HomeMy Public PortalAbout12-03-1979 561 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, DECEMBER 3, 1979 1 The Common Council of the City of Richmond, Indiana, met in regular session 2 December 3, 1979 at the hour of .7:30 p.m. in the Council Chambers in the 3 Municipal Building in said City. President Paust presided with the follow- "' 4 ing members present: Messrs. Elstro, Williams, Ahaus, Whitesell, Mills, 5 Carter and Welch. Absent: Austerman. The following business was had, 6 to-wit: 7 8 Councilman Whitesell gave devotions. 9 10 Councilman Williams moved to approve the minutes of the previous meeting as 11 prepared, seconded by Councilman Mills and on unanimous voice vote the 12 motion was carried. 13 14 Mayor Clifford Dickman reported on his recent trip to Las V6gas to attend 15 the convention of the National League of Cities and urged the President of 16 Council to attend this convention in the future. The Mayor also urged 17 passage of the appropriation of money for the South "L" Street project. 18 19 President Paust announced Mr. Pete Prosser is interested in being reappoint- 20 ed to the Police Merit Board .and asked if Council has any other recommenda- 21 tions for this position. Councilman Williams moved that Mr. Prosser be 22 appointed, seconded by Councilman Ahaus and on unanimous voice vote the 23 motion was carried. 24 25 Councilman Mills moved to suspend the rules and read Ordinance Nos. 117-1979, 26 118-1979, 119-1979 and 120-1979 on first reading by title only, seconded by 27 Councilman Carter and on unanimous voice vote the motion was carried. 28 29 The Clerk read on first reading by title only Ordinance No.- 117-1979 - AN 30 ORDINANCE AMENDING CHAPTER 22 MUNICIPAL-CODE,THE MUNICIPA CODE, BEING ORDINANCE NO. . • 31 .2325-1968, COMMONLY KNOWN AS THE ZONING._ORDINANCE OF THE CITY OF RICHMOND, 32 'INDIANA, ADOPTED JUNE 3, 1968, PROVIDING FOR THE REZONING OF PROPERTY 33 LOCAI'bD AT 1400 EAST MAIN STREET FROM R-4 MULTI-FAMILY RESIDENCE TO C-2 34 COMMUNITY BUSINESS DISTRICT. 35 36 President Paust announced Ordinance No. 117-1979 is referred to the Plan 37 Commission. 38 • 39 The Clerk read on first reading by title only Ordinance No. 118-1979 - AN 40 ORDINANCE OF THE CITY OF RICHMOND AUTHORIZING THE ISSUANCE ANI) SALE OF 41 REVENUE BONDS AND LOANING THE PROCEEDS THEREOF- TO BELDEN CORPORATION FOR THE 42 FINANCING OF ECONOMIC DEVELOPMENT FACILITIES, AND OTHER MATTERS RELATING 43 THERETO. 44 45 Councilman Mills stated, due to the full disclosure law, he will be voting 46 for this ordinance. He is a Process Engineering Supervisor at Belden and 47 does own Belden stock. 48 49 Councilman Mills moved to suspend the rules and read Ordinance No. 118-1979 50 on second reading, seconded by Councilman Ahaus and on unanimous voice vote 51 the motion was carried. 52 53 The Clerk read on second reading Ordinance No. 118-1979. 54 55 President Paust announced Ordinance No. 118-1979 is on public hearing. 56 57 Speaking for Ordinance No. 118-1979 was Attorney Andrew Cecere, 101 South 58 10th Street, representing Belden. 59 60 Councilman Mills moved for engrossment of Ordinance No. 118-1979, seconded 61 by Councilman Carter and on unanimous voice vote' the motion was carried. 62 63 Councilman Mills moved to suspend the rules and read Ordinance No. 118-1979 64 on third and final reading by title only, seconded by Councilman Carter and 65 . on unanimous voice vote the motion was carried. 562 Common Council Minutes Cont. The vote being eight (8) 6 to zero (0) in favor of passage of Ordinance No. 118-1979. 7 8 The Clerk read on first reading by title only Ordinance No. 119-1979 - AN 9 ORDINANCE TO TRANSFER WITHIN THE GENERAL FUND. 10 11 Councilman Mills moved to suspend the rules and read Ordinance No. 119-1979 12 on second reading, seconded by Councilman Ahaus and on unanimous voice vote 13 the motion was carried. 