HomeMy Public PortalAbout09-04-1979 537 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, SEPTEMBER 4, 1979 1 The Common Council of the City of Richmond, Indiana, met in regular 2 session September 4, 1979 at the hour of 7: 30 p.m. in the Council Chambers 3 in the Municipal Building in said City. President Paust presided with the 4 following members present: Messrs. Elstro, Williams, Ahaus, Austerman, 5 Whitesell, Mills, Carter and Welch. Absent: None. The following business 6 was had, to wit: 7 8 Councilman Austerman gave devotions. 9 10 Councilman Williams moved to approve the minutes of the previous meeting 11 as prepared, seconded by Councilman Whitesell and on unanimous voice vote, 12 the motion was carried. 13 14 Councilman Mills moved to suspend the rules and read Resolution No. 15 18-1979 by title only, seconded by Councilman Welch and on unanimous voice 16 vote, the motion was carried. 17 18 The Clerk read by title only Resolution No. 18-1979 - A RESOLUTION 19 AUTHORIZING AND APPROVING THE CONVEYANCE OF CERTAIN REAL ESTATE IN THE CITY 20 OF RICHMOND, INDIANA, FOR THE USE AND BENEFIT OF ITS DEPARTMENT OF COMMUNITY 21 DEVELOPMENT. 22 23 Speaking for the Resolution was Director of Community Development Tim Ryder 24 noting this is two (2) lots adjacent to SWAC House being conveyed to the 25 Park Department. 26 27 Councilman Ahaus moved for adoption of Resolution No. 18-1979, seconded by 28 Councilman Austerman and on unanimous voice vote, the motion was carried. 29 30 Councilman Elstro reported to the Board of Works a van parked in the alley 31 partially on City property located at 305 S .W. 3rd Street. 32 33 Councilman Austerman moved to suspend the rules and read- Ordinance Nos. 34 89-1979, 90-1979, 91-1979 and 92-1979 on first reading by title only, seconded 35 by Councilman Mills and on unanimous voice- vote, the motion was carried. 36 37 The Clerk read on first reading by title only Ordinance No. 89-1979 - AN 38 ORDINANCE AUTHORIZING THE CITY OF RICHMOND TO ISSUE ITS "ECONOMIC DEVELOPME T 39 REVENUE BONDS, SERIES A (IMPERIAL DIE CASTING, INC. PROJECT)" AND ITS 40 "ECONOMIC DEVELOPMENT REVENUE BONDS, SERIES B (IMPERIAL DIE CASTING INC. 41 PROJECT)" AND APPROVING OTHER ACTIONS IN RESPECT THERETO. 42 43 Councilman Mills moved to suspend the rules and read Ordinance No. 89-1979 0 44 second reading, seconded by Councilman Carter and on unanimous voice vote, 45 the motion was carried. 46 47 The Clerk read on second reading Ordinance No. 89-1979. 48 49 Speaking for Ordinance No. 89-1979 was Attorney Bert Keller, noting the 50 percentage on page 3 should read 100%. 51 52 Councilman Mills moved to insert "100%"' on page 3, seconded by Councilman III53 Austerman and on ;unanimous voice vote, the motion was carried. Is54 55 Councilman Ahaus moved for engrossment of Ordinance No. 89-1979, seconded 56 by Councilman Carter and on unanimous voice vote, the motion was carried. 57 58 Councilman Carter moved to suspend the rules and read Ordinance No. 89-1979 59 on third and final reading by title only, seconded by Councilman Mills and 60 on unanimous voice vote, the motion was carried. 61 62 The Clerk read Ordinance No. 89-1979 on third and final reading by title an y. 63 64 Ordinance No. 89-1979 was placed on final passage or rejection and on a cal: 65 of the roll, the following was recorded: Ayes: Elstro, Williams, Ahaus, 66 Austerman, Whitesell, Mills, Carter, Welch and Paust. September 4, 1979 Page 2 1 The Clerk read on first reading by title only Ordinance No. 90-1979 - AN 2 ORDINANCE AMENDING ARTICLE 37 OF CHAPTER 22 OF THE MUNICIPAL CODE, BEING 3 ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY 4 OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. 