HomeMy Public PortalAbout11-19-1979 555 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, NOVEMBER 19, 1979 1 The Common Council of the City of Richmond, Indiana, met in regular 2 session November 19, 1979 at the hour of 7:30 p.m. in the Council 3 Chambers in the Municipal Building in said City. President Paust presided III 4 with the following members present: Messrs. Elstro, Williams, Ahaus, 5 Austerman,. Whitesell, Carter and Welch. Absent: Mills. The following 6 business was had, to-wit: 7 8 Councilman Welch gave devotions. 9 10 Councilman Williams moved to approve the minutes of the previous meeting 11 as prepared., seconded by Councilman Whitesell and on unanimous voice 12 vote the motion was carried. 13 14 Councilman Ahaus moved to suspend the rules and read Resolution Nos. 25- 15 1979 and 26-1979 by title only, seconded by Councilman Carter and on . 16 unanimous voice vote the motion was carried. 17 18 The Clerk read by title only Resolution No. 25-1979 - A RESOLUTION TO 19 TRANSFER WITHIN THE GENERAL FUND. 20 21 Councilman Ahaus moved for adoption of Resolution No. 25-1979, seconded 22 by Councilman Carter and on unanimous voice vote the motion was carried. 23 24 The Clerk read by title only Resolution No. 26-1979 - A RESOLUTION AUTHORI- 25 ZING THE EXECUTION OF AN AGREEMENT BY AND BETWEEN THE INDIANA STATE HOUSING 26 BOARD AND THE OFFICE OF COMMUNITY DEVELOPMENT, RICHMOND, INDIANA FOR THE 27 IMPLEMENTATION OF SECTION 8 MODERATE REHABILITATION PROGRAM FOR EXISTING 28 HOUSING. 29 30 Speaking for and explaining Resolution No. 26-1979 was Director of 31 Community Development.Tim Ryder. 32 33 Councilman. Williams moved for adoption of Resolution No. 26-1979, seconded 34 by Councilman Carter and on unanimous voice vote the motion was carried. 35 36 City Controller Don Meredith reminded Councilmen of their appointment to 37 the Police Merit Commission. President Paust stated. he has. contacted Mr. 38 Pete Prosser, who is currently serving on the Commission and he indicated 39 willingness to continue serving. Councilman Austerman suggested to the 40 media their notifying the public to contact any Councilman, if they are 41 interested in serving. Mr. Meredith noted Mr. Richard Hamm had been 42 appointed from Council and was elected by the Police. 43 44 Councilman Welch moved to suspend the rules and read Ordinance Nos. 114- 45 • 1979, 115-1979 and 116-1979 on first reading by title only, seconded by 46 Councilman Austerman and on unanimous voice vote the motion was carried. 47 48 The Clerk read on first reading by title only Ordinance No. 114-1979 - AN 49 ORDINANCE AUTHORIZING A SPECIAL USE IN. AN R-3 ONE-TO-EIGHT FAMILY- RESI- 50 DENCE DISTRICT FOR ADMINISTRATIVE AND BUSINESS OFFICES ON PROPERTY LOCATED 51 AT 701 NORTH 13TH STREET, PURSUANT TO ARTICLE 48 OF CHAPTER 22 OF THE 52 MUNICIPAL CODE COMMONLY KNOWN AS THE ZONING ORDINANCE OF -THE CITY OF RICH- ' 53 MOND, INDIANA. 54 55 Councilman Paust announced Ordinance No. 114-1979 is referred to the 56 Plan Commission. . 57 58 . The Clerk read on first reading by title only Ordinance No. 115-1979 - 59 ORDINANCE OF THE CITY OF RICHMOND AUTHORIZING THE CONSENT OF THE CITY TO 60 THE ASSIGNMENT OF A CERTAIN LEASE, A PART OF A FINANCING AGREEMENT UNDER 61 WHICH RICHMOND ECONOMIC DEVELOPMENT FIRST MORTGAGE REVENUE BONDS (KB 62 LAMINATES, INC) WERE ISSUED AND SOLD. 63 64 Councilman Austerman moved to suspend the rules and read Ordinance -No. 115- 65 1979 on second reading, seconded by Councilman Williams and on uanimous 66 voice vote the motion was carried. 556 - ---- - ---—--- - -- --- --- -- - --- --- - -- Common Council Minutes Cont. November 19, 1979 Page 2 1 The Clerk read on second reading Ordinance No. 115-1979. 2 3 President Paust announced Ordinance No. 115-1979 is on public hearing. 