HomeMy Public PortalAbout11-06-1978 445 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, NOVEMBER 6, 1978 1 The Common Council of the City of Richmond, Indiana, met in regular session 2 • November 6, 1978 at the hour of 7: 30 p.m. in the Council Chambers in the 3 Municipal Building in said City. President Austerman presided with the 4 following members present: Messrs. Elstro, Williams, Ahaus, Merchanthouse, 5 Mills, Carter, Paust and Welch. Absent: None. 'The following business was 6 had, to-wit: 7 8 Councilman Ahaus gave devotions. 9 10 President Austerman noted he was absent from the previous meeting as he was 11 in Chicago on business. 12 13 Councilman Mills moved to approve the minutes of the previous regular and 14 special meetings held on October 16 and October 30, seconded by Councilman 15 Welch and on unanimous voice vote, the motion was carried. 16 17 Councilman Elstro reminded the. City Attorney he had requested an ordinance 18 against leaf burning and enforcing the law against burning after 5:00 p.m. 19 20 Councilman Paust, Chairman of the Public Safety Committee, reminded 21 ' Councilmen to prepare their recommendations as to,.the Council appointment to 22 the Police_Merit Board. 23 24 The Clerk read on second reading Ordinance No. 88-1978 - AN ORDINANCE TO 25 APPROPRIATE FROM CUMULATIVE CAPITAL IMPROVEMENT FUND (CIGARETTE TAX) . 26 27 City Attorney Ed Anderson examined proof of publication for Ordinances No. 28 88-1978, 89-1978, 96-1978, 97-1978 and 99-1978 and found it to be in order. 29 30 Councilman Mills moved to accept and file proof of publication for 31 Ordinance Nos 88-1978, 89-1978, 96-1978, 97-1978 and 99-1978, seconded by 32 Councilman Williams and on unanimous voice vote, the motion was carried. 33 34 Councilman Merchanthouse moved for engrossment of Ordinance No. 88-1978, 35 seconded by Councilman Williams and on unanimous voice vote, the motion was 36 carried. 37 38 Councilman Merchanthouse moved to suspend the rules and read Ordinance No. 39 88-1978 on third and final reading by title only, seconded by Councilman 40 Welch and on unanimous voice vote, the motion was carried. 41 42 The Clerk read on third reading by title only Ordinance No. 88-1978. 43 44 Ordinance No. 88-1978 was placed on final passage or rejection and on a call 45 of the roll; the following was recorded: Ayes: Elstro, Williams, Ahaus, 46 Merchanthouse, Carter, Paust, Welch and Austerman. Noes: Mills. The. 47 vote being eight (8) to one (1) in favor of passage of Ordinance. No. 88-1978. 48 49 The Clerk read on second reading Ordinance No. 89-1978 - AN ORDINANCE TO 50 APPROPRIATE WITHIN THE PARK & RECREATION FUND. 51 52 Councilman Williams moved for engrossment of Ordinance No. 89-1978, seconded 53 by Councilman Mills and on unanimous voice vote, the motion was carried. 54 55 Councilman Williams moved to suspend the rules and read Ordinance No. 56 89-1978 on third and final reading by title. only, seconded by Councilman 57 • Welch and on unanimous voice vote, the motion was. carried. 58 59 The Clerk read on third reading by title only Ordinance. Noes: None. The 4 vote being nine (9) to zero (0) in favor of passage of Ordinance. No. 89-1978. 5 6 The Clerk read on second reading Ordinance. No. 94-1978 . AN ORDINANCE 7 PROVIDING FOR THE CONTINUATION OF THE RICHMOND CITY COURT. 8 9 Councilman Mills moved to table Ordinance No. 94-1978, seconded by Councilman 10 Elstro and on unanimous voice vote, the motion was carried. 11 12 The Clerk read on second reading Ordinance No. 96-1978 - AN ORDINANCE TO 13 APPROPRIATE FROM THE FEDERAL REVENUE SHARING TRUST FUND. 14 15 Speaking for Ordinance No. 96-1978 were Mr. Bob B.rooks, 2747 Northmont Blvd. , 16 President of the Board of Aviation Commissioners and Mr.. Roger Cornett, 17 355 Henley Road South, representing Belden Corporation. 18 19 Councilman Williams moved for engrossment of Ordinance No. 96-1978, seconded 20 by Councilman Mills and on unanimous voice vote, the motion was carried. 