HomeMy Public PortalAbout04-02-1979 487 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, APRIL 2, 1979 1 The Common Council of the City of Richmond, Indiana, met in regular session 2 April 2, 1979 at the hour of 7:30 p.m. in the Council Chambers in the 3 Municipal Building in said City. President Paust presided with the following 4 members present : Messrs. Elstro, Williams, Ahaus, Austerman, Mills, Carter 5 and Welch. Absent: None. The following business was had, to wit: 6 7 Councilman Austerman gave devotions. 8 9 Councilman Williams moved to approve the minutes of the previous meeting as 10 prepared, seconded by Councilman Mills and on unanimous voice vote, the motion. 11 was carried. 12 13 Councilman Austerman moved to suspend the rules and read Resolution No. 7-197$ 14 by title only, seconded by Councilman Mills and on unanimous voice vote, the 15 motion was carried. 16 17 The Clerk read by title only Resolution No. 7-1979 - A RESOLUTION'AUTHORIZING 18 AND APPROVING THE CONVEYANCE OF CERTAIN REAL ESTATE IN THE CITY OF RICHMOND, 19 INDIANA, for the use and benefit of its Department of Community Development. 20 21 Speaking for Resolution No. 7-1979 was Director of Community Development Tim 22 Ryder, 438 Carol Drive. He stated this is a part of the Gorge project and 23 the property must be in the name of the Park Department for the City to 24 receive fifty percent of their monies back toward purchase of the property. 25 26 Councilman Elstro moved for adoption of Resolution No. 7-1979, seconded by 27 Councilman Ahaus and on unanimous voice vote, the motion was carried. 28 29 Councilman Elstro stated he is against the City letting the County use any 30 of the Municipal Building land for a parking lot. 31 32 The Clerk read on second reading Ordinance No. 6-1979 - AN ORDINANCE AMENDING 33 CHAPTER 22 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY 34 KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED 35 JUNE 3, 1968, PROVIDING FOR THE REZONING OF PROPERTY LOCATED EAST OF UNION 36 PIKE; A PORTION TO BE REZONED FROM R-1 ONE-FAMILY RESIDENCE DISTRICT TO M-2 37 GENERAL INDUSTRIAL DISTRICT, AND A PORTION TO BE REZONED FROM R-1 ONE=FAMILY 38 RESIDENCE DISTRICT TO R-2 ONE-FAMILY RESIDENCE DISTRICT. 39 40 Deputy Director of Community Development_ Dan Dooley stated the Plan Commissio 41 held public hearings on January 23, February 27 and March 27, 1979 and voted 42 nine (9) to zero (0) in favor of this rezoning. 43 44 Councilman Welch moved for engrossment of Ordinance No. 6-1979, seconded by 45 Councilman Williams and on unanimous voice vote, the motion was carried. 46 47 Councilman Austerman moved to suspend the rules and read Ordinance No. 6-1979 48 on third and final reading by title only, seconded by Councilman Williams and 49 on unanimous voice vote, the motion was carried. 50 51 The Clerk read on third reading by title only Ordinance No. 6-1979. III 52 53 Ordinance No. 6-1979 was placed on final passage or rejection and on a call 54 of the roll, the following was recorded: Ayes: Elstro, Williams, Ahaus, 55 Austerman, Mills, Carter, Welch and Paust. Noes: None. The vote being 56 eight (8) to zero (0) in favor of passage of Ordinance No. 6-1979. 57 58 The Clerk read on second reading Ordinance No. 23-1979 - AN ORDINANCE AMENDIN 59 CHAPTER 22 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY 60 KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED 61 JUNE 3, 1968, PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT 501 SOUTH "Q" 62 STREET FROM R-3 ONE-FAMILY RESIDENCE DISTRICT TO M-1 LIGHT INDUSTRIAL DISTRIC . 488 Common Council Minutes Cont. April 2, 1979 Page 2 1 Speaking for Ordinance No. 23-1979 was Attorney Don Simkin, representing 2 Petitioners Robert Farmer and James Jackson. 3 4 Mr. Dooley stated the Plan Commission held a public hearing On March 27, 1979 5 and voted nine (9) to zero (0) in favor of this rezoning. 6 7 Councilman Elstro moved for engrossment of Ordinance No. 23-1979, seconded by 8 Councilman Williams and on unanimous voice vote, the motion was carried. 9 10 Councilman Austerman moved to suspend the rules and read Ordinance No. 23-1979 11 on third and final reading, seconded by Councilman Carter and on unanimous 12 voice vote, the motion was carried. 13 14 The Clerk read on third reading by title only Ordinance No. 23-1979. 