PROCEEDINGS OF THE COMMON COUNCIL OF THE
CITY OF RICHMOND, INDIANA, MAY 5, 1980

1 The Common Council of the City of Richmond,, Indiana, met in regular -s=
2 session May 5, 1980 at the hour of 7:30 p.m. in the Council Chambers
3 in the Municipal Building in said City. President Paust presided with
4 the following members present: Messrs. Elstro, Ahaus, Hankinson, Welch,
5 Parker and Carter. Absent: Messrs. Williams and Mills. The following
6 business was had, to-wit:

8 Councilman Ahaus gave devotions.

10 Councilman Welch moved to approve the minutes of the previous meeting
11 as prepared, seconded by Councilman Parker and on unanimous voice vote
12 the motion was carried.

14 Councilman Elstro moved to suspend the rules and read Resolution No.
15 10-1980 by title only, seconded by Councilman Parker and on unanimous
16 voice vote the motion was carried.

18 The Clerk read by title only Resolution- No. 10-1980 - A RESOLUTION TO
19 TRANSFER WITHIN THE GENERAL FUND.

21 Councilman Elstro moved for adoption of Resolution No. 10-1980, second-
22 ed by Councilman Carter and on unanimous voice vote the motion was
2g carried.

•25 Councilman Carter stated he called the Street Department to investigate
26 the condition of the sidewalk at 1011 Peacock Road. The owner has since
27 fixed the sidewalk and he requested Mr. Haynes be so notified. He
28 stated the owner is asking reimbursement of his costs and Mr. Meredith
29 stated there are no provisions for this.

31 President Paust announced Council has the responsibility of selecting
32 three (3) members to the Board of Managers of the Wayne County Conven-
33 tion-Tourism Bureau. One is to be from the Chamber of Commerce Board
34 of Directors, one from the hotel-motel industry and one from the travel
35 industry. Councilman Ahaus nominated the following: Mr. Richard Ze-
36 browski, travel; Mr. Fred Droddy, motel; and Mr. Dave Runyon, Chamber
37 Board. There being no further nominations, Councilman Hankinson moved
38 acceptance of the nominations, seconded by Councilman Parker and on
39 unanimous voice vote the motion was carried.

41 Mr. Perry Maul, Director of the Institute for Urban Transportation for
42 . Indiana University presented a films and talk on Section 18. "This film
43 is available to the public through Mr. Matt Nepote's office.

45 Councilman Elstro moved to suspend the rules and read Ordinance Nos. •
46 37-1980„ 38-1980 and 39-1980 on first reading by title only, seconded
47 " by Councilman Welch and. on unanimous voice vote the motion was carried.

50 AN ORDINANCE TO AMEND ORDINANCE NO. 64-1979 FIXING SALARIES FOR APPOINT-
51 ED OFFICERS AND EMPLOYEES OF THE CITY OF RICHMOND, INDIANA,- FOR THE
52 FISCAL YEAR BEGINNING JANUARY 1, 1980 AND ENDING DECEMBER 31, 1980.
53 Councilman Elstro moved to suspend the rules and move Ordinance No. 37-
54 1980 to second reading, seconded by.Councilman Welch and on unanimous
55 vote the motion was carried.

8 Ordinance No. 37-1980 was placed on final passage or rejection and on
9 a call of the roll the following was recorded: Ayes: Elstro, Ahaus,
10 Hankinson, Welch, Parker, Carter and Paust. Noes: None. The vote
11 being seven (7) to zero (0) in favor of passage of Ordinance No. 37-
12 1980.

14 The Clerk read on first reading by title only Ordinance No. 38-1980 -
15 AN ORDINANCE AMENDING ORDINANCE NO. 2440-1969 AND AUTHORIZING A SPECIAL
16 USE FOR A RESIDENTIAL DEVELOPMENT UNIT PROJECT LOCATED WEST OF WINDING
17 RIDGE DRIVE ON 17.401 ACRES PURSUANT TO ARTICLES 48 AND 45 OF CHAPTER
18 22 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968 COMMONLY KNOWN
19 AS THE ZONING ORFINANCE OF THE CITY OF RICHMOND, INDIANA.

