HomeMy Public PortalAbout10-01-1979 543 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, OCTOBER 1, 1979 1 The Common Council of the City of Richmond, Indiana, met in regular session 2 October 1, 1979 at the hour of 7:30 p.m. in the Council Chambers in the 3 Municipal Building in said City. President Paust presided with the following III4 members present: Messrs. Elstro, Williams, Austerman, Whitesell, Mills, Ahaus 5 Carter and Welch. Absent : None. The following business was had, to wit: 6 7 ' Councilman Elstro gave devotions. 8 9 Councilman Mills moved to approve the minutes of the previous meeting, as 10 prepared, seconded by Councilman Whitesell and on unanimous voice vote, 11 the motion was carried. 12 13 Councilman Mills moved to suspend the rules and read Resolution No. 20-1979 14 by title only, seconded by Councilman Carter and on unanimous voice vote, 15 the motion was carried. 16 17 The Clerk read by title only Resolution No. 20-1979 - A RESOLUTION TO 18 _ AUTHORIZE THE ACQUISITION OF CERTAIN LAND AND THE SELLING OF SUCH LAND 19 TO THE U.S . GOVERNMENT FOR THE PURPOSE OF THE U.S . GOVERNMENT CONSTRUCTING 20 THEREON AN ARMY RESERVE CENTER. 21 22 Councilman Mills moved for adoption of Resolution No. 20-1979, seconded by 23 Councilman Elstro and on unanimous voice vote, the motion was carried. 24 25 Councilman Mills moved to suspend the rules and read Resolution No. 21-1979 26 by title only, seconded by Councilman. Welch and on unanimous voice vote, 27 the motion was carried. 28 29 The Clerk read by title only Resolution No. 21-1979 - A RESOLUTION TO 30 TRANSFER WITHINI;THE GENERAL FUND. 31 32 Councilman Ahaus moved for adoption of Resolution .No. 21-1979, .seconded by 33 Councilman Mills and on unanimous voice vote, the motion was carried. 34 35 Councilman Whitesell reported to the Board of Works a bad weed problem at 36 a vacant house located at 428 Lincoln. 37 38 Councilman Elstro requested. the Street Department check the condition of an 39 alley between "M" and. Perry and 9th and llth Streets. 40 41 Councilman Williams reported a big hole which should be filled on North 42 8th Street across the railroad on the west side. 43 44 Councilman Whitesell requested receiving the minutes of the Plan Commission, 45 sooner than in the past. 46 47 Councilman Mills moved to suspend the rules and read on first reading by 48 title only, Ordinance Nos. 95-1979, 96-1979, 97-1979 and 98-1979, seconded 49 by Councilman Elstro and on unanimous voice vote, the motion was carried. 50 51 The Clerk read on first reading by title only Ordinance No. 95-1979 - AN 52 ORDINANCE OF THE CITY OF RICHMOND AUTHORIZING THE ISSUANCE AND SALE OF REVENUE 53 BONDS AND LOANING THE PROCEEDS THEREOF TO PRIMEX PLASTICS CORP. FOR THE 54 FINANCING OF ECONOMIC DEVELOPMENT FACILITIES, AND OTHER MATTERS RELATING 55 THERETO. 56 57 Councilman Mills moved to suspend the rules and read Ordinance No. 95-1979 58 on second reading, seconded by Councilman Williams and on unanimous voice 59 vote, the motion was carried. 60 61 The Clerk read on second reading Ordinance No. 95-1979. 62 63 Speaking for Ordinance No. 95-1979 was Mr. Robert O'Maley, Attorney representing 64 Primex Plastics . 544 Common Council Minutes Cont. October 1, 1979 Page 2 Councilman Austerman moved for engrossment of _Ordinance No. 95-1979, seconded by Councilman Mills and on unanimous voice vote, the motion was carried. Councilman Carter moved to suspend the rules and read Ordinance No. 95-1979 on third and final reading by title only, seconded by Councilman Williams and on unanimous voice vote, the motion was carried. The Clerk read on third reading by title only Ordinance No. 95-1979 . Ordinance No. 95-1979 was placed on final passage or rejection and on a call of the roll, the following was recorded: Ayes: Elstro, Williams, Ahaus, Austerman, Whitesell, Mills, Carter, Welch and Paust. Noes: None. The vote being nine (9) to zero (0) in favor of passage of Ordinance No. 95-1979. The Clerk read on first reading by title only Ordinance No. 96-1979 - AN ORDINANCE TO APPROPRIATE WITHIN THE MOTOR VEHICLE HIGHWAY FUND. President Paust announced Ordinance No. 96-1979 has to be advertised. The Clerk read on first reading by title only Ordinance No. 97-1979 - AN ORDINANCE TO APPROPRIATE WITHIN THE GENERAL FUND. President