HomeMy Public PortalAbout02-19-1979 473 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, FEBRUARY 19, 1979 1 The Common Council of the City of Richmond, Indiana, met in regular session 2 February 19, 1979 at the hour of 7: 30 p.m. in the Council Chambers in the 3 Municipal Building in said City. President Paust presided with the 4 following members present: Messrs. Elstro, Williams, Ahaus, Austerman, 5 Merchanthouse, Mills, Carter and Welch. Absent: None. The following 6 business was had, to-wit: 7 8 Councilman Welch gave devotions. 9 10 Councilman Williams moved to approve the minutes of the previous meeting as 11 prepared, seconded by Councilman Mills and on unanimous voice vote, the 12 motion was carried. 13 14 Councilman Mills moved to suspend the rules and read Ordinance Nos. 15-1979, 15 16 - 1979, 17-1979, 18-1979, 19-1979, 20-1979 and 21-1979 on first reading 16 by title only, seconded by Councilman Williams and on unanimous voice vote, 17 the motion was carried. 18 19 The Clerk read on first reading by title only Ordinance No. 15-1979 - AN 20 ORDINANCE AUTHORIZING A SPECIAL USE IN AN M-2 GENERAL INDUSTRIAL DISTRICT 21 FOR A TREE CUTTING SERVICE ON PROPERTY LOCATED AT 2320 FLATLEY ROAD, PURSUAN 22 TO ARTICLE 48 OF CHAPTER 22 OF THE MUNICIPAL CODE, COMMONLY KNOWN AS THE 23 ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA. 24 25 President Paust announced Ordinance No. 15-1979 is referred to the Plan 26 Commission. 27 28 The Clerk read on first reading by title only Ordinance No.. 16-1979 - AN 29 ORDINANCE AMENDING A SPECIAL USE BY ELIMINATING IN ITS ENTIRETY THE 30 RESIDENTIAL PLANNED UNIT DEVELOPMENT KNOWN AS RICHLAND EXTENSION LOCATED 31 WITHIN THE TWO-MILE FRINGE JURISDICTIONAL AREA IN CENTER TOWNSHIP, WAYNE 32 COUNTY, INDIANA. 33 34 President Paust announced Ordinance No. 16-1979 is referred to the Plan 35 Commission. 36 37 The Clerk read on first reading by title only Ordinance No. 17-1979 - AN 38 ORDINANCE TO REDUCE WITHIN THE MOTOR VEHICLE-HIGHWAY FUND. 39 40 President Paust announced Ordinance No. 17-1979 has to be advertised. 41 42 The Clerk read on first reading by title only Ordinance_ No. 18-1979 - AN 43 ORDINANCE TO APPROPRIATE FROM THE FEDERAL REVENUE SHARING TRUST FUND. 44 45 President Paust announced Ordinance No. 18-1979 has to be advertised. 46 47 The Clerk read on first reading by title only Ordinance No. 19-1979 - AN 48 ORDINANCE TO. APPROPRIATE FROM THE FEDERAL REVENUE SHARING. TRUST FUND. 49 50 President Paust announced Ordinance No. 19-1979 has to be advertised and is 51 referred to the Committee of the Whole. Councilman Mills called a meeting 52 for the Committee of the Whole for Tuesday, February 27, 1979 at 7:00 p.m. 53 in the Board of Works Room of the City Building to discuss Federal Revenue 54 Sharing monies. 55 -, - 56 The Clerk read on first reading by title only Ordinance No:. 20-1979 - AN 57 ORDINANCE TO APPROPRIATE WITHIN THE GENERAL FUND. 58 59 President Paust announced Ordinance No. 20-1979 has to be advertised. 474 Common Council Minutes Cont. February 19, 1979 Page 2 1 The Clerk read on first reading by title only Ordinance No. 21-1979 - AN 2 ORDINANCE TO TRANSFER WITHIN THE MOTOR VEHICLE HIGHWAY SPECIAL DISTRIBUTION 3 FUND. 4 5 Councilman Mills moved to suspend the rules and move Ordinance No. 21-1979 to 6 second reading, seconded by Councilman Austerman and on unanimous voice 7 vote, the motion was carried. 8 9 The Clerk read on second reading Ordinance No. 21-1979. 10 11 Speaking for and explaining Ordinance No. 21-1979 was Mr. Jerry Haynes, 2116 12 North "D" Street, Director of Transportation for the City of Richmond. 