HomeMy Public PortalAbout05-05-1980 1 • PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MAY 5, 1980 • 1 The Common Council of the City of Richmond,, Indiana, met in regular -s= 2 session May 5, 1980 at the hour of 7:30 p.m. in the Council Chambers 3 in the Municipal Building in said City. President Paust presided with 4 the following members present: Messrs. Elstro, Ahaus, Hankinson, Welch, 5 Parker and Carter. Absent: Messrs. Williams and Mills. The following 6 business was had, to-wit: 7 8 Councilman Ahaus gave devotions. 9 10 Councilman Welch moved to approve the minutes of the previous meeting 11 as prepared, seconded by Councilman Parker and on unanimous voice vote 12 the motion was carried. 13 14 Councilman Elstro moved to suspend the rules and read Resolution No. 15 10-1980 by title only, seconded by Councilman Parker and on unanimous 16 voice vote the motion was carried. 17 18 The Clerk read by title only Resolution- No. 10-1980 - A RESOLUTION TO 19 TRANSFER WITHIN THE GENERAL FUND. 20 • 21 Councilman Elstro moved for adoption of Resolution No. 10-1980, second- 22 ed by Councilman Carter and on unanimous voice vote the motion was 2g carried. 24 •25 Councilman Carter stated he called the Street Department to investigate 26 the condition of the sidewalk at 1011 Peacock Road. The owner has since 27 fixed the sidewalk and he requested Mr. Haynes be so notified. He 28 stated the owner is asking reimbursement of his costs and Mr. Meredith 29 stated there are no provisions for this. 30 31 President Paust announced Council has the responsibility of selecting 32 three (3) members to the Board of Managers of the Wayne County Conven- 33 tion-Tourism Bureau. One is to be from the Chamber of Commerce Board 34 of Directors, one from the hotel-motel industry and one from the travel 35 industry. Councilman Ahaus nominated the following: Mr. Richard Ze- 36 browski, travel; Mr. Fred Droddy, motel; and Mr. Dave Runyon, Chamber 37 Board. There being no further nominations, Councilman Hankinson moved 38 acceptance of the nominations, seconded by Councilman Parker and on 39 unanimous voice vote the motion was carried. 40 41 Mr. Perry Maul, Director of the Institute for Urban Transportation for 42 . Indiana University presented a films and talk on Section 18. "This film 43 is available to the public through Mr. Matt Nepote's office. 44 45 Councilman Elstro moved to suspend the rules and read Ordinance Nos. • 46 37-1980„ 38-1980 and 39-1980 on first reading by title only, seconded 47 " by Councilman Welch and. on unanimous voice vote the motion was carried. 48 49 The Clerk read on first reading by title only Ordinance No. 37-1980 - 50 AN ORDINANCE TO AMEND ORDINANCE NO. 64-1979 FIXING SALARIES FOR APPOINT- 51 ED OFFICERS AND EMPLOYEES OF THE CITY OF RICHMOND, INDIANA,- FOR THE 52 FISCAL YEAR BEGINNING JANUARY 1, 1980 AND ENDING DECEMBER 31, 1980. 53 Councilman Elstro moved to suspend the rules and move Ordinance No. 37- 54 1980 to second reading, seconded by.Councilman Welch and on unanimous 55 vote the motion was carried. 56- 57 • :The.Clerk read on second reading Ordinance No. 37-1980. 58 59 President Paust announced Ordinance No. 37-1980 is on 'public hearing. 60 - - - - 61 Following City.Controller`s .explanation of.:Ordinance--No: >37:-1980•;. , 62 Councilman Elstro:moved-for engrossment, aeconded.by, _Councilman .Welch. 63 and on unanimous voice vote the motion'was carried: ' 2 Common Council Minutes Cont'd. May 5, 1980 Page 2 1 2 Councilman Welch moved to suspend the rules and read Ordinance No. 37- 3 1980 on third and final reading by title only, seconded by Councilman 4 Elstro and on unanimous voice vote the motion was carried. 