mills announced Ordinance No. 76-1981 is on public hearing. 11 Speaking for this Ordinance was Director of Community Development Tim Ryder. 12 13 Councilman Ahaus moved for engrossment of Ordinance No. 76-1981, seconded by 14 Councilman Parker and on unanimous voice vote the motion was carried. 15 16 Councilman Welch moved to suspend the rules and read Ordinance No. 76-1981 17 on third and final reading by title' only, seconded by Councilman Williams 18 and on unanimous voice vote the motion was carried. 19 20 The Clerk read on-third reading by title only Ordinance No. 76-1981. 21 22 Ordinance No. 76-1981 was adopted by the following vote: 23 AYES: Elstro, Williams, Ahaus, Hankinson, (9) 24 Welch, Parker, Carter, Paust, Mills 25 NOES: None (0)' 26 27 ORDINANCE NO. 77-1981 28 29 The Clerk read on first reading by title only Ordinance No. 77-1981 - AN 30 ORDINANCE TO APPROPRIATE WITHIN THE GENERAL FUND. 31 32 President Mills announced Ordinance No. 77-1981 has to be advertised. 33 34 ORDINANCES ON 2ND READING 35 36 ORDINANCE NO. 73-1981 37 38 The Clerk read on second reading Ordinance No. 73-1981 - AN ORDINANCE TO 39 APPROPRIATE WITHIN THE GENERAL FUND. 40 41 City Attorney Ed Anderson examined proof of publication and found it to be 42 in order. Councilman Welch moved it be accepted and filed, seconded by 43 Councilman Ahaus and on unanimous voice vote the motion was carried. 44 45 President Mills announced this Ordinance is on public hearing. Speaking for 46 this Ordinance were City Controller Don Meredith, Park Superintendent Don 47 McBride, Chief Charles Chris and Deputy Fire Chief Bill Smith. Chief Chris 48 requested the Ordinance be amended to cut line item "Pistols and Guns" from 49 $10,000 to $4,315 reducing the total amount to' $278,815. Councilman Carter 50 so moved, seconded by Councilman Parker and on unanimous voice vote the 51 motion was carried. 52 53 Councilman Williams moved for engrossment of Amended Ordinance No. 73-1981, 54 seconded by Councilman Ahaus and on unanimous voice vote the motion was11/ 55 carried. 56 57 Councilman Welch moved to suspend the rules and' read'Amended Ordinance No. 58 73-1981 on third and final reading by title only, seconded by Councilman 59 Williams and on unanimous voice vote the motion was carried. 60 61 The Clerk read on third reading by title only Amended Ordinance No. 73-1981. 62 63 Amended Ordinance No. 73-1981 was adopted by the following vote: 65 Common Council Minutes Cont'd.
