HomeMy Public PortalAbout02-04-1980 573 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, FEBRUARY 4, 1980 1 The Common Council of the City of Richmond, Indiana met in regular 2 session February 4, 1980 at the hour of 7:30 p.m. in the Council 3 , Chambers in the Municipal Building in said City. President Paust 4 presided with the following members present: Messrs. Elstro, Williams, 5 Ahaus, Hankinson, Welch, Parker, Carter and Mills. Absent: None. The 6 following business was had, to-wit: 7 8 Councilman Elstro gave devotions. 9 10 Councilman Williams moved the minutes of the previous meeting be ac- 11 cepted as prepared, seconded by Councilman Welch and on unanimous 12 voice vote the motion was carried. 13 14 Councilman Mills moved to suspend the rules and read Resolution No. 3- 15 1980 by title only, seconded by Councilman Carter and on unanimous 16 voice vote the motion was carried. 17 18 The Clerk read by title only Resolution No. 3-1980 - A RESOLUTION TO 19 AUTHORIZE THE AMENDMENT OF AN APPLICATION WITH THE UNITED STATES OF 20 AMERICA, DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT, FOR EXISTING 21 HOUSING ASSISTANCE PAYMENTS FOR ONE HUNDRED SEVENTEEN (117) LOW IN- 22 COME FAMILIES, AS PROVIDED IN SECTION 8 OF THE HOUSING AND COMMUNITY 23 DEVELOPMENT ACT OF 1974. 24 25 Speaking for Resolution No. 3-1980 was Keith McGathey, Executive Direc- 26 tor of the Richmond Housing Authority. 27 28 Councilman Mills moved for adoption of Resolution No. 3-1980, seconded 29 by Councilman Williams, and on unanimous voice vote the motion was 30 carried. 31 32 Councilman Parker requested the Board of Works check the area on 33 Southwest 16th Street where homeowners have cleaned up and built a 34 barricade at the dead end of the street. The homeowners sent a letter 35 requesting gravel be put down and a better barricade be built. 36 37 Councilman Paust recommended Wilbur Thomas be reappointed to serve 38 another four year term on the Richmond Economic Development Commis- 39 sion. Councilman Ahaus moved to accept the recommendation, seconded 40 by Councilman Mills and on unanimous voice vote the motion was carried. 41 42 Councilman Mills moved to suspend the rules and read Ordinance No. 7- 43 1980 and No. 8-1980 on first reading by title only, seconded by Council- 44 man Welch and on unanimous voice vote the motion was carried. 45 46 The Clerk read on first reading by title only Ordinance No. 7-1980 - 47 AN ORDINANCE AMENDING CHAPTER 22 OF THE MUNICIPAL CODE, BEING ORDI- 48 NANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY 49 OF RICHMOND, INDIANA ADOPTED JUNE 3, 1968, PROVIDING FOR THE REZONING 50 OF PROPERTY LOCATED ON BOSTON PIKE FROM R-2 ONE-FAMILY RESIDENCE 51 DISTRICT TO C-4 GENERAL BUSINESS DISTRICT. III 52 53 President Paust announced Ordinance No. 7-1980 is referred to the 54 Plan Commission. 55 56 The Clerk read on first reading by title only Ordinance No. 8-1980 - 57 AN ORDINANCE ESTABLISHING A NEW SCHEDULE OF RATES FOR SERVICE RENDERED 58 BY RICHMOND POWER AND LIGHT, THE MUNICIPAL ELECTRIC UTILITY SYSTEM OF 59 THE CITY OF RICHMOND, INDIANA AND MATTERS RELATED THERETO. 60 61 President Paust announced Ordinance No. 8-1980 would be on public 62 hearing at the'next regularly scheduled meeting. 574 Common Council Minutes Cont. February 4, 1980 Page 2 1 The Clerk read on second reading Ordinance No. 117-1979 - AN ORDINANCE 2 AMENDING CHAPTER 22 OF THE MUNICIPAL CODE BEING ORDINANCE NO. 2325- 3 1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, 4 INDIANA ADOPTED JUNE 3, 1968, PROVIDING FOR THE REZONING OF PROPERTY 5 LOCATED AT 1400 EAST MAIN STREET FROM R-4 MULTI-FAMILY RESIDENCE TO 6 C-2 COMMUNITY BUSINESS DISTRICT. 7 8 President Paust announced Ordinance No. 117-1979 is on public hearing. 9 10 There being no one speaking against or for Ordinance No. 117-1979, 11 Councilman Williams moved for engrossment, seconded by Councilman 12 Elstro and on unanimous voice vote the motion was carried. 13 14 Councilman Elstro moved to suspend the rules and read Ordinance No. 117- 15 1979 on third and final reading by title only, seconded by Councilman 16 Williams and on unanimous voice vote the motion was carried. 17 18 The Clerk read on third reading by title only Ordinance No. 117-1979. 19 20 Ordinance No. 117-1979 was placed on final passage or rejection and on 21 a call of the roll the following was recorded: Ayes: Elstro, Williams, 22 Ahaus, Hankinson, Welch, Parker,Carter and Mills. Noes: None. The 23 vote being nine (9) to zero (0) in favor of passage of Ordinance No. 24 117-1979. 