HomeMy Public PortalAbout10-10-1980 51 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, OCTOBER 20, 1980 1 The Common Council of the City of Richmond, Indiana, met in regular 2 session October 20, 1980 at the hour of 7:30 p.m. in the Council Chambers 3 in the Municipal Building in said City. President Paust presided with the 4 following members present: Messrs. Elstro, Williams, Ahaus, Hankinson, 5 Welch, Parker, Carter and Mills. Absent: None. The following business 6 was had, to-wit: 7 8 DEVOTIONS 9 10 President Paust gave devotions. 11 12 APPROVAL OF MINUTES 13 14 Councilman Williams moved to approve the minutes of the previous meeting 15 as prepared, seconded by Councilman Mills and on unanimous voice vote 16 the motion was carried. 17 18 RESOLUTION NO. 18-1980 19 20 Councilman Mills moved to suspend the rules and read Resolution No. 18- 21 1980 by title only, seconded by Councilman Elstro and on unanimous 22 voice vote the motion was carried. 23 24 The Clerk read by title only Resolution No. 18-1980 - A RESOLUTION TO 25 TRANSFER WITHIN THE GENERAL FUND. 26 27 Councilman Elstro moved for adoption of Resolution No. 18-1980, seconded 28 by Councilman Mills and on unanimous voice vote the motion was carried. 29 30 REPORT ON FORMATION MEETING OF STATE ENERGY COMMITTEE 31 32 Councilman Welch reported he attended a meeting in Indianapolis last 33 Friday held by the Indiana Association of Cities and Towns for the 34 formation of an energy advisory committee. Reports were heard from 35 other cities represented on the committee in connection with energy saving 36 programs, sounding out purposes for this committee to become associated 37 with. The main three (3) purposes were: (1) to be a sounding board 38 ' for all the cities in Indiana (2) to draft a statement of purpose 39 showing intent of the committee (3) to advise the Legislature on any 40 needed legislation that should be brought before them pertaining to 41 energy. The committee will meet every quarter, meeting more often after 42 the first of the year when the Legislature is in session. Meetings 43 will be held with members of the Legislative Energy Committee and the 44 Energy Departmentjto form new legislation for tax credits and energy 45 conservation. 46 47 ORDINANCES ON 1ST READING 48 49 Councilman Mills moved to suspend the rules and read Ordinance Nos. 50 85-1980, 86-1980, and 87-1980 on first reading by title only, seconded 51 by Councilman Welch and on unanimous voice vote the motion was carried. 52 53 ORDINANCE NO. 85-1980 54 55 The Clerk read on first reading by title only Ordinance No. 85-1980 - 56 AN ORDINANCE TO ANNEX TO THE CITY OF RICHMOND, INDIANA CERTAIN CONTIGUOUS 57 TERRITORY, ADJACENT AND ABUTTING• THERETO, DESCRIBING THE SAME, PROVIDING 58 FOR THE PUBLICATION THEREOF AND FIXING THE TIME WHEN THE SAME SHALL 59 TAKE EFFECT. 60 61 Councilman Mills moved to suspend the rules and read Ordinance No. 85- 62 1980 on second reading, seconded by Councilman Ahaus and on unanimous 63 voice vote the motion was carried. October 20, 1980 - Page 2, 1980 1 The Clerk read on second reading Ordinance No. 85-1980. 2 3 President Paust announced Ordinance No. 85-1980 is on public hearing. 4 In answer to Councilman Carter's question as to this ordinance being 5 referred to the Plan Commission, President Paust stated this is a 6 voluntary annexation. Concerning the platting of the ground, it was 7 noted this annexation is for vacant land. 8 9 There being no one speaking for or against Ordinance No. 85-1980, 10 Councilman Mills moved for engrossment, seconded by Councilman Ahaus 11 and on unanimous voice vote the motion was carried. 12 13 President Paust announced if there are no objections Ordinance No. 85- 14 1980 will remain as engrossed until the next meeting to give Councilmen 15 time to find any answers they may be seeking. 16 17 ORDINANCE NO. 86-1980 18 19 The Clerk read on first reading by title only Ordinance No. 86-1980 - 20 AN ORDINANCE TO TRANSFER WITHIN THE MUNICIPAL AIRPORT FUND. 21 22 Councilman Mills moved to suspend the rules and read Ordinance No. 86- 23 1980 on second reading, seconded by Councilman Welch and on unanimous 24 voice vote the motion was carried. 25 26 The Clerk read on second reading Ordinance No. 86-1980. 