MEETING MINUTES
June 6, 2012

Meeting came to order at 8:03 a.m., the minutes were approved unanimously.
CONVENTION AND VISITORS BUREAU (CVB) CONTRACT: Presented by Drew Hilpert. We will hold for
now and discuss at the next meeting.
CHARTER ISSUE:
Presented by Nathan Nickolaus. There are citizen concerns that the ballot language recently approved for
hiring police officers may have been confusing. Nickolaus discussed the history of why the charter
amendment was brought to the citizens. Feedback was received from the original charter members. The
majority expressed support for the change. This concern was not raised until after the elections. Legal
analysis says it now has “mootness” since it was not raised earlier and presumption by the court is in
favor of the voters intelligence. The council is commonly understood to include the Mayor , although
admitted it would have been clearer to have added Mayor. The legal opinion is there is probably no legal
violation. There is a very narrow group affected and the assumption is that there were voters who
wanted to remove the council from the process but not the Mayor. To change it, there would have to be
an election to repeal what voters already approved, or an initiative petition. It would cost $25,000 -
$50,000 to hold elections. Carolyn McDowell, 1222 Carter Street and Ken Wildhaber, both charter
members and previous council members, spoke about th e history of the charter. They feel as though the
ballot language should have included the Mayor. There was a lengthy discussion, where questions and
answers took place.
AMENDING ORDINANCE CHAPTER 19 SECTION 103 AND 108 – MOTOR VEHICLE SPEED LIMITS:
Presented by Drew Hilpert. The City’s new software is automatic but needs violations to be listed
individually for it to work. There is no change in substance, but this change will allow the software to be
set up to correctly charge offenses. A motion was made by Prather to send to the Council with a second
by Henry, passed unanimously.
AMENDING ORDINANCE CHAPTER 4 SECION 24 – TEMPORARY OUTDOOR CONSUMPTION PERMITS:
Presented by Drew Hilpert. The first Ordinance e xpired in July 2011 and the second is set to expire
November 2012. A fee has been established and charged, but was not listed in the ordinance. This
addition will allow the fee to be set like other fees are set within the City. There will not be a change in
fee because of this addition . The ordinance still excludes July 4th. A motion was made by Henry to send
to the Council with a second by Mihalevich, passed unanimously.
APPOINTMENT REVIEW:
All were approved as recommended by Mayor Eric Struemph. A motion was made by Henry to approve
for recommendation to the full Council and a second by Mihalevich, passed unanimously.

PUBLIC COMMENTS: Mo McCullough from Jefferson City Board of Realtors introduced himself. He is
visiting a number of the boards and commissions.

Next meeting is set for the last Wednesday in June; June 27th, in the Boone/Bancroft Room at City Hall.