13 14 Councilman Williams moved for engrossment of Ordinance No. 21-1979, seconded 15 by Councilman Ahaus and on unanimous voice vote, the motion was carried. 16 17 Councilman Williams moved to suspend the rules and read Ordinance No. 21-1979 18 on third and final reading by title only, seconded by Councilman Ahaus and 19 on unanimous voice vote, the motion was carried. 20 21 The Clerk read on third reading by title only Ordinance No. 21-1979. 22 23 Ordinance No. 21-1979 was placed on final passage or rejection and on a'call of 24 the roll, the following was recorded: Ayes: Elstro, Williams, Ahaus, Austerman, 25 Merchanthouse, Mills, Carter, Welch and Paust. Noes: None. The vote being 26 nine (9) to zero (0) in favor of passage of Ordinance No. 21-1979. 27 28 The Clerk read on second reading Ordinance No. 8-1979. 29 30 City Attorney Ed Anderson examined proof of publication for Ordinance Nos. 31 8-1979, 13-1979 and 14-1979 and found them to be in order. 32 33 Councilman Mills moved to accept and file proof of publication for Ordinance 34 Nos. 8-1979, 13-1979 and 14-1979, seconded by Councilman Welch and on unanimous 35 voice vote, the motion was carried. 36 37 Councilman Mills moved for engrossment of Ordinance No. 8-1979, seconded by 38 Councilman Welch. 39 40 Councilman-Williams=-moved that Ordinance No. 8-1979 be amended to read that 41 Council's salary be reduced by a total of four hundred dollars ($400.00). (one 42 hundred dollars out of each year) , seconded by Councilman Elstro and on a call 43 of the roll, the following was recorded: Ayes: Elstro, Williams and 44 Merchanthouse. Noes: Ahaus, Austerman, Mills, Carter, Welch and Paust. The 45 vote being three (3) to six (6) in favor of the amendment. On unanimous voice 46 vote Councilman Mills' motion for engrossment was carried. _ 47 48 Councilman Mills moved to suspend the rules and read Ordinance No. 8-1979 on 49 third and final reading by title only, seconded by Councilman Welch and on 50 unanimous voice vote, the motion was carried. 51 52 The Clerk read on third reading by title only Ordinance No. 8-1979. 53 54 Ordinance No. 8-1979 was placed on final passage or rejection and on a call of 55 the roll, the following was recorded: Ayes: Ahaus, Austerman, Mills, Carter, 56 Welch and Paust. Noes: Elstro, Williams and Merchanthouse. The vote being 57 six (6) to three (3) in favor of passage of Ordinance No. 8-1979 58 59 The Clerk read on second reading Ordinance No. 13-1979 - AN ORDINANCE TO 60 - APPROPRIATE FROM THE FEDERAL REVENUE SHARING TRUST FUND. 475 Common Council Minutes Cont. February 19, 1979 Page 3 1 Speaking for Ordinance No. 13-1979 were Dr. David Fulton, 102 South 18th Str-et, 2 Chairperson of Social Services Planning Board; Mr. Martin Berg, 63 South 15t III314 Street, Executive Director of CARES, Inc. ; Mr. John Brumbaugh, 50 Central 4 Drive, Director of Addiction Services for Dunn Mental Health; Mr. Darrell 5 Beane, 3701 Pinehurst Drive, Judge of Richmond City Court. 6' 7 Councilman Elstro moved for engrossment of Ordinance No. 13-1979, seconded 8 by Councilman Welch and on unanimous voice vote, the motion was carried. 9 10 Councilman Elstro moved to suspend the rules and read Ordinance No. 13-1979 11 on third and final reading by title only, seconded by Councilman Williams 12 and on unanimous voice vote, the motion was carried. 13 14 The Clerk read on third reading' by title only Ordinance No. 13-1979 . 