PROCEEDINGS OF THE COMMON COUNCIL OF THE
CITY OF RICHMOND, INDIANA, FEBRUARY 19, 1979
1 The Common Council of the City of Richmond, Indiana, met in regular session
2 February 19, 1979 at the hour of 7: 30 p.m. in the Council Chambers in the
3 Municipal Building in said City. President Paust presided with the
4 following members present: Messrs. Elstro, Williams, Ahaus, Austerman,
5 Merchanthouse, Mills, Carter and Welch. Absent: None. The following
6 business was had, to-wit:

8 Councilman Welch gave devotions.

10 Councilman Williams moved to approve the minutes of the previous meeting as
11 prepared, seconded by Councilman Mills and on unanimous voice vote, the
12 motion was carried.

14 Councilman Mills moved to suspend the rules and read Ordinance Nos. 15-1979,
15 16 - 1979, 17-1979, 18-1979, 19-1979, 20-1979 and 21-1979 on first reading
16 by title only, seconded by Councilman Williams and on unanimous voice vote,
17 the motion was carried.

20 ORDINANCE AUTHORIZING A SPECIAL USE IN AN M-2 GENERAL INDUSTRIAL DISTRICT
21 FOR A TREE CUTTING SERVICE ON PROPERTY LOCATED AT 2320 FLATLEY ROAD, PURSUAN
22 TO ARTICLE 48 OF CHAPTER 22 OF THE MUNICIPAL CODE, COMMONLY KNOWN AS THE
23 ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA.

51 referred to the Committee of the Whole. Councilman Mills called a meeting
52 for the Committee of the Whole for Tuesday, February 27, 1979 at 7:00 p.m.
53 in the Board of Works Room of the City Building to discuss Federal Revenue
54 Sharing monies.

5 Councilman Mills moved to suspend the rules and move Ordinance No. 21-1979 to
6 second reading, seconded by Councilman Austerman and on unanimous voice
7 vote, the motion was carried.

11 Speaking for and explaining Ordinance No. 21-1979 was Mr. Jerry Haynes, 2116
12 North "D" Street, Director of Transportation for the City of Richmond.

14 Councilman Williams moved for engrossment of Ordinance No. 21-1979, seconded
15 by Councilman Ahaus and on unanimous voice vote, the motion was carried.

17 Councilman Williams moved to suspend the rules and read Ordinance No. 21-1979
18 on third and final reading by title only, seconded by Councilman Ahaus and
19 on unanimous voice vote, the motion was carried.

23 Ordinance No. 21-1979 was placed on final passage or rejection and on a'call of
24 the roll, the following was recorded: Ayes: Elstro, Williams, Ahaus, Austerman,
25 Merchanthouse, Mills, Carter, Welch and Paust. Noes: None. The vote being
26 nine (9) to zero (0) in favor of passage of Ordinance No. 21-1979.

28 The Clerk read on second reading Ordinance No. 8-1979.

30 City Attorney Ed Anderson examined proof of publication for Ordinance Nos.
31 8-1979, 13-1979 and 14-1979 and found them to be in order.

33 Councilman Mills moved to accept and file proof of publication for Ordinance
34 Nos. 8-1979, 13-1979 and 14-1979, seconded by Councilman Welch and on unanimous
35 voice vote, the motion was carried.

37 Councilman Mills moved for engrossment of Ordinance No. 8-1979, seconded by
38 Councilman Welch.

40 Councilman-Williams=-moved that Ordinance No. 8-1979 be amended to read that
41 Council's salary be reduced by a total of four hundred dollars ($400.00). (one
42 hundred dollars out of each year) , seconded by Councilman Elstro and on a call
43 of the roll, the following was recorded: Ayes: Elstro, Williams and
44 Merchanthouse. Noes: Ahaus, Austerman, Mills, Carter, Welch and Paust. The
45 vote being three (3) to six (6) in favor of the amendment. On unanimous voice
46 vote Councilman Mills' motion for engrossment was carried. _

48 Councilman Mills moved to suspend the rules and read Ordinance No. 8-1979 on
49 third and final reading by title only, seconded by Councilman Welch and on
50 unanimous voice vote, the motion was carried.

54 Ordinance No. 8-1979 was placed on final passage or rejection and on a call of
55 the roll, the following was recorded: Ayes: Ahaus, Austerman, Mills, Carter,

57 six (6) to three (3) in favor of passage of Ordinance No. 8-1979

8 by Councilman Welch and on unanimous voice vote, the motion was carried.

10 Councilman Elstro moved to suspend the rules and read Ordinance No. 13-1979
11 on third and final reading by title only, seconded by Councilman Williams
12 and on unanimous voice vote, the motion was carried.

25 by Councilman Elstro and on unanimous voice vote, the motion was carried.

27 Councilman Elstro moved to suspend the rules and read Ordinance No. 14-1979

39 Councilman Mills moved to bring Ordinance No. 9-1979 from the table,
40 seconded by Councilman Ahaus and on unanimous voice vote, the motion was
41 carried.

43 Councilman Mills moved to suspend the rules and read Ordinance No. 9-1979
44 on third and final reading by title only, seconded by Councilman Welch and
45 on unanimous voice vote,- the motion was carried.

54 Councilman Austerman moved to suspend the rules and read Ordinance No. 5-19 9
55 on third reading by title only, seconded by Councilman Mills and on unanimo s
56 voice vote, the motion was carried.

61 INDIANA, ADOPTED JUNE 3, 1968, PROVIDING FOR THE REZONING OF PROPERTY LOCA D
62 ON UNION PIKE, NORTH OF INDUSTRIES ROAD (RUHLEN ROAD) FROM R-2 ONE-FAMILY
63 RESIDENCE DISTRICT AND M-2 GENERAL INDUSTRIAL DISTRICT TO M-2 GENERAL
64 INDUSTRIAL DISTRICT FOR THE ENTIRE PARCEL.

1 President Paust asked City Attorney Anderson if this Ordinance is affected
2 by the fact that the owner of the property was Mr. Richard_Brantner, who is
3 now deceased. Mr. Anderson stated that it is his opinion that this in no
4 way affects the Ordinance on the question of zoning.

6 Ordinance No. 5-1979 was placed on final passage or rejection and on a call
7 of the roll, the following was recorded: Ayes: Elstro, Williams, Ahaus,
8 Austerman, Merchanthouse, Welch and Paust. Noes: Mills and Carter. The
9 vote being seven (7) to two (2) in favor of Ordinance No. 5-1979.

11 Councilman Ahaus, Council's representative to the Board of Aviation
12 Commissioners, reported the new hangars at the airport are completely filled
13 and there is a waiting list of seven (7) airplanes for these spaces.

15 Councilman Elstro brought the condition of parking at Roy Cates to the attention
16 of the Board of Works.

18 There being no further business on motion duly made, seconded and passed, the
19 meeting was adjourned.