21 22 Councilman Williams moved to suspend the rules and read Ordinance No. 96-1978 23 on third and final reading by title only, secon.de.d by Councilman Carter and 24 on unanimous voice vote, the motion was carried. 25 26 The Clerk read on third reading by title only Ordinance No. 96-1978. 27 28 Ordinance No. 96-1978 was placed on final passage or rejection and on call of 29 the roll, the following was recorded: Ayes: Elstro, Williams, Ahaus, 30 Merchanthouse, Mills, Carter, Paust, Welch and Austerman. Noes: None. 31 The vote being nine (9) to zero (0) in favor of passage of Ordinance No. 32 96-1978. 33 34 The Clerk read on second reading Ordinance No. 97-1978 - AN ORDINANCE. TO 35 APPROPRIATE FROM THE FEDERAL REVENUE SHARING TRUST FUND. 36 37 Councilman Mills moved for engrossment of Ordinance No. 97-1978, seconded by 38 Councilman Welch and on unanimous voice vote, the motion was carried. 39 40 Councilman Mills moved to suspend the rules and read Ordinance No. 97-1978 41 on third and final reading, seconded by Councilmen Welch and on unanimous 42 voice vote, the motion was carried. 43 44 The Clerk read on third reading by title only Ordinance No. 97-1978. 45 46 Ordinance No. 97-1978 was placed on final passage. or rejection and on a call 47 of the roll, the following was recorded: Ayes: Elstro, Williams, Ahaus, 48 Merchanthouse, Mills, Carter, Paust, Welch and Austerman. Noes: None. The. 49 vote being nine (9) to zero (0) in favor of passage. of Ordinance No. _ 97-1978. 50 51 The Clerk read on second reading Ordinance No. 98-1978 - AN ORDINANCE 52 REGULATING THE OPERATION AND PARKING OF MOTOR VEHICLES DURING SNOW EMERGENCY 53 AND ESTABLISHING SNOW EMERGENCY ROUTES . 54 55 Councilman Merchanthouse proposed changing -Section 14 "Richmond Avenue, North 56 5th to Northwest 9th" to read"nZ chmon.d' Avenue',i\7Northwest`5 h toNNorthwest 57 9th", seconded by Councilman Elstro and on a call of the roll, the following 58 was recorded: Ayes: Elstro, Williams, Merchanthouse, and Mills. Noes: 59 Ahaus, Carter, Paust, Welch and Austerman. The vote being four (4) to five 60 (5) in favor of the proposal; therefore, it was defeated. 447 Common Council Minutes Cont. No. 98-1978, seconded 6 by Councilman Carter and on unanimous' voice vote, the motion was carried. 7 8 Councilman Mills moved to suspend the rules and read Ordinance No. 98-1978 9 on third and final reading by title only, seconded by Councilman Ahaus. 10 Councilman Merchanthouse voted no. 11 12 The Clerk read on second reading Ordinance No. 99-1978 - AN ORDINANCE. 13 TO APPROPRIATE WITHIN THE GENERAL FUND. 14 15 Councilman Mills moved for engrossment of Ordinance No. 99-1978, seconded 16 by Councilman Welch and on unanimous voice vote, the motion was carried. 17 18 Councilman Mills moved to suspend the rules and read Ordinance No. 99-1978 19 on third and final reading by title only, seconded by Councilman Paust 20 and on unanimous voice vote, the motion was carried. 21 22 The Clerk read on third reading by title only Ordinance No. 99-1978. 23 - 24 Ordinance No. 99-1978 was placed on final passage or rejection and on a 25 call of the roll, the following was recorded: Ayes: Williams, Ahaus, 26 Mills, Carter, Paust, Welch and Austerman. Noes: Elstro and Merchanthouse. 27 The vote being seven (7) to two (2) in favor of passage of Ordinance No. 28 99-1978. 29 30 The Clerk- read on second reading Ordinance No. 103-1978 - AN ORDINANCE TO 31 APPROPRIATE WITHIN THE MUNICIPAL AIRPORT FUND. 32 33 City Attorney Ed Anderson examined proof of publication for Ordi_annce. No. 34 103-1978 and found it to be in order. - 35 - 36 Councilman Mills moved to accept and file proof of publication of Ordinance 37 No. 103-1978, seconded by Councilman Welch and on unanimous voice vote, the 38 motion was carried. 39 40 Councilman Ahaus reported his Committee met concerning Ordinance Nos. 41 103-1978, 106-1978 and 107-1978 and recommend passage of these ordinances. 