5 6 President Paust announced Ordinance No. 90-1979 is referred to the Committee 7 of the Whole. 8 9 The Clerk read on first reading by title only Ordinance No. 91-1979 - AN 10 ORDINANCE TO APPROPRIATE WITHIN THE GENERAL FUND. 11 12 President Paust announced Ordinance No. 91-1979 has to be advertised. 13 14 The Clerk read on first reading by title only Ordinance No. 92-1979 - AN 15 ORDINANCE TO TRANSFER WITHIN THE PARK AND RECREATION FUND. 16 17 Councilman Mills moved to suspend the rules and read Ordinance No. 92-1979 18 on second reading, seconded by Councilman Williams and on unanimous voice 19 vote, the motion was carried. 20 21 The Clerk read on second reading Ordinance No. 92-1979. 22 23 Speaking for Ordinance No. 92-1979. was Park Superintendent Don McBride. 24 25 Councilman Carter moved for engrossment of Ordinance No. 92-1979, seconded by 26 Councilman Austerman and on unanimous voice vote, the motion was carried. 27 28 Councilman Austerman moved to suspend the rules and read Ordinance No. 92-1979 29 on third and final reading by title only, seconded by Councilman Williams 30 and on unanimous voice vote, the motion was carried. 31 32 The Clerk read on third reading by title only Ordinance No. 92-1979. 33 34 Ordinance No. 92-1979 was placed on final passage or rejection and on a call 35 of the roll, the following was recorded: Ayes: Elstro, Williams, Ahaus, 36 Austerman, Whitesell, Mills, Carter, Welch and Paust. Noes: None. The votz 37 being nine (9) to zero (0) in favor of passage of Ordinance No. 92-1979. 38 39 The Clerk read on second reading Ordinance No. 67-1979 - AN ORDINANCE 40 AMENDING CHAPTER 22 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, 41 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, 42 ADOPTED JUNE 3, 1968, PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT 43 2405 NEW PARIS PIKE, ' FROM R-2 ONE-FAMILY RESIDENCE DISTRICT TO M-2- GENERAL 44 INDUSTRIAL DISTRICT. _ - 45 46 President Paust made reference to a letter from the Plan Commission noting 47 the petitioner has withdrawn the request and the Plan Commission struck this 48 Ordinance. 49 50 Councilman Austerman moved to strike Ordinance No. 67-1979, seconded by 51 Councilman Mills and on unanimous voice vote, the motion was carried. 52 53 The Clerk read on second reading Ordinance No. 68-1979 - AN ORDINANCE 54 AMENDING CHAPTER 22 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, 55 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, ADOPTED 56 JUNE 3, 1968, PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT 2030 CHESTER 57 BOULEVARD FROM R-3 ONE-TO-EIGHT FAMILY RESIDENCE DISTRICT TO R-4 MULTI-FAMIL 58 RESIDENCE DISTRICT. 59 60 Speaking for Ordinance No. 68-1979 was Attorney Ron Cross, 2 North 8th Street, 61 representing Friends Fellowship. 539 Common Council Minutes Cont. September 4, 1979 Page 3 1 It was noted the Plan Commission held a public hearing on Tuesday, August 2 28, 1979 on this petition and voted eight (8) to zero (0) to recommend the 3 Ordinance be approved. 45 Councilman Austerman moved for engrossment of Ordinance No. 68-1979, 6 seconded by Councilman Whitesell and on unanimous voice vote, the motion 7 was carried. 8 9 Councilman Austerman moved to suspend the rules and read Ordinance No. 10 68-1979 on third and final reading by title only, seconded by Councilman 11 Carter and on unanimous voice vote, the motion was carried. 12 13 - The Clerk read on third reading by title only Ordinance No. 68-1979. 