HomeMy Public PortalAbout09-05-1978 421 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, SEPTEMBER 5, 1978 1 The Common Council of the City of Richmond, Indiana met in regular session 2 September 5, 1978 at the hour of 7:30 p.m. in the Council Chambers in the _--. 3 Municipal Building in said City. President Austerman presided with the following III4 members present: Messrs. Elstro, Williams, Ahaus, Merchanthouse, Carter, 5 Paust and Welch. Absent: Councilman Mills. The following business was 6 had, to wit: 7 8 A moment of silent devotions was observed. 9 10 Councilman Williams moved to approve the minutes of the previous meeting as 11 prepared, seconded by Councilman Welch and on unanimous voice vote, the 12 motion was carried. 13 14 Councilman Paust moved to suspend the rules and read Resolution No. 13-1978 15 by title only, seconded by Councilman Williams and on unanimous voice vote, 16 the motion was carried. 17 18 The Clerk read by title only Resolution No. 13-1978. 19 20 Attorney Robert Hudson, representing the City Attorney's office, presented 21 background on Caesar's Palace and explained Resolution No. 13-1978. 22 23 Speaking against Resolution No. 13-1978 were Mr. Charles W. Ronan, Sr. , 24 719 Abington Pike; Attorney James Backmeyer, 2505 Northmont Blvd. , and 25 Ms Dorothy Brumbaugh, 314 Pearl Street. 26 27 Councilman Paust moved to strike Resolution No. 13-1978, seconded by 28 Councilman Elstro. III 29 30 Councilman Paust withdrew his motion to strike Resolution No. 13-1978 and 31 Councilman Elstro withdrew his second. 32 33 On a call of the roll the following was recorded: Ayes: None. Noes : 34 Elstro, Williams, Ahaus, Merchanthouse, Carter, Paust, Welch .and Austerman. 35 i Absent: Mills. The vote being zero (0) to eight (8) in favor of 36 Resolution No. 13-1978; therefore, the resolution was defeated. 37 38 The following' problems were given to the Board of Works: 39 40 1. Councilman Carter presented a problem with Cable TV. A 41 resident at 917 Henley Road South, since May, has had a 42 cable that was underground strung through a tree. She has 43 called the office of Cable TV and they have told her they 44 are going to fix it. 45 46 2. Councilman Williams noted chuckholes in the north-south 47 alley between "H" and "F" behind Hooks. ,He, also, noted 48 weeds at 411 South 9th. This house has been condemned 49 but the people keep getting building permits to reconstruct 50 the structure. He recommended taking a look at the Ordinance 51 allowing people to get permits, do little or nothing, and 52 then get another permit. 53 54 3. Councilman Elstro noted weeds at 508:: or 510 South 10th. 55 56 4. Councilman Merchanthouse presented a bag of fiberglass 57 which is being blown from the stacks at Johns Manville. 422 Common Council Minutes Cont. September 5, 1978 Page 2 1 Councilman Merchanthouse moved to suspend the rules and read Ordinance Nos. 2 73-1978, 74-1978, 75-1978, 76-1978 and 77-1978 on first reading by title only, 3 seconded by Councilman Faust and on unanimous voice vote, the motion was 4 carried. 5 6 The Clerk read on first reading by title only Ordinance No. 73-1978 - AN 7 ORDINANCE TO AMEND CHAPTER 22 OF THE MUNICIPAL CODE AS AMENDED, BEING 8 ORDINANCE NO . 2325-1968 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY 9 OF RICHMOND, INDIANA ADOPTED JUNE 3, 1968, PROVIDING FOR THE RICHMOND BOARD 10 OF ZONING APPEALS TO HEAR AND DECIDE SPECIAL USES AND ALSO REFERRED TO AS 11 SPECIAL EXCEPTIONS . 12 13 Explaining Ordinance No. 73-1978 was Director of City Planning Bob Goodwin. 14 15 President Austerman announced Ordinance No. 73-1978 is referred to the Plan 16 Commission. 17 18 The Clerk read on first reading by title only Ordinance No. 74-1978 - AN 19 ORDINANCE TO REGULATE AND CONTROL THE USE OF GUNS OR OTHER INSTRUMENTS WHICH 20 LAUNCH AN OBJECT OR PROJECTILE BY THE USE OF COMPRESSED GAS OR AIR OR OTHER 21 MECHANICAL MEANS . 22 23 President Austerman announced Ordinance No. 74-1978 is referred to the Publi. 24 Safety Committee. 25 26 The Clerk read on first reading by title only Ordinance No. 75-1978 - AN 27 ORDINANCE TO CONTROL TRAFFIC AT SCHOOL CROSSINGS . 28 29 President Austerman announced Ordinance No. 75-1978 is referred to the Publi. 30 Safety Committee. 31 32 The Clerk read on first reading by title only Ordinance No. 76-1978 - AN 33 ORDINANCE TO AID IN THE CONTROL OF JUVENILES WHO ARE ABSENT FROM SCHOOL 34 CONTRARY TO LAW. 35 36 President Austerman announced Ordinance No. 76-1978 is referred to the Publi 37 Safety Committee. 38 39 Councilman Faust, Chairman of the Public Safety Committee, announced a meeti g 40 of his committee September 11 at 7:00 p.m. in the Board of Works Room. 41 42 The Clerk read on first reading by title only Ordinance No. 77-1978 - AN 43 ORDINANCE TO TRANSFER WITHIN THE PARKING METER FUND. 44 45 Councilman Welch moved to suspend the rules and read Ordinance No. 77-1978 46 on second reading, seconded by Councilman Paust and on unanimous voice vote, 47 the motion was carried. 48 49 The Clerk read on second reading Ordinance No. 77-1978. 50 51 Councilman Welch moved for engrossment of Ordinance No. 77-1978, seconded by 52 Councilman Ahaus and on unanimous voice vote, the motion was carried. 53 54 Councilman Welch moved to suspend the rules and read Ordinance No. 77-1978 55 on third and final reading by title only, seconded by Councilman Elstro and 56 on unanimous voice vote, the motion was carried. 423 Common Council Minutes Cont. Noes.: None. The vote 6 being eight (8) to zero (0) in favor of passage of Ordinance No. 77-1978. 7 8 There being no further business on motion duly made, seconded and passed, 9 the meeting was adjourned. 10 11 Thomas L.
