HomeMy Public PortalAbout01-21-1980 570 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, JANUARY.21, 1980 1 The Common Council of the City of Richmond, Indiana, met in regular 2 session January 21, 1980 at the hour of 7:30 p.m. in the Council 3 Chambers in .the Municipal Building in said City. President Paust 4 presided with the following members present: Messrs. Elstro, Williams, 5 Hankinson, Welch, Carter and Mills. Absent: Ahaus and Parker. The 6 following business was had, to-wit: 7 8 Councilman Carter gave devotions. 9 10 Councilman Williams moved the minutes of the previous meeting be ac- 11 cepted as prepared, seconded by Councilman Welch and on unanimous voice 12 vote the motion was carried. 13 14 Councilman Mills moved to suspend the rules and read Resolution No. 2- 15 1980 by title only, seconded by Councilman Welch and on unanimous voice 16 vote the motion was carried. 17 18 The Clerk read by title only Resolution No. 2-1980 - A RESOLUTION TO 19 AUTHORIZE THE SIGNING OF A GRANT AGREEMENT WITH THE DEPARTMENT OF 20 HOUSING AND URBAN DEVELOPMENT FOR FUNDING FOR THE CONSTRUCTION OF THE 21 SOUTH EXTENSION OF INDUSTRIAL PARKWAY. 22 23 Speaking for Resolution No. 2-1980 was Director of Community Develop- 24 ment Tim Ryder. 25 26 Councilman Mills moved for adoption of Resolution No. 2-1980, second- 27 ed by Councilman Elstro and on unanimous voice vote the motion was 28 carried. 29 30 Councilman Elstro inquired about the status of the water problem of Mr. 31 and Mrs. Jones on South 3rd Street which had been discussed at the last 32 meeting. 33 34 Tim Ryder, Director of Community Development, stated the Water Com- 35 pany says it is a problem of the home owner because of the lateral 36 main on 3rd Street. He sees three options available. One would be 37 to patch the line, which would not be the best answer in his opinion. 38 Secondly, run a new water main up t:l 4th Street, which would move the 39 lateral closer to the property line, and thirdly, to move the lateral 40 off the street but keep as a lateral up to the person's property. 41 The Water Company is willing to build a main from 3rd to 4th Street. 42 The City is willing to pay one-third of the cost for the lateral 43 running to the owner's property. The Council expressed its feeling 44 that the City should use Community Development funds for running water 45 to the home at 1337 South 3rd Street. Mr. Ryder replied that he would 46 check with the Mayor regarding making the necessary repairs, if that 47 is the desire of Council. Mr. Anderson is to check with the PSCI to 48 see if the Water Company's policy is a local decision or the policy 49 of the American Water Works. Mr. Willie Jones, the homeowner, expres- 50 sed his thanks to the council for their efforts on his behalf. 51 52 City Controller Donald Meredith brought to Council's attention the 53 reduction in the size of the copies of the minutes and told of the 54 savings to the city in cost of paper. 55 56 Mr. McGathey, Executive Director of the Richmond Housing Authority, 57 announced to the council that he would be requesting approval of the 58 City to apply for one-hundred-seventeen (117) additional units for low 59 and moderate income housing. 60 61 Councilman Mills moved to suspend the rules and read Ordinance No. 5- 62 1980 and Ordinance No. 6-1980 on first reading by title only, seconded 63 by Councilman Williams and on unanimous voice vote the motion was 64 carried. 571 Common Council Minutes Cont. January 21, 1980 Page 2 1 The Clerk read on first reading by title only Ordinance No. 5- 2 1980 - AN ORDINANCE AMENDING CHAPTER 22 OF THE MUNICIPAL CODE, 3 BEING ORDINANCE NO. 2325-1968,COMMONLY KNOWN AS THE ZONING ORDI- 4 NANCE OF THE CITY OF RICHMOND, INDIANA ADOPTED JUNE 3, 1968,PRO- 5 VIDING FOR THE REZONING OF PROPERTY LOCATED ON COMMERCE ROAD 6 FROM M-2 GENERAL INDUSTRIAL DISTRICT AND C-4 GENERAL BUSINESS 7 DISTRICT. 8 9 President Paust announced Ordinance No. 5-1980 is referred to the 10 Plan Commission. 11 12 The Clerk read on first reading by title only Ordinance No. 6- 13 1980 - AN ORDINANCE AMENDING SPECIAL USE ORDINANCE NO. 2508- 14 1970, WHICH AUTHORIZED A MEDICAL OFFICE BUILDING AT 2519 EAST 15 MAIN STREET LOCATED IN AN R-3 ONE -TO-EIGHT FAMILY RESIDENCE DIS- 16 TRICT, FOR THE PURPOSE OF AMENDING THE SPECIAL USE TRAFFIC CIRCU- 17 LATION PLAN TO PERMIT AN EXIT FROM THE REAR OF THE PROPERTY. 