HomeMy Public PortalAbout04-16-1979 491 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, APRIL 16, 1979 1 The Common Council of the City of Richmond, Indiana, met in regular session 2 April 16, 1979 at the hour of 7:30 p.m. in the Council Chambers in the 3 Municipal Building in said City. President Paust presided with the followin: 4 members present: Messrs. Elstro, Williams, Ahaus, Austerman, Whitesell, 5 Mills, CarterandWelch. 6 7 Councilman Carter gave devotions. 8 9 City Clerk, JoEllen Trimble, swore in newly elected Councilman Terrell 10 Whitesell who replaced Greg Merchanthouse as 5th District Councilman. 11 12 Councilman Williams moved to approve the minutes of the previous meeting as 13 prepared, seconded by Councilman Mills and on unanimous voice vote, the motion 14 was carried. 15 16 Councilman Williams reported to the Board of Works that the sidewalk is 17 cracking in front of Townsend Center. 18 19 Councilman Mills moved to suspend the rules and read Ordinance Nos. 34-1979, 20 35-1979, 36-1979, 37-1979, 38-1979, 39-1979, 40-1979 and 41-1979 on first 21 reading by title only, seconded by Councilman Ahaus and on unanimous voice 22 vote, the motion was carried. 23 24 The Clerk read on first reading by title only Ordinance No. 34-1979 - AN 25 ORDINANCE AUTHORIZING A SPECIAL USE IN AN R-2 :-'ONE-FAMILY RESIDENCE DISTRICT 26 AND R-3 ONE-TO-EIGHT FAMILY RESIDENCE DISTRICT FOR A MEDICAL OFFICE ON 27 PROPERTY LOCATED AT 1824 CHESTER BOULEVARD, PURSUANT TO ARTICLE 48 OF CHAPTE' 28 22 OF THE MUNICIPAL CODE COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY III29 OF RICHMOND, INDIANA. 30 31 President Paust referred Ordinance No. 34-1979 to the Plan Commission. 32 33 The Clerk read on first reading by title only Ordinance No. 35-1979 - AN 34 ORDINANCE AMENDING CHAPTER 22 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 35 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF. RICHMOND, 36 INDIANA, ADOPTED JUNE 3, 1968, PROVIDING FOR THE REZONING OF PROPERTY 37 LOCATED AT 1851 SOUTHWEST "A" STREET FROM R-2 ONE FAMILY RESIDENCE DISTRICT 38 TO R-3 ONE-TO-EIGHT FAMILY RESIDENCE DISTRICT. 39 40 I President Paust referred Ordinance No. 35-1979 to the Plan Commission. 41 42 The Clerk read on first reading by title only Ordinance No. 36-1979 - AN 43 ORDINANCE TO AUTHORIZE AN APPLICATION TO THE STATE OF INDIANA FOR A LOAN: 44 AND TO BORROW FOR THE CITY OF RICHMOND, INDIANA, TO INSTITUTE, ACCOMPLISH 45 AND ADMINISTER`THE CONSTRUCTION OF (12) TWELVE NESTED TYPE T-HANGARS AT THE 46 RICHMOND MUNICIPAL AIRPORT. 47 48 Councilman Ahaus moved to suspend the rules and move Ordinance No. 36-1979 49 to second reading, seconded by Councilman Mills and on unanimous voice vote, 50 the motion was carried. 51 52 The Clerk read on second reading Ordinance No. 36-1979. 53 54 Councilman Carter moved for engrossment of Ordinance No. 36-1979, seconded 55 by Councilman Welch and on unanimous voice vote, the motion was carried. 56 57 Councilman Ahaus moved to suspend the rules and read Ordinance No. 36-1979 58 on third and final reading by title only, seconded by Councilman Williams 59 and on unanimous voice vote, the motion was carried. 492 Common Council Minutes Cont. April 16, 1979 Page 2 1 The Clerk read on third reading by title only Ordinance No. 36-1979. 2 3 Ordinance No. 36-1979 was placed on final passage or rejection and on a call 4 of the roll, the following was recorded: Ayes: Elstro, Williams, Ahaus, 5 Austerman, Whitesell, Mills, Carter, Welch and Paust. Noes: None. The vote 6 being (9) to zero (0) in favor of passage of Ordinance No. 36-1979. 7 8 The Clerk read on first reading by title only Ordinance No. 37-1979 - AN 9 ORDINANCE TO TRANSFER WITHIN THE GENERAL FUND. 10 11 Councilman Mills moved to suspend the rules and read Ordinance No. 37-1979 on 12 second reading, seconded by Councilman Welch and on unanimous voice vote, 13 the motion was carried. 14 15 The Clerk read on second reading Ordinance No. 37-1979. 16 17 Councilman Mills moved for engrossment of Ordinance No. 37-1979, seconded by 18 Councilman Carter and on unanimous voice vote, the motion was carried. 19 20 Councilman Mills moved to suspend the rules and read Ordinance No. 37-1979 on 21 third and final reading by title only, seconded by Councilman Carter and . 22 on unanimous voice vote, the motion was carried. 23 24 The Clerk read on third reading by title only Ordinance No._ 37-1979. 25 26 Ordinance No. 37-1979 was placed on final passage or rejection and on a call 27 of the roll, the following was recorded: Ayes: Elstro, Williams, Ahaus, 28 Austerman, Whitesell, Mills, Carter, Welch and Paust. Noes: None. The vote 29 being nine (9) to zero(0) in favor of passage of Ordinance No. 37-1979. 30 31 The Clerk read on first reading by title only Ordinance No. 38-1979 - AN 32 ORDINANCE TO APPROPRIATE WITHIN THE MUNICIPAL AIRPORT FUND. 33 34 President Paust announced Ordinance No. 38-1979 has to be advertised. 35 36 The Clerk read on first reading by title only Ordinance No. 39-1979 - AN 37 ORDINANCE TO APPROPRIATE WITHIN THE GENERAL FUND. 38 39 President Paust announced Ordinance No. 39-1979 has to be advertised. 40 41 The Clerk read on first reading by title only Ordinance No. 40-1979 - AN 42 ORDINANCE TO APPROPRIATE FROM THE FEDERAL AVIATION ADMINISTRATION GRANT. 43 44 President Paust announced Ordinance No. 40-1979 has to be advertised. 45 46 The Clerk read on first reading by title only Ordinance No. 41-1979 - AN 47 ORDINANCE TO REDUCE WITHIN THE MOTOR VEHICLE HIGHWAY FUND. 48 49 President Paust announced Ordinance No. 41-1979 has to be advertised. 50 51 Councilman Mills moved to bring Ordinance NO. 22-1979 from the table, seconder. 52 by Councilman Elstro and on unanimous voice vote, the motion was carried. 53 54 President Paust announced Ordinance. No. 22-1979 is on public hearing. 55 56 Speaking against Ordinance No. 22-1979 were. Mr. Sam Knobler, 740 S .W. 15th 57 Street and Attorney Robert Burton, representing the Knobler family. 493 Common Council Minutes Cont. April 16, 1979 Page 3 1 Speaking for Ordinance No. 22-1979 were Attorney Russell Schussler, 2 representing Heritage Regency; Attorney Rex Killion; Mr. James E.F.
