HomeMy Public PortalAbout04-07-1980 591 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, APRIL 7, 1980 1 The Common Council of the City of Richmond, Indiana, met in regular 2 session April 7, 1980 at the hour of 7:30 p.m. in the Council Chambers 3 in the Municipal Building in said City. President Paust presided with 4 the following members present: Messrs. Elstro, Williams, Ahaus, Hankin- s son, Welch, Parker, Carter and Mills. Absent: none. The following 6 business was had, to-wit: 7 8 Councilman Paust gave devotions. 9 10 Councilman Hankinson moved to approve the minutes of the previous meeting 11 as presented, seconded by Councilman Mills and on unanimous voice vote 12 the motion was carried. 13 14 President Paust announced Councilmen had a resolution from the Economic 15 Development Committee in front of them which does not appear on the 16 agenda and it will take a unanimous vote of the members to add this to 17 the agenda. Councilman Mills so moved, seconded by Councilman Carter 18 and on unanimous voice vote the motion was carried. 19 20 Councilman Mills moved to read Resolution Nos. 6-1980 and 7-1980 by 21 title only, seconded by Councilman Parker and on unanimous voice vote 22 the motion was carried. 23 24 The Clerk read by title only Resolution No. 6-1980 - A RESOLUTION AUTH- 25 ORIZING THE FILING OF AN APPLICATION FOR A GRANT UNDER SECTION 18 OF 26 THE URBAN MASS TRANSPORTATION ACT OF 1964, AS AMENDED. 27 28 Councilman Elstro moved for adoption of Resolution No. 6-1980, second- 29 ed by Councilman Ahaus. The motion carried with Councilmen Carter and 30 Hankinson voting no. 31 32 The Clerk read by title only Resolution No. 7-1980 - A RESOLUTION OF 33 THE CITY OF RICHMOND TO INDUCE EIIPCO REALTY, AN INDIANA PARTNERSHIP, 34 TO ACQUIRE, CONSTRUCT AND EQUIP AN ECONOMIC DEVELOPMENT FACILITY, AND 35 TO UNDERTAKE TO SELL, AND DELIVER REVENUE BONDS TO PAY THE COSTS THERE- 36 OF, AND OTHER MATTERS RELATING THERETO. 37 38 Speaking for Resolution No. 7-1980 was Attorney Andrew Cecere, repre- 39 senting Staco. Present in support of Resolution No. 7-1980 were Mr. 40 C. Alan Rosar and Mr. Henry Boppel. 41 42 Councilman Mills moved for adoption. of Resolution No. 7-1980, seconded 43 by Councilman Carter and on unanimous voice vote the motion was carried. 44 45 Councilman Mills moved to suspend the rules and read Ordinance Nos. 31- 46 1980 and 32-1980 on first reading by title only, seconded by Council- 47 man Carter and on unanimous voice vote the motion was carried. 48 49 The Clerk read on first reading by title only Ordinance No. 31-1980 - 50 AN ORDINANCE TO APPROPRIATE WITHIN THE GENERAL FUND. 51 52 President Paust announced Ordinance No. 31-1980 has to be advertised. 53 54 The Clerk read on first reading by title only Ordinance No. 32-1980 - 55 AN ORDINANCE ANNEXING CERTAIN CONTIGUOUS TERRITORY PLATTED AND UN- 56 PLATTED, LEGALLY DESCRIBING THE ANNEXED TERRITORY, PROVIDING FOR THE 57 PUBLICATION THEREOF, AND FIXING THE TIME WHEN THE SAME SHALL TAKE 58 EFFECT. 59 60 President Paust announced Ordinance No. 32-1980 is referred to the 61 Plan Commission. 62 63 Chairman of the Committee of the Whole Mills announced his committee 64 met March 24 on the eleven (11) ordinances on federal revenue sharing 592 Common Council Minutes cont'd. April 7, 1980 Page 2 1 and discussed these ordinances with Mr. Meredith, the Mayor and concerned 2 citizens. A public hearing was held on these ordinances on March 17 at 3 which time they were held on second reading. 4 5 The Clerk read on second reading Ordinance No. 14-1980 - AN ORDINANCE 6 TO APPROPRIATE FROM THE FEDERAL REVENUE SHARING TRUST FUND. 7 8 President Paust announced Ordinance No. 14-1980 is on public hearing. 9 10 There being no one speaking for or against Ordinance No. 14-1980, 11 Councilman Mills moved for engrossment, seconded by Councilman Williams 12 and on unanimous voice vote the motion was carried. 13 14 Councilman Mills moved to suspend the rules and read Ordinance No. 14- 15 1980 on third and final reading by title only, seconded by Councilman 16 Welch and on unanimous voice vote the motion was carried. 17 18 Ordinance No. 14-1980 was placed on final passage or rejection and on 19 a call of the roll the following was recorded: Ayes: Elstro, Williams, 20 Ahaus, Hankinson, Welch, Parker, Carter, Mills and Paust. Noes: None. 21 The vote being nine (9) to zero (0) in favor of passage of Ordinance 22 No. 14-1980. 23 24 The Clerk read on second reading Ordinance No. 15-1980 - AN ORDINANCE 25 TO APPROPRIATE FROM THE FEDERAL REVENUE SHARING TRUST FUND. 26 27 President Paust announced Ordinance No. 15-1980 is on public hearing. 