18 19 President Paust announced Ordinance No. 6-1980 is referred to the 20 Plan Commission. 21 22 The Clerk read on second reading Ordinance No. 1-1980 - AN ORDI- 23 NANCE AUTHORIZING CERTAIN EXPENDITURES AND ACTIVITIES OF THE 24 RICHMOND POWER & LIGHT AND MATTERS RELATED THERETO. 25 26 President Paust announced Ordinance No. 1-1980 is on public hearing. 27 28 There being no one speaking against or for Ordinance No. 1-1980, III 29 Councilman Williams moved for engrossment, seconded by Councilman 30 Mills. The motion carried with Councilman Carter voting no. 31 Ordinance No. 1-1980 will appear on third reading at the next 32 meeting. 33 34 City Attorney Ed Anderson examined proof of publication for Ordi- 35 nances Nos. 3-1980 and No. 4-1980 and found them to be in order. 36 Councilman Mills moved the proof of publication be accepted and 37 filed, seconded by Councilman Welch and on unanimous voice vote 38 the motion was carried. 39 40 The Clerk read on second reading Ordinance No. 3-1980 - AN ORDI- 41 NANCE TO APPROPRIATE TO THE GENERAL FUND FROM THE CUMULATIVE 42 - CAPITAL IMPROVEMENT FUND. 43 44 President Paust announced Ordinance No. 3-1980 is on public hearing. 45 46 There being no one speaking against or for Ordinance No. 3-1980, 47 Councilman Elstro moved for engrossment, seconded by Councilman 48 Williams and on unanimous voice vote the motion was carried. 49 50 Councilman Elstro moved to suspend the rules and read Ordinance 51 No. 3-1980 on third and final reading by title only, seconded 52 by Councilman Mills and on unanimous voice vote the motion was 53 carried. 54 55 The Clerk read on third reading by title only Ordinance No. 3-1980. 56 57 Ordinance No. 3-1980 was placed on final passage or rejection and 58 on a call of the roll the following was recorded: Ayes: Elstro, 59 Williams, Hankinson, Welch, Carter, Mills and Paust. Noes: None. 60 The vote being seven (7) to zero (0) in favor of passage of Ordi- 61 nance No. 3-1980. 62 63 The Clerk read on second reading Ordinance No. 4-1980 - AN ORDI- 64 NANCE TO APPROPRIATE FROM THE LOCAL ROAD & STREET FUND. 572 _ _ Common Council Minutes Cont. January 21, 1980 Page 3 1 President Paust announced Ordinance No. 4-1980 is on public hearing. 2 3 There being no one speaking aginst or for Ordinance No. 4-1980, Council- 4 man Mills moved for engrossment, seconded by Councilman Welch and on 5 unanimous voice vote the motion was carried. 6 7 Councilman Williams moved to suspend the rules and read Ordinance No. 8 4-1980 on third and final reading by title only, seconded by Councilman 9 Mills and on unanimous voice vote the motion was carried. 10 11 The Clerk read on third reading by title only Ordinance No. 4-1980. 12 13 Ordinance No. 4-1980 was placed on final passage or rejection and on 14 a call of the roll the following was recorded: Ayes: Elstro, Williams, 15 Hankinson, Welch, Carter, Mills and Paust. Noes: None. The vote 16 being seven (7) to zero (0) in favor of passage of Ordinance No. 4-1980. 17 18 Councilman Mills moved to suspend the rules and read Ordinance No. 114- 19 1979 on third and final reading by title only, seconded by Councilman 20 Williams and on unanimous voice vote the motion was carried. 21 22 The Clerk read on third reading by title only Ordinance No. 114-1979 - 23 AN ORDINANCE AUTHORIZING A SPECIAL USE IN AN R-3 ONE-TO-EIGHT FAMILY 24 RESIDENCE DISTRICT FOR ADMINISTRATIVE AND BUSINESS OFFICES ON PROPERTY 25 LOCATED AT 701 NORTH 13TH STREET, PURSUANT TO ARTICLE 48 OF CHAPTER 26 22 OF THE MUNICIPAL CODE COMMONLY KNOWN AS THE ZONING ORDINANCE OF 27 THE CITY OF RICHMOND, INDIANA. 28 29 Ordinance No. 114-1979 was placed on final passage or rejection and on 30 a call of the roll the following was recorded: Ayes: Elstro, Williams, 31 Hankinson, Welch, Mills and Paust. Noes: Carter. The vote being 32 six (6) to one (1) in favor of passage of Ordinance No. 114-1979. 33 34 There being no further business on motion duly made, seconded and 35 passed the meeting was adjourned.
