CITY OF RICHMOND, INDIANA, DECEMBER 1, 1980 1 The Common Council of the City of Richmond, Indiana, met in regular 2 session December 1, 1980 at the hour of 7 :30 p.m. in the Council Chambers 3 in the Municipal Building in said City. President Paust presided with 4 the following members present: Messrs. Elstro, Williams, Ahaus, 5 Hankinson, Welch, Parker, Carter and Mills. Absent: None. The 6 following business was had, to-wit: 7 8 DEVOTIONS 9 10 Councilman Ahaus gave devotions. 11 12 APPROVAL OF MINUTES 13 14 Councilman Williams moved to approve the minutes of the previous 15 meeting as prepared, seconded by Councilman Mills and on unanimous 16 voice vote the motion was carried. 17 18 BOARD OF WORKS 19 20 Councilman Williams requested the Board of Public Works check con- 21 cerning the repaving of North 7th from North "A" to Ft. Wayne Avenue. 22 Councilman Williams stated this street was on the list to be paved. 23 Mr. Meredith will check. 24 25 ORDINANCES ON 2ND READING _ 26 27 City Attorney Ed Anderson stated the proof of publication was in order 28 for Ordinance Nos. 91-1980, 97-1980 and 98-1980. Councilman Mills 29 moved it be accepted and filed,' seconded by Councilman Welch and on 30 unanimous voice vote the motion was carried. 31 32 ORDINANCE NO. 91-1980 33 34 The Clerk read on second reading Ordinance No. 91-1980 - AN ORDINANCE 35 TO APPROPRIATE WITHIN THE PARKING METER FUND. 36 37 President Paust announced Ordinance No. 91-1980 is on public hearing. 38 There being no one speaking for or against this ordinance, Councilman 39 Mills moved for engrossment, seconded by Councilman Welch and on 40 unanimous voice vote the motion was carried. 41 • 42 Councilman Mills moved to suspend the rules and read Ordinance No. 91- 43 1980 on third and final reading by title only, seconded by Councilman 44 Parker and on unanimous voice vote the motion was carried. 45 46 The Clerk read on third reading by title only Ordinance 91-1980. 47 48 Ordinance No.. 91-1980 was adopted by the following vote: 49 AYES: Elstro, Williams, Ahaus, Hankinson, Welch, Parker, Carter 50 Paust (8) 51 NOES: Mills (1) 52 53 ORDINANCE NO. 97-1980 54 55 The Clerk read on second reading Ordinance NO. 97-1980 - AN ORDINANCE 56 TO APPROPRIATE WITHIN THE PARK & RECREATION FUND. 57 58 President Paust announced Ordinance No. 97-1980 is on public hearing. 59 60 There being no one speaking for or against Ordinance No. 97-1980 61 Councilman Williams moved for engrossment, seconded by Councilman Ahaus 62 and on unanimous voice vote the motion was carried. 63 64 Councilman Williams moved to suspend the rules and read Ordinance No. 65 97-1980 on third and final reading by title only, seconded by 68 Common Council Minutes Cont'd. (9) 8 NOES; None (0) 9 10 ORDINANCE NO. 98-1980 11 12 The Clerk read on second reading Ordinance No. 98-1980 - AN ORDINANCE 13 TO APPROPRIATE WITHIN THE GENERAL FUND. 14 15 President Paust announced Ordinance No. 98-1980 is on public hearing. 16 There being no one speaking for or against this ordinance Councilman 17 Mills moved for engrossment, seconded by Councilman Welch and on 18 unanimous voice vote the motion was carried. 19 20 Councilman Mills moved to suspend the rules and read Ordinance No. 98- 21 1980 on third and final reading by title only, seconded by Councilman 22 Parker and on unanimous voice vote the motion was carried. 23 24 The Clerk read on third reading by title only Ordinance No. 98-1980. 25 26 Ordinance No. 98-1980 was adopted by the following vote: 27 AYES: Elstro, Williams, Ahaus, Hankinson, Welch, Parker, Carter, 28 Mills and Paust (9) 29 NOES: None (0) 30 31 ORDINANCE NO. 69-1980 32 33 Councilman Mills moved to suspend the rules and read Ordinance No. 69- 34 1980 on third reading by title only, seconded by Councilman Elstro and 35 on unanimous voice vote the motion was carried. 36 37 The Clerk read on third reading by title only Ordinance No. 69-1980 - 38 AN ORDINANCE ANNEXING CERTAIN TERRITORY PLATTED AND UNPLATTED, LEGALLY 39 DESCRIBING THE AREA TO BE ANNEXED, PROVIDING FOR THE PUBLICATION THEREOF, 40 AND FIXING THE TIME WHEN THE ANNEXATION SHALL TAKE EFFECT. 41 42 Councilman Carter stated he endorses the idea of annexation if done right. 43 He concludes the City has no plans to furnish sewers for the annexed 44 area. It is his belief that every city has a responsibility to furnish 45 the four basic rights to every citizen. This includes fire and police 46 protection, sewer facilities and good streets and roads. Although most 47 of the property owners have sanitary sewers, some do not. If the Ordi- 48 nance passes, in all probability the Court will have the final say as 49 to whether this plan is adequate or fair. For the above reasons, he 50 stated he finds it necessary to cast his vote against Ordinance No. 69. 51 52 Councilman Elstro stated that a letter received from Mr. Bill Smith 53 stated that the annexation would result in a loss of tax revenue to 54 the Centerville schools. He thinks the day will come when Center 1, 55 2 and 3 will be annexed, but at the present time he feels areas in the 56 City need improvement and will be voting against the Ordinance. 57 58 Councilman Williams said there are areas in the City needing improvement. 59 He fears the Federal Revenue sharing may be cut and that the taxation 60 will not offset the money spent on extra police and fire protection. 61 He felt there is not enough money to go around and would vote against 62 the Ordinance. 63 64 Councilman Hankinson remarked he feels that the people residing in a 69 Common Council Minutes Cont'd. December 1, 1980 Page 3 1 certain area should have some control of their own destiny, and would 2 be voting against the Ordinance. 3 4 Ordinance No. 69-1980 was defeated by the following vote: 5 AYES: Ahaus, Welch, Mills and Paust (4) 6 NOES: Elstro, Williams, Hankinson, Parker and, Carter (5) 7 8 COUNCIL COMMITTEE APPOINTMENTS 9 10 President Paust reminded Council !members of Council's appointment to 11 the Police Merit Commission and appointments to the Tourism and Con- 12 vention Board. Councilman Mills suggested Charles McConnell or 13 Richard Tiernan for the Merit Commission and Councilman Hankinson _ 14 ' suggested Dr. John Egger.
