PROCEEDINGS OF THE COMMON COUNCIL OF THE
CITY OF RICHMOND, INDIANA, JANUARY 5, 1981
1 The Common Council of the City of Richmond, Indiana, met in regular
2 session January 5, 1981 at the hour of 7 :30 p.m. in the Council Chambers
3 in the Municipal Building in said City. President Paust presided with
4 the following members present : Messrs. Elstro, Williams, Ahaus,
5 Hankinson, Welch, Parker, Carter and Mills. Absent: None. The
6 following business was had, to-wit:

10 Councilman Elstro gave devotions.

12 PRESIDENT AND PRESIDENT PRO TEM FOR 1981

14 President Paust announced the floor was open for nomination for Presi-
15 dent. Councilman Welch placed in nomination Ken Mills, seconded by
16 Councilman Parker. Councilman Hankinson moved the nominations be
17 closed, seconded by Councilman Carter and on unanimous voice vote the
18 motion was carried. Councilman Hankinson moved by acclamation Council-
19 man Mills for President, seconded by Councilman Carter and on unani-
20 mous voice vote the motion was carried.

22 President Mills assumed the chair. President Mills announced nomina-
23 tions are open for President Pro Tem for 1981. Councilman Welch
24 nominated Rick Ahaus, seconded by Councilman Parker. Councilman
25 Paust moved the nominations be closed, seconded by Councilman Hankinson
26 and on unanimous voice vote the motion was carried. President Mills
27 stated we have by acclamation Mr. Ahaus as President Pro Tem and on
28 unanimous voice vote it was so acclamed.

30 COMMITTEE OF THE WHOLE MEETING

32 At the request of the President, Committee of the Whole Chairman Ahaus
33 set January 20 at 7:00 p.m. in the Board of Works Room to discuss
34 Ordinance No. 78-1980 which deals with fees and permits.

36 APPROVAL OF MINUTES

38 Councilman Williams moved the minutes of the previous meeting be
39 approved as prepared, seconded by Councilman Paust and on unanimous
40 voice vote the motion was carried.

44 Councilman Welch moved to suspend the rules and read Resolution No. 1-
45 1981 by title only, seconded by Councilman Paust and on unanimous voice
46 vote the motion was carried.

28 Councilman Welch moved to suspend the rules and read Ordinance No. 1-
29 1981 on first reading by title only, seconded by Councilman Elsto and
30 on unanimous voice vote the motion was carried.

33 AN ORDINANCE TO ANNEX TO THE CITY OF RICHMOND, INDIANA, CERTAIN CON-
34 TIGUOUS TERRITORY, ADJACENT AND ABUTTING THERETO, DESCRIBING THE SAME,
35 AND FIXING THE TIME WHEN: THE SAME SHALL TAKE EFFECT.

37 Councilman Welch moved to suspend the "rules and read Ordinance No. 1-
38 1981 on second reading, seconded by Councilman Hankinson and on
39 unanimous voice vote the motion was carried.

43 President Mills announced Ordinance No. 1-1981 is on public hearing.
44 Speaking for Ordinance No. 1-1981 were Mr. Dan Dooley, 1183 Beelor
45 Road, representing the Richmond City Plan Department; Attorney James
46 Ronald, 1120 E. Main, representing Jerry Jennings; and Mr. Jerry
47 Jennings, 4794 King Road. He desires annexation to obtain sanitary
48 sewer service. The present sanitary sewer goes by River Court.

50 Councilman Paust moved for engrossment of Ordinance No. 1-1981,
51 seconded by Councilman Hankinson and on unanimous voice vote the
52 motion was carried.

54 Councilman Welch moved to suspend the rules and read Ordinance No. 1-
55 1981 on third and final reading by title only, seconded by Councilman
56 Hankinson and on unanimous voice vote the motion was carried.

5 Councilman Welch moved to suspend the rules and read Ordinance No. 101-
6 1980 on third reading by title only, seconded by Councilman Elstro and
7 on unanimous voice vote the motion was carried.

9 The Clerk read on third reading by title only Ordinance No. 101-1980 -
10 AN ORDINANCE AMENDING CHAPTER 22 OF THE MUNICIPAL CODE, BEING ORDINANCE
11 NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF
12 RICHMOND, INDIANA ADOPTED JUNE 3, 1968, PROVIDING FOR THE REZONING OF
13 PROPERTY LOCATED AT 2001 U.S. 27 SOUTH FROM R-2 ONE FAMILY RESIDENCE
14 DISTRICT TO C-2 COMMUNITY BUSINESS DISTRICT.

16 Further discussion was held concerning the sanitary sewer, which is
17 under the Barrett Law and the nursing home had connected to in their
18 previous expansion. Attorney_ Bob Burton stated he had furnished Mr.
19 Arthur Clouse a copy of the sewer connection permit and a copy. of Mr.
20 Knob ler's cancelled check for payment of the tap permit.

22 Councilman Welch noted that since this is a Barrett Law sewer, the
23 determination of any policy or assessment should be directed to the
24 Board of Works since they administer the Barrett Law sewers. The
25 Sanitary Commissioners have no jurisdiction over Barrett Law sewers.
26 They could issue a tap permit to tap in but it would have to be
27 through the authorization of the Board of Works.

29 Ordinance No. 101-1980 was adopted by the following vote:
30 AYES: Elstro, Williams, Ahaus, Hankinson, Welch, Parker,
31 Paust and Mills. (8)

34 UNFINISHED BUSINESS
35 APPOINTMENT TO POLICE MERIT COMMISSION

37 President Mills announced Mr. Dick Tiernan has a conflict with the
38 meeting date of the Merit Commission and will not be able to fulfill
39 his appointment to this commission. Councilman Hankinson has contacted
40 Dr. John Egger and he has agreed to serve on this Commission.
41 President Mills announced with Council's full consent he would recom-
42 mend Dr. John Egger to serve on the Police Merit Commission with all
43 voting aye.

45 APPOINTMENT TO REDEVELOPMENT TRUSTEES

47 President Mills announced Mr. Tom Glennen has agreed to be re-appointed
48 to the Redevelopment Trustees. By unanimous voice vote the re-appoint-
49 ment was passed.
