PROCEEDINGS OF THE COMMON COUNCIL OF THE
CITY OF RICHMOND, INDIANA, SEPTEMBER 17, 1979
1 The Common Council of the City of Richmond, Indiana, met in regular
2 session September 17, 1979 at the hour of 7: 30 p.m. in the Council Chambers
3 in the Municipal Building in said City. President Paust presided with the
4 following members present: Messrs. Elstro, Williams, Ahaus, Austerman,
5 Whitesell, Mills, Carter and Welch. Absent: None. The following business
6 was had, to-wit:

8 Councilman James Carter gave devotions. -

10 - -"Councilman Whitesell noted a correction in the minutes of the last meeting.
11 Line 43 and 44 should read "2405 New Paris Pike" rather than "2030 Chester
12 Blvd". Councilman Williams moved to accept the minutes as corrected,
13 seconded by Councilman Mills and on unanimous voice vote, the motion was
14 • carried.

'16 Councilman Mills moved to suspend the rules and read Resolution No. 19-
17 1979 by title only, seconded by Councilman Welch and on unanimous voice
18 vote, the motion was carried.

20 The Clerk read by title only Resolution No. 19-1979 - A RESOLUTION
21 AUTHORIZING THE FILING OF AN APPLICATION FOR A GRANT UNDER SECTION 18 OF
22 THE URBAN MASS TRANSPORTATION ACT OF 1964, AS AMENDED.

24 Councilman Mills moved for adoption :of Resolution-No: 19-1979, seconded
25 by Councilman Welch and on unanimous voice vote, the motion was carried.

27 Councilman Mills moved to suspend the rules and read Ordinance Nos.
28 93-1979 and 94-1979 on first reading by title only, seconded by Councilman
29 Carter and on unanimous voice vote, the motion was carried.

32 ORDINANCE AUTHORIZING A SPECIAL USE IN AN R-2 ONE FAMILY RESIDENCE DISTRICT
33 FOR A MEINICAL OFFICE ON PROPERTY LOCATED AT 624 NATIONAL ROAD WEST, PURSUANT
34, TO ARTICLE 48 OF CHAPTER 21 OF THE MUNICIPAL CODE COMMONLY KNOWN AS THE
35 ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA.

37 President Paust announced Ordinance No. 93-1979 is referred to the Plan
38 Commission.

40 The Clerk read on first reading by title only Ordinance No. 94-1979 - AN
41 ORDINANCE TO APPROPRIATE WITHIN THE MOTOR VEHICLE HIGHWAY FUND.

43 President Paust announced Ordinance No. 94-1979 has to be advertised.

45 The Clerk read on second reading Ordinance No. 90-1979 - AN ORDINANCE
46 AMENDING ARTICLE 37 OF CHAPTER 22 OF THE MUNICIPAL CODE, BEING ORDINANCE
47 NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF
48 RICHMOND, INDIANA, ADOPTED JUNE 3, 1968.

50 Councilman Austerman moved to strike Ordinance No. 90-1979, seconded by
51 Councilman Mills and on unanimous voice vote, the motion was carried.

53 Councilman Austerman moved to bring Ordinance No. 60-1979 off the table,
54 seconded by Councilman Mills and on unanimous voice vote, the motion was
55 carried.

57 The Clerk read on second reading Ordinance No. 60-1979 - AN ORDINANCE
58 AMENDING CHAPTER 22 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968,
59 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA
60 ADOPTED JUNE 3, 1968, PROVIDING FOR THE REZONING OF THE RICHMOND MUNICIPAL
61 AIRPORT FROM R-1 SINGLE FAMILY RESIDENCE DISTRICT TO AZ AIRPORT ZONE
62 DISTRICT, AND AIP AIRPORT INDUSTRIAL PARK DISTRICT.

1 Councilman Austerman moved to strike the words "and ALP Airport Industrial
2 Park District" from the title of said Ordinance, seconded by Councilman
3 Welch and on unanimous voice vote, the motion was. carried.

5 Councilman Austerman moved to delete from Section 1 of Ordinance No. 60-1979
6 that part of the said section beginning with the words "excepting therefrom:"
7 to the end of Section 1; and further to delete. Section 2 of Ordinance No.
8 60-1979 in its entirety; and to alter the section designation "Section 3"
9 to be "Section 2", seconded by Councilman Mills and on unanimous voice vote,
10 ` the motion was carried.

12 Councilman Mills moved for engrossment of Amended Ordinance. No. 60-1979,
13 seconded by Councilman Austerman and on unanimous voice vote, the motion was
14 carried.

16 Councilman Austerman moved to suspend the rules and read Amended Ordinance No.
17 60-1979 on third and final reading by title only, seconded by Councilman Carter
18 and on unanimous voice vote, the motion was carried.

20 The Clerk read on third reading by title only Amended Ordinance No. 60-1979.

22 Amended Ordinance No. 60-1979 was placed on final passage or rejection and
23 on a call of the roll, the following was recorded: Ayes: Elstro, Williams,
24 Ahaus, Austerman, Whitesell, Mills, Carter, Welch and Paust. Noes: None.
25 The vote being nine (9) to zero (0) in favor of passage of Amended _Ordinance I o.
26 60-1979.

28 The Clerk read on second reading Ordinance No. 91-1979.- AN ORDINANCE TO
29 APPROPRIATE WITHIN THE GENERAL FUND.

31 City Attorney Ed Anderson examined the proof of publication for Ordinance
32 No. 91-1979 and found it to be in order. Councilman Mills moved to accept
33 and file the proof, seconded by Councilman Welch and on unanimous voice
34 vote, the motion was carried.

36 Councilman Elstro moved for engrossment of Ordinance No. 91 1979, seconded
37 by Councilman Ahaus and on a voice vote, the following was recorded: Ayes:
38 Elstro, Williams, Ahaus, Austerman, Mills, Carter, Welch and Paust. Noes:
39 Whitesell. Motion carried.

41 Councilman Ahaus moved to suspend the rules and read Ordinance No. 91-1979
42 oh .third and final reading by title only, seconded by Councilman Williams an.
43 on a voice vote, the following was recorded: Ayes: Elstro, Williams, Ahaus,
44 Austerman, Mills, Carter, Welch and Paust. Noes: Councilman Whitesell.

46 There being no further business on motion duly made, seconded and passed, th-
47 meeting was adjourned.