42 43 Speaking for Ordinance No. 103-1978 was. Attorney Bob Hudson, 2533 South "B". 44 45 Councilman Williams moved for engrossment of Ordinance No. 103-1978, seconded 46 by Councilman Ahaus and on unanimous voice vote, the motion was carried. 47 48 Councilman Williams moved to suspend the rules and read Ordinance. No. 49 103-1978 on third and final reading by title only, seconded by Councilman 50 Carter arid on unanimous voice vote, the motion was carried. 51 52 The Clerk read on third reading by title. only Ordinance No. 103-1978. 53 54 Ordinance No. 103-1978 was placed on final passage or rejection and on a 55 call of the roll, the following was recorded: Ayes: Elstro, Williams, 56 - Ahaus, Merchanthouse, Mills, Carter, Paust, Welch and Austerman. Noes: 57 None. The vote being nine (9) to zero (0) in favor of passage of .Ordinance 58 No. 103-1978. 448 Common Council Minutes Cont. November 6, 1978 Page 4 1 The Clerk read on second.reading Ordinance No. 106-1978 - AN ORDINANCE OF THE 2 CITY OF RICHMOND, INDIANA, AUTHORIZING AND. EMPOWERING ITS BOARD OF AVIATION 3 COMMISSIONERS TO TERMINATE A LEASE BY WAY OF CONCESSION OF AIRCRATT STRIP 4 PREMISES: FOR THE FINANCING OF COST OF SAID TERMINATION, AND OTHER MATTERS 5 RELATING THERETO. 6 7 Councilman Ahaus moved for engrossment of Ordinance No. 106-1978, seconded 8 by Councilman Welch and on unanimous voice voter, the motion was carried. 9 10 The Clerk read on third reading by title only Ordinance No. 106-1978. 11 - 12 Ordinance No. 106-1978 was placed on final passage or rejection and on a 13 call of the roll, the following was recorded: Ayes: Elstro, Williams, 14 Ahaus, Merchanthouse, Mills, Carter, Paust, Welch and Austerman. Noes: None. 15 The vote being nine (9) to zero (0) in favor of passage of Ordinance No. - 16 106-1978. 17 18 The Clerk read on second reading Ordinance No. 107-1978 - AN ORDINANCE 19 AUTHORIZING AND EMPOWERING THE BOARD OF AVIATION COMMISSIONERS OF THE CITY OF 20 RICHMOND, INDIANA, TO ENTER INTO A LEASE WITH A FIXED BASED OPERATOR FOR THE 21 RICHMOND MUNICIPAL AIRPORT. 22 - 23 Councilman Mills moved for engrossment of Ordinance No. 107-1978, seconded by 24 Councilman Welch and on unanimous voice vote, the motion was carried. 25 26 Councilman Welch moved to suspend. the rules and read Ordinance No. 107-1978 27 on third and final reading by title only, seconded by Councilman Carter and 28 on unanimous voice vote, the motion was carried. 29 30 The Clerk read on third reading by title only Ordinance No. 107-1978. 31 32 Ordinance No. 107-1978 was placed on final passage or rejection and on a call 33 of the roll, the following was recorded: Ayes: Elstro, Williams, Ahaus, 34 Merchanthouse, Mills, Carter, Paust,rAWelch and Austerman. Noes: None. 35 The vote being nine (9) to zero (0) in favor of passage of Ordinance. No. 36 107-1978. 37 38 Councilmen thanked the Airport Board and Mr. Hudson for action taken by the 39 three (3) airport ordinances. 40 41 Councilman Mills moved to remove from the table Ordinance No. 8-1978, seconded 42 by Councilman Welch and on unanimous voice vote, the motion was carried. 43 44 Councilman Mills moved to strike Ordinance No. 8-1978, seconded by Councilman 45 Ahaus and on unanimous voice vote, the motion was carried. 46 47 Councilman Mills moved to remove from the table Ordinance No. 76-1978, 48 seconded by Councilman Williams. The motion carried with Councilman Ahaus 49 voting no. 50 51 Councilman Mills moved to strike from the record Ordinance No. 76-1978, 52 seconded by Councilman Williams. On a call of the roll, the following was 53 recorded: Ayes: Elstro, Williams, Mills, Carter, Paust, Welch and Austerman. 54 Noes: Ahaus and Merchanthouse. The vote being seven (7) to two (2) in favor 55 of passage of striking Ordinance No. 76-1978. 56 57 There being no further business on motion duly made, seconded and passed, the 58 meeting was adjourned. 59 60 Thomas L.
