PROCEEDINGS OF THE COMMON COUNCIL OF THE
CITY OF RICHMOND, INDIANA, MARCH 19, 1979
1 The Common Council of the City of .Richmond,. Indiana, met in regular session
2 March 19, 1979 at the hour of 7: 30 p.m. in the Council Chambers in the
3 Municipal Building in said City. President Paust presided with the following
4 members present: Messrs. Elstro, Williams, Ahaus, Austerman, Merchanthouse,
5 Mills, Carter and Welch. Absent: None. The following business was had,
6 to-wit:

8 A moment of silence was observed for Mr. William Kyle, who was a long time
9 member of the City Plan Commission.

11 Councilman Ahaus gave devotions.

13 Councilman Williams moved to approve the minutes of the previous meeting, as
14 prepared, seconded by. Councilman Mills and on unanimous voice vote, the
15 motion was carried.

17 Councilman Austerman moved to suspend the rules and read Resolution No.
18 6-1979 by title only, seconded by Councilman Mills and on unanimous voice
19 vote, the motion was carried.

21 The Clerk read by title only Resolution No. 6-1979 - A RESOLUTION TO
22 ESTABLISH "THE CITY OF RICHMOND, INDIANA DEFERRED COMPENSATION PLAN FOR
23 PUBLIC EMPLOYEES ."

25 Councilman Mills moved for adoption of Resolution No. 6-1979, seconded by
26 Councilman Elstro. The motion passed with Councilman Austerman voting no.

28 Councilman Williams requested the Board of Works remove a tree located at
29 323 South 6th Street.

31 President Paust requested the Board of Works check the ditch on the east
32 side of St. Andrews cemetery by Riley Hills.

34 Councilman Merchanthouse announced he intends to resign Council effective in
35 March as he is moving out of his district. Councilmen commended Councilman
36 Merchanthouse for his service to this body.

38 Councilman Mills moved to suspend the rules and read Ordinance Nos 28-1979,
39 29-1979, 30-1979, 31-1979 and 32-1979 on first reading by title only,
40 seconded by Councilman Welch and on unanimous voice vote, the motion was
41 carried.

44 ORDINANCE AUTHORIZING A SPECIAL USE IN AN M-1 LIGHT INDUSTRIAL DISTRICT FOR
45 AN AMBULANCE SERVICE ON PROPERTY LOCATED AT 715 NORTHWEST 5th STREET, PURSUANT
46 TO ARTICLE 48 OF CHAPTER 22 OF THE MUNICIPAL CODE COMMONLY.KNOWN AS THE
47 , ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA.

49 President Paust announced Ordinance No. 28-1979 is referred to the Plan

10 Councilman Mills moved to suspend the rules and read Ordinance No. 32-1979
11 on second reading, seconded by Councilman Welch and on unanimous voice
12 vote, the motion was carried.

16 Councilman Mills moved for engrossment of Ordinance No. 32-1979, seconded
17 by Councilman Welch and on unanimous voice vote, the motion was carried.

19 Councilman Mills moved to suspend the rules and read Ordinance No. 32-1979
20 on third and final reading by title only, seconded by Councilman Carter and
21 on unanimous voice vote, the motion was carried.

32 ORDINANCE AMENDING ORDINANCE NO. 2245-1967.

34 President Paust announced Ordinance No. 33-1979 is referred to the Committee
35 of the Whole. Committee Chairman Mills stated his Committee will be meeting
36 on this Ordinance on April 9 at 7:00 p.m. in the Board of Works Room in
37 the Municipal Building.

39 President Paust stated he has received a letter from the Attorney representing
40 the Knobler's concerning Ordinance No. 22-1979 requesting the public hearing
41 on this Ordinance be taped. There were no objections stated from any member
42 of Council.

44 President Paust noted Councilmen Carter and Merchanthouse are excused from
45 any discussion or participation concerning Ordinance No. 22-1979 as requested
46 at the previous Council meeting.

48 The Clerk read on second reading Ordinance No. 22-1979 - AN ORDINANCE AUTHORIZING
49 THE ISSUANCE OF $1,650,000. ECONOMIC DEVELOPMENT REVENUE BOND, SERIES A
50 (HERITAGE REGENCY, INC. PROJECT) OF THE CITY OF RICHMOND, INDIANA, FOR THE
51 PURPOSE OF FUNDING A LOAN TO HERITAGE REGENCY, INC. IN ORDER TO FINANCE THE
52 - ACQUISITION AND CONSTRUCTION OF CERTAIN ECONOMIC DEVELOPMENT FACILITIES
53 LOCATED WITHIN THE BOUNDARIES OF THE CITY FOR USE BY HERITAGE REGENCY, INC. :
54 AUTHORIZING.EXECUTION OF THE LOAN. AGREEMENT, MORTGAGE AND SECURITY AGREEMENT:
55 PROVIDING FOR THE DELIVERY OF THE FIRST MORTGAGE NOTE, THE COLLATERAL ASSIGN t NT
56 OF RENTS, THE CROSS-LIEN AND CROSS-DEFAULT AGREEMENT, AND THE GUARANTY AS
57 SECURITY FOR-SAID BOND. AND THE MORTGAGOR'S AFFIDAVIT: AUTHORIZING AN INDENTU'
58 OF TRUST APPROPRIATE FOR THE PROTECTION AND DISPOSITION OF THE REVENUES FROM

62 Al and Sam Knobler, owners of Golden Rule and Colonial Crest nursing homes;
63 and Mr. Sam Knobler, 740 S .W. 15th Street.

1 Speaking for Ordinance No. 22-1979 were Attorney Russell Schussler, 400
2 First National Bank Building, representing Heritage Regency, Inc. , applicants
3 in this Ordinance; Mr. James E.F. Carter, one of the incorporators of the
4 proposed facility; and Mr. C. Robert Norman, R.R. 4, Box 36, Shelbyville,
5 who has interest in the corporation.

7 Councilman Williams moved to table Ordinance No. 22-a979, seconded by
8 Councilman Elstro. The motion was carried with Councilmen Ahaus and
9 Austerman voting no.

,11 President Paust referred Ordinance No. 22-1979 to the Committee of the Whol:.
12 Committee Chairman Mills announced his Committee will meet Tuesday, April
13 3 at 7:00 p.m. in the Board of Works Room in the Municipal Building.

15 The Clerk read on second reading Ordinance No. 25-1979 - AN ORDINANCE TO
16 APPROPRIATE FROM THE GENERAL FUND.

18 City Attorney Ed Anderson examined proof of publication for Ordinance Nos.
19 25-1979, 26-1979 and 27-1979 and found it to be in order. Councilman Mills
20 moved it be accepted and filed, seconded by Councilman Carter and on
21 unanimous voice vote, the motion was carried.

23 Councilman Mills moved for engrossment of Ordinance No. 25-1979, seconded
24 by Councilman Williams and on unanimous voice vote, the motion was carried.

26 Councilman Mills moved to suspend the rules and read Ordinance No. 25-1979
27 on third and final reading by title only, seconded by Councilman Welch and
III 28 on unanimous voice vote, the motion was carried.