15 16 Ordinance No. 13-1979 was placed on final passage or rejection and on a call 17 of the roll, the following was recorded: Ayes: Elstro, Williams, Ahaus, 18 Austerman, Merchanthouse, Mills, Carter, Welch and Paust. Noes: None. The 19 vote being nine (9) to zero (0) in favor of passage of Ordinance No. 13-1979 20 21 The Clerk read on second reading Ordinance No. 14-1979 - AN ORDINANCE TO 22 APPROPRIATE FROM THE CUMULATIVE CAPITAL IMPROVEMENT FUND (CIGARETTE TAX) . 23 24 Councilman Mills moved for engrossment of Ordinance No. 14-1979, seconded 25 by Councilman Elstro and on unanimous voice vote, the motion was carried. 26 27 Councilman Elstro moved to suspend the rules and read Ordinance No. 14-1979 III28 on third and final reading by title only, seconded by Councilman Mills and 29 on unanimous, voice vote, the motion was carried. 30 31 The Clerk read on third reading by title only Ordinance No. 14-1979. 32 33 Ordinance No. 14-1979 was placed on final passage or rejection and on a 34 call of the roll, the following was recorded: Ayes: Elstro, Williams, 35 Ahaus, Austerman, Merchanthouse, Mills, Carter, Welch and Paust. Noes: 36 None. The vote being nine (9) to zero (0) in favor of passage of Ordinance 37 No. 14-1979. 38 39 Councilman Mills moved to bring Ordinance No. 9-1979 from the table, 40 seconded by Councilman Ahaus and on unanimous voice vote, the motion was 41 carried. 42 43 Councilman Mills moved to suspend the rules and read Ordinance No. 9-1979 44 on third and final reading by title only, seconded by Councilman Welch and 45 on unanimous voice vote,- the motion was carried. 46 47 The Clerk read on third reading by title only Ordinance No. 9-1979. 48 49 Ordinance No. 9-1979 was placed on final passage or rejection and on a call 50 of the roll, the following was recorded: Ayes: Ahaus, Austerman, Mills, 51 Carter, Welch and Paust. Noes: Elstro, Williams,.and Merchanthouse. The 52 vote being six (6) to three (3) in favor of passage of Ordinance No. 9-1979. III 53 54 Councilman Austerman moved to suspend the rules and read Ordinance No. 5-19 9 55 on third reading by title only, seconded by Councilman Mills and on unanimo s 56 voice vote, the motion was carried. 57 58 The Clerk read on third reading by title only Ordinance No. 5-1979 - AN 59 ORDINANCE AMENDING CHAPTER 22 OF THE MUNICIPAL CODE, BEING-ORDINANCE NO. 60 2325-1968, COMMONLY KNOWN AS THE ZONING` ORDINANCE OF THE CITY OF RICHMOND, 61 INDIANA, ADOPTED JUNE 3, 1968, PROVIDING FOR THE REZONING OF PROPERTY LOCA D 62 ON UNION PIKE, NORTH OF INDUSTRIES ROAD (RUHLEN ROAD) FROM R-2 ONE-FAMILY 63 RESIDENCE DISTRICT AND M-2 GENERAL INDUSTRIAL DISTRICT TO M-2 GENERAL 64 INDUSTRIAL DISTRICT FOR THE ENTIRE PARCEL. 476 Common Council Minutes Cont. February 19, 1979 Page 4 1 President Paust asked City Attorney Anderson if this Ordinance is affected 2 by the fact that the owner of the property was Mr. Richard_Brantner, who is 3 now deceased. Mr. Anderson stated that it is his opinion that this in no 4 way affects the Ordinance on the question of zoning. 5 6 Ordinance No. 5-1979 was placed on final passage or rejection and on a call 7 of the roll, the following was recorded: Ayes: Elstro, Williams, Ahaus, 8 Austerman, Merchanthouse, Welch and Paust. Noes: Mills and Carter. The 9 vote being seven (7) to two (2) in favor of Ordinance No. 5-1979. 10 11 Councilman Ahaus, Council's representative to the Board of Aviation 12 Commissioners, reported the new hangars at the airport are completely filled 13 and there is a waiting list of seven (7) airplanes for these spaces. 14 15 Councilman Elstro brought the condition of parking at Roy Cates to the attention 16 of the Board of Works. 17 18 There being no further business on motion duly made, seconded and passed, the 19 meeting was adjourned. 20 21 Kenneth Paust 22 President 23 24 ATTEST: JoEllen Trimble 25 City Clerk
