HomeMy Public PortalAbout05-19-1980 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MAY 19, 1980 1 The Common Council of the City of Richmond, Indiana, met in regular 2 session May 19, 1980 at the hour of 7:30 p.m. in the Council Chambers 3 in the Municipal Building in said City. President Paust presided with 4 the following members present: Messrs. Elstro, Williams, Ahaus, Hank- 5 inson, Welch, Parker and Mills. Absent: Messr. Carter. The following 6 business was had, to-wit: 7 8 Councilman Welch gave devotions. 9 10 Councilman Williams moved to approve the minutes of the previous meeting 11 as prepared, seconded by Councilman Mills and on unanimous voice vote 12 the motion was carried. 13 14 Councilman Mills moved to suspend the rules and read Resolution No. 11- 15 1980 by title only, seconded by Councilman Parker and on unanimous voice 16 vote the motion was carried. 17 18 The Clerk read by title only Resolution No. 11-1980 - A RESOLUTION 19 AUTHORIZING THE FILING OF AN APPLICATION WITH THE DEPARTMENT OF HOUSING 20 AND URBAN DEVELOPMENT, FOR COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS, AS 21 PROVIDED IN TITLE I OF THE COMMUNITY DEVELOPMENT ACT 1974. P.L. 93-383. 22 23 Speaking- in favor of Resolution No.• 1L-1980 was Tim Ryder, 1804 S.W. "D", 24 Director of Community Development. 25 26 Also speaking in regard to Resolution No. 11-1980 were Rev. George 27 White, 914 Liberty Av. , Bobby Smith, 1109 No. "I" and Marie Johnson, 28 1105 No. 15th. III 29 30 Councilman Williams moved for adoption of Resolution No. 11-1980, 31 seconded by Councilman Welch and on a voice vote the motion was carried 32 with Councilman Elstro voting no. 33 34 Under miscellaneous business., speakers regarding the River Court area 35 were Bobby Smith, 1109 No. "I", Michael Wagers, 1130 N. 12th and Nanny 36 Florence, 1 River Court. 37 38 Addressing himself to the Needmore area was Director of Community De- 39 velopment, Tim Ryder. Mr. Ryder stated they are going to bid South 40 15th and South 16th for storm sewer improvements, and are negotiating 41 with the railroad to be allowed to dump the water on their property. 42 43 Speaking to Council was Carl Love, 2013 So. 15th St. , and also repre- 44 senting other Needmore - area residents. 45 46 Also speaking regarding Needmore area were William Grimes, 1423 So. "U" 47 and Noel Chamberlain, 2016 So. 15th. 48 49 Councilman Mills moved to read Ordinance Nos. 40, 41 , 42, 43, 44, 45, 50 46, 47, 48, 49, 50, 51 and 52 on first reading by title only, seconded 51 by Councilman Welch and on unanimous voice vote the motion was carried. 52 53 The Clerk read on first reading by title only Ordinance No. 40-1980 - 54 AN ORDINANCE TO APPROPRIATE FROM THE GENERAL FUND TO THE UNSAFE 55 BUILDING FUND. 56 57 President Paust announced Ordinance No. 40-1980 has to be advertised. 58 59 The Clerk read on first reading by title only Ordinance No. 41-1980 - 60 AN ORDINANCE TO APPROPRIATE FROM THE FEDERAL REVENUE SHARING TRUST FUND. 61 62 President Paust announced Ordinance No. 41-1980 has to be advertised. 63 64 The Clerk read on first reading by title only Ordinance No. 42-1980 - 65 AN ORDINANCE TO APPROPRIATE FROM THE FEDERAL REVENUE SHARING TRUST FUND. 6 Common Council Minutes Cont'd. The 3 vote being eight (8) to zero (0) in favor of passage. 4 5 The Clerk read on first reading by title only Ordinance No. 52-1980 - 6 AN ORDINANCE TO TRANSFER WITHIN THE GENERAL FUND. 7 8 Councilman Mills moved to suspend the rules and move Ordinance No. 52- 9 1980 to second reading, seconded by Councilman Welch and on unanimous 10 voice vote the motion was carried. 11 12 The Clerk read on second reading Ordinance No. 52-1980. 13 14 Councilman Ahaus moved for engrossment, seconded by Councilman Welch 15 and on unanimous voice vote the motion was carried. 16 17 Councilman Ahaus moved to suspend the rules and read Ordinance No. 52- 18 1980 on third and final reading by title only, seconded by Councilman 19 Parker and on unanimous voice vote the motion was carried. 