PROCEEDINGS OF THE COMMON COUNCIL OF THE
CITY OF RICHMOND, INDIANA, SEPTEMBER 8, 1981
1 The Common Council of the City of Richmond, Indiana, met in regular
2 session September 8, 1981 at the hour of 7 :30 p.m. in the Council
3 Chambers in the Municipal Building in said City. President Mills
4 presided with the following members present: Messrs. Elstro, Williams,
5 Ahaus, Hankinson, Welch, Parker, Carter and Paust. Absent: None.
6 The following business was had, to-wit:

10 Councilman Ahaus gave devotions.

12 APPROVAL OF MINUTES OF AUGUST 17 and AUGUST 24, 1981

14 Councilman Hankinson moved the minutes of the regular meeting August
15 17th and the special meeting August 24th be approved, seconded by
16 Councilman Paust and on unanimous voice vote the motion was carried.

18 REPORT FROM THE BOARD OF PUBLIC WORKS AND SAFETY

20 Councilman Elstro stated he read in the paper where City Attorney
21 Ed Anderson had to resign from the Board of Works due to his residency
22 outside the City limits. He akked if it was legal for Mr. Anderson to
23 serve as City Attorney due to his residency. Mr. Anderson stated the
24 • residency requirement for City Attorney is within the County.

26 Councilman Elstro requested City Controller Don Meredith furnish him
III 27 with the total attorney fees spent by the City, with the exception of
28 RP&L, for the calendar year 1980.

30 REPORT OF STREET LIGHT COMMITTEE

32 The Street Light Committee has received a request from the Board of
33 Works for lights at Garwood & Backmeyer Roads and has taken the re-
34 quest under advisement.

36 Councilman Williams questioned the rubberized crossing not being laid
37 on the North 12th Street railroad crossing. He stated it has been
38 there ready to be installed for about two (2) years. 'Work was to
39 have started last April. City Engineer stated he called Philadelphia
40 a week or two ago and talked to the Chief Engineer of Conrail. He
41 stated the reason no work is being done is that Norfolk & Western is
42 negotiating with Conrail to buy that line. Until Norfolk & Western
43 takes over the line, he doubts if anything is going to be done there.
44 Mr. Meredith stated we are under contract with Conrail and the Board
45 received word a new contract would have to be drawn, but that would
46 be a part of their buy/sell agreement.

50 Councilman Welch moved to suspend the rules and read Resolution Nos.

57 AUTHORIZING THE FILING OF AN APPLICATION FOR A GRANT UNDER SECTION 18
58 OF THE URBAN MASS TRANSPORTATION ACT OF 1964, AS AMENDED.

60 Mr. Meredith stated this is a request to file a grant for the calendar
61 year 1982 to apply for subsidy funds under Section 18, which we have
62 been receiving for the last two (2) or three (3) years. 1982 will be
63 the last year, as the law stands now, for funding.

22 Committee Chairman Rick Ahaus announced he is scheduling. a Committee
23 meeting for Monday, September 14 at 7 :00 p.m. in the Board of Works
24 Room to discuss User Charge.

43 Speaking for this Ordinance were City Attorney Ed Anderson, explaining
44 a new law permits cities to create these areas in which there is given
45 a tax break and Mr. Arthur Vivian, Wernle Road, explaining the ad-
46 vantages of this ordinance.

49 seconded by Councilman Welch and on unanimous voice vote the motion