5 The Clerk read on third reading by title only Ordinance No. 37-1980. 6 7 8 Ordinance No. 37-1980 was placed on final passage or rejection and on 9 a call of the roll the following was recorded: Ayes: Elstro, Ahaus, 10 Hankinson, Welch, Parker, Carter and Paust. Noes: None. The vote 11 being seven (7) to zero (0) in favor of passage of Ordinance No. 37- 12 1980. 13 14 The Clerk read on first reading by title only Ordinance No. 38-1980 - 15 AN ORDINANCE AMENDING ORDINANCE NO. 2440-1969 AND AUTHORIZING A SPECIAL 16 USE FOR A RESIDENTIAL DEVELOPMENT UNIT PROJECT LOCATED WEST OF WINDING 17 RIDGE DRIVE ON 17.401 ACRES PURSUANT TO ARTICLES 48 AND 45 OF CHAPTER 18 22 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968 COMMONLY KNOWN 19 AS THE ZONING ORFINANCE OF THE CITY OF RICHMOND, INDIANA. 20 21 Councilman Elstro moved to suspend the rules and read Ordinance No. 38- 22 1980 on second reading, seconded by Councilman Welch and on unanimous 23 voice vote the motion was carried. 24 25 The Clerk read on second reading Ordinance No. 38-1980. 26 President Paust noted a letter from the Plan Commission with the vote 27 28 being eight (8) to three (3) to recommend passage with conditions 29 specified in Section 3. JO 111- 31 President Paust announced Ordinance No. 38-1980 is on public hearing. 32 Speaking against Section 3. (f) The owner shall erect a safety fence 33 around the storm water detention area on line no lower than the 1055 34 elevation as shown on the topography map, was Mr. Dick Clifford of 35 Gene B. Glick Co. His company feels it is unnecessary to erect a 36 fence around the detention basin. 37 38 President Paust announced Ordinance No. 38-1980 will remain on second 39 reading. 40 41 The Clerk read on first reading by title only Ordinance No. 39-1980 - 42 AN ORDINANCE AMENDING CHAPTER 22 OF THE MUNICIPAL CODE, BEING ORDI- 43 NANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE 44 CITY OF RICHMOND, INDIANA ADOPTED JUNE 3, 1968, PROVIDING FOR THE 45 REZONING OF PROPERTY LOCATED AT 3712 NATIONAL ROAD WEST FROM C-4 46 GENERAL BUSINESS DISTRICT AND R-1 SINGLE FAMILY RESIDENCE DISTRICT 47 TO C-4 GENERAL BUSINESS DISTRICT, AND ALSO PROVIDING FOR THE REZON- 48 ING OF PROPERTY LOCATED AT 3712 NATIONAL ROAD WEST FROM R-1 SINGLE FAMILY 49 RESIDENCE DISTRICT TO 0-1 GREENBELT DISTRICT. 50 51 Councilman Welch moved to suspend the rules and read Ordinance No. 39- 52 1980 on second reading, seconded by Councilman Elstro and on unanimous 53 voice vote the motion was carried. 54 55 The Clerk read on second reading Ordinance No. 39-1980. 56 57 President Paust noted a letter from the Plan Commission with the vote 58 being eleven (11) to zero (0) in favor of passage of Ordinance No. 59 39-1980. 60 61 President Paust announced Ordinance No. 39-1980 is on public hearing. 62 Speaking for Ordinance No. 39-1980 was Attorney Gayle Gardner, repre- 63 senting Parris Cross. 3 Common Council Minutes Cont'd. May 5, 1980 Page 3 1 Councilman Elstro moved for engrossment of Ordinance No. 39-1980, 2 seconded by Councilman Parker and on unanimous voice vote the motion 3 was carried. 4 5 Councilman Ahaus moved to suspend the rules and read Ordinance No. 39- 6 1980 on third and final reading by title only, seconded by Councilman 7 Welch and on unanimous voice vote the motion was carried. 8 9 The Clerk read on third reading by title only Ordinance No. 39-1980. 