4 5 Speaking for Ordinance No. 115-1979 was Attorney Andy Cecere, noting this 6 is an assignment of lease from KB Laminates, Inc. to Productivity Corporation. 7 8 Councilman Austerman moved for engrossment of Ordinance No. 115-1979, 9 seconded by Councilman Whitesell and on unanimous voice vote_the motion 10 was carried. 11 12 Councilman Austerman moved to suspend the rules and read Ordinance No. 115- 13 1979 on third and final reading by title only, seconded by Councilman 14 Williams and on unanimous voice vote the motion was carried. 15 16 The Clerk read on third reading by title only Ordinance No. 115-1979. 17 18 Ordinance No. 115-1979 was placed on final passage or rejection and on a 19 call of the roll the following was recorded: Ayes: Elstro, Williams, 20 Ahaus, Austerman, Whitesell, Carter, Welch and Paust. Noes: None. The 21 vote being eight (8) to zero (0) in favor of passage of Ordinance No. 22 115-1979. 23 24 The Clerk read on first reading by title only Ordinance No. 116-1979 - AN 25 ORDINANCE TO APPROPRIATE FROM THE LOCAL ROAD AND STREET FUNDS. 26 27 President Paust announced Ordinance No. 116-1979 has to be advertised. 28 29 City Attorney Ed Anderson examined proof of publication for Ordinance Nos. 30 104-1979, 105-1979, 106-1979, 107-1979, 110-1979, 111-1979, 112-1979 and 31 113-1979 and found it to be in order. Councilman Austerman moved the proof 32 of publication be accepted and filed, seconded by Councilman Ahaus and on 33 unanimous voice vote the motion was carried. 34 35 The Clerk read on second reading Ordinance No. 104-1979 - AN ORDINANCE TO 36 APPROPRIATE FROM THE FEDERAL REVENUE SHARING TRUST FUND. 37 38 President Paust announced Ordinance No. 104-1979 is on public hearing. 39 40 There being no one speaking in favor of or against Ordinance No. 104-1979 41 Councilman Williams moved for engrossment, seconded by Councilman Elstro. 42 The motion carried with Councilman Carter voting no. 43 44 Councilman Elstro moved to suspend the rules and read Ordinance No. 104- 45 1979 on third and final reading by title only, seconded by Councilman 46 Williams and on unanimous voice vote the motion was carried. 47 48 The Clerk read on third reading by title only Ordinance No. 104-1979. 49 50 Ordinance No. 104-1979 was placed on final passage or rejection and on a 51 call of the roll the following was recorded: Ayes: Elstro, Williams, 52 Ahaus, Austerman, Whitesell, Welch and Paust. Noes: Carter. The vote 53 being seven (7) to one (1) in favor of passage of Ordinance No. 104-1979. 54 55 The Clerk read on second reading Ordinance No. 105-1979 - AN ORDINANCE TO 56 APPROPRIATE WITHIN THE MOTOR VEHICLE HIGHWAY FUND. 57 58 President Paust announced Ordinance No. 105-1979 is on public hearing. 59 Speaking for-this Ordinance was Director of Transportation Jerry Haynes. 60 61 Councilman Austerman moved for engrossment of Ordinance No. 105-1979, 62 seconded by Councilman Welch and on unanimous voice vote the motion was 63 carried. 557 • Common Council Minutes Cont. The 4 vote being eight (8) to zero (0) in favor of passage of Ordinance No. 5 113-1979. 6 7 Councilman Carter explained why he voted against the ordinances relating 8 to payroll as he supports the philosophy of operating within a balanced 9 budget and frugality has to be practiced within the City budget._ He is 10 going to be critical of additional payroll for salaries. 11 • 12 Councilman Welch recognized the following students who were in attendance 13 observing Council for their government classes: Mr. Larry Koening, Presi- 14 dent of Student Congress for Richmond Senior High School; Jim Hudson, 15 Karen Allen, Eric Binford, Tom Ropp. 16 17 There being no further business on motion duly made, seconded and passed 18 the meeting was adjourned. 19 20 Kenneth Paust 21 President 22 . 23 A1"1'LST: JoEllen Trimble 24 City Clerk 560
