HomeMy Public PortalAbout02-18-1980 577 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, FEBRUARY 18, 1980 1 The Common Council of the City of Richmond, Indiana met in regular 2 session February 18, 1980 at the hour of 7:30 p.m. in the Council 3 Chambers in the Municipal Building in said City. President Paust III4 presided with the following members present: Messrs. Elstro, Williams, 5 Ahaus, Hankinson, Welch, Parker, Carter and Mills. Absent: None. The 6 following business was had, to-wit: 7 8 Councilman Hankinson gave devotions. 9 10 Councilman Williams moved the minutes of the previous meeting be accep- 11 ted as prepared, seconded by Councilman Mills and on unanimous voice 12 vote the motion was carried. 13 14 Mayor Clifford Dickman distributed yearly reports from the City Depart- 15 ments for the year 1979 to the councilmen. He stated that this has been 16 an excellent year, but of course, there is still room for improvement. 17 18 Councilman Mills,moved to suspend the rules and read Ordinance Nos. 19 9-1980, 10-1980, 11-1980, 12-1980 and 13-1980 on first reading by 20 title only, seconded by Councilman Carter and on unanimous voice vote 21 the motion was carried. 22 23 The Clerk read on first reading by title only ORDINANCE NO. 9-1980 - AN 24 ORDINANCE AMENDING CHAPTER 22 OF THE.MUNICIPAL CODE, BEING ORDINANCE NO. 25 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICH- 26 MOND, INDIANA ADOPTED JUNE 3, 1968, PROVIDING FOR THE REZONING OF PRO- 27 PERTY LOCATED AT THE CORNER OF WOODSIDE DRIVE AND HAYES ARBORETUM ROAD 28 FROM C-4 GENERAL BUSINESS DISTRICT TO C-2 .COMMUNITY BUSINESS DISTRICT. 29 30 President Paust announced Ordinance No. 9-1980 is referred to the Plan 31 Commission. 32 33 The Clerk read on first reading by title only ORDINANCE NO. 10-1980 - 34 AN ORDINANCE AUTHORIZING A SPECIAL USE IN AN R-3 ONE-TO-EIGHT FAMILY 35 RESIDENCE DISTRICT FOR MEDICAL AND/OR DENTAL OFFICES ON PROPERTY LOCA- 36 TED AT 1915 CHESTER BOULEVARD, PURSUANT TO ARTICLE 48 OF CHAPTER 22 OF 37 THE MUNICIPAL CODE COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF 38 RICHMOND, INDIANA. 39 40 President Paust announced Ordinance No. 10-1980 is referred to the Plan 41 Commission. 42 43 The Clerk read on first reading by title only ORDINANCE NO. 11-1980 - 44 AN ORDINANCE AMENDING CHAPTER 22 OF THE MUNICIPAL CODE, BEING ORDINANCE 45 NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF 46 RICHMOND, INDIANA ADOPTED JUNE 3, 1968, PROVIDING FOR THE REZONING OF 47 PROPERTY LOCATED AT NORTH 5TH AND "D" STREETS FROM M-1 LIGHT INDUSTRIAL 48 DISTRICT TO C-4 GENERAL BUSINESS DISTRICT. 49 50 President Paust announced Ordinance No. 11-1980 is referred to the Plan 51 Commission. 52 53 The Clerk read on first reading by title only ORDINANCE NO. 12-1980 - 54 AN ORDINANCE AUTHORIZING A RESIDENTIAL DEVELOPMENT UNIT PROJECT LOCATED 55 AT 422 SOUTH SEVENTH STREET PURSUANT TO ARTICLES 48 AND 45 OF CHAPTER 56 22 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968 COMMONLY KNOWN 57 AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA. 58 59 President Paust announced Ordinance No. 12-1980 is referred to the Plan 60 Commission. 61 62 The Clerk read on first reading by title only ORDINANCE NO. 13-1980 - 63 AN ORDINANCE TO APPROPRIATE WITHIN THE GENERAL FUND. 578 Common Council Minutes Cont. February 18, 1980 Page 2 1 President Paust announced Ordinance No. 13-1980 has to be advertised. 2 3 The Clerk read on second reading AMENDED ORDINANCE NO. 2-1980 - AN ORDI- 4 NANCE AUTHORIZING A SPECIAL USE IN AN R-3 ONE-TO-EIGHT FAMILY RESIDENCE 5 DISTRICT FOR A MEDICAL AND/OR DENTAL OFFICE ON PROPERTY LOCATED AT 1921 6 CHESTER BOULEVARD, PURSUANT TO ARTICLE 48 OF CHAPTER 22 OF THE MUNICIPAL 7 CODE COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, IND- 8 IANA. 9 10 Speaking against Amended Ordinance No. 2-1980 were Darrell Richards, 11 1970 Darvin Court, Glee Ann Pitstick, 2250 ,Autumn Way, Al Dillon, 1304 12 Woodland Trail (also representing the Bradleys, 1904 Chester Boulevard) . 