HomeMy Public PortalAbout03-18-1980 587 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MARCH 18, 1980 1 The Common Council of the City of Richmond, Indiana met in regular 2 session March 17, 1980 at the hour of 7:30 p.m. in the Council Chambers 3 in the Municipal Building in said City. President Paust presided with 4 the following members present: Messrs. Elstro, Williams, Ahaus, Hank- 5 inson, Parker, Carter and Mills. Absent: Welch. The following busi- 6 ness was had, to-wit: 7 8 Councilman Parker gave devotions. 9 10 Councilman Williams moved the minutes of the previous meeting be accep- 11 ted as prepared, seconded by Councilman Carter and on unanimous voice 12 vote the motion was carried. 13 14 The Clerk read by title only RESOLUTION NO. 5-1980 - A RESOLUTION 15 ADOPTING A POLICY ON ANNEXATION. 16 17 On a call of the roll the following was recorded: Ayes: Williams, 18 Hankinson, Ahaus, Parker, Mills and Paust. Noes: Elstro and Carter. 19 The vote being six (6) to two (2) in favor of adopting Resolution 20 No. 5-1980. 21 22 Councilman Mills moved to suspend the rules and read Ordinances Nos. 23 28-1980, No. 29-1980 .and No. 30-1980 on first reading by title only, 24 seconded by Councilman Ahaus and on unanimous voice vote the motion 25 was carried. 26 27 The Clerk read on first reading by title only ORDINANCE NO. 28-1980 - 28 AN ORDINANCE TO TRANSFER WITHIN THE MUNICIPAL AIRPORT FUND. 29 30 Councilman Mills moved to suspend the rules and read Ordinance No. 28- 31 1980 on second reading, seconded by Councilman Ahaus and on unanimous 32 voice vote the motion was carried. 33 34 The Clerk read on second reading Ordinance No. 28-1980. 35 36 President Paust announced Ordinance NO. 28-1980 is on public hearing. 37 38 Speaking for Ordinance No. 28-1980 was Robert Hudson, Attorney repre- 39 senting the Board of Aviation Commissioners. 40 41 President Paust announced Ordinance No. 28-1980 would be held until 42 Ordinance No. 30-1980 was discussed. 43 44 The Clerk read on first reading by title only ORDINANCE NO. 29-1980 - 45 AN ORDINANCE TO APPROPRIATE WITHIN THE PARK FUND. 46 47 President Paust announced Ordinance No. 29-1980 has to be advertised. 48 49 The Clerk read on first reading by title only ORDINANCE NO. 30-1980 - 50 AN ORDINANCE OF THE CITY OF RICHMOND, INDIANA, AUTHORIZING AND EM- 51 POWERING ITS BOARD OF AVIATION COMMISSIONERS TO TERMINATE AN EMPLOY- 52 MENT AGREEMENT OF EUGENE R. SMITH AND MATTERS RELATING THERTO. 53 54 Councilman Ahaus moved to suspend the rules and read Ordinance No. 30- 55 1980 on second reading, seconded by Councilman Carter and on unanimous 56 voice vote the motion was car-Tied. 57 58 The Clerk read on second reading Ordinance No. 30-1980. 59 60 Speaking for Ordinance No. 30-1980 was Robert Hudson, Attorney repre- 61 senting the Board of Aviation Commissioners. 62 63 Councilman Mills moved to engross Ordinance No. 30-1980, seconded by 64 Councilman Ahaus and on unanimous voice vote the motion was carried. 588 Common Council Minutes Cont. March 17, 1980 Page 2 1 Councilman Ahaus moved to suspend the rules and read Ordinance No. 30- 2 1980 on third and final reading by title only, seconded by Councilman 3 Carter and on unanimous voice vote the motion was carried. 4 5 The Clerk read on third reading by title only Ordinance No. 30-1980. 6 7 Ordinance No. 30-1980 was placed on final passage or rejection and on a 8 call of the roll the following was recorded: Ayes: Williams, Ahaaa, 9 Hankinson, Parker, Mills, Carter and Paust. Noes: Elstro. The vote 10 being seven (7) to one (1) in favor of passage of Ordinance No. 30-1980. 11 12 Councilman Mills moved for engrossment of Ordinance No. 28-1980, se- 13 conded by Councilman Ahaus and on unanimous voice vote the motion was 14 carried. 