HomeMy Public PortalAbout02-02-1981 81 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, FEBRUARY 2, 1981 1 The Common Council of the City of Richmond, Indiana, met. in regular 2 session February 2, 1981 at the hour of 7 :30 p.m. in the Council 3 Chambers in the Municipal Building in said City. President Mills 4 presided with the following members present : Messrs. Elstro, Williams, 5 Ahaus, Hankinson,' Welch, Parker, Carter and Paust. Absent: None. 6 The following business was had, to-wit: 7 8 DEVOTIONS • 9 10 President Mills gave devotions. 11 12 APPROVAL OF MINUTES OF JANUARY 19, 1981 13 14 Councilman Hankinson moved to approve the minutes of the previous 15 meeting as prepared, seconded by Councilman Welch and on unanimous 16 voice vote the motion was carried. 17 18 CHANGE NEXT COUNCIL MEETING DATE 19 20 President Mills announced the City Building will be closed on February 21 16, which would be the regularly scheduled meeting date, for Presi- 22 dent's Day. He recommended the meeting date be changed to Tuesday, 23 February 17. 24 25 Councilman Hankinson so moved, seconded by Councilman Welch and on 26 unanimous voice vote the motion was carried. 27 28 SET BOARD OF FINANCE MEETING DATE 29 30 City Controller Don Meredith reminded Council the Board of Finance 31 is to meet under the Public Depository Act I.C. 5-12-1 on the third 32 Monday of_ February in each odd numbered year. Since the meeting date 33 has been changed, this should be changed to the third Tuesday in 34 February. He recommended this meeting be just prior to the RP&L 35 meeting at 6:45 p.m. The current president of the Board of Finance 36 is Mr. Carter. 37 38 INSURANCE FIGURES PAID BY CITY 39 40 City Controller Don Meredith presented the following insurance figures 41 paid by the City: City Liability $33,063; City Property Coverage 42 $24,253 with $1,000 deductible.; Fleet Policy $55,892; Workmen's 43 Compensation $49,826; Umbrella Liability $39,000: Police Professional 44 Liability $23,461. 45 46 APPOINTMENT TO TOURISM/CONVENTION BUREAU 47 48 Councilman Paust announced he has contacted Mr. Russell Powell of 49 AAA as a representative under the travel category and he has agreed 50 to serve. Councilman Paust recommended Mr. Russell Powell be ap- 51 pointed to serve on the Tourism Board. 52 53 Councilman Ahaus so moved, seconded by Councilman Welch and on 54 unanimous voice vote the motion was carried. 55 56 FORMAT SET FOR DISCUSSIONS 57 58 President Mills announced he will expect attorneys appearing before 59 Council to limit their presentation to ten (10) minutes and all 60 others speaking to limit their presentations to five (5) minutes. 61 Those in favor will speak first and those opposed last. 62 63 ORDINANCES ON 1ST READING 64 65 Councilman Welch moved to suspend the rules and read Ordinance Nos. 82 Common Council Minutes Cont'd. February 2, 1981 Page 2 1 3-1981, 4-1981 and 5-1981 on first reading by title only, seconded 2 by Councilman Paust and on unanimous voice vote the motion was 3 carried. 4 5 ORDINANCE NO. 3-1981 6 7 The Clerk read on first reading by title only Ordinance No. 3-1981 - 8 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING 9 ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF 10 THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968, PROVIDING FOR 11 THE REZONING OF PROPERTY LOCATED AT 300 THROUGH 326 NORTH 4TH STREET 12 FROM R-3 ONE-TO-EIGHT FAMILY RESIDENCE DISTRICT TO M-1 LIGHT 13 INDUSTRIAL DISTRICT. 14 15 Councilman Ahaus moved to suspend the rules and read Ordinance No. 3- 16 1981 on second reading, seconded by Councilman Carter and on unanimous 17 voice vote the motion was carried. 18 19 The Clerk read on second reading Ordinance No. 3-1981. 20 21 President Mills announced Ordinance No. 3-1981 is on public hearing. 22 Speaking for this Ordinance was Attorney Gayle Gardner, 304 Peoples 23 Building, representing Petitioner Floyd Nixon. 24 25 Councilman Paust moved for engrossment of Ordinance No. 3-1981, 26 seconded by Councilman Carter and on unanimous voice vote the motion 27 was carried. 28 29 Councilman Welch moved to suspend the rules and read Ordinance No. 3- 30 , 1981 on third and final reading by title only, seconded by Council- 31 man Parker and on unanimous voice vote the motion was carried. 32 33 The Clerk read on third reading by title only Ordinance No. 3-1981. 34 35 Ordinance No. 3-1981 was adopted by the following vote: 36 AYES: Elstro, Williams, Ahaus, Hankinson, Welch, Parker, 37 Carter, Paust and Mills (9) 38 NOES: None (0) 39 40 ORDINANCE NO. 4-1981 41 42 The Clerk read on first reading by title only Ordinance No. 4-1981 - 43 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING 44 ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE 45 OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968, PROVIDING 46 FOR THE REZONING OF PROPERTY GENERALLY BOUNDED BY SOUTH 9TH STREET, 47 THE C&O RAILROAD, SOUTH 13TH STREET AND BOSTON PIKE FROM R-2 SINGLE 48 FAMILY RESIDENCE DISTRICT AND R-4 MULTI-FAMILY RESIDENCE DISTRICT 49 TO C-4 GENERAL BUSINESS DISTRICT. 