21 Councilman Elstro moved to suspend the rules and read Ordinance No. 38-
22 1980 on second reading, seconded by Councilman Welch and on unanimous
23 voice vote the motion was carried.

26 President Paust noted a letter from the Plan Commission with the vote

28 being eight (8) to three (3) to recommend passage with conditions
29 specified in Section 3.

31 President Paust announced Ordinance No. 38-1980 is on public hearing.
32 Speaking against Section 3. (f) The owner shall erect a safety fence
33 around the storm water detention area on line no lower than the 1055
34 elevation as shown on the topography map, was Mr. Dick Clifford of
35 Gene B. Glick Co. His company feels it is unnecessary to erect a
36 fence around the detention basin.

38 President Paust announced Ordinance No. 38-1980 will remain on second
39 reading.

44 CITY OF RICHMOND, INDIANA ADOPTED JUNE 3, 1968, PROVIDING FOR THE
45 REZONING OF PROPERTY LOCATED AT 3712 NATIONAL ROAD WEST FROM C-4
46 GENERAL BUSINESS DISTRICT AND R-1 SINGLE FAMILY RESIDENCE DISTRICT
47 TO C-4 GENERAL BUSINESS DISTRICT, AND ALSO PROVIDING FOR THE REZON-
48 ING OF PROPERTY LOCATED AT 3712 NATIONAL ROAD WEST FROM R-1 SINGLE FAMILY

51 Councilman Welch moved to suspend the rules and read Ordinance No. 39-
52 1980 on second reading, seconded by Councilman Elstro and on unanimous
53 voice vote the motion was carried.

2 seconded by Councilman Parker and on unanimous voice vote the motion
3 was carried.

5 Councilman Ahaus moved to suspend the rules and read Ordinance No. 39-
6 1980 on third and final reading by title only, seconded by Councilman
7 Welch and on unanimous voice vote the motion was carried.

11 Ordinance No. 39-1980 was placed on final passage or rejection and on a

17 ANNEXING CERTAIN CONTIGUOUS TERRITORY PLATTED AND UNPLATTED, LEGALLY
18 DESCRIBING THE ANNEXED TERRITORY, PROVIDING FOR THE PUBLICATION THERE-
19 OF, AND FIXING THE TIME WHEN SAME SHALL TAKE EFFECT.

21 President Paust noted a letter from the Plan Commission with the vote
22 being ten (10) to zero (0) in favor of passage of Ordinance No.
23 32-1980.

25 President Faust announced Ordinance No. 32-1980 is on public hearing.
26 Speaking for Ordinance No. 32-1980 was City Plan Director Bob Goodwin.
27 He requested the Fiscal Plan be adopted by Resolution to accompany the
28 Ordinance. Councilman Ahaus moved to accept the Fiscal Plan as presented
29 for Ordinance No. 32-1980, seconded by Councilman Hankinson and on
30 unanimous voice vote the motion was carried.

32 Councilman Welch moved for engrossment of Ordinance No. 32-1980,
33 seconded by Councilman Ahaus and on unanimous voice vote the motion
34 was carried.

36 Councilman Ahaus moved to suspend the rules and read Ordinance No. 32-
37 1980 on third and final reading by title only, seconded by Councilman
38 Welch and on unanimous voice vote the motion was carried.

9 There being no one speaking for or against Ordinance No. 36-1980
10 Councilman Carter moved for engrossment, seconded by Councilman Parker
11 and on unanimous voice vote the motion was carried.

13 Councilman Carter moved to suspend the rules and read Ordinance No. 36-
14 1980 on third and final reading by title only, seconded by Councilman
15 Parker and on unanimous voice vote the motion was carried.