13 Property owners expressed concern over surface drainage problems and 14 noted they are not objecting to Dr. Ackerman as a neighbor. "Mr. Dillon 15 asked if there had been a proposed drawing for the location showing 16 commercial usage, or if there was any proposed use for the remaining 17 property. 18 19 Speaking for Amended Ordinance No. 2-1980 was Mr. Stan Combs, architect 20 representing Dr. Ackerman. Mr. Combs noted there was a drawing prepared 21 with no particular plans or items which had commercial in the front, a 22 dental office and possibly residential. He noted any usage other than a 23 dental office would have to come back before this body. It was noted 24 the property is now zoned R-•3 one-to-eight family residential. 25 26 Councilman Carter asked if Mr. Combs would accept an amendment to limit 27 the special use permit to 500' or 550' which would take it back to the 28 east end of the parking area. Mr. Combs stated he could live with 600' . 29 Councilman Carter so moved, seconded by Councilman Mills. 30 31 Councilman Carter amended the special use permit to include all areas 32 back to the east edge of the parking lot as shown on the proposed map, 33 seconded by Councilman Mills. 34 35 Mr. Combs recommended the amendment be to locate_ the building and 36 parking lot as shown in the original drawing dated December 31st that 37 should locate' corresponding with the topo drawing. 38 39 Councilman Carter withdrew his motion; Councilman Mills withdrew his 40 second. 41 42 City Attorney Ed Anderson noted the site plan is a part of the Ordinance. 43 He further noted the Ordinance at this time has only two (2) conditions 44 and the Plan Commission recommends four (4) more. 45 46 Councilman Ahaus suggested changing a portion of condition (c) " a 50 47 foot easement along the south property line shall be granted to the City 48 of Richmond for the construction of a future street and cul-de-sac" to 49 read "a 50 foot easement along the south property line shall be granted 50 to the City of Richmond in the event a street and cul-de-sac should be 51 constructed". 52 53 President Paust referred Amended Ordinance No. 2-1980 to the Parks and 54' Recreation, Public Safety and Public Works and Sanitation Committee to 55 meet with the Board of Works and Plan Department. He requested an in- 56 depth study with a written report to answer the questions, particularily 57 with the water problem. It was noted the conditions of this Ordinance 58 has not been amended to include the recommendations of the Plan Com- 59 mission at this time. 60 61 The Clerk read on second reading . ORDINANCE 8-1980 - AN- 62 ORDINANCE ESTABLISHING A NEW SCHEDULE OF RATES FOR SERVICE RENDERED BY 63 RICHMOND POWER AND LIGHT, THE MUNICIPAL ELECTRIC UTILITY SYSTEM OF THE 64 CITY OF RICHMOND, INDIANA AND MATTERS RELATED THERETO. 579 Common Council Minutes Cont. February 18, 1980 Page 3 1 Speaking against Ordinance No. 8-1980 were H. C. Simpson, 482 South 19th 2 Street, and Gregory Ball, 1343 Liberty Avenue. 3 4 Speaking for Ordinance No. 8- 1980 was Irving Huffman, General Manager 5 of Richmond Power & Light. 6 7 Irving Huffman answered questions from Robert VanPelt. 8 9 Mr. Huffman said a typographical error in the second paragraph, line 10 6 should be changed from "Pulice" to "Public". The change was accepted 11 by generalconsent. 12 13 Councilman Ahaus moved for engrossment of Amended Ordinance No. 8-1980, 14 seconded by Councilman Welch, and on a call of the roll the following 15 was recorded: Ayes: Elstro, Williams, Ahaus, Hankinson, Welch, Parker, 16 and Paust. Noes: Carter and Mills. The vote being seven (7) to two 17 (2) in favor of engrossment. 18 19 Councilman Mills moved to bring Vetoed Ordinance No. 1-1980 to the 20 floor., seconded by Councilman Elstro and read by title only and on 21 unanimous voice vote the motion was carried. 22 23 The Clerk read by title only Vetoed ORDINANCE NO. 1-1980 - AN ORDINANCE 24 AUTHORIZING CERTAIN EXPENDITURES AND ACTIVITIES OF THE RICHMOND POWER 25 AND LIGHT AND MATTERS RELATED THERETO. On a call of the roll, the fol- 26 lowing was recorded. Ayes: Elstro, Williams, Ahaus, Hankinson, Welch, 27 Parker, Mills and Paust. Noes: Carter.