14 15 Ordinance No. 68-1979 was placed on final passage or rejection and on a 16 call of the roll, the following was recorded: Ayes: Elstro_, Williams, 17 Ahaus, Austerman, Whitesell, Mills, Carter, Welch and Paust. Noes: None. 18 The vote being nine (9) to zero (0) in favor of passage of Ordinance No. 19 68-1979. 20 21 The Clerk read on second reading Ordinance No. 86-1979 - AN ORDINANCE 22 TO APPROPRIATE WITHIN THE GENERAL FUND. 23 24 City Attorney Ed Anderson examined proof of publication for Ordinance 25 No. 86-1979 and found it to be in order. Councilman Mills moved it be 26 accepted and filed, seconded by Councilman Austerman and on unanimous 27 voice vote, the motion was carried. 28 29 Councilman Austerman moved for engrossment of Ordinance No. 86-1979, 30 seconded by Councilman Carter and on unanimous voice vote, the motion was 31 carried. 32 33 Councilman Austerman moved to suspend the rules and read Ordinance No. 34 86-1979 on third and final reading by title only, seconded by Councilman 35 Carter and on unanimous voice vote, the motion was carried. 36 37 The Clerk read on third reading by title only Ordinance No. 86-1979. 38 39 Ordinance No. 86-1979 was placed on final passage or rejection and on 40 a call of the roll, the following was recorded: Ayes : Elstro, Williams, 41 Ahaus, Austerman, Whitesell, Mills, Carter, Welch and Paust. Noes : None. 42 The vote being nine (9) to zero (0) in favor of passage of Ordinance No. 43 86-1979. 44 45 The Clerk read on second reading Ordinance No. 87-1979 - AN ORDINANCE TO 46 APPROPRIATE WITHIN THE PARKING METER FUND. 47 48 Councilman Carter moved for engrossment of Ordinance No. 87-1979, 49 seconded by Councilman Whitesell and on unanimous voice vote, the motion 50 was carried. 51 52 Councilman Carter moved to suspend the rules and read Ordinance No. 87-1979 53 on third and final reading by title only, seconded by Councilman Austerman 54 and on unanimous voice vote, the motion was carried. 55 56 The Glerk read on third reading by title only Ordinance No. 87-1979. 57 58 Ordinance No. 87-1979 was placed on final passage or rejection and on a 59 call of the roll, the following was recorded: Ayes: Elstro, Williams, 60, _ Ahaus, Austerman, Whitesell, Carter, Welch and Paust. September 4, 1979 Page 4 1 Councilman Mills moved to suspend the rules and read Ordinance No. 83-1979 2 on' third and final reading by title only, seconded by Councilman Austerman 3 and on unanimous voice vote, the motion was carried. 4 5 The Clerk read on. third reading by title only Ordinance No. 83-1979 AN 6 ORDINANCE AMENDING CHAPTER 22 OF THE MUNI.CIPAL.CODE, BEING ORDINANCE NO. 7 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, 8 INDIANA, ADOPTED JUNE 3, 1968, PROVIDING FOR THE_ ADDITION OF ARTICLE 45.051 9 TO THE TEXT OF SAID CHAPTER. 10 11 . The Plan Commission held a public hearing on Tuesday, August 28, 1979 on 12 Ordinance No. 83-1979 which gives Council another element of flexibility in 13 approving Development Unit Projects by allowing modifications so long as • 14 they do not nullify the intent' of the requirements and standards relating to 15 . Development Unit Projects, and so long as the general public health, safety .nd 16 welfare is not adversely affected, The.Plan Commission voted eight (8) 17 to zero (0) to recommend the Ordinance be approved. 18 19 Ordinance No. 83-1979 was placed on final passage or rejection and on a call 20 of the roll, the following was recorded: Ayes: Elstro, Williams,- Ahaus, 21 Austerman, Whitesell, Mills, Carter, Welch and Paust. Noes: None.
