HomeMy Public PortalAbout10-30-1978 - Special Meeting 441 SPECIAL MEETING PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, OCTOBER 30, 1978 III1 The Common Council of the City of Richmond, Indiana met in special session 2 October 30, 1978 at the hour of 7:30 p.m. in the Council Chambers in the 3 Municipal Building in said City. President Austerman presided with the 4 following members present: Messrs. Elstro, Williams, Ahaus, Merchanthouse, 5 Mills, Carter and Welch. Absent: Councilman Paust. The following 6 business was had, to-wit: 7 8 A moment of silent devotions were observed. 9 10 President Austerman announced the purpose of this special meeting is to 11 hear Ordinances dealing with selling and rezoning of a parcel of land 12 owned by the Park Department, Ordinances concerning the airport and an 13 Ordinance which would extend and construct Industrial Parkway. 14 15 Councilman Mills moved to suspend the rules and read Ordinance Nos. 103- 16 1978, 104-1978, 105-1978, 106-1978 and 107-1978 on first reading by title 17 only, seconded by Councilman Carter and on unanimous voice vote, the motion 18 was carried. 19 20 The Clerk read on first reading by title only Ordinance No. 103-1978 - 21 AN ORDINANCE TO APPROPRIATE WITHIN THE MUNICIPAL AIRPORT FUND. 22 23 President Austerman announced Ordinance No. 103-1978 has to be advertised. 24 25 The Clerk read on first reading by title only Ordinance No. 104-1978 - 26 AN ORDINANCE OF THE CITY OF RICHMOND AUTHORIZING AND APPROVING THE SALE OF 27 CERTAIN UNIMPROVED REAL ESTATE IN THE CITY OF RICHMOND, INDIANA. 28 29 Councilman Ahaus moved to suspend the rules and read Ordinance No. 104-1978 30 on second reading, seconded by Councilman Carter and on unanimous voice 31 vote the motion was carried. 32 33 The Clerk read on second reading Ordinance No. 104-1978. 34 35 Speaking against Ordinance No. 104-1978 was Ms Gertrude Ward, RR 1, 36 Centerville, Indiana. 37 38 Councilman Mills moved for engrossment of Ordinance No. 104-1978, seconded 39 by Councilman Carter and on unanimous voice vote, the motion was carried. 40 '41 Councilman Mills moved to suspend the rules and read Ordinance No. 104-1978 42 on third and final reading by title only, seconded by Councilman Elstro and 43 on unanimous voice vote, the motion was carried. 44 45 The Clerk read on third reading by title only Ordinance No. 104-1978. 46 47 Ordinance No. 104-1978 was placed on final passage or rejection and on -a 48 call of the roll, the following was recorded: 'Ayes: Elstro, Williams, 49 Ahaus, Merchanthouse, Mills, Carter, Welch and Austerman. Noes: None. 50 The vote being eight (8) to zero (0) in favor of passage of Ordinance No. III 51 104-1978. 52 53 The Clerk read on first reading by title only Ordinance. No. 105-1978 - AN 54 ORDINANCE AMENDING CHAPTER 22 OF THE.MUNICIPAL CODE BEING ORDINANCE NO. 55 ' 2325-1968 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, 56 INDIANA, ADOPTED JUNE 3, 1968, PROVIDING FOR THE REZONING OF A CERTAIN PART 57 OF SPRINGWOOD PARK FROM 0-1 GREENBELT DISTRICT TO M-2 GENERAL INDUSTRIAL 58 DISTRICT. 442 Common Council Minutes Cont. October 30, 1978 Page 2 1 Councilman Ahaus moved to suspend the rules and read Ordinance No. 105-1978 2 on second reading, seconded by Councilman Carter and on unanimous voice vote, 3 the motion was carried. 4 5 The Clerk read on second reading Ordinance No. 105-1978. 6 7 Speaking for Ordinance No. 105-1978 was Director of City Planning Robert 8 Goodwin who stated the Plan Commission voted nine (9) to zero (0) in favor of 9 Ordinance No. 105-1978. 10 11 Speaking against Ordinance No. 105-1978 was Ms Gertrude Ward, RR 1, Centerville, 12 Indiana. 13 14 Councilman Mills moved for engrossment of Ordinance No. 105-1978, seconded 15 by Councilman Carter and on unanimous voice vote, the motion was carried. 16 17 Councilman Welch moved to suspend the rules and read Ordinance No. 105-1978 18 on third and final reading by title only, seconded by Councilman Elstro and 19 on unanimous voice vote, the motion was carried: 20 21 The Clerk read on third reading by title only Ordinance No. 105-1978. 22 23 Ordinance -No. 105-1978 was placed on final passage or rejection.and, on a call 24 of the roll, the following was recorded: Ayes: Elstro, Williams,' Ahaus, 25 Merchanthouse, Mills, Carter, Welch and Austerman. Noes: None. The vote 26 being eight (8) to zero (0) in favor of passage of Ordinance No. 105-1978. 