27 28 President Paust announced Ordinance No. 86-1980 is on public hearing. 29 30 There being no one speaking for or against Ordinance No. 86-1980, 31 Councilman Mills moved for engrossment, seconded by Councilman Welch and 32 on unanimous voice vote the motion was carried. 33 34 Councilman Ahaus moved to suspend the rules and read Ordinance No. 86- 35 1980 on third and final reading by title only, seconded by Councilman 36 Parker and on unanimous voice vote the motion was carried. 37 38 The Clerk read on third reading by title only Ordinance No. 86-1980. 39 40 Ordinance No. 86-1980 was adopted by the following vote: 41 AYES: Elstro, Williams, Ahaus, Hankinson, Welch, Parker, Carter, 42 Mills, Paust (9) 43 NOES: None (0) 44 45 ORDINANCE NO. 87-1980 46 47 The Clerk read on first reading by title only Ordinance No. 87-1980 - 48 AN ORDINANCE TO TRANSFER WITHIN THE MOTOR VEHICLE HIGHWAY FUND. 49 50 Councilman Mills moved to suspend the rules and read Ordinance No. 87-1980 51 on second reading, seconded by Councilman Welch and on unanimous voice 52 vote the motion was carried. 53 54 The Clerk read on second reading Ordinance No. 87-1980. 55 56 President Paust announced Ordinance No. 87-1980 is on public hearing. 57 58 There being no one speaking for or against Ordinance No. 87-1980, 59 Councilman Mills moved for engrossment, seconded by Councilman Welch 60 and on unanimous voice vote the motion was carried. 61 62 Councilman Mills moved to suspend the rules and read Ordinance No. 87- 63 1980 on third and final reading by title only, seconded by Councilman 64 Welch and on unanimous voice vote the motion was carried. 53 Common Council Minutes Cont'd. October 20, 1980 Page 3 1 The Clerk read on third reading by title only Ordinance No. 87-1980. 2 3 Ordinance No. 87-1980 was adopted by the following vote: 4 AYES: Elstro, Williams, Ahaus, Hankinson, Welch, Parker, Carter, 5 Mills, Paust (9) 6 NOES: None (0) 7 8 ORDINANCES ON 2ND READING 9 10 ORDINANCE NO. 81-1980 11 12 The Clerk read on second reading Ordinance No. 81-1980 - AN ORDINANCE 13 AMENDING CHAPTER 92, FIRE PREVENTION, TITLE IX OF THE CODE OF ORDINANCES 14 OF THE CITY OF RICHMOND, INDIANA TO REQUIRE INSTALLATION OF SMOKE 15 DETECTORS AND ADDING THERETO A NEW SECTION 92.11 FIRE DETECTION 16 EQUIPMENT AND FIXING THE TIME WHEN THE SAME SHALL TAKE EFFECT. 17 18 Chairman of the Public Safety Committee Welch announced his committee 19 held a hearing last week along with the Fire Department to discuss 20 this ordinance. The concern was the statement that it was originally 21 directed in the ordinance toward the-private residents. There were 22 questions concerning the total effect this ordinance might have to 23 nursing homes, hospitals, motels and other various establishments. 24 The Committee directed Bill Smith, Assistant Fire Chief, to contact 25 these people to survey what buildings at present have smoke detectors, 26 to obtain their basic comments and to invite them here tonight. It 27 was the recommendation of the Committee to bring this Ordinance back 28 on second reading tonight and it be held there until the next meeting 29 for citizen input. 30 31 President Paust announced Ordinance No. 81-1980 is on public hearing. 32 33 Speaking in favor of Ordinance No. 81-1980 was Assistant Fire Chief 34 Bill Smith who read letters from the Chamber of Commerce and the Fire 35 Department and gave a report of his survey. Mr. John Jones, Country 36 Club Apartments, asked if wired in, plugged in and battery operated 37 detectors would all be acceptable under the Ordinance. President 38 Paust stated either type qualifies. 39 40 President Paust announced Ordinance No. 81-1980 is held on public 41 hearing. 42 43 ORDINANCES ON 3RD READING 44 45 ORDINANCE NO. 75-1980 46 47 Councilman Mills moved to suspend the rules and read Ordinance No. 75- 48 1980 on third and final reading by title only, seconded by Councilman 49 Elstro and on unanimous voice vote the motion was carried. 50 51 The Clerk read on third reading by title only Ordinance No. 75-1980 - 52 AN ORDINANCE TO APPROPRIATE FROM THE LOCAL ROAD AND STREET FUND. 53 54 President Paust read letters from himself to the Mayor, the Mayor's 55 answer, a letter from the Mayor to the Butler, Fairman and Seufert, 56 Inc. Engineering firm, and a letter from the Engineering firm.
