HomeMy Public PortalAbout09-02-1980 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, SEPTEMBER 2, 1980 1 The Common Council of the City of Richmond, Indiana, met in regular 2 session September 2, 1980 at the hour of 7:30 p.m. in the Council 3 Chambers in the Municipal Building in said City. The following members 4 were present: Messrs. Elstro, Williams, Ahaus, Hankinson, Welch, 5 Parker and Carter. Absent: Messrs. Mills and Paust. The following 6 business was had, to-wit: 7 8 Councilman Welch gave devotions. 9 10 PRESIDENT PRO-TEM 11 12 Councilman Ahaus stated that in the absence of the President and 13 President Pro-Tem he maintained the chair; however, a motion is in 14 order to select a President Pro-Tem to run this meeting. Councilman 15 Ahaus stated he would assume that responsibility if Council so desired. 16 Councilman Parker so moved, seconded by Councilman Williams and on 17 unanimous voice vote the motion was carried. 18 19 APPROVAL OF MINUTES 20 21 Councilman Williams moved to approve the minutes of the previous 22 meeting as prepared, seconded by Councilman Welch and on unanimous 23 voice vote the motion was carried. 24 25 ORDINANCES ON FIRST READING 26 27 Councilman Elstro moved to suspend the rules and read Ordinance Nos. 28 72-1980, 73-1980, 74-1980, 75-1980, 76-1980 and 77-1980 on first 29 reading by title only, seconded by Councilman Welch and on unanimous 30 voice vote the motion was carried. 31 32 ORDINANCE NO. 72-1980 33 34 The Clerk read on first reading by title only Ordinance No. 72-1980 - 35 AN ORDINANCE ENACTING A CODE OF ORDINANCES FOR THE CITY OF RICHMOND, 36 INDIANA, REVISING, AMENDING, RE-STATING, CODIFYING, AND COMPILING 37 CERTAIN EXISTING GENERAL ORDINANCES OF THE CITY DEALING WITH SUBJECTS 38 EMBRACED IN SAID CODE. 39 40 City Attorney Ed Anderson stated he had suggested this Ordinance be 41 referred to the Committee of the Whole; however, if Council prefers 42 not to do this, the Ordinance can be passed tonight. The Ordinance 43 recodifies all the Ordinances and amendments. 44 45 Councilman Carter moved to suspend the rules and read Ordinance No. 46 72-1980 on second reading, seconded by Councilman Parker and on 47 unanimous voice vote the motion was carried. 48 49 The Clerk read on second reading Ordinance No. 72-1980. 50 51 President Pro-Tem Ahaus announced Ordinance No. 71-1980 is on public 52 hearing. 53 54 There being no one speaking for or against Ordinance No. 72-1980 55 Councilman Elstro moved for engrossment, seconded by Councilman 56 Parker and on unanimous voice vote the motion was carried. 57 58 Councilman Elstro moved to suspend the rules and read Ordinance No. 59 72-1980 on third and final reading by title only, seconded by Council- 60 man Welch and on unanimous voice vote the motion was carried. 61 62 The Clerk read on third reading by title only Ordinance No. 72-1980. 63 64 Ordinance No. 72-1980 was adopted by the following vote: 40 Common Council Minutes Cont'd. (7) 2 NOES: None (0) 3 4 ORDINANCE NO. 73-1980 5 6 The Clerk read on first reading by title only Ordinance No. 73-1980 - 7 AN ORDINANCE AUTHORIZING A SPECIAL USE IN A R-2 SINGLE-FAMILY RESIDENCE 8 DISTRICT FOR A NURSING HOME ON PROPERTY LOCATED AT 1811 AND 1813 SOUTH 9 NINTH STREET, PURSUANT TO ARTICLES 48 AND 20.017 OF CHAPTER 22 OF THE 10 MUNICIPAL CODE COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF 11 RICHMOND, INDIANA. 12 13 President Pro-Tem noted the recommendation from the Plan Commission 14 which states the Commission conducted a public hearing on August 26, 15 1980 and voted ten (10) to (0) to recommend the Special Use. 16 17 Councilman Welch moved to suspend the rules and move Ordinance No. 73- 18 1980 to second reading , seconded by Councilman Williams. Councilman 19 Elstro voted no. 20 21 ORDINANCE NO, i4-1980 22 23 The Clerk read on first reading by title only Ordinance No. 74-1980 - 24 AN ORDINANCE TO APPROPRIATE WITHIN THE MUNICIPAL AIRPORI'FUND. 25 26 President Pro-Tem Ahaus announced Ordinance No. 74-1980 has to be 27 advertised. 28 29 ORDINANCE NO. 75-1980 30 31 The Clerk read on first reading by title only Ordinance No. 75-1980 - 32 AN ORDINANCE TO APPROPRIATE FROM THE LOCAL ROAD AND STREET FUND. 33 34 President Pro-Tem Ahaus announced Ordinance No. 75-1980 has to be 35 advertised. 36 37 ORDINANCE NO. 76-1980 38 39 The Clerk read on first reading by title only Ordinance No. 76-1980 - 40 AN ORDINANCE TO TRANSFER WITHIN THE GENERAL FUND. 41 42 Councilman Welch moved to suspend the rules and read Ordinance No. 76- 43 1980 on second reading, seconded by Councilman Williams and on unanimous 44 voice vote the motion was carried. 45 46 The Clerk read on second reading Ordinance No. 76-1980. 47 48 President Pro-Tem Ahaus announced Ordinance No. 76-1980 is on public 49 hearing. 50 51 There being no one speaking for or against Ordinance No. 76-1980 52 Councilman Elstro moved for engrossment, seconded by Councilman 53 Welch and on unanimous voice vote the motion was carried. 54 55 Councilman Elstro moved to suspend the rules and read Ordinance No. 56 76-1980 on third and final reading by title only, seconded by Council- 57 man Welch and on unanimous voice vote the motion was carried. 58 59 The Clerk read on third reading by title only Ordinance No. 76-1980. 60 61 Ordinance No. 76-1980 was adopted by the following vote: 62 AYES: Elstro, Williams, Ahaus, Hankinson, Welch, Parker. September 2, 1980 Page 3 1 ORDINANCE NO. 77-1980 2 3 The Clerk read on first reading by title only Ordinance No. 77-1980 - 4 5 AN ORDINANCE TO APPROPRIATE WITHIN THE GENERAL FUND. 6 President Pro-Tem Ahaus announced Ordinance No. 77-1980 has to be 7 advertised. 8 9 Councilman Carter requested some people in the audience be allowed 10 to talk about Local Road and Street Funds in Ordinance No. 75-1980. 11 Council agreed.
