HomeMy Public PortalAbout11-20-1978 449 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, NOVEMBER 20, 1978 1 The Common Council of the City of Richmond, Indiana, met in regular session 2 November 20, 1978 at thehour of 7:30 p.m. in the Council Chambers in the 3 Municipal Building in said City. President Austerman presided with the 4 following members present: Messrs. Elstro, Williams, Ahaus, Paust and Welch. 5 Absent: Messrs. Merchanthouse, Mills and Carter. The following business 6 was had, to-wit : 7 8 PresidentAusterman gave devotions. 9 10 Councilman Williams moved to approve the minutes of the previous meeting as 11 prepareded seconded by Councilman Paust and on unanimous voice vote, the 12 motion was carried. 13 14 Councilman Paust moved to suspend the rules and read Resolution No. 15-1978 15 by title only, seconded by Councilman Elstro and on unanimous voice vote, the 16 motion was carried. 17 18 The Clerk read by title only Resolution No. 15-1978 - A RESOLUTION AUTHORIZING 19 THE FILING OF AN APPLICATION WITH`THE -DEPARTMENT OF HOUSING AND URBAN 20 DEVELOPMENT, FOR URBAN DEVELOPMENT ACTION GRANT FUNDS, AS PROVIDED IN TITLE 21 I OF THE COMMUNITY DEVELOPMENT ACT 1974, P.L. 93-383, AS AMENDED. 22 23 Speaking for and explaining Resolution No. 15-1978 was Director of Community 24 Development Tim Ryder. Mr. Ryder stated this resolution authorizes the 25 filing of an application with HUD for the extension of Industrial Parkway 26 from U.S. 40 to Hodgin Road. This application is for funds to build this 27 road. 28 29 Councilman Ahaus moved for adoption of Ordinance No. 15-1978, seconded by 30 Councilman Elstro and on unanimous voice vote, the motion was carried. 31 32 Ms Barbara Barnhizer, Director of EEOC, presented a yearly up-date of the 33 program. 34 35 Councilman Paust requested anyone who is interested in an appointment to the 36 Merit Commission should contact him or any member of the Common Council. 37 As soon as the Police Department makes their selection, Council will know 38 their position for their selection. 39 40 Councilman Paust moved to suspend the rules and read Ordinance Nos. 108-1978, 41 109-1978, 110-1978 and 111-1978 on first reading by title only, seconded by 42 -Councilman Williams and on unanimous voice vote, the motion was carried. 43 44 The Clerk read on first reading by title only Ordinance No. 108-1978 - AN 45 ORDINANCE AUTHORIZING A SPECIAL USE IN AN R-3 ONE-TO-EIGHT FAMILY RESIDENCE 46 DISTRICT FOR A BUSINESS OFFICE ON PROPERTY LOCATED AT 15 SOUTH 17TH STREET, 47 PURSUANT TO ARTICLE 48 OF CHAPTER 22 OF THE MUNICIPAL CODE COMMONLY KNOWN 48 AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA. 49 50 President Austerman announced Ordinance No. 108-1978 is referred to the Plan 51 Commission. 52 - 53 The Clerk read on first reading by title only Ordinance No. 109-1978 - AN 54 ORDINANCE TO TRANSFER WITHIN THE MOTOR VEHICLE HIGHWAY FUND. 55 56 Councilman Ahaus moved to suspend the rules and move Ordinance No. 109-1978 57 to second reading, seconded by Councilman Williams, and on unanimous voice 58 vote, the motion was carried. 59 60 The Clerk read on second reading Ordinance No. 109-1978. 450 Common Council Minutes Cont. November 20, 1978 Page 2 1 Speaking for and explaining Ordinance No. 109-1978 was Director of the 2 Department of Transportation Jerry Haynes. 3 4 Councilman Williams moved for engrossment of Ordinance No. 109-1978, seconded 11/ 5 by Councilman Ahaus and on unanimous voice vote, the motion was carried. 6 7 Councilman Williams moved to suspend the rules and read Ordinance No. 109-197: 8 on third and final reading by title only, seconded by Councilman Ahaus and 9 on unanimous voice vote, the motion was carried. 10 11 The Clerk read on third reading by title only, Ordinance No. 109-1978. 12 13 Ordinance No. 109-1978 was placed on final passage or rejection and on a call 14 _ of the roll, the following was recorded: Ayes: Elstro, Williams, Ahaus, 15 Paust, Welch and Austerman. Noes: None. The, vote being six (6) to zero 16 (0) in favor of passage of Ordinance No. 109-1978. 17 18 The Clerk read on first reading by title only Ordinance No. 110-1978 - AN 19 ORDINANCE TO APPROPRIATE FROM THE FEDERAL REVENUE SHARING TRUST' FUND. 20 21 President Austerman announced Ordinance No. 110-1978 has to be advertised and 22 is referred to the Transportation Committee. Councilman Ahaus, Chairman 23 of the Transportation Committee announced his committee will be meeting on 24 Thursday, November 30 at 7:00 p.m. in the Board of Works Room. 25 26 The Clerk read on first reading by title only Ordinance No. 111-1978 - AN 27 ORDINANCE TO TRANSFER WITHIN THE PARKS AND RECREATION FUND. 28 29 Councilman Welch moved to suspend the rules and move Ordinance No. 111-1978 30 to second reading,' seconded'by Councilman Ahaus and on unanimous voice vote, 31 the motion was carried. 