15 16 Councilman Mills moved to suspend the rules and read Ordinance No. 28- 17 1980 on third and final reading by title only, seconded by Councilman 18 Parker and on unanimous voice vote the motion was carried. 19 20 The Clerk read on third reading by title only Ordinance No. 28-1980. 21 22 Ordinance No. 28-1980 was placed on final passage or rejection and on a 23 call of the roll the following was recorded: Ayes: Williams, Ahaus, 24 Hankinson, Parker, Mills, Carter and Paust. Noes: Elstro. The vote 25 being seven (7) to (1) in favor of passage of Ordinance No. 28-1980. 26 27 President Paust announced 'that Dr. Fox' requested that Ordinance No. 6- 28 1980 be withdrawn at this time. 29 30 Councilman Mills moved to strike Ordinance No. 6-1980, seconded by 31 Councilman Carter and on unanimous voice vote the motion was carried. 32 33 President Paust announced that with the budget cuts that may be made in 34 the Federal Revenue Sharing, the Ordinances on second reading would be 35 on public hearing and then referred to the Committee of the Whole for 36 study. He set March 31st at 7:00 p.m. for that meeting in the Board of 37 Works room and requested the Mayor and Mr. Meredith be in attendance. 38 39 The Clerk read on second reading ORDINANCE NO. 14-1980 - AN ORDINANCE 40 TO APPROPRIATE FROM THE FEDERAL REVENUE SHARING TRUST FUND. 41 42 Speaking for Ordinance No. 14-1980 were Patricia Heiny, 801 S. W. "A" 42 St. , representing Carol Brown, President of the League of Women Voters, 43 and Jerry Haynes, Director of Transportation. 44 45 President Paust announced Ordinance No. 14-1980 is referred to the 46 Committee of the Whole. 47 48 The Clerk read on second reading ORDINANCE NO. 15-1980 - AN ORDINANCE 49 TO APPROPRIATE FROM THE FEDERAL REVENUE SHARING TRUST FUND. 50 51 Speaking for Ordinance No. 15-1980 was Dick Huckaba, 3331 N. W. "C" 52 St. , President of United Way and speaking also for Ann Brown, Social 53 Service Planner and Ed Peterson, Executive Director of United Way. 54 Also speaking in favor was Frank Pumerville, 128 South 22nd St. , 55 President of the Social Services Planning Board. 56 57 President Paust announced.Ordinance No. 15-1980 is referred to the 58 Committee of the Whole. 59 60 The Clerk read on second reading ORDINANCE NO. 16-1980 - AN ORDINANCE 61 TO APPROPRIATE FROM THE FEDERAL REVENUE SHARING TRUST FUND. 62 63 Speaking in favor of Ordinance No. 16-1980 was Russell Doren, city 64 employee in the Printing Department. 589 Common Council Minutes cont. March 17, 1980 Page 4 1 Speaking for Ordinance No. 24-1980 was Jerry Haynes, Director of 2 Transportation. 3 4 President Paust announced Ordinance No. 24-1980 is referred to the 5 Committee of the Whole. 6 7 City Attorney Ed Anderson examined proof of publication for Ordinances 8 Nos. 14-1980 through Ordinance No. 24-1980 and found it to be in order. 9 Councilman Mills moved the proof of publication be accepted and filed, 10 seconded by Councilman Ahaus and on unanimous voice vote the motion 11 was carried. 12 13 Councilman Elstro commented on the alleys south of the Promenade be- 14 tween 5th and 8th St. looking bad with the wind blowing debris. City 15 Attorney Ed Anderson said Mr. Longer reported the area had been clean- 16 ed, but he will check in the morning. 17 18 Councilman Carter inquired if the gates have been fixed at the Parking 19 Garage, to which Mr. Haynes replied that some parts are on order but 20 they have been working on it and hope to have it repaired by tomorrow; 21 however, they also have a problem -with vandalism. 22 23 President Paust asked Mr. Haynes if the exit arm at the North 7th St. 24 parking lot was automatic. Mr. Haynes replied that it is, but occasion- 25 ally a radio frequency will trip it. 26 27 There being no further business on motion duly made, seconded and passed 28 the meeting was adjourned. 29 30 Kenneth Paust 31 President 32 33 ATTEST: Nancy V.