14 15 The Clerk read on second reading Ordinance No. 119-1979. 16 17 President Paust announced Ordinance No. 119-1979 is on public hearing. 18 19 There being no one speaking against or for Ordinance No. 119-1979, Council- 20 man Mills moved for engrossment of Ordinance No. 119-1979, seconded by 21 Councilman Ahaus and on unanimous voice vote the motion was carried. 22 23 Councilman Welch moved to suspend the rules and read Ordinance No. 119-1979 24 on third and final reading by title only, seconded by Councilman Williams 25 and on unanimous voice vote the motion was carried. 26 27 The Clerk read on third reading by title only Ordinance No. 119-1979. 28 29 Ordinance No. 119-1979 was placed on final passage or rejection and on a cal 30 of the roll the following was recorded: Ayes: Elstro, Williams, Ahaus, 31 Whitesell, Mills, Carter, Welch and Paust. Noes: None. The vote being 32 eight (8) to zero (0) in favor of passage of Ordinance No. 119-1979. 33 34 The Clerk read on first reading by title only Ordinance No. 120-1979 - AN 35 ORDINANCE TO TRANSFER WITHIN THE AIRPORT FUND. 36 37 Councilman Mills moved to suspend the rules and read Ordinance No. 120-1979 38 on second reading, seconded by Councilman Welch and on unanimous voice vote 39 the motion was carried. 40 41 The Clerk read on second reading Ordinance No. 120-1979. 42 43 President Paust announced Ordinance No. 120-1979 is on public hearing. 44 45 There being no one speaking against or for Ordinance No. 120-1979 Councilman 46 Elstro moved for engrossment, seconded by Councilman Mills and on unanimous 47 voice vote the motion was carried. 48 49 Councilman Ahaus moved to suspend the rules and read Ordinance No. 120-1979 50 on third and final reading by title only, seconded by Councilman Williams 51 and on unanimous voice vote the motion was carried. 52 53 The Clerk read on third reading by title only Ordinance No. 120-1979. 54 55 Ordinance No. 120-1979 was placed on final passage or rejection and on a cal 56 of the roll the following was recorded: Ayes: Elstro, Williams, Ahaus, 57 Whitesell, Mills, Carter, Welch and Paust. The vote being eigh. 58 (8) to zero (0) in favor of passage of Ordinance No. 120-1979. 59 60 The Clerk read on second reading Ordinance No. 116-1979 - AN ORDINANCE TO 61 APPROPRIATE FROM THE LOCAL ROAD AND STREET FUND. 563 Common Council Minutes Cont. December 3, 1979 Page 3 • 1 City Attorney Ed Anderson examined proof of publication for Ordinance No. 2 116-1979 and found it to be in order. Councilman Mills moved the proof be 3 accepted and filed, seconded by Councilman Welch and on unanimous voice vote • 4 the motion was carried. 5 6 President Paust announced Ordinance No. 116-1979 is on public hearing. 7 8 There being no one speaking against -or for Ordinance No. 116-1979 Councilman 9 Williams moved for engrossment, seconded by Councilman Elstro and on 10 unanimous voice vote the motion was carried. 11 12 Councilman Williams moved to suspend the rules and read Ordinance No. 13 116-1979 on third and final reading by title only, seconded by Councilman 14 Ahaus and on unanimous voice vote the motion was carried. 15 16 The Clerk read on third reading by title only Ordinance No. 116-1979. 17 18 Ordinance No. 116-1979 was placed on final passage or rejection and on a 19.' call of the roll the following was recorded: Elstro, Williams, Ahaus, 20 Whitesell, Mills, Welch and Paust. Noes: Carter. The vote being seven (7) 21 to one (1) in favor of passage of Ordinance No. 116-1979. 22 23 Councilman Mills, Chairman of the Committee of the Whole, announced there 24 was a meeting on Ordinance No. 100-1979 on November 12 and some parts of 25 the Ordinance had to do with the Wayne County Health Department. Mr. 26 Anderson contacted the Department and has a reply back and will have a new 27 Ordinance forthcoming.