Paust announced Ordinance No. 97-1979 has to be advertised. The Clerk read on first reading by title only Ordinance No. 98-1979 - AN ORDINANCE TO TRANSFER WITHIN THE GENERAL FUND. Councilman Mills moved to suspend the rules and read Ordinance No. 98-1979 on second reading, seconded by Councilman Williams and on unanimous voice vote, the motion was carried. The Clerk read on second reading Ordinance No. 98-1979. Councilman Mills moved for engrossment of Ordinance No. 98-1979, seconded by Councilman Welch and on unanimous voice vote, the-motion was carried. Councilman Mills moved to suspend the rules and read Ordinance No. 98-1979 on third and final reading by title only, seconded by Councilman Carter, and on unanimous voice vote, the motion was carried. The Clerk read on third reading by title only Ordinance No. 98-1979. Ordinance No. 98-1979 was placed on final passage or rejection and on a call of the roll, the following was recorded: Ayes: Elstro, Williams, Ahaus, Auste) man, Whitesell, Mills, Carter, Welch and Paust. Noes: None. The vote being nine (9) to zero (0) in favor of passage of Ordinance No. 98-1979. The Clerk read on second reading Ordinance No. 93-1979 - AN ORDINANCE AUTHORIZING A SPECIAL USE IN AN R-2 ONE-FAMILY RESIDENCE DISTRICT FOR A MEDIC OFFICE ON PROPERTY LOCATED AT 624 NATIONAL ROAD WEST, PURUSANT TO ARTICLE 48 OF CHAPTER 21 OF THE MUNICIPAL CODE COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA. Speaking for Ordinance No. 93-1979 was Mr. Karl Kolger, Attorney and Agent for the owner. Councilman Mills moved to amend Ordinance No. 93-1979 to include conditions (c) and (d) as recommended by the Plan Commission, seconded by Councilman Carter and on unanimous- voice vote, the motion was carried. Councilman Mills moved for engrossment of Amended Ordinance No. 93-1979, seconded by Councilman Welch and on unanimous voice vote, the motion was carried. 545 Common Council Minutes Cont. October 1, 1979 Page 3 1 Councilman Carter moved to suspend the rules and read Amended Ordinance No. 2 93-1979 on third and final .reading by title only, seconded by Councilman 3 Mills and on unanimous voice vote, the motion was carried. 4 5 The Clerk read on third reading by title only Amended Ordinance No. 6 93-1979. 7 8 Amended Ordinance No. 93-1979 was placed on final passage or rejection and 9 on a call of the roll, the following was recorded: Ayes: Elstro, Williams, 10 Ahaus, Austerman, Whitesell, Mills, Carter, Welch and Paust. Noes: None. 11 The vote being nine (9). to zero (0) in favor of passage of Amended Ordinance 12 No. 93-1979. 13 14 The Clerk read on second reading Ordinance No. 94-1979 - AN ORDINANCE TO 15 APPROPRIATE WITHIN THE MOTOR VEHICLE HIGHWAY FUND. 16 17 City Attorney Ed Anderson examined proof of publication for Ordinance No. 18 94-1979 and found it to be in order. Councilman Mills moved the proof be 19 accepted and placed on file, seconded by Councilman Ahaus and on unanimous 20 voice vote, the motion was carried. 21 22 Councilman Austerman moved for engrossment of Ordinance No. 94-1979, second-d 23 by Councilman Whitesell and on unanimous voice vote, the motion was carried. 24 25 Councilman Carter moved to suspend the rules and read Ordinance No. 94-1979 26 on third and final reading by title only, seconded by Councilman Mills and 27 on unanimous voice vote, ,the motion was carried. III 28 29 The Clerk read on third reading by title only Ordinance No. 94-1979. 30 31 Ordinance No. 94-1979 was placed on final passage or rejection and on a 32 call of the roll, the following was recorded: Ayes: Elstro, Williams, 33 Ahaus, Austerman, Whitesell, Mills, Carter, Welch and Paust. Noes: None. 34 The vote being nine (9) to zero (0) in favor of passage of Ordinance No. 35 94-1979. - 36 37 Councilman Mills moved to suspend the rules and read Ordinance No. 91-1979 38 on third reading by title only, seconded by Councilman Welch and on unanimo 39 voice vote, the motion was carried. 40 41 The Clerk read on third reading by title only Ordinance No. 91-1979 - AN 42 ORDINANCE TO APPROPRIATE WITHIN THE GENERAL FUND. 43 44 Ordinance No. 91-1979 was placed on final passage or rejection and on a 45 call of the roll, the following was recorded: Ayes: Elstro, Williams, 46 Ahaus, Austerman, Whitesell, Mills, Carter, Welch and Paust.
