HomeMy Public PortalAbout10-15-1979 547 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, OCTOBER 15, 1979 1 The Common Council of the City of Richmond, Indiana, met in regular session 2 October 15, 1979 at the hour of 7:30 p.m. in the Council Chambers in the 3IIIMunicipal Building in said City. President Paust presided with the 4 following members present: Messrs. Elstro, Williams, Ahaus, Austerman, 5 Whitesell, Mills, Carter and Welch. Absent: None. The following 6 business was had, to wit: 7 8 Councilman Mills gave devotions. 9 10 Councilman Williams moved to approve the minutes of the previous meeting 11 as prepared, seconded by Councilman Mills and on unanimous voice vote, 12 the motion was carried. 13 14 Councilman Mills moved to suspend the rules and read Resolution Nos. 15 22-1979 and 23-1979 by title only, seconded by Councilman Carter and 16 on unanimous voice vote, the motion was carried. 17 18 The Clerk read by title only Resolution No. 22-1979 - A RESOLUTION APPROVING 19 THE USE OF LOCAL OPTION FUNDS OF THE FOURTH YEAR COMMUNITY DEVELOPMENT 20 BLOCK GRANT FOR ACTIVITIES RELATING TO THE REHABILITATION OF THE FORMER 21 NICHOLSON SCHOOL BUILDING. 22 23 Speaking for Resolution No. 22-1979 was Director of Community Development 24 Tim Ryder and Rev. R.E. Girton, 2105 South "M" Street. 25 26 Councilman Elstro moved for adoption of Resolution No. 22-1979, seconded 27 by Councilman Williams. The motion was carried with Councilman Mills and 28 Carter voting-no. 29 30 The Clerk read by title only Resolution No. 23-1979 - A RESOLUTION TO 31 TRANSFER WITHIN THE GENERAL FUND. 32 - 33 Councilman Williams moved for adoption of Resolution No. 23-1979, seconded 34 by Councilman Ahaus and on unanimous voice vote, the motion was carried. 35 36 Councilman Elstro reported a hole in the alley between 9th and llth on 37 "M" Street. 38 39 Councilman Williams. reported a chuck hole between "B" and "C" Streets in the 40 alley on South 10th Street and from an alley in the 1100 block between 41 North "I" and "J" Streets, gravel is washing into the street. 42 43 Councilman Mills moved to suspend the rules and read Ordinance Nos. 99-1979 44 and 100-1979 on first reading by title only, seconded by Councilman 45 Williams and on unanimous voice vote, the motion was carried. 46 47 The Clerk read on first reading by title only Ordinance No. 99-1979 - AN 48 ORDINANCE TO TRANSFER WITHIN THE AIRPORT FUND. 49 50 Councilman Mills moved to suspend the rules and read Ordinance No. 99-1979 51 on second reading, seconded by Councilman Welch and on unanimous voice vote, 52 the motion was carried. 53 54 The Clerk read on second reading Ordinance No. 99-1979. 55 56 Councilman Mills moved for engrossment of Ordinance No. 99-1979, seconded b 57 Councilman Welch and on unanimous voice vote, the motion was carried. 58 59 Councilman Mills moved to suspend the rules and read Ordinance No. 99-1979 60 on third and final reading by title only, seconded by Councilman Welch and 61 on unanimous voice vote, the motion was carried. 58 Common Council Minutes Cont. October 15, 1979 Page 2 1 The Clerk read on third reading by title only Ordinance No. 99-1979. 2 3 Ordinance No. 99-1979 was placed on final passage or rejection and on a call 4 of the roll, the following was recorded: Ayes: Elstro, Williams, Ahaus, 5 Austerman, Whitesell, Mills, Carter, Welch and Paust. Noes: None. The vote 6 being nine (9) to zero (0) in favor of passage of Ordinance No. 99-1979. 7 8 The Clerk read on first reading by title only Ordinance No. 100-1979 - AN 9 ORDINANCE TO ADOPT AS PART OF THE MUNICIPAL CODE OF THE CITY OF RICHMOND, 10 WAYNE COUNTY, INDIANA, AN UNSAFE BUILDING LAW AS PROVIDED IN IC 18-5-5.5-1 11 OF THE LAWS OF THE STATE OF INDIANA. 12 13 Councilman Welch requested a Committee of the Whole hearing on Ordinance No. 14 100-1979. Councilman Welch proposed delaying Ordinance No. 100-1979 for a 15 Committee of the Whole Meeting, seconded by Councilman Elstro and on unanimous 16 voice vote, the motion was carried. 17 18 Councilman Mills set Monday, November 12 at 7:00 p.m. in the Board of Works 19 Room for the .meeting of the Committee of the Whole. 20 21 The Clerk read on second reading Ordinance No. 96-1979 - AN ORDINANCE TO 22 APPROPRIATE WITHIN THE MOTOR VEHICLE HIGHWAY FUND. 23 24 City Attorney Ed Anderson examined proof of publication for Ordinance Nos. 25 96-1979 and 97-1979 and found it to be in order. Councilman Mills moved the 26 proof be accepted and filed, seconded by Councilman Carter and on unanimous 27 voice vote, the motion was carried. 28 29 Councilman Carter moved for engrossment of Ordinance No. 96-1979, seconded b 30 Councilman Elstro and on unanimous voice vote, the motion was carried. 31 32 Councilman Carter moved to suspend the rules and read Ordinance No. 96-1979 33 on third and final reading by title only, seconded by Councilman Whitesell 34 and on unanimous voice vote, the motion was carried. 35 36 The Clerk read on third reading by title only Ordinance No. 96-1979. 37 38 Ordinance No. 96-1979 was placed on final passage or rejection and on a call 39 of the roll, the following was recorded: Ayes: Elstro, Williams, Ahaus, 40 Austerman, Whitesell, Mills, Carter, Welch and Paust. Noes: None. The 41 vote being nine (9) to zero (0) in favor of passage of Ordinance No. 96-1979. 42 43 The Clerk read on second reading Ordinance No. 97-1979 - AN ORDINANCE TO 44 APPROPRIATE WITHIN THE GENERAL FUND. 45 46 Councilman Austerman moved for engrossment of Ordinance. No. 97-1979, seconded 47 by Councilman Whitesell and on unanimous voice vote, the motion was carried. 48 49 Councilman Austerman moved to suspend the rules and read Ordinance No. 97-19 9 50 on third and final reading by title only, seconded by Councilman Mills and 51 on unanimous voice vote, the motion was carried. 52 53 The Clerk read on third reading by title only Ordinance No. 97-1979. 54 55 Ordinance No. 97-1979 was placed on final passage or rejection and on a call 56 of the roll, the following was recorded: Ayes: Elstro, Williams, Ahaus, 57 Austerman, Whitesell, Mills, Carter, Welch and Paust. Noes: None. The vot: 58 being nine (9) to zero (0) in favor of passage of Ordinance No. 97-1979. 59 60 Councilman Austerman presented a memorial to Dr. Alan Crum who recently pass=d 61 away. He stated the City of Richmond has lost a very able and responsible 62 citizen. Councilman Carter added that Dr. Crum founded the chapter in 63 Richmond of the Fellowship of Christian Athletes. 549 Common Council Minutes Cont. October 15, 1979 Page 3 1 Councilman Williams moved to bring Ordinance No. 58-1978 off the table, 2 seconded by Councilman Elstro and on a call of the roll, the following was III3 recorded: Ayes: Elstro, Williams, Ahaus and Whitesell. Noes: Austerman, 4 Mills, Carter, Welch and Paust.