27 28 The Clerk read on first reading by-title only Ordinance No. 106-1978 - AN 29 ORDINANCE OF THE CITY OF RICHMOND, INDIANA, AUTHORIZING AND EMPOWERING ITS 30 BOARD OF AVIATION COMMISSIONERS TO TERMINATE A LEASE BY WAY OF CONCESSION OF 31 AIRCRAFT STRIP PREMISES: FOR THE FINANCING OF COST OF SAID TERMINATION, AND 32 OTHER MATTERS REALTING THERETO. 33 . 34 Councilman Williams moved to suspend the rules and read Ordinance No. 106- 35 1978 on second reading, seconded by Councilman Welch and on unanimous voice 36 vote, the motion was carried. 37 38 The Clerk read on second reading Ordinance No. 106-1978. 39 40 Speaking for Ordinance No. 106-1978 were Attorney Andrew Cecere, representing 41 Sky Tech; Mr. Robert Brooks, 2747 Northmont Blvd, President of the Board of 42 Aviation Commissioners; Attorney Robert Hudson, 2533 South "B", working for 43 the City Attorney. 44 45 President Austerman announced Ordinance No. 106-1978 is held on second reading. 46 47 The Clerk read on first reading by title only Ordinance No. 107-1978 - AN 48 ORDINANCE AUTHORIZING AND EMPOWERING THE BOARD OF AVIATION COMMISSIONERS OF THE 49 CITY OF RICHMOND, INDIANA, TO ENTER INTO A LEASE WITH A FIXED BASED OPERATOR 50 FOR THE RICHMOND MUNICIPAL AIRPORT. 51 52 Councilman Mills moved to suspend the rules and read Ordinance No. 107-1978 53 on second reading, seconded by Councilman Welch and on unanimous voice. vote, 54 the motion was carried. 55 56 Speaking for Ordinance No. 107-1978 was Mr. Robert Brooks, 2747 Northmont 57 Blvd. , President of the Board of Aviation Commissioners. 58 - 59 President Austerman announced Ordinance No. 107-1978 is held on second readin:. 443 Common Council Minutes Cont. October 30, 1978 Page 3 1 President Austerman announced Ordinance Nos. 106-1978 and 107-1978 are referred 2 to the Community Development, Community Service and Transportation Committee, 3 III4 Councilman Elstro moved to bring Ordinance No. 80-1978 off the table, seconded 5 by Councilman Williams and on unanimous voice vote, the motion was carried. 6 7 Speaking for Ordinance No. 80-1978 was Director of City Planning Robert 8 Goodwin, stating the Plan Commission voted nine (9) to zero (0) recommending 9 approval. Mr. Goodwin presented a proposed amendment. Also speaking for 10 the Ordinance were Mr. Tim Ryder, 438 Carol Drive, Director of Community 11 Development; Attorney Tom Milligan, 532 Farlow Road, representing the Quigg 12 family; Attorney Andrew Cecere, representing Eastern Indiana Industrial 13 Park, Inc.; Mr. Allan Rosar, 858 Greenmount Pike of Eastern Indiana Industrial 14 Park, Inc.; and Mayor Clifford J. Dickman. 15 16 Speaking against Ordinance No. 80-1978 was Ms Shirley Rodgers, 405 Henley Road 17 South, National Resources Chairman of the League of Women Voters. 18 19 ' Councilman Elstro moved for engrossment of Ordinance No. 80-1978, seconded 20 by Councilman Welch and on unanimous voice vote, the motion was carried. 21 22 Councilman Welch moved to suspend the rules and read Ordinance No. 80-1978 23 on third and final reading by title only, seconded by Councilman Elstro 24 and on unanimous voice vote, the motion was carried. 25 26 The Clerk read on third readingby title only Ordinance No. 80-1978. 27 28 Councilman Elstro moved to amend by unanimous consent Ordinance No. 80-1978, 29 seconded by Councilman Welch and on unanimous voice vote, the motion was 30 carried. 31 32 The Clerk read the following amendment to be added to SECTION 1. "and that • 33 the extension of Industrial Parkway south to Hodgin Road shall, if proven 34 economically feasible by engineering studies and hearing before proper 35 authorities, abut or be situated upon the half section line between the 36 Southwest and Southeast quarters of Section 1, Township 13 North, Ralge 37 1 West". 38 39 Councilman Ahaus moved to amend Ordinance No. 80-1978, seconded by Councilman 40 Welch and on unanimous voice vote, the motion was carried. 41 42 Amended Ordinance No. 80-1978 was placed on final passage or rejection 43 and on a call of the roll, the following was recorded: Ayes: Elstro, Williams,, 44 Ahaus, Merchanthouse, Mills, Welch and Austerman. Noes: Carter. The vote 45 being seven (7) to one (1) in favor of passage of Amended Ordinance No. 46 80-1978. 47 48 Councilman Ahaus announced a meeting of the Transportation, Community 49 Development and Community Service Committee for Thursday, November 2 at 50 7:00 p.m. in the Board- ;of Works Room. 51 52 There being no further business on motion duly made, seconded and passed, 53 the meeting was adjourned. - 54 55 Thomas L.