10 11 Ordinance No. 39-1980 was placed on final passage or rejection and on a 12 call of the roll the following was recorded: Ayes: Elstro, Ahaus, Hank- 13 inson, Welch, Parker, Carter and Paust. Noes: None. The vote being 14: seven (7) to zero (0) in favor of passage of Ordinance No. 39-1980. 15 16 The Clerk read on second reading Ordinance No. 32-1980 - AN ORDINANCE 17 ANNEXING CERTAIN CONTIGUOUS TERRITORY PLATTED AND UNPLATTED, LEGALLY 18 DESCRIBING THE ANNEXED TERRITORY, PROVIDING FOR THE PUBLICATION THERE- 19 OF, AND FIXING THE TIME WHEN SAME SHALL TAKE EFFECT. 20 21 President Paust noted a letter from the Plan Commission with the vote 22 being ten (10) to zero (0) in favor of passage of Ordinance No. 23 32-1980. 24 25 President Faust announced Ordinance No. 32-1980 is on public hearing. 26 Speaking for Ordinance No. 32-1980 was City Plan Director Bob Goodwin. 27 He requested the Fiscal Plan be adopted by Resolution to accompany the 28 Ordinance. Councilman Ahaus moved to accept the Fiscal Plan as presented 29 for Ordinance No. 32-1980, seconded by Councilman Hankinson and on 30 unanimous voice vote the motion was carried. 31 32 Councilman Welch moved for engrossment of Ordinance No. 32-1980, 33 seconded by Councilman Ahaus and on unanimous voice vote the motion 34 was carried. 35 36 Councilman Ahaus moved to suspend the rules and read Ordinance No. 32- 37 1980 on third and final reading by title only, seconded by Councilman 38 Welch and on unanimous voice vote the motion was carried. 39 40 The Clerk read on third reading by title only Ordinance No. 32-1980. 41 42 Ordinance No. 32-1980 was placed on final passage or rejection and on 43 a call of the roll the following was recorded: Ayes: Ahaus, Hankinson, 44 Welch, Parker, Carter and Faust. Noes: Elstro. The vote being six (6) 45 to one (1) in favor of passage of Ordinance No. 32-1980. 46 47 The Clerk read on second reading Ordinance No. 33-1980 - AN ORDINANCE 48 TO REDUCE WITHIN THE MOTOR VEHICLE HIGHWAY FUND. 49 50 President Paust announced Ordinance No. 33-1980 is on public hearing. 51 52 There being no proof of publication, Ordinance No. 33-1980 was held 53 on second reading. 54 55 The Clerk read on second reading Ordinance No. 35-1980 - AN ORDINANCE 56 TO APPROPRIATE WITHIN THE GENERAL FUND. 57 58 President Paust announced Ordinance No. 35-1980 is on public hearing. 59 60 There being no proof of publication, Ordinance No. 35-1980 was held 61 on second reading. 62 63 The Clerk read on second reading Ordinance No. 36-1980 - AN ORDINANCE Common Council Minutes Cont'd. May 5, 1980 Page 4 1 TO CREATE A JOINT AGENCY WITH OTHER MUNICIPALITIES WITHIN THE STATE 2 OF INDIANA, FOR THE PURPOSE OF UNDERTAKING THE PLANNING, FINANCING, 3 OWNERSHIP AND OPERATION OF A PROJECT OR PROJECTS TO SUPPLY ELECTRIC 4 POWER AND ENERGY FOR THE PRESENT AND FUTURE NEEDS OF SUCH MUNICIPALI- 5 TIES, AND OTHER MATTERS CONNECTED THEREWITH. 6 7 President Paust announced Ordinance No. 36-1980 is on public hearing. 8 9 There being no one speaking for or against Ordinance No. 36-1980 10 Councilman Carter moved for engrossment, seconded by Councilman Parker 11 and on unanimous voice vote the motion was carried. 12 13 Councilman Carter moved to suspend the rules and read Ordinance No. 36- 14 1980 on third and final reading by title only, seconded by Councilman 15 Parker and on unanimous voice vote the motion was carried. 16 17 The Clerk read on third reading by title only Ordinance No. 36-1980. 18 19 Ordinance No. 36-1980 was placed on final passage or rejection and on 20 a call of the roll the following was recorded: Ayes: Elstro, Ahaus, 21 Hankinson, Welch, Parker, Carter and Paust. Noes: None.