32 33 The Clerk read on second reading Ordinance No. 111-1978. 34 35 Speaking for and explaining Ordinance No. 111-1978 was Superintendent of Park 36 Don McBride. 37 38 Councilman Ahaus moved for engrossment of Ordinance No. 111-1978, seconded 39 by Councilman Paust and on unanimous voice vote, the motion was carried. 40 41 Councilman Ahaus moved to suspend the rules and read Ordinance No. 111-1978 42 on third and final reading by title only, seconded-by Councilman Williams 43 and on unanimous voice vote, the motion was carried. 44 45 The Clerk read on third and final reading by title only Ordinance No. 111-1970. 46 47 Ordinance No. 111-1978 was placed on final passage or rejection and on a call 48 of the roll, the following was recorded: Ayes: Elstro, Williams, Ahaus, 49 Paust, Welch and Austerman. Noes: None. The vote being six (6) to zero 50 (0) in favor of passage of Ordinance No. 111-1978. 51 52 Councilman Ahaus moved to suspend the rules and read Ordinance No. 98-1978 53 on third reading by title only, seconded by Councilman Paust and on unanimous 54 voice vote, the motion was carried. 55 11/ 56 The Clerk read on third reading by title only Ordinance No. 98-1978 - AN 57 ORDINANCE REGULATING THE OPERATION AND PARKING OF MOTOR VEHICLES DURING 58 SNOW EMERGENCY AND ESTABLISHING SNOW EMERGENCY ROUTES . 59 60 Ordinance No: 98-1978 was placed on final passage or rejection and on a call 61 of the roll, the following was recorded: Ayes: Elstro, Williams, Ahaus, 62 Paust, Welch and Austerman. Noes: None. The vote being six (6) to zero 63 (0) in favor of passage of Ordinance. President Austerman presided with the 4 following members present: Messrs. Elstro, Williams, Ahaus, Mills, Carter, 5 and Paust. Absent: Messrs. Merchanthouse and Welch. The following business 6 was had, to- wit: 7 8 Councilman Carter gave devotions. 9 10 Councilman Mills stated he was absent from the previous meeting due to 11 vacation and Councilman Carter. stated he was absent due to illness. 12 13 Councilman Williams moved to approve the minutes of the previous meeting as 14 prepared, seconded by Councilman Mills and on unanimous voice vote, the 15 - motion was carried. 16 • 17 Addressing:- Council was -Mr. Walter Boger, 812 N.W. 5th.Street, Lot 26, 18 requesting information of the Special Task Force .and Stake Outs of the Crime 19 Watch of the Richmond Police Department. President Austerman stated this 20 is privileged information and Mr. Boger would have to petition through the 21 Courts-to obtain this information. 22 • - 23 Mr. Paul Wessler, 2015 South 16th Street and Ms Wanda Potter, 2040 South 24 16th Street appeared to request sewers in their Needmore Addition. President 25 Austerman requested Director of Community Development Tim Ryder, City 26 Engineer George Webb. and Superintendent of the Richmond Sanitary District 27 Ed Goodknight look into the problem. I28 . 29 Councilman Mills moved to suspend the rules and read Resolution Nos. 16-1978 30 . and 17-1978. by title only, seconded by Councilman Paust and on unanimous 31 voice vote, the motion was carried. 32 • 33 The Clerk read by title only Resolution No. 16-1978 - A RESOLUTION SUPPORTINi3 34 THE RICHMOND SANITARY DISTRICT APPLICATION FOR FUNDS TO STUDY THE FEASIBILIT 35 OF A LOCAL RESOURCE RECOVERY FACILITY; 36 37 Speaking for and explaining Resolution No. 16-1978 were Mr. Ed Goodknight, 38 200 South 21st Street, Superintendent of the Richmond _Sanitary District; 39 Mr. Tom Burke of Clark Dietz and Associates; Ms Ann Cline, 2711 South "G" 40 Street, Director of the City's Energy Program. 41 42 Councilman Mills moved for adoption of Resolution No. 16-1978, seconded by 43 Councilman Paust and on unanimous voice vote, the motion was carried. 44 45 The Clerk read by title only .Resolution No. 17-1978 - A RESOLUTION TO 46 TRANSFER WITHIN THE MUNICIPAL AIRPORT FUND. 47 48 Councilman Ahaus moved for adoption of Resolution No.. 17-1978, seconded by 49 Councilman Mills and on unanimous voice vote, the motion was carried. 