HomeMy Public PortalAbout12-15-1980 71 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, DECEMBER 15, 1980 1 The Common Council of the City of Richmond, Indiana, met in regular 2 session December 15, 1980 at the hour of 7:30 p.m. in the Council Chambers 3 of the Municipal Building in said City. President Paust presided with 4 the following members present: Messrs. Elstro, Williams, Ahaus, 5 Hankinson, Welch, Parker, Carter and Mills. Absent: None. The 6 following business was had, to-wit: 7 8 DEVOTIONS 9 10 Councilman Carter gave devotions. 11 12 APPROVAL OF MINUTES 13 14 Councilman Williams moved the minutes of the previous meeting be approved 15 as prepared, seconded by Councilman Mills and on unanimous voice vote 16 the motion was carried. 17 18 REPORT TO BOARD OF WORKS 19 20 Councilman Elstro presented a copy of a letter from Mr. & Mrs. Roy 21 Cruse concerning a business being operated on the old Rauss greenhouse 22 property on Boston Pike and South 9th Street. The letter states an 23 electrical business is being operated in this location which is zoned 24 R-2. Councilman Elstro requested this business either be closed down 25 or have the owner come for a rezoning. 26 III 27 In response to Councilman Welch's question concerning the lighting of 28 the intersections of Interstate 70, Mr. Meredith noted the City agreed 29 to assume the responsibility of the power to these lights as of Decem- 30 ber 1, 1980 and on normal maintenance. The State will let the contract 31 the first of the year. There is a qualified contractor in the City. 32 There are two (2) not functioning due to burned out switches, which 33 are on order. The State is paying charges up to December 1, 1980. 34 35 Councilman Mills reported the Hankinson report on Ordinance No. 78- 36 1980 is complete and there will be a Committee of the Whole meeting 37 the first of January, so hopefully this Ordinance will appear on the 38 January- 19th agenda. 39 40 POLICE MERIT COMMISSION APPOINTMENT 41 42 Following balloting, Richard Tierman was selected as the Council 43 representative to the Police Merit Commission. 44 45 President Paust reminded members of their two (2) appointments to 46 the Convention-Tourism Bureau and one (1) appointment to the Redevel- 47 opment Trustees. 48 49 ORDINANCES ON 1ST READING 50 III 51 Councilman Mills moved to suspend the rules and read Ordinance Nos. 52 101-1980, 102-1980, 103-1980 and 104-1980 on first reading by title 53 only, seconded by Councilman Ahaus and on unanimous voice vote the 54 motion was carried. 55 56 The Clerk read on first reading by title only Ordinance No. 101-1980 - 57 AN ORDINANCE AMENDING CHAPTER 22 OF THE MUNICIPAL CODE, BEING ORDINANCE 58 NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF 59 RICHMOND, INDIANA ADOPTED JUNE 3, 1968, PROVIDING FOR THE REZONING OF 60 PROPERTY LOCATED AT 2001 U.S. 27 SOUTH FROM R-2 ONE FAMILY RESIDENCE 61 'DISTRICT TO C-2 COMMUNITY BUSINESS DISTRICT. 62 63 Councilman Mills moved to suspend the rules and read Ordinance No. 64 101-1980 on second reading, seconded by Councilman Welch and on Common Council Minutes Cont'd. December 15, 1980 Page 2 1 unanimous voice vote the motion was carried. 2 3 The Clerk read on second reading Ordinance No. 101-1980. 4 5 President Paust announced Ordinance No. 101-1980 is on public hearing. 6 7 Speaking against Ordinance No. 101-1980 was Mr. Arthur Clouse, 1943 8 Straightline Pike, noting sewers in the area were constructed under 9 the Barrett Law. 10 11 Speaking for Ordinance No. 101-1980 was Attorney Robert Burton, 25 12 North 7th Street, representing the petitioners. 13 14 It was noted the Plan Commission recommended approval by a vote of 15 ten to zero. 16 17 Following discussion of the sewers, Mr. Burton noted the petitioners 18 will abide by any ruling from the Sanitary District. 19 20 Councilman Hankinson moved for engrossment, seconded by Councilman 21 Elstro. The motion carried with Councilman Carter voting no. 22 23 ORDINANCE NO. 102-1980 24 25 The Clerk read on first reading by title only Ordinance No. 102-1980 - 26 AN ORDINANCE AMENDING CHAPTER 22 OF THE MUNICIPAL CODE, BEING ORDINANCE 27 NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF 28 RICHMOND, INDIANA ADOPTED JUNE 3, 1968, PROVIDING FOR THE REZONING OF 29 PROPERTY LOCATED AT 928 NORTH 12TH STREET AND 1140 NORTH "J" STREET 30 FROM R-3 ONE-TO-EIGHT FAMILY RESIDENCE DISTRICT TO C-2 COMMUNITY 31 BUSINESS DISTRICT. 