20 21 The Clerk read on third reading by title only Ordinance No. 52-1980. 22 23 Ordinance No. 52-1980 was placed on final passage or rejection and on 24 a call of the roll the following was recorded. Ayes: Elstro, Williams, 25 Ahaus, Hankinson, Welch, Parker, Mills and Paust. Noes: None. The vote 26 being eight (8) to zero (0) .in favor of passage. 27 28 The Clerk read on second reading Ordinance No. 33-1980 - AN ORDINANCE 29 TO REDUCE WITHIN THE MOTOR VEHICLE HIGHWAY FUND. 30 31 City Attorney Ed Anderson examined proof of publication for Ordinance 32 No. 33-1980 and Ordinance No. 35-1980 and found them to be in order'. 33 34 Councilman Mills moved the proof be accepted and filed, seconded by 35 Councilman Welch and on unanimous voice vote the motion was carried. 36 37 Councilman Mills moved for engrossment, seconded by Councilman 38 Parker and on unanimous voice vote the motion was carried. 39 40 Councilman Mills moved to suspend the rules and read Ordinance No. 33- 41 1980 on third and final reading by title only, seconded by Councilman 42 Hankinson and on unanimous voice vote the motion was carried. 43 44 The Clerk read on third reading by title only Ordinance No. 33-1980. 45 46 Ordinance No. 33-1980 was placed on final passage or rejection and on 47 a call of the roll the following was recorded. Ayes: Elstro, Williams, 48 Ahaus, Hankinson, Welch, Parker, Mills and Paust. Noes: None. The 49 vote being eight (8) to zero (0) in favor of passage. 50 51 The Clerk read on second reading Ordinance No. 35-1980 - AN ORDINANCE 52 , TO APPROPRIATE WITHIN THE GENERAL FUND. 53 54 Councilman Welch moved for engrossment, seconded by Councilman Hankin- 55 son and on unanimous voice vote the motion was carried. 56 57 Councilman Welch moved to suspend the rules and read Ordinance No. 35- 58 1980 on third and final reading by title only, seconded by Councilman 59 Parker and on unanimous voice vote the motion was carried. 60 61 The Clerk read on third reading by title only Ordinance No. 35-1980. 62 63 Ordinance No. 35-1980 was placed on final passage or rejection and on 64 a call of the roll the following was recorded. The vote 2 being eight (8) to zero (0)in favor of passage. 3 4 The Clerk read on second reading Ordinance No. 38-1980 - AN ORDINANCE 5 AMENDING ORDINANCE NO. 2440-1969 AND AUTHORIZING A SPECIAL USE FOR A 6 RESIDENTIAL DEVELOPMENT UNIT PROJECT LOCATED WEST OF WINDING RIDGE 7 DRIVE ON 17.401 ACRES PURSUANT TO ARTICLES 48 AND 45 OF CHAPTER 22 OF 8 THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE 9 ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA. 10 11 Councilman Elstro moved to amend Ordinance No. 38-1980 by deleting para- 12 graph "f" of Section 3 which reads "The owner shall erect a safety fence 13 around the storm water detention area on a line no lower than the 1055 14 elevation as shown on the topography map." Seconding the motion was 15 Councilman Welch, and on a voice vote the motion was carried with 16 Councilman Parker voting no. 17 18 Councilman Welch moved for engrossment, seconded by Councilman Hankin- 19 son and on unanimous voice vote the motion was carried.. 20 21 Councilman Welch moved to suspend the rules and read Amended Ordinance 22 No. 38-1980 on third and final reading by title only, seconded by Coun- 23 cilman Williams and on unanimous voice vote the motion was carried. 24 25 The Clerk read on third reading by title only Amended Ordinance No. 38- 26 1980. 27 28 Amended Ordinance No. 38-1980 was placed on final passage or rejection and 29 on a call of the roll the following was recorded: Ayes: Elstro, Williams 30 Ahaus, Hankinson, Welch, Parker and Paust. Noes: Mills. The vote being 31 seven (7) to one (1) in favor of passage of Amended Ordinance No. 38-1980. 32 33 Councilman Williams read a letter to the Council from Rev.