50 51 President Mills read the following letter from Attorney Robert G. 52 Burton: , 53 54 On behalf of the petitioners, would you please withdraw the 55 Petition known as PC-81-2 for the rezoning of certain land 56 from generally R-2 to C-4, brought by Daniel Stamper and 57 others. Thank you for your consideration. 58 59 Councilman Paust moved to strike Ordinance No. 4-1981, seconded by 60 Councilman Carter and on unanimous voice vote the motion was carried. 61 62 ORDINANCE NO. 5-1981 63 64 The Clerk read on first reading by title only Ordinance No. 5-1981 - 83 Common Council Minutes Cont'd. February 2, 1981 Page 3 1 AN ORDINANCE AMENDING ARTICLE 14.06 OF CHAPTER 154 OF THE MUNICIPAL 2 CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING 3 ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. 4 5 Councilman Welch moved to suspend the rules and read Ordinance No. 5- 6 1981 on second reading, seconded by Councilman Parker and on unanimous 7 voice vote the motion was carried. 8 9 The Clerk read on second reading Ordinance No. 5-1981. 10 11 President Mills announced Ordinance No. 5-1981 is on public hearing. 12 Speaking for this Ordinance was Director of City Planning Bob 13 Goodwin, who stated this change will allow annexation properties 14 to come in as previously zoned in the fringe area. 15 16 Councilman Ahaus moved for engrossment of Ordinance No. 5-1981, 17 seconded by Councilman Welch and on unanimous voice vote the motion 18 was carried. 19 20 Councilman Welch moved to suspend the rules and read Ordinance No. 5- 21 1981 on third and final reading by title only, seconded by Councilman 22 Paust and on unanimous voice vote the motion was carried. 23 24 The Clerk read on third reading by title only Ordinance No. 5-1981. 25 26 Ordinance No. 5-1981 was adopted by the following vote: 27 AYES: Elstro, Williams, Ahaus, Hankinson, Welch, Parker, 28 Carter, Paust and Mills (9) 29 NOES: None (0) 30 31 ORDINANCES ON 2ND READING 32 33 ORDINANCE NO. 78-1980 33 34 The Clerk read on second reading Ordinance No. 78-1980 - AN ORDINANCE 35 ESTABLISHING CERTAIN FEES AND PERMITS FOR THE SEVERAL DEPARTMENTS OF 36 THE CITY OF RICHMOND, INDIANA, AMENDING CHAPTER 23 OF THE MUNICIPAL 37 CODE AND AMENDING OTHER ORDINANCES IN CONFLICT HEREWITH. 38 39 Chairman of the Committee of the Whole Ahaus presented numerous 40 amendments to Ordinance No. 78-1980. He recommended leaving the 41 Ordinance on second reading to allow it to be retyped and bringing 42 it back in two (2) weeks still on second reading. 43 44 President Mills announced the Ordinance is on public hearing and 45 asked if anyone in the audience would like to speak for or against 46 this Ordinance. There being no one speaking, President Mills 47 announced Ordinance No. 78-1980 will come back as amended at the 48 next meeting. 49 50 ORDINANCE NO. 2-1981 51 52 The Clerk read on second reading Ordinance No. 2-1981 - AN ORDINANCE 53 AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325- 54 1968 AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY 55 OF RICHMOND, INDIANA, TO PERMIT CERTAIN BEAUTY .PARLORS AND BARBER 56 SHOPS AS AN ACCESSORY USE IN R-3 AND LESS-RESTRICTED DISTRICTS AND 57 TO ALTER THE NUMBERING OF CERTAIN SECTIONS OF SAID ORDINANCE. 58 59 President Mills announced Ordinance No. 2-1981 is on public hearing. 60 Speaking for Ordinance No. 2-1981 were Attorney Steve Bone, 400 First 61 National Bank Bldg. and Attorney Bob Reinke, 433 South 21st Street. 62 The Clerk read a letter from Attorney Keith Dilworth who was unable 63 to appear to speak against Ordinance No. 2-1981. 84 • Common Council Minutes Cont'd. February 2, 1981 Page 4 1 Councilman Ahaus moved for engrossment of Ordinance No. 2-1981, 2 seconded by Councilman Williams and on unanimous voice vote the motion 3 was carried. 4 5 Councilman Williams moved to suspend the rules and read Ordinance No. 2- 6 1981 on third and final reading by title only, seconded by Councilman 7 Hankinson and on a call of the roll Councilman Elstro voted no. 8 9 COMMITTEE OF THE WHOLE MEETING SET 10 11 Chairman of the Committee of the Whole Ahaus set_ _Monday, February_ 9 12 --- in the Board of Works Room to meet with Ms. Ann Cline, CCEMP, to 13 discuss the new proposed energy plan. 14 15 COMPLAINT TO BOARD OF WORKS 16 17 Councilman Williams complained to the Board that Ms. Howell, 221 South 18 6th, is having problems with large dogs. 19 20 INSTALLATION OF STORM WINDOWS 21 22 City Controller Don Meredith reminded Council to look at the new storm 23 windows which have been installed in the Council Chambers. 24 25 ADJOURNMENT 26 27 There being, no further business on motion duly made, seconded and 28 passed the meeting was adjourned. 29 30 Kenneth Mills 31 President 32 33 ATTEST: JoEllen Trimble 34 City Clerk