32 33 Councilman Mills moved to suspend the rules and raad Ordinance No. 102- 34 1980 on second reading, seconded by Councilman Welch and on unanimous 35 voice vote the motion was carried. 36 37 The Clerk read on second reading Ordinance No. 102-1980. 38 39 President Paust announced Ordinance No. 102-1980 is on public hearing. 40 41 Speaking for Ordinance No. 102-1980 was Mr. Ted Lyons, Lyons Insurance 42 & Real Estate, 19 South 8th. 43 44 Councilman Mills moved for engrossment of Ordinance No. 102-1980, 45 seconded by Councilman Welch and on unanimous voice vote the motion 46 was carried. 47 48 Councilman Williams moved to suspend the rules and read Ordinance No. 49 102-1980 on third and final reading by title only, seconded by Council- 50 man Carter and on unanimous voice vote the motion was carried. 51 52 The Clerk read on third reading by title only Ordinance No. 102-1980. 53 54 Ordinance No. 102-1980 was adopted by the following vote: 55 AYES: Elstro, Williams, Ahaus, Hankinson, Welch, 56 Parker, Carter, Mills and Paust (9) 57 NOES: None (0) 58 59 ORDINANCE NO. 103-1980 60 61 The Clerk read on first reading by title only Ordinance No. 103-1980 - 62 AN ORDINANCE AUTHORIZING A SPECIAL USE IN AN M-1 LIGHT INDUSTRIAL 63 DISTRICT FOR A BUSINESS AND ADMINISTRATIVE OFFICES ON PROPERTY LOCATED 64 AT 25 BRIDGE AVENUE, PURSUANT TO ARTICLES 48 AND 34.013 OF CHAPTER 22 Common Council Minutes Cont'd. December 15, 1980 Page 3 1 OF THE MUNICIPAL CODE COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE 2 CITY OF RICHMOND, INDIANA. 3 4 Councilman Mills moved to suspend the rules and read Ordinance No. 103- 5 1980 on second reading, seconded by Councilman Hankinson and on 6 unanimous voice vote the motion was carried. 7 8 The Clerk read on second reading Ordinance No. 103-1980. 9 10 President Paust announced Ordinance No. 103-1980 is on public hearing. 11 12 Speaking for Ordinance No. 103-1980 was Attorney Gayle Gardner, 304 13 Peoples Building, representing Hoff co and City West Realty. In the 14 audience in support of this Ordinance were Charles Short, Larry Owens 15 and Lynn Galloway. 16 17 Councilman Mills moved for engrossment of Ordinance No. 103-1980, 18 seconded by Councilman Ahaus and on unanimous voice vote the motion 19 was carried. 20 21 Councilman Mills moved to suspend the rules and read Ordinance No. 22 103-1980 on third and final reading by title only, seconded by 23 Councilman Welch and on unanimous voice vote the motion was carried. 24 25 The Clerk read on third reading by title only Ordinance No. 103-1980. 26 27 Ordinance No. 103-1980 was adopted by the following vote: III 28 AYES: Elstro, Williams, Ahaus, Hankinson, Welch, 29 Parker, Carter, Mills and Paust (9) 30 NOES: - None (0) 31 32 ORDINANCE NO. 104-1980 33 34 The Clerk read on first reading by title only Ordinance No. 104-1980 - 35 -.-AN ORDINANCE AMENDING ORDINANCE NO. 60-1980 COMMONLY KNOWN AS THE 36 SALARY AND POSITION ORDINANCE OF THE CITY OF RICHMOND, INDIANA, 37 ADOPTED JULY 28, 1980. 38 39 Councilman Mills moved to suspend the rules and read Ordinance No. 40 104-1980 on second reading, seconded by Councilman Welch and on 41 unanimous voice vote the motion was carried. 42 43 The Clerk read on second reading Ordinance No. 104-1980. 44 45 President Paust announced Ordinance No. 104-1980 is on public hearing,. 46 47 There being no one speaking for or against this Ordinance, Councilman 48 Mills moved for engrossment, seconded by Councilman Welch and on 49 unanimous voice vote the motion was carried. 50 51 Councilman Mills moved to suspend the rules and read Ordinance No. III 52 104-1980 on third and final reading by title only, seconded by 53 Councilman Welch and on unanimous voice vote the motion was carried. 54 56 The Clerk read on third reading by title only Ordinance No. 104-1980. 57 58 Ordinance No. 104-1980 was adopted by the following vote: 59 AYES: Elstro, Williams, Ahaus, Hankinson, Welch 60 Parker, Carter, Mills and Paust (9) 61 NOES: None (0) 62 63 There being no further business the meeting was adjourned by general 64 consent. 65 66 Kenneth Paust 67 President 68 ATTEST: JoEllen Trimble 69 City Clerk 74 1