50 51 City Controller Don Meredith noted Council may now proceed with their 52 appointment to the_Police .Merit Commission. This person should be of "any III53 other endeavor" category and must be a Democrat or Independent and live in 5.4 Wayne Township. . 55 56 Councilman Elstro asked th Board of Works to continue investigating the 57 light at 5th and the Promenade to be put on flasher;, during certain periods 58 of the- day. Also, Cable, TV being run to Winding Ridge Apartments. 59 60 ' City Engineer George. Webb stated the railroad overpass on Industries Road 61 has been approved. 152 Common Council Minutes Cont. The vote being seven (7) 26 to zero (0) in favor of passage of Ordinance No. 112-1978. 27 28 The Clerk read on first reading by title only Ordinance No. 113-1978 - AN 29 ORDINANCE FIXING AND DEFINING THE BOUNDARIES AND TERRITORIES OF THE 30 COUNCILMANIC DISTRICTS IN THE CITY OF RICHMOND, WAYNE COUNTY, INDIANA, AS 31 PROVIDED FOR IN ACTS 1972, P .O. 131, § 1, P. 625; 1975, P.L. 177, § 1, 32 P. 975, AND REPEALING ALL ORDINANCES OR PARTS THEREOF IN CONFLICT HEREWITH. 33 - 34 President Austerman announced there will be a Special Meeting of Common 35 Council on Monday, December 11 at 7:00 p.m. in Council Chambers in the 36 Municipal Building. President Austerman asked the Clerk to send a map 37 for this Ordinance to Councilmen. 38 39 The Clerk read on second reading Ordinance No. 108-1978 - AN ORDINANCE 40 AUTHORIZING A SPECIAL USE IN AN R-3 ONE-TO-EIGHT FAMILY RESIDENT DISTRICT 41 FOR A BUSINESS OFFICE ON PROPERTY LOCATED AT 15 SOUTH 17TH STREET, PURSUANT TO 42 ARTICLE 48 OF THE MUNICIPAL CODE COMMONLY KNOWN AS THE ZONING ORDINANCE OF 43 THE CITY OF RICHMOND, INDIANA. 44 45 Speaking for Ordinance No. 108-1978 was Deputy Director of City Planning 46 Dan Dooley. Mr. Dooley noted the Plan Commission voted nine (9) to zero 47 (0) in favor of this special use. 48 49 Councilman Williams moved for engrossment of Ordinance No. 108-1978, seconded. 50 by Councilman Ahaus and on unanimous voice vote, the motion was carried. 51 52 Councilman Williams moved to suspend the rules and read Ordinance No. 108- 53 1978 on third and final reading by title only, seconded by Councilman Ahaus 54 and on unanimous voice vote, the motion was carried. 55 56 The Clerk read on third reading by title-o ;Odnce No: 108-1978.lyrn 57 58 Ordinance No. 108-1978 was placed on final passage or rejection and on a cal: 59 of the roll, the following was recorded: Ayes: Elstro, Williams, Ahaus, 60 Mills, Carter, Paust and Austerman. December 4, 1978 Page 3 J 1 The Clerk read on second reading Ordinance No. 110-1978 - AN ORDINANCE TO 2 APPROPRIATE FROM THE FEDERAL REVENUE SHARING TRUST FUND. 3 III4 City Attorney Ed Anderson examined proof of publication and found it to be 5- in order. - Councilman Mills moved to accept and file proof of publication, 6 seconded by Councilman Paust and on unanimous voice vote, the motion was 7 carried. 8 9 Councilman Ahaus reported the Community Development, Community Service and 10 Transportation Committee held a meeting on this Ordinance and recommends this 11 allocation; however, it was recommended that next year's allocation be reduced 12 to $60 - $70,000 and that no future allocation be approved without Council's 13 review of complete budget information with projected income and expenses 14 included. "I" Court. 22 23 Councilman Williams moved for engrossment of Ordinance No. 110-1978, seconder 24 by Councilman Mills and on unanimous voice vote, the motion was carried. 25 26 Councilman Williams moved to suspend the rules and read Ordinance No. 110-1978 27 on third and final reading by title only, seconded by Councilman Paust and 28 on unanimous voice vote, the motion was carried. 29 30 The Clerk read on third reading by title only Ordinance No. 110-1978. 31 32 Ordinance No. 110-1978 was placed on final passage or rejection and on a 33 call of the roll, the following was recorded: Ayes: Elstro, Williams, 34 Ahaus, Mills, Carter, Paust, and Austerman. The vote being 35 seven (7) to zero (0) in favor of passage of Ordinance No., 110-1978. 36 37 Councilman Mills moved to remove Ordinance No. 94-1978 - AN ORDINANCE 38 PROVIDING FOR THE CONTINUATION OF THE RICHMOND CITY COURT from the table, 39 seconded by Councilman Paust and on unanimous voice vote, the motion was 40 carried. 41 - 42 Councilman Mills moved to strike Ordinance No. 94-1978, seconded by Councilman 43 Ahaus and on unanimous voice vote, the motion was carried. 44 45 There being no further business on motion duly made, seconded and passed, th- 46 meeting was adjourned. 47 48 Thomas L.
