HomeMy Public PortalAbout01-15-1979 463 • PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, JANUARY 15, 1979 1 The Common Council of the City of Richmond, Indiana, met in regular session 2 January 15, 1979 at the hour of 7:30 p.m. in the Council Chambers in the 3 Municipal Building in said City. President Paust presided with the 4 following members present: Messrs. Elstro, Williams, Ahaus, Austerman, 5 Mills and Welch. Absent: Messrs. Merchanthouse and Carter. The following 6 business was had, 'towit: 7 8 Councilman Mills gave devotions. 9 10 Councilman Austerman moved to approve the minutes of the previous meeting, 11 as prepared, seconded by Councilman Welch and on unanimous voice vote, the 12 motion was carried. 13 14 Councilman Mills moved to suspend the rules and read Resolution Nos. 3-1979 15 and 4-1979 by title only, seconded by Councilman Austerman and on unanimous 16 voice vote, the motion was carried. 17 18 The Clerk read by title only Resolution No. 3-1979 - RESOLUTION AUTHORIZING 19 THE FILING OF PREAPPLICATION WITH THE DEPARTMENT .OF HOUSING AND URBAN 20 DEVELOPMENT, FOR COMMUNITY DEVELOPMENT BLOCK. GRANT FUNDS, AS PROVIDED IN 21 TITLE I OF THE COMMUNITY DEVELOPMENT ACT 1974, P.L. 93-383. . 22 23 Speaking for Resolution No. 3-1979 was Director of Community Development 24 Tim Ryder. 25 26. January 15, 1979 Page 2 1 The City Controller brought to the attention of the Council that as of January 2 1, 1979 he, as City Controller, assumed duties as Treasurer for the City. He 3 is now under a $50,000 bond as Controller and requested Council make. the 4 decision whether or not to raise the amount of the bond to $100,000, which 5 was the amount of the County Treasurer. The concensus of Council was that 6 $50,000 is sufficient. 7 8 Councilman Mills moved to suspend the rules and read Ordinance Nos. 3-1979, 9 4-1979, 5-1979, 6-1979, 7-1979, 8-1979, 9-1979, 10-1979 and 11-1979 on first 10 reading by title only, seconded by Councilman Ahaus and on unanimous voice 11 vote the motion was carried. 12 13 The Clerk read on first reading by title only Ordinance No. 3-1979 - AN 14 ORDINANCE AMENDING CHAPTER 22 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 15 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, 16 INDIANA, ADOPTED JUNE 3, 1968, PROVIDING FOR THE REZONING OF PROPERTY LOCATED 17 AT U.S. 40 EAST AT OHIO-INDIANA LINE FROM A-1 AGRICULTURAL DISTRICT TO C-4 18 GENERAL BUSINESS DISTRICT. 19 20 President Paust announced' Ordinance No. 3-1979 is referred to the Plan 21 Commission. 22 23 The Clerk read on first reading by title only Ordinance No. 4-1979 - AN 24 ORDINANCE AMENDING CHAPTER 22 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 25 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, 26 INDIANA, ADOPTED JUNE 3, 1968, PROVIDING FOR THE REZONING OF AREA KNOWN AS 27 RICHLAND EXTENSION FROM R-1 ONE-FAMILY RESIDENCE DISTRICT TO R-2 ONE-FAMILY 28 RESIDENCE DISTRICT. 29 30 President Paust announced Ordinance No. 4-1979 is referred to the Plan 31 Commission. 32 33 The Clerk read on first reading by title only Ordinance No. 5-1979 - AN 34 ORDINANCE AMENDING CHAPTER 22 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 35 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, 36 INDIANA, ADOPTED JUNE 3, 1968, PROVIDING FOR THE REZONING OF PROPERTY LOCATED 37 ON UNION PIKES NORTH OF INDUSTRIES ROAD (RUHLEN ROAD) FROM R-2 ONE-FAMILY 38 RESIDENCE DISTRICT AND M-2 GENERAL INDUSTRIAL DISTRICT TO M-2 GENERAL 39 INDUSTRIAL DISTRICT FOR THE ENTIRE PARCEL. 40 41 President Paust announced Ordinance No. 5-1979 is referred to the Plan 42 Commission. 43 44 The Clerk read on first reading by title only Ordinance No. 6-1979 - AN 45 ORDINANCE AMENDING CHAPTER 22 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 46 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, 47 INDIANA, ADOPTED JUNE 3, 1968, PROVIDING FOR THE REZONING OF PROPERTY LOCATED 48 EAST OF UNION PIKE: A PORTION TO BE REZONED FROM R-1 ONE-FAMILY RESIDENCE 49 DISTRICT TO M-2 GENERAL INDUSTRIAL DISTRICT, AND A PORTION TO BE REZONED FROM 50 R-1 ONE-FAMILY RESIDENCE DISTRICT TO R-2 ONE-FAMILY RESIDENCE DISTRICT. 51 52 President Paust announced Ordinance No. 6-1979 is referred to the Plan 53 Commission. 54 55 The Clerk read on first reading by title only Ordinance No. 7-1979 - AN 56 ORDINANCE AUTHORIZING REPEAL OF ORDINANCE NO. 107-1978 57 58 Councilman Austerman moved to suspend the rules and read Ordinance No. 7-1979 59 on second reading, seconded by Councilman Mills and on unanimous voice vote, 60 the motion was carried. 61 62 The Clerk read on second reading Ordinance No. 7-1979. 63 64 Speaking for Ordinance No. 7-1979 was Mr. Robert Hudson, City Attorney's Office. 