PROCEEDINGS OF THE COMMON COUNCIL OF THE
CITY OF RICHMOND, INDIANA, DECEMBER 18, 1978
1 The Common Council of the City of Richmond, Indiana, met in regular session
2 December 18, 1978 at the hour of 7:30 p.m. in the Council Chambers in the
3 Municipal Building in said City. President Austerman presided with the
4 following members present: Messrs. Elstro, Williams, Ahaus, Merchanthouse,
5 Mills, Carter, Paust and Welch. Absent: None. The following business was
6 had, to-wit:

8 Councilman Elstro gave devotions.

10 Councilman Williams movedto approve the minutes of the previous meeting as
11 prepared, seconded by Councilman Mills and on unanimous voice vote, the
12 motion was carried.

14 Councilman Mills moved to suspend the rules and read Resolution Nos. 18-1978
15 and 19-1978 by title only, seconded by Councilman Paust and on unanimous
16 ' voice vote-, the motion was carried.

18 The Clerk read by title only Resolution No. 18-1978 - A RESOLUTION TO
19 TRANSFER WITHIN THE GENERAL FUND.

21 Councilman Merchanthouse moved for adoption of Resolution No. 18-1978,
22 seconded by Councilman Carter and on unanimous voice vote, the motion was
23 carried.

25 The Clerk read by title only Resolution No. 19-1978 - A RESOLUTION TO
26 TRANSFER WITHIN THE PARKING METER FUND.

28 Councilman Ahaus movedfor adoption of Resolution No. 19-1978, seconded
29 by Councilman Williams and on unanimous voice vote, the motion was carried.

31 Mayor Clifford Dickman invited the Councilmen to take a bus tour of the City
32 on a.Sa.t.urday. in January, tentatively set as.. the 27th at 9:00 _a.m...

34 In answer to a question from Councilman Elstro, concerning why property
35 on West Main was sold without coming before Council, Mr. Anderson stated
36 the Board of Works as well as Council has the power to sell proPerty and
37 the Mayor must sign all deeds.

39 Councilman Williams requested the Board to study on-street parking in the
40 100 and 200 blocks ;-of South 8th Street. He noted this was once limited to
41 two (2), hour: parking, but that has been removed. Mr.. Meredith stated the
42 Traffic Department did.do a study of this and most businesses in the area
43 have off-street parking; however, he will ask Captain Loper to study this
44 again.

46 Councilman Paust stated his Committee was asked to study the sewer project
47 in South Richmond and he asked Community Development Director Tim Ryder to
48 explain the project. Mr. Ryder stated the area in question is South 16th
49 between South "T" and South "U". Clyde Williams, Engineers, have been
50 drawing plans for this sewer. This project will be done with C.D. funds.
51 - He further stated there will be a lift station at the corner of 16th and
52 "U" to pump to the- existing. sewer. This project should be bid no later than
53 March and this will give adequate. time to complete the sewer and street in
54 the summer of 1979. An estimated sewer cost is $25,000 to $30,000 and with
55 the street added, will be a. $60,000 to $80,000 project.

57 Councilman Paust stated he had received the names of Ms Mary Esther Culligan,
58 Mr. Fred Power, Jr. , and Ms Marie Fredricks as candidates for the Merit
59 Commission. This decision will be made the first meeting in January.

61 Councilman Mills moved to suspend the rules and read Ordinance Nos. 114-1978
62 115-1978, 116-1978 and 117-1978 on first reading by title only, seconded
63 by Councilman Paust and on unanimous voice vote, the motion was carried.

5 Councilman Mills moved to suspend the rules and read Ordinance No. -114-1978
6 on second reading, seconded by Councilman Welch and on unanimous voice vote,
7 the motion was carried.

11 Speaking for and explaining Ordinance No. 114-1978 was Director of Community
12 Development Tim Ryder.

14 Councilman Ahaus moved for engrossment of Ordinance No. 114-1978, seconded
15 by Councilman Paust and on unanimous voice vote, the motion wascarried.

17 Councilman Ahaus moved to suspend the rules and read Ordinance No. 114-1978
18 on third and final reading by title only, seconded by Councilman Welch and
19 on unanimous voice vote, the motion was carried.

24 call of the roll, the following was recorded: Ayes: Elstro, Williams,

26 None. The vote being nine (9) to zero (0) in favor of passage of Ordinance
27 No. 114-1978.

34 vote, the motion was carried.

40 Councilman Mills moved to suspend the rules and read Ordinance No. 113-1978
41 on third reading by title only, seconded by Councilman Paust and on unanimous
42 voice vote, the motion was carried.

45 ORDINANCE FIXING AND DEFINING THE BOUNDARIES AND TERRITORIES OF THE COUNCI IC
46 DISTRICTS IN THE CITY OF RICHMOND, WAYNE COUNTY, INDIANA, AS PROVIDED FORIN
47 ACTS 1972, P .L. 131, § 1, p. 625; 1975, P.L. 177, § 1, p. 975, AND REPEALING
48 ALL ORDINANCES OR PARTS THEREOF IN CONFLICT HEREWITH.

50 Councilman Merchanthouse asked City Attorney Ed Anderson if the publication if
51 the advertising was in order. Mr. Anderson stated the Ordinance did not ha e
52 to be published before it was.passed. Mr. Merchanthouse asked Mr. Anderson
53 to look at a statute he had and Mr. Anderson stated the statute had to do with
54 the creation of Wards and was not applicable to the situation.

56 Mr. Merchanthouse moved to strike Ordinance No. 113-1978 from the agenda,
57 seconded by Councilman Elstro. On a call of the roll, the following was
58 recorded: Ayes: Elstro, Williams, and Merchanthouse. Noes: Ahaus, Mills,
59 Carter, Paust, Welch and Austerman. The vote being three (3) to six (6) in
60 favor of passage of the motion; therefore, the motion was defeated.

Ordinance No. 113-1978 was placed bn 'final passage or rejection and on a call
of the roll, the following was recorded: Ayes: Ahaus, Mills, Carter, Paust,
Welch and Austerman. Noes: Elstro, Williams, and Merchanthouse. The vote
being six (6) to three (3) in favor of passage of Ordinance No. ' 113-1978.
President Austerman announced the next meeting of Common Council will be
Tuesday, January 2, 1979.
There being no further business on motion duly made, seconded and passed, the
meeting was adjourned.