15 16 Ordinance No. 23-1979 was placed on final passage or rejection and on a call .f 17 the roll, the following was recorded: Ayes: Elstro, Williams, Ahaus, 18 Austerman, Mills, Carter, Welch and Paust. Noes: None. The vote being 19 eight (8) to zero (0) in favor of passage of Ordinance No. 23-1979. 20 21 The Clerk read on second reading Ordinance No. 28-1979 - AN ORDINANCE 22 AUTHORIZING A SPECIAL USE-IN AN M-1 LIGHT INDUSTRIAL DISTRICT FOR AN 23 AMBULANCE SERVICE ON PROPERTY'LOCATED AT 715 NORTHWEST 5TH STREET, PURSUANT 24 TO ARTICLE 48 OF CHAPTER 22 OF THE MUNICIPAL CODE COMMONLY KNOWN AS THE 25 ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA. 26 27 Mr. Dooley stated the. Plan Commission held a public hearing on March 27, 1979 28 and voted nine (9) to zero (0) in favor of the rezoning. 29 30 Councilman Williams moved for engrossment of Ordinance No. 28-1979, seconded 31 by Councilman Elstro and on unanimous voice vote, the motion was carried. 32 33 Councilman Williams moved to suspend the rules and read Ordinance No. 28-1979 34 on third and final reading by title only, seconded by Councilman Ahaus and 35 on unanimous voice vote, the motion was carried. 36 37 The Clerk read on third reading by title only Ordinance No. 28-1979. 38 39 Ordinance No. 28-1979 was placed on final passage or rejection and on a call 40 of the roll, the following was recorded: Ayes: Elstro, Williams, Ahaus, 41 Austerman, Mills, Carter, Welch and Paust. Noes: None. The vote being 42 eight (8) to zero (0) in favor of passage of Ordinance No. 28-1979. 43 44 City Attorney Ed Anderson examined proof of publication for Ordinance Nos. 45 29-1979, 30-1979, and 31-1979 and found it to be in order. Councilman Mills 46 moved to accept and file the proof, seconded by Councilman Austerman and on 47 unanimous voice vote, the motion was carried. 48 49 The Clerk read on second reading Ordinance NO. 29-1979 - AN ORDINANCE TO 50 APPROPRIATE FROM THE CUMULATIVE CAPITAL IMPROVEMENT FUND (CIGARETTE TAX) . 51 52 Speaking for Ordinance No. 29-1979 was Mr. Bob Brooks, 2747 Northmont Blvd. 53 54 Councilman Mills moved for engrossment of Ordinance No. 29-1979, seconded by 55 Councilman Welch and on unanimous voice vote, the motion was carried. 56 57 Councilman Mills moved to suspend the rules and read Ordinance No. 29-1979 58 on third and final reading by title only, seconded by Councilman Carter and 59 on unanimous voice vote, the motion was carried. 60 61 The Clerk read on third reading by title only Ordinance No. 29-1979. 489. The vote being 4 eight (8) to zero (0) in favor of passage of Ordinance No. 29-1979. 5 6 The Clerk read on second reading Ordinance No. 30-1979 - AN ORDINANCE TO 7 APPROPRIATE WITHIN THE GENERAL FUND. 8 9 Councilman Carter moved for engrossment of Ordinance No. 30-1979, seconded 10 by Councilman Mills and on unanimous voice vote, the motion was carried. 11 12 Councilman Carter moved to suspend the rules and read Ordinance No. 30-1979 13 on third and final reading by title only, seconded by Councilman Mills and 14 on unanimous voice vote, the motion was carried. 15 16 The Clerk read on third reading by title only Ordinance No. 30-1979. 17 18 Ordinance No. 30-1979 was placed on final passage or rejection and on a call 19 of the roll, the following was recorded: Ayes: Elstro, Williams, Ahaus, 20 Austerman, Mills, Carter, Welch and Paust. Noes: None. The vote being 21 eight (8) to zero (0) in favor of passage of Ordinance No. 30-1979. 22 23 ! The Clerk read on second reading Ordinance No. 3171979 - AN ORDINANCE TO 24 APPROPRIATE FROM THE MOTOR VEHICLE HIGHWAY _FUND. 25 26 Councilman Williams moved for engrossment of Ordinance No. 31-1979, seconded 27 by Councilman Elstro and on unanimous voice vote, the motion was carried. 28 29 Councilman Williams moved to suspend the rules and read Ordinance No. 31-197c 30 on third and final reading by title only, seconded by Councilman Elstro 31 and on unanimous voice vote, the motion was carried. 32 33 The Clerk read on third reading by title only Ordinance No. 31-1979. 34 35 Ordinance No. 31-1979 was placed on final passage or rejection and on a call 36 of the roll, the following was recorded: Ayes: Elstro, Williams, Ahaus, 37 Austerman, Mills, Carter, Welch and Paust. Noes: None.
