PROCEEDINGS OF THE COMMON COUNCIL OF THE
CITY OF RICHMOND, INDIANA, FEBRUARY 5, 1979
1 The Common Council of the City of Richmond, Indiana, met in regular session
2 February 5, 1979 at the hour of 7:30 p.m. in the Council Chambers in the
3 Municipal Building in said City. President Paust presided with the
III4 following members present: Messrs. Elstro, Williams, Ahaus, Austerman,
5 Merchanthouse, Mills, Carter and Welch. Absent: None. The following
6 business was had, to-wit:

8 Councilman Paust gave devotions.

10 Councilman Carter and Merchanthouse stated they were absent at the previous
11 meeting as they were out of town.

13 Councilman Williams moved to approve the minutes of the previous meeting as
14 prepared, seconded by Councilman Mills and on unanimous voice vote, the
15 motion was approved.

17 Director of Community Development Tim Ryder reported the City has received
18 $137,700. as a matching grant for acquisition and development in the
19 Whi.tewater gorge. In two weeks he will be submitting an ordinance for part
20 of the match which is required for that grant. Community Development is
21 putting $85,000 into the project and he will be seeking the balance of
22 $52,000 from Federal Revenue Sharing Fund. He anticipates a follow up
23 application to include the dredging of Springwood Lake. An application has
24 been submitted for the dredging of Glen Miller Lake, which will also need the
25 50% match of $84,000.

27 Councilman Mills moved to suspend the rules and read Ordinance Nos.. 12-1979,
III28 13-1979 and 14-1979 on first reading by title only, seconded by Councilman
29 Austerman and on unanimous voice vote, the motion was carried.

35 Councilman Mills moved to suspend the rules and read Ordinance No. 12-1979
36 on second reading, seconded by Councilman Ahaus and on unanimous voice vote
37 the motion was carried.

41 Councilman Williams moved for engrossment of Ordinance No. 12-1979, seconded
42 by Councilman Mills and on unanimous voice vote, the motion was carried.

44 Councilman Williams moved to suspend the rules and read Ordinance No. 12-197'
45 on third and final reading by title only, seconded by Councilman Welch and
46 on unanimous voice vote, the motion was carried.

50 Ordinance No. 12-1979 was placed on final passage or rejection and on a
51 call of the roll, the following was recorded: Ayes: Elstro, Williams, Ahau-,

53 vote being nine (9) to zero (0) in favor of passage of Ordinance No. 12-1979.

5 KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE
6 3, 1968, PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT U.S. 40 EAST AT
7 OHIO-INDIANA LINE FROM A-1 AGRICULTURAL DISTRICT TO C-4 GENERAL BUSINESS

10 As the petitioner had asked the request be withdrawn, Councilman Austerman
11 moved to strike Ordinance No. 3-1979, seconded by Councilman Ahaus and on
12 unanimous voice vote, the motion was carried.

20 As the petitioner had asked the request be withdrawn, Councilman Welch moved
21 to strike Ordinance No. 4-1979, seconded by Councilman Carter and on unanimous
22 voice vote, the motion was carried.

24 The Clerk read on second reading Ordinance No. 5-1979 - AN ORDINANCE AMENDING
25 ' CHAPTER 22 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY
26 KNOWN AS THE ZONING ORDINANCE OF THE CITY, OF RICHMOND, INDIANA, ADOPTED
27 JUNE 3, 1968, PROVIDING FOR THE REZONING OF PROPERTY LOCATED ON UNION PIKE,
28 . NORTH OF INDUSTRIES ROAD (RUHLEN ROAD) FROM R-2 ONE-FAMILY RESIDENCE DISTRICT
29 AND M-2 GENERAL INDUSTRIAL DISTRICT TO M-2 GENERAL INDUSTRIAL DISTRICT FOR

36 Speaking for Ordinance No. 5-1979 were Mr. Robert Reinke, 433 South 21st
37 Street, Attorney for Jerry Stanton; and Mr. Jerry Stanton, 1206 Sycamore

40 Assistant Director of the Plan Department Dan Dooley, R.'R. , Centerville,
41 stated the Plan Commission by a vote of ten (10) to zero (0) recommended
42 approval of Ordinance No. 5-19-79 on January 23, 1979.

