ADDENDUM
THIS AD E UM, umber 1 to Contract No. 69-2021) is made and entered into this
..;,oilday of e � - 2021, by and between Richmond, Indiana, a municipal corporation
acting through its oard of Public Works and Safety with its office at 50 North 5th Street, Richmond,
Indiana, 47374 (hereinafter referred to as "City"), and All American Lawn and Landscape, LLC, 6040
Hill Road,Fountain City,Indiana, 47341 (hereinafter referred to as"Contractor").
WHEREAS, City and Contractor entered into Contract No. 69-2021 on June 17, 2021, which
Agreement retains Contractor to provide services to furnish and install specified plants
and landscaping materials for the Izzy David Edelman Police and Fire Training and
Physical Fitness Center located at 1740 South 8th Street in Richmond, Indiana, for the
City of Richmond Fire Department of the City of Richmond,Indiana; and
WHEREAS, The Parties have agreed, due to the relocation of the monument, the Contractor shall
furnish and install additional grading and landscaping adjacent to the monument and
concrete pads, including edging installation.
NOW, THEREFORE, in consideration of the mutual promises and covenants herein contained, including
the above stated recitals, City and Contractor hereby agree as follows:
1. The City and Contractor executed and entered into. Contract No. 69-2021, on June 17,
2021, which Agreement is incorporated herein by reference. Pursuant to Contract No.
69-2021, Section XI (Miscellaneous), the Parties may alter or amend the Agreement in
whole or in part at any time by filing with the Agreement a written instrument setting
forth such changes signed by both Parties. The Parties agree the Contractor shall also
install additional grading and landscaping adjacent to the monument and concrete pads,
including edging installation, in accordance with the scope of said Agreement. Said
purchase shall be completed and delivered in a manner consistent with Contract No. 69-
2021, which is hereby incorporated by reference and made a part hereof. Compensation
paid to Contractor as described in accordance with Section III (Compensation) of said
Agreement for said additional services shall be increased by an amount not to exceed
Two Thousand Nine Hundred Forty Dollars and Zero Cents ($2,940.00) reflected within
Contractor's quote, dated September 3, 2021, and attached hereto as Exhibit A to this
Addendum, which quote is incorporated herein by reference. The new total amount to be
paid to Contractor under the Agreement shall be an amount not to exceed Thirteen
Thousand Seven Hundred Twenty-three Dollars and Zero Cents ($13,723.00).
2. City and Contractor expressly agree that all other terms, conditions, and covenants
contained in Contract No. 69-2021, shall be applicable to this Addendum, unless such
term, condition or covenant conflicts with this Addendum Number 1, in which case this
Addendum Number 1 shall be controlling.

3. Both Parties hereby agree that with the exception of the additional services to include the
installation of additional grading and landscaping adjacent to the monument and concrete
pads, including edging installation, and with the exception of the corresponding
compensation increase, Contract No. 69-2021 shall remain intact and unchanged and in
full force and effect.
4. Both Parties agree that any person executing this Contract in a representative capacity
hereby warrants that he or she has been duly authorized by his or her principal to execute
this Addendum.