28 29 There being no one speaking for or against Ordinance No. 15-1980, 30 Councilman Mills moved for engrossment, seconded by Councilman Ahaus 31 and on unanimous voice vote the motion was carried. 32 33 Councilman Williams moved to suspend the rules and read Ordinance No. 34 15-1980 on third and final reading by title only, seconded by Council- 35 man Welch and on unanimous voice vote the motion was carried. 36 37 The Clerk read on third reading by title only Ordinance No. 15-1980. 38 39 Ordinance No. 15-1980 was placed on final passage or rejection and on 40 a call of the roll the following was recorded: Ayes: Elstro, Williams, 41 Ahaus, Hankinson, Welch, Parker, Carter, Mills and Paust. Noes: None. 42 The vote being nine (9) to zero (0) in favor of passage of Ordinance 43 No. 15-1980. 44 45 The Clerk read on second reading Ordinance No. 16-1980 - AN ORDINANCE 46 TO APPROPRIATE FROM THE FEDERAL REVENUE SHARING TRUST FUND. 47 48 President Paust announced Ordinance No. 16-1980 is on public hearing. 49 50 There being no one speaking for or against Ordinance No. 16-1980 51 Councilman Williams moved for engrossment, seconded by Councilman Mills 52 and on unanimous voice vote the motion was carried. 53 54 Councilman Williams moved to suspend the rules and read Ordinance No. 55 16-1980 on third and final reading by title only, seconded by Council- 56 man Mills and on unanimous voice vote the motion was carried. 57 58 The Clerk read on third reading by title only Ordinance No. 16-1980. 59 60 Ordinance No. 16-1980 was placed on final passage or rejection and on 61 a call of the roll the following was recorded: Ayes: Elstro, Williams 62 and Mills. Noes: None. •2 The vote being nine (9) to zero (0) in favor of passage of Ordinance 3 25-1980. 4 5 The Clerk read on second reading Ordinance No. 27-1980 - AN ORDINANCE 6 AUTHORIZING A SPECIAL USE IN AN R-2 SINGLE-FAMILY RESIDENCE DISTRICT 7 FOR A NON-COMMERCIAL CLUB ON PROPERTY LOCATED AT 2601 STRAIGHTLINE 8 PIKE, PURSUANT TO ARTICLES 48 AND 20.023 OF CHAPTER 22 OF THE MUNICIPAL 9 CODE COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, 10 INDIANA. 11 12 President Paust announced Ordinance No. 27-1980 is on public hearing. 13 14 Speaking for Ordinance No. 27-1980 was Mr. Ray Moak, 2616 Willow Drive, 15 President of Old Trails Rifle Club, representing several people in the 16 audience. 17 18 A letter was.received noting the Plan Commission held a public hearing 19 on Tuesday,March 25, 1980 and voted seven (7) to zero (0) to recommend 20 the Special Use be authorized. 21 22 Councilman Mills moved for engrossment of Ordinance No. 27-1980, second- 23 ed by Councilman Parker and on unanimous voice vote the motion was 24 carried. 25 26 Councilman Mills moved to suspend the rules and read Ordinance No. 27- 27 1980 on third and final reading by title only, seconded by Councilman 28 Parker and on unanimous voice vote the motion was carried. 29 30 The Clerk read on third reading by title only Ordinance No. 27-1980. 31 32 Ordinance No. 27-1980 was placed on final passage or rejection and 33 on a call of the roll the following was recorded: Ayes: Elstro, Williams, 34 Ahaus, Hankinson, Welch, Parker, Carter, Mills and Paust. Noes: None. 35 The vote being nine (9) to zero (0) in favor of Passage of Ordinance 36 No. 27-1980. 37 38 The Clerk read on second reading Ordinance No. 29-1980 - AN ORDINANCE 39 TO APPROPRIATE WITHIN THE PARK FUND. 40 41 City Attorney Ed Anderson examined proof of publication for Ordinance 42 No. 29-1980 and found it to be in order. Councilman Ahaus moved the 43 proof be accepted, seconded by Councilman Welch and on unanimous voice 44 vote the motion was carried. 45 46 President Paust announced Ordinance No. 29-1980 is on public hearing. 47 48 There being no one speaking for or against Ordinance No. 29-1980 49 Councilman Mills moved for engrossment, seconded by Councilman Ahaus 50 and on unanimous voice vote the motion was carried. 51 52 Councilman Mills moved to suspend the rules and read Ordinance No. 29- 53 1980 on third and final reading by title only, seconded by Councilman 54 Carter and on unanimous voice vote the motion was carried. - 55 56 The Clerk read on third reading by title only Ordinance No. 29-1980. 57 58 Ordinance No. 29-1980 was placed on final passage or rejection and 59 on a call of the roll the following was recorded: Ayes : Elstro, Williams, 60 Ahaus, Hankinson, Welch, Parker, Carter, Mills and Paust.