25 26 The Clerk read on second reading Amended Ordinance No. 2-1980 - AN 27 ORDINANCE AUTHORIZING A SPECIAL USE IN AN R-3 ONE-TO-EIGHT FAMILY 28 RESIDENCE DISTRICT FOR A MEDICAL AND/OR DENTAL OFFICE ON PROPERTY 29 LOCATED AT 1921 CHESTER BOULEVARD, PURSUANT TO ARTICLE 48 OF CHAP- 30 TER 21 OF THE MUNICIPAL CODE COMMONLY KNOWN' AS THE ZONING ORDINANCE 31 OF THE'CITY OF RICHMOND, INDIANA. . - 32 33 President Paust announced Amended Ordinance No. 2-1980 is on public 34 hearing. Al Dillon, 1304 Woodland Trail spoke in opposition, because 35 of the drainage problem across his property. 36 Speaking for Amended Ordinance No. 2-1980 was Stan Combs, 1 Woodside 37 Drive, architect representing Dr. Ackerman. 38 39 Councilmen questioned Condition (c) . City Engineer George Webb re- 40 commended changing Condition (d) from "As a condition of being granted 41 the Special Use, an access drive shall be constructed within easement 42 mentioned in "c" above. Said access drive shall have a minimum width 43 of 24 feet and shall be constructed according to city street standards" 44 to read "As a condition of being granted the Special Use, an access 45 drive shall be constructed within easement mentioned in "c" above. 46 Said access drive shall have a minimum width of 24 feet and shall be 47 constructed to be compatible with city street standards." Mr. Webb's 48 recommendation was passed by general consent. 49 50 President Paust announced Ordinance No. 2-1980 would be held on second 51 reading. 52 53 The Clerk read on second reading Ordinance No. 5-1980 - AN ORDINANCE 54 AMENDING CHAPTER 22 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325- 55 1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, 56 INDIANA ADOPTED JUNE 3, 1968, PROVIDING FOR THE REZONING OF PROPERTY 57 LOCATED ON COMMERCE ROAD FROM M-2 GENERAL INDUSTRIAL DISTRICT AND C-4 58 GENERAL BUSINESS DISTRICT TO C-4 GENERAL BUSINESS DISTRICT. 59 60 Councilman Carter announced his intention to vote on the Ordinance 61 - .. although he is involved in the real estate. 62 63 Speaking on behalf of the Ordinance was Darrell M. Beane, 2 Peoples 64 Building, attorney; and Fred Talbot, 3531 Dorothy Lane. 575 Common Council Minutes Cont. February 4, 1980 Page 3 1 Councilman Mills moved to engross,seconded by Councilman Ahaus and on 2 unanimous voice vote the motion was carried. 3 4 Councilman Mills moved to suspend the rules and read Ordinance No. 5- 5 1980 on third and final reading by title only, seconded by Councilman 6 Welch and on unanimous voice vote the motion was carried. 7 8 The Clerk read on third reading by title only Ordinance No. 5-1980. 9 10 Ordinance No. 5-1980 was placed on final passage or rejection and on a 11 call of the roll the following was recorded: Ayes: Elstro, Williams, 12 Ahaus, Hankinson, Welch, Parker, Carter, Mills and Paust. Noes: None. 13 The vote being nine (9) to zero (0) in favor of passage of Ordinance 14 No. 5-1980. 15 16 Councilman Mills moved to suspend the rules and read Ordinance No. 1- 17 1980 on third and final reading by title only, seconded by Councilman 18 Parker and on unanimous voice vote the motion was carried. 19 20 The Clerk read on third and final reading by title only Ordinance No. 21 1-1980. 22 23 The Clerk pointed out that the Ordinance carried a date of January in 24 the passage section and should be changed to February. By general 25 consent of the Council, was told it could be changed. 26 27 Ordinance No. 1-1980 was placed on final passage or rejection and on 28 a call of the roll the following was recorded: Ayes: Elstro, Williams, 29 Ahaus, Hankinson, Welch, Parker, Mills and Paust. Noes: Carter. The 30 vote being eight (8) to one (1) in favor of passage of Ordinance No. 31 1-1980. 32 33 Councilman Ahaus announced the Transportation Committee would meet 34 with the Institute of Urban Transit for a presentation on February 35 7, 1980 at 7:00 p.m. in the Board of Works room. On February 11, 36 1980 there will be a public hearing on the presentation in the 37 Board of Works room, at 7:00 p.m. 38 39 The Council was invited by the League of Women Voters to attend 40 their birthday party on February 14, 1980 from 2:00 p.m. to 3:00 41 p.m. in the Board of Works room. 42 43 There being no further business on motion duly made, seconded and 44 passed, the meeting was adjourned. 45 46 Kenneth Paust 47 President 48 49 ATTEST: JoEllen Trimble 50 City Clerk 576 1 1