44 Councilman Ahaus moved to amend Ordinance No. 5-1979 as recommended by the
45 Plan Commission to correct the legal description, seconded by Councilman
46 Williams and on unanimous voice vote, the motion was carried.

48 Councilman Austerman moved for engrossment of Amended Ordinance No. 5-1979,
49 seconded by Councilman Welch and on unanimous voice vote, the motion was
50 carried with Councilman Carter voting no.

52 Amended Ordinance No. 5-1979 will come back to Council at the next meeting
53 on third reading.

55 The Clerk read on second reading Ordinance No. 10-1979 AN ORDINANCE TO
56 APPROPRIATE WITHIN THE PARK AND RECREATION FUND.

58 Attorney Robert Hudson examined proof of publication for Ordinance No.
59 10-1979 and found it to be in -order. Councilman Mills moved to accept and
60 file proof of publication, seconded by Councilman Welch and on unanimous
61 voice vote, the motion was carried.

17 Ordinance No. 10-1979.

20 AMEND AMENDED ORDINANCE NO. 2432-1969 TO ENFORCE THE RULES AND REGULATIONS
21 SET OUT IN ORDINANCE NO. 2432-1969.

23 Councilman Mills, Chairman of the Public Safety and Sanitation Committee,
24 stated his committee met last Monday night and recommend approval of
25 Ordinance No. 11-1979.

27 Speaking for Ordinance No. 11-1979 was Department of Sanitation
III28 Superintendent Ed Goodknight, 200 South 21st Street.

30 Councilman Austerman moved to amend Ordinance No. 11-1979 as presented
31 (omitting the words "building inspector or police. officer".:and_changing
32 the time limit from 72 hours to 7 days), seconded by Councilman Welch and
33 on unanimous voice vote, the motion was carried.

35 Attorney Robert Hudson recommended the addition to paragraph 3 of the words
36 "or transfer said nuisance from private premises to adjacent public
37 premises". Councilman Mills moved to amend paragraph 3 as recommended,
38 seconded by Councilman Austerman and on unanimous voice vote, the motion
39 was carried.

41 Councilman Ahaus moved for engrossment of Amended Ordinance No. 11-1979,
42 seconded by Councilman Carter and on unanimous voice vote, the motion was
43 carried.

45 Councilman Mills moved to suspend the rules and read Amended Ordinance No.
46 11-1979 on third and final reading by title only, seconded by Councilman
47 Welch and on unanimous voice vote, the motion was carried.

57 Councilman Mills moved to bring Ordinance No. 2-1979 from the table, second-d
58 by Councilman Merchanthouse and on unanimous voice vote, the motion was
59 carried with Councilman Austerman voting no.

62 Councilman Williams and=_on unanimous voice vote, the motion was carried.

64 Councilman Mills moved to suspend the rules and read Ordinance No. 2-1979
65 on third and final reading by title only, seconded by Councilman Williams
66 and on unanimous voice -vote., the motion was carried.

4 Ordinance No. 2-19-79 was placed on final passage or rejection and on a call
5 of the roll, the following was recorded: Ayes: Elstro, Williams, Ahaus,
6 Austerman, Merchanthouse, Mills, Carter, Welch and Paust. Noes: None. The
7 vote being nine (9) to zero (0) in favor of passage of Ordinance No. 2-1979.

9 Councilmen Ahaus and Carter asked the Attorney's office to seek out charges
10 from American Water Works to other cities for a comparison.

12 Addressing Council was Mr. Jeff Roller, 4041 Round Barn Road, North,
13 representing Rev. R.E. Girten presenting a plan to help the socially and
14 economically disadvantaged of the community. Nicholson School will not be
15 used as a school building and the Richmond Community-School-Board will have-
16 this property before them at their next meeting to possibly sell this propert
17 to OIC for a community services building to be constructed through a Federal
18 grant.

20 There being no further business on motion duly made, seconded and passed, the
21 meeting was adjourned.