465 Common Council Minutes Cont. January 15, 1979 Page 3 1 Councilman Mills moved for engrossment of Ordinance No. 7-1979, seconded by 2 Councilman Welch and on unanimous voice vote, the motion was carried. III3 4 Councilman Mills moved to suspend the rules and read Ordinance No. 7-1979 5 on third and final reading by title only, seconded by Councilman Ahaus and 6 on unanimous voice vote, the motion was carried. 7 8 The Clerk read on third reading by title only Ordinance No. 7-1979. 9 10 Ordinance No. 7-1979 was placed on final passage or rejection and on a call 11 of the roll, the following was recorded: Ayes: Elstro, Williams, Ahaus, 12 Austerman, Mills, Welch and Paust. Noes: None. The vote being seven (7) 13 to zero (0) in favor of passage of Ordinance No. 7-1979. 14 15 The Clerk read on first reading by title only Ordinance No. 8-1979 - AN 16 ORDINANCE FIXING THE ANNUAL SALARIES OF ALL ELECTED OFFICERS OF THE CITY OF 17 RICHMOND, INDIANA. 18 19 President Paust announced Ordinance No. 8-1979 has to be advertised thirty 20 (30) days in advance of its passage, so it will be back on the February 19 21 agenda. 22 23 The Clerk read on first reading by title only Ordinance No. 9-1979 - AN 24 ORDINANCE APPROVING THE PAYMENT OF ADDITIONAL COMPENSATION TO CERTAIN 25 ELECTED OFFICIALS OF THE CITY OF RICHMOND, INDIANA. 26 27 Councilman Mills moved to suspend the rules and read Ordinance No. 9-1979 III28 on second reading, seconded by Councilman Elstro and on unanimous voice vote, 29 the motion was carried. 30 31 The Clerk read on second reading Ordinance No. 9-1979. 32 33 Councilman Mills moved for engrossment of Ordinance No. 9-1979, seconded 34 by Councilman Ahaus and on unanimous voice vote, the motion was carried. 35 36 Councilman Mills moved to suspend the rules and read Ordinance No. 9-1979 37 on third and final reading, seconded by Councilman Welch. On a call of the 38 roll, Councilman Elstro voted no stopping the suspension. 39 40 Councilman Mills moved to table Ordinance No. 9-1979, seconded by Councilman 41 Ahaus and on unanimous voice vote, the motion was carried. 42 43 The Clerk read on first reading by title only Ordinance No. 10-1979 - AN 44 ORDINANCE TO APPROPRIATE WITHIN THE PARK AND RECREATION FUND. 45 46 President Paust announced Ordinance No. 10-1979 has to be advertised. 47 48 The Clerk read on first reading by title only Ordinance NO. 11-1979 - AN 49 ORDINANCE TO AMEND AMENDED ORDINANCE NO. 2432-1969 TO ENFORCE THE RULES 50 AND REGULATIONS SET OUT IN ORDINANCE NO. 2432-1969. 51 52 President Paust referred Ordinance No. 11-1979 to the Public Safety Committee. III 53 54 The Clerk read on second reading Ordinance No. 1-1979 - AN ORDINANCE TO 55 APPROPRIATE TO THE GENERAL FUND FROM THE CUMULATIVE CAPITAL IMPROVEMENT FUND 56 (CIGARETTE TAX) . 57 58 City Attorney Ed Anderson examined proof of publication for Ordinance No. 59 1-1979 and found it to be in order. Councilman Mills moved to accept and 60 file the proof of publication, seconded by Councilman Ahaus and on unanimous 61 voice vote, the motion was carried. 62 63 Councilman Williams moved for engrossment of Ordinance No. 1-1979, seconded 64 by Councilman Mills and on unanimous voice vote, the motion was carried. 466 Common Council Minutes Cont. January 15, 1979 Page 4 1 Councilman Austerman moved to suspend the rules and read Ordinance No. 1-197' 2 on third and final reading by title only, seconded by Councilman Williams an. 3 on unanimous voice vote, the motion was carried. 4 _. 5 The Clerk read on third reading by title only Ordinance No. 1-1979. 6 7 Ordinance No. 1-1979 was placed on final passage or rejection and on a call 8 of the roll, the following was recorded: Ayes: Elstro, Williams, Ahaus, 9 Austerman, Mills, Welch and Paust. (0) in favor of passage of Ordinance No. 1-1979. 11 12 The Clerk read on second reading Ordinance No. 2-1979 - AN ORDINANCE TO 13 APPROPRIATE FROM THE FEDERAL REVENUE SHARING TRUST FUND. 14 15 City Attorney Ed Anderson examined proof of publication for Ordinance No. 16 2-1979 and found it to be in order. Councilman Ahaus moved it b.e accepted 17 and filed, seconded by Councilman Welch and on unanimous voice vote, the 18 motion was carried. 19 20 City Attorney stated, at the request of Councilman Carter, he had 21 researched the contract with the Water Company and found there is no contrac•. 22 Rates were set by a rate case in 1973. 23 24 Councilman Elstro moved to table Ordinance No. 2-1979, seconded by Councilma 25 Austerman and on unanimous voice vote, the motion was carried. 26 27 Councilman Austerman requested. the City Attorney to find if there is any 28 conceivable way of getting out of paying the $190,000 in Ordinance. No. 29